Commissioner Richards commended -staff and the committees that worked
on this study and moved for approval .
Commissioner Wood spoke to the motion, emphasizing that his own
view point was that on Fred Waring's south side, if commission could
not zone R-3 two story units, it would remain unimproved,
unattractive vacant lots.
Chairman Crites requested Commissioner Richard's comments thanking
staff for time and excellent work on this project be noted for the
record and that a letter be sent to each committee member -in thanks.
Action:
Moved by Commissioner Richards, seconded by Commissioner Downs,
approving the findings as presented by staff. Carried 5-0.
Moved by Commissioner Richards, seconded by Commissioner Downs,
adopting Planning Commission Resolution No. 1079, recommending to
city council approval of C/Z 85-7 Exhibit "A." Carried 5-0.
_Chairman Crites recommended that the agenda be suspended to consider Item
#G.

G. Case No. PP 85-22 - HOVLEY GROUP, Applicant
Request for approval of two buildings totaling
27,000 square foot including a 3,000 square foot
restaurant (with the remainder office and
warehouse space) located in a service industrial
zone at the northwest corner of Eclectic and
Lennon place.
Mr. Joy outlined the staff report and recommended approval subject
to the addition of a condition requiring the applicant to provide
sidewalks upon further city council direction.

Chairman Crites asked if staff's concern regarding landscaping in
the north parking area outlined In the staff report had been
addressed. Mr. Joy replied that the applicant had provided
acceptable landscaping.
Chairman Crites opened the public testimony and asked the applicant
to address the commission.
MR. BOB RITCHEY, architect: 45-120 San Pablo, stated that he
had no problems with the landscaping requirements.
Chairman Crites asked if anyone present wished to speak if FAVOR or
OPPOSITION to the request. There being no one, the public testimony
was closed.
Action:
Moved by Commissioner Downs, seconded by Commissioner Erwood,
approving the findings as presented by staff. Carried 5-0.
Moved by Commissioner Downs, seconded by Commissioner Erwood,
adopting Planning Commission Resolution No. 1080, approving PP 85-22

F. Case Nos. PP 85-18 and PM 20573 - CARVER COMPANIES, Applicant i
Request for approval of a 10 lot parcel map in
the PR-5, PR-10, and PC-2 zone, precise plan of
design, and negative declaration of environmental
impact to permit the development of a group of
hotels and retail commercial complex. The site
encompasses some 81 acres at the northwest corner
of Cook Street and Country Club Drive.
Mr. Diaz explained that the applicant needed certain approvals to
j proceed with development, and indicated that the applicant did not
want to be so specific as to development standards that would make
the commission feel that what is shown is exactly what will occur.
Mr. Diaz reviewed the staff report with the assistance of the
development guidelines. Mr. Diaz explained that parcel seven was
proposed as some type of public element and that the applicant may
wish to delete parcel seven until a proposal comes in for parcel
six, and that if approved, the parcel map would require the
improvement of Country Club Drive and Cook Street. He stated that
the applicants intent was to develop a north/south entry corridor as

WHEREAS, the Planning `Commission of the City of Palm Desert, California,
did on the 3rd day of September, 1985, hold a duly noticed public hearing to
consider the request of HOVLEY GROUP for above mentioned project.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project will not adversely affect the
environment and a negative declaration is hereby certified.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify recommending approval of the precise plan:
1 . The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
3. The precise plan will not endanger the public peace, health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
I . That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That approval of Precise Plan 85-22 is hereby granted for reasons

CONDITIONS OF APPROVAL
CASE NO. PP 85-22
Department of Community Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of environmental services, as modified by the
following conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
3. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null , void and of no effect
whatsoever.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Palm Desert Architectural Commission
Coachella Valley Water District
Public Works Department
Palm Desert Water and Services District
City Fire Marshal
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. A walkway shall be provided from the restaurant to the north parking area.
6. Employees in both buildings shall park in north parking area.
7. Increased landscaping required in north parking area to the satisfaction
of the director of community development.
8. Payment of fringe-toed lizard mitigation fees required prior to issuance
of a grading permit.
9. Applicant shall install sidewalks along Eclectic and Lennon Place pending
city council direction.

