DIAZ, SECRE PALM DESERT PLANNING COMMISSION RAD/tm r PLANNING COMMISSION RESOLUTION NO. 1071 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING PLANS FOR THE CONSTRUCTION OF A 48,000 SQUARE FOOT TWO STORY OFFICE/WAREHOUSE BUILDING, A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND THE CONSOLIDATION OF THREE LOTS ONTO ONE LOT FOR PROPERTY LOCATED IN A SERVICE INDUSTRIAL ZONE ON THE EAST SIDE OF CORPORATE WAY, ALSO DESCRIBED AS LOTS 29, 30, AND 31 OF PM 17452. CASE NO. PP 85-21 and PMW 85-15 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of August, 1985, hold a duly noticed public hearing to consider the request of WILLIAM ALEXANDER for above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implement of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have a significant negative impact on the environment and a negative declaration of environmental impact has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify recommending approval of the parcel map: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. 4. The proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control , appropriate improved public roads, sanitary disposal facilities , water supply availability, environmental protection and other requirements of this title. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case; 2. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Payment of fringe-toed lizard impact fee required prior grading permit issuance. 6. Compact parking spaces shall not exceed 10% of parking lot and shall be a minimum 8 1/2 ft. x 17 ft. 7. Installation of sidewalk along Corporate Way, pending city council clarification. 8. A parcel map waiver shall be required if a consolidation of lots occur. 9. Applicant may shift building southward (deleting four parking spaces) to avoid building within the storm drain easement. PLANNING COMMISSION RESOLUTION NO. 1071 Department of Public Works: € 10. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. It . Landscaping maintenance on Lennon Place shall be provided by the property owner. 12. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 13. Size, number and location of driveways to public works specifications with only two (2) driveway approaches to be allowed to serve this property. 14. Any permit issuance shall be subject to the waiver of parcel map first being approved and recorded. 15. Complete parcel map waiver shall be submitted as required by ordinance to the city engineer for checking and approval and be recorded before issuance of certificate of occupancy by building department. City Fire Marshal : 16. Install a water system capable of delivering 3500 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 17. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle. caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 18. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. PLANNING COMMISSION —SOLUTION NO. 1071 19. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-21 is in accordance with the requirements prescribed by the fire marshal ." 20. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 21 . Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 22. All buildings over 5000 square feet require an approved fire sprinkler system. Sheriff's Department: 23. For the deterrence of burglary, each building entrance should be lighted from two sources. For deterrence of vehicle vandalism during the hours of darkness and for personal safety, a low level of crime prevention lighting should be maintained throughout the parking lot. MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 'i II Chairman Crites commented that he felt the project needed a better design. Commissioner Downs felt that the driveway width should be investigated. Commissioner Richards also expressed concern regarding the garage doors. Mr. Diaz suggested a two-week continuance. Action: Moved by Commissioner Richards, seconded by Commissioner Erwood. continuing PP 85-20 to August 20, 1985. Carried 5-0. K. Case Nos. PP 85-21 and PMW 85-15 ._' WILLIAM ALEXANDER, Applicant Request for approval of a 48,000 square foot two story office/warehouse building and negative declaration of environmental impact located in a service industrial zone on the west side of Corporate Way, 260 feet north of 42nd Avenue. Mr. Joy outlined the staff report and suggested the addition of conditions for an additinnal 25 foot setback, sidewalks along Corporate Way, and the requirement of a parcel map waiver if consolidation occurs. Mr. Joy also indicated that the applicant would like to shift the huilding southward to eliminate building in the storm drain easement area. Commissioner Richards clarified that there was a zero lot line and asked about adjoining parcels. Mr. Joy indicated there were no structures at the present time. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. ALEXANDER felt that the installation of sidewalks could be a problem for. the safety of patrons. