The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. I 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits j and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. Fire Marshal : 5. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 6. ADJACENT 7_ONING AND LAND USE: NORTH: R-1 , 13,000/SINGLE FAMILY DWELLING UNITS SOUTH: C-I/GENERAL COMMERCIAL EAST: R-3 (4)/TWO STORY APARTMENTS WEST: R-3 (4)/1 & 2 STORY MULTI-FAMILY RESIDENTIAL DEVELOPMENTS B. PALMA VILLAGE PLAN LAND USE DESIGNATION: Office professional/high density residential . C. SITE DESCRIPTION: The site is currently vacant and improved with curb and gutter along Alessandro. 11 . PROJECT DESCRIPTION: The project involves consolidating three lots into one lot to build one single complex. The project site was designated on the Palma Village Specific Plan as high density ( 18 d.u./acre) in addition to office professional . The northern boundary of this designation was purposefully drawn to include part of the single family lot adjacent to the lot so that if a lot line adjustment in this area was executed a project may be expanded. The applicant, however, was not interested in acquiring property from an adjacent land owner or waiting for specific plan implementing zone change to or_r_ur and merely build to existing zoning. STAFF REPORT CONTINIIEL The project is designed so that all eight units face a pool/courtyard area with spa and barbecues. This recreation area is adjacent to the intersection and surrounded by a six foot masonry wall set back five feet from the property line. The parking is located in the east portion of the site. The applicant provides enough parking so that the project may go condo in the future. The elevations indicate the tallest structure to be 14 1/2 feet in height with tile roofs. II1. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. FINDINGS FOR APPROVAL OF A PARCEL MAP WAIVER: I . The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings . 2. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review.