Fire Marshal :
9. Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a 3 hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of measurement. Fire flow requirements will depend on built-in fire
protection provisions of buildings.
10. Install Riverside County super fire hydrants so that no point of any
building is more than 200 feet or a distance acceptable to the fire
marshal from a fire hydrant measured along approved vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
C. hydrants shall not be located closer than 25 feet to any building,
11 . Prior to issuance of a building permit, the developer shall furnish the
original and three copies of the water system plan to the Fire Marshal
for review. Upon approval , one copy will be sent to the building
department and the original will be returned to the developer.
12. The water system plan shall be signed by a registered civil engineer and
approved by the water company with the following certification: "I
certify that the design of the water system in PP 85-22 is in accordance
with the requirements prescribed by the fire marshal ."
13. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.
14. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval .
15. All buildings over 5000 square feet require an approved fire sprinkler
system.
Department of Public Works:
16. Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior .to building permit issuance.

17. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is .approved by the department of public works.

18. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
19. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the city engineer for checking and approval
before construction of any improvements is commenced. The engineer shall
submit "as-built" plans prior to the acceptance of the improvements by
the city.
20. All driveways and parking lots shall be inspected by the engineering
department and a standard inspection fee shall be paid prior to any
permit issuance.
21 . Landscaping maintenance on Eclectic Street and Lennon Place shall be
provided by the property owner.
22. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the city engineer for checking and approval prior to
issuance of any permits.
23. Installation of driveway approaches as per city standard, matching paving
and a sidewalk on Eclectic Street and Lennon Place.
24. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
permit issuance.
25. Size, number, and location of driveways to public works specifications
with only three (3) driveway approaches to be allowed to serve this
property.
26. Any applicable conditions of approval relative to Parcel Map 17452 shall
pertain to this project.
Sheriff's Department:
27. Each doorway into the buildings should be lit from two sources, as a
deterrent to burglary. Provisions should be made so that commercial
vehicles left on the premises overnight will be protected from theft and
vandalism via crime prevention lighting, or conditions to provide for
inside parking.

1. BACKGROUND:

B. LOT DESCRIPTION:
The site has been rough graded as part of PM 17452.
C. GENERAL PLAN LAND USE DESIGNATION:
Service industrial .
II . PROJECT DESCRIPTION:
The project was discussed briefly by commission regarding restaurants at
a study session previously (8-6-85) .
The first of the two buildings is located along the west property line
utilizing zero setbacks while maintaining a 20 foot setback from Lennon
Place.
The other building is L-shaped and adjacent to the intersection surrounded
by parking on three sides.
STAFF REPORT CONTINUE.
The buildings are both single story and attain maximum heights of 22
feet.
The restaurant is located adjacent to the intersection in the
aforementioned building. The restaurant is to be surrounded by a covered
walkway that will lead to a parking area on the north portion of the
site. The walkway will make the extra parking accessible to the
restaurant and if not installed would require one to either walk all the
way around the building or in the street to reach the restaurant, which
would encourage on-street parking.
Staff's other concern is that some landscaping be provided in the north
parking area on the site utilizing either/and/or compact spaces, reduced
number of spaces while still meeting code requirements.
III. ANALYSIS:
A. FINDINGS FOR APPROVAL OF A PRECISE PLAN:
I . The design of the precise plan will not substantially depreciate
property values in the vicinity.
Justification:
The design of the use is attractive and will be compatible with
other industrial uses in the vicinity.
2. The precise plan will not unreasonably interfere with the use
of or enjoyment of property in the vicinity of the occupants
thereof for lawful purposes.
Justification:
The surrounding land in the vicinity is zoned for the same type
of use as proposed and owners would not be deprived the use of
their land.
3. The precise plan will not endanger the public peace, health,
safety, or general welfare.
Justification:
The precise plan complies with all code requirements and will
not be detrimental to the public peace, health, safety, or
general welfare.
Staff feels the findings for approval can be justified for this
precise plan.

