Commissioner Wood spoke to the motion, emphasizing that his own view point was that on Fred Waring's south side, if commission could not zone R-3 two story units, it would remain unimproved, unattractive vacant lots. Chairman Crites requested Commissioner Richard's comments thanking staff for time and excellent work on this project be noted for the record and that a letter be sent to each committee member -in thanks. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, approving the findings as presented by staff. Carried 5-0. Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1079, recommending to city council approval of C/Z 85-7 Exhibit "A." Case No. PP 85-22 - HOVLEY GROUP, Applicant Request for approval of two buildings totaling 27,000 square foot including a 3,000 square foot restaurant (with the remainder office and warehouse space) located in a service industrial zone at the northwest corner of Eclectic and Lennon place. Mr. Joy outlined the staff report and recommended approval subject to the addition of a condition requiring the applicant to provide sidewalks upon further city council direction. ll � MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 3, 1985 - i Chairman Crites asked if staff's concern regarding landscaping in the north parking area outlined In the staff report had been addressed. Mr. Joy replied that the applicant had provided acceptable landscaping. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. BOB RITCHEY, architect: 45-120 San Pablo, stated that he had no problems with the landscaping requirements. Chairman Crites asked if anyone present wished to speak if FAVOR or OPPOSITION to the request. There being no one, the public testimony was closed. Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, approving the findings as presented by staff. Carried 5-0. PP 85-18 and PM 20573 - CARVER COMPANIES, Applicant i Request for approval of a 10 lot parcel map in the PR-5, PR-10, and PC-2 zone, precise plan of design, and negative declaration of environmental impact to permit the development of a group of hotels and retail commercial complex. The site encompasses some 81 acres at the northwest corner of Cook Street and Country Club Drive. Mr. Diaz explained that the applicant needed certain approvals to j proceed with development, and indicated that the applicant did not want to be so specific as to development standards that would make the commission feel that what is shown is exactly what will occur. Mr. Diaz reviewed the staff report with the assistance of the development guidelines. Mr. Diaz explained that parcel seven was proposed as some type of public element and that the applicant may wish to delete parcel seven until a proposal comes in for parcel six, and that if approved, the parcel map would require the improvement of Country Club Drive and Cook Street. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Applicant shall install sidewalks along Eclectic and Lennon Place pending city council direction. 3 PLANNING COMMISSION ._SOLUTION NO. 1080 Fire Marshal : 9. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 10. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet or a distance acceptable to the fire marshal from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building, 11 . Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 12. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-22 is in accordance with the requirements prescribed by the fire marshal ." 13. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 14. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 15. All buildings over 5000 square feet require an approved fire sprinkler system. Department of Public Works: 16. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to permit issuance. 25. Size, number, and location of driveways to public works specifications with only three (3) driveway approaches to be allowed to serve this property. 26. I ./VACANT SOUTH: S. I ./PALM DESERT DISPOSAL HEADQUARTERS EAST: S. I ./CABLE TV SERVICE YARD WEST: S. I ./VACANT B. LOT DESCRIPTION: The site has been rough graded as part of PM 17452. C. GENERAL PLAN LAND USE DESIGNATION: Service industrial . II . PROJECT DESCRIPTION: The project was discussed briefly by commission regarding restaurants at a study session previously (8-6-85) . The first of the two buildings is located along the west property line utilizing zero setbacks while maintaining a 20 foot setback from Lennon Place. The other building is L-shaped and adjacent to the intersection surrounded by parking on three sides. STAFF REPORT CONTINUE. The buildings are both single story and attain maximum heights of 22 feet. The restaurant is located adjacent to the intersection in the aforementioned building. The restaurant is to be surrounded by a covered walkway that will lead to a parking area on the north portion of the site. The walkway will make the extra parking accessible to the restaurant and if not installed would require one to either walk all the way around the building or in the street to reach the restaurant, which would encourage on-street parking. Staff's other concern is that some landscaping be provided in the north parking area on the site utilizing either/and/or compact spaces, reduced number of spaces while still meeting code requirements. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: I . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. 2 STAFF REPORT CONTINUED B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse impact on the environment and a negative declaration has been prepared. Install a water system capable of delivering 3000GPM fire flow from any fire hydrant for a I hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than200 feet from a fire hydrant measured along approved vehicular travel ways . a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. - b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-22 is in accordance with the requirements prescribed by the Fire Marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7.