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being no one, the public testimony was closed. Commissioner Richards asked for clarification regarding the allowance . of zero lot line. Mr. Joy indicated that a previous proposal by Mr. Solomon had been approved with a zero lot line. 12 MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 I i Chairman Crites expressed opposition to having a zero lot line. Commissioner Wood commented that maintenance problems occur when two properties have walls facing each other with space in between. Chairman Crites also expressed concern regarding the possibility of R-1 property developing next to a wall with a zero lot line. He felt that mitigation measures should not be placed on the other property owner. He felt_ that a lot line setback provides protection for both property owners. Moved by Commissioner Richards, seconded by Commissioner Wond to anprove the findings as presented by staff. Vote: 2-3 (Crites, Downs, Erwood voted no) . Not carried. Commissioner Erwood noted that a resolution of denial would have to be prepared. Mr. Diaz explained that in terms of open space, an application had been filed and the individual would bear the mitigation. Commissioner Downs requested a reopen of discussion to allow him a change of vote. Moved by Commissioner Downs, seconded by Commissioner Richards, to reopen the discussion. Carried 3-2 (Crites and Erwood voted no) . Commissioner Richards stated that the commission could not grant a zero lot line in one case and not another. He also stated that if a commissioner is against a particular proposal , he should state those reasons why. Commissioner Richards asked staff if there were any cases where a zero Int line was not allowed. Mr. Joy indicated that a 25 foot setback was required next to R-I . MR. GEORGE BERKEY, Joshua Tree, explained that the ownership of both properties in question was the same and that there was no objection to the setback being placed all on that one property. He felt that if a 25 foot setback was needed, the commission could require it on the adjacent property. Chairman Crites spoke in opposition to the burden of a setback being placed on only one property owner. Action: Moved by Commissioner Wood, seconded by Commissioner Richards, approving the findings as presented by staff. Chairman Crites spoke regarding the length of the agenda. He instructed staff to consult him if there were more than five or six oublir hearing items on the agenda and if a study session was called. Chairman Crites requested that an agenda be prepared for all stuciy sessions. C. Commissioner Wood felt there should be a time frame for the initiation of public hearing items. Commission agreed to continue this matter. D. Commissioner Erwood indicated that on a previous tour with the city council , they had indicated that sidewalks in the city were desirable. Commissioner Richards stated that he would like to hear from the council on this matter; he felt that it was a policy decision . He also stated that if a commissioner is against a particular proposal , he should state those reasons why. Joshua Tree, explained that the ownership of both properties in question was the same and that there was no obiection to the setback being placed all on that one property. The commission previously had concerns with another building on the same street in that It had a zero rear yard setback adjacent to a proposed sand dunes park. Presently this proposed park area is a retention basin surrounded by a six foot chain link fence. As mentioned earlier, this area will also be before the commission for a zone change in the future to planned residential 7 du/acre since staff has recently received an application requesting such change. In the event that a zone change is granted for residential in this area, staff would recommend that the setback for any residential development in this area then be increased from 20 to 45 feet to also accommodate the 25 feet required for an industrial building when adjacent to residential zoning. C. PARCEL MAP WAIVER: The map is required to consolidate the three lots into one lot, thereby allowing building over the property lines without providing extra fire walls. III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF A PARCEL MAP WAIVER: 1 . The planning commission shall grant a waiver, provided that it finds that the proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvements and design, floodwater drainage control , appropriate improved public roads, sanitary disposal facilities, water supply availability environmental protection and other requirements of this title_. Justification: The consolidation into one parcel for this development will comply with all applicable requirements and will allow one integrated development. STAFF REPORT CONTINUED B. Justification: The development is located in an industrial park and the use proposed is compatible with any potential uses in the area. The design of the facility with limited access points and service areas in the center of the project, assure that adjacent property can be used for the purposes they have been zoned. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The plan meets or exceeds all code requirements and care has been taken in its design to assure that during its operation the facility will not impact surrounding areas. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse environmental Impact on the environment and a Negative Declaration of Environmental Impact should be approved as meeting the requirements for the California Environmental Quality Act of 1970, as amended.