The director of environmental services has determined that the
proposed project will not have an adverse impact on the environment

Dear Mr. Ramon Diaz
The following fire protection requirements are in accordance with the Uniform Fire
Code and Life Safety Code standards.
1 . Install a water system capable of delivering 3000GPM fire flow from any fire
hydrant for a I hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement. Fire flow require-
ments will depend on built-in fire protection provisions of buildings.
2. Install Riverside County super fire hydrants so that no point of any building is
more than200 feet from a fire hydrant measured along approved vehicular travel ways .
a. exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green. -
b. curbs shall be painted red 15 feet in either direction from each hydrant.
c. hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three copies of the water system plan to the Fire Marshal for review. Upon
approval , one copy will be sent to the Building Department and the original will
be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and approved by
the water company with the following certification: "I certify that the design of the
water system in PP 85-22 is in accordance with the requirements prescribed by
the Fire Marshal ."
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
6. Additional fire protection requirements may be necessary when the applicant submits
specific plans for consideration and approval .
7. All buildings over 5000 square feet require an approved fire sprinkler system.

The following should be considered conditions of approval :
l ) Drainage and signalization fund fees , as required by City
ordinance, shall be paid prior to building permit issuance.
2 ) Storm drain construction shall be contingent upon a drainage
study by the private engineer that is approved by the
Department of Public Works .
3) Full public improvements, including .traffic safety lighting,
as required by ordinance and the Director of Public Works ,
shall be installed in accordance with City standards .
4) Complete improvement plans and specifications shall be
submitted, as required by ordinance, to the City Engineer
for checking and approval before construction of any
improvements is commenced. The engineer shall submit
"as-built" plans prior to the acceptance of the improvements
by the City.
5) All driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall
be paid prior to any permit issuance.
6) Landscaping maintenance on Eclectic Street and Lennon Place
shall be provided by the property owner .
7 ) Complete grading plans and specifications shall be submitted,
as required by ordinance, to the City Engineer for checking
and approval prior to issuance of any permits .
8) Installation of driveway approaches as per City standard ,
matching paving and sidewalk on Eclectic Street and Lennon
Place.
9) Offsite improvement plans to be approved by Public Works
Department and a surety posted to guarantee the required
offsite improvements prior to permit issuance .

permit for our project on the corner of Electic and Lennon. As
representatives . for the Hovley Group , the applicant , it is our
intention to develop a 27000 square foot multi-tenant facility
at this location. As part of the project we would like to propose
a restaurant on .the corner . We feel withthe rapidly growing
area on both sides of Cook Street as well as the existing park
to the South a restaurant that serves hot meals such as breakfast
and lunch would be ideal for the working people in. the neighborhood .
The nearest location for this type of operation is Cook and Hwy .
111 which is quite a distance . With Waste Disposal , Cable TV ,
Gas Company as well as other businesses in the area , I 'm sure
they would welcome the close proximity of a restaurant .
In the pre-planning stages which we have submitted for review, we
proposed a 3000 foot space with . additonal parking on-site per
City ordinances . We feel we have complied with all major
requirements at this time and hope that your consideration to
allow a restaurant will be approved .

projects , we realize it takes a talented and experienced
operator to handle a good store . We have obtained , we feel
a qualified operator who presently has restaurants in other
towns and wants to expand to the desert . We have personally
visited these restaurants and were impressed with the quality
of food , the atmosphere and the clean operation this company
maintains . We feel this type of operation is in keeping
with the high standards Palm Desert has developed and wants
to continue to develop .
