The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Twenty-four (24) foot reciprocal easement required along south property line with adjacent property. 6. Extensive landscaping required along all street frontages to screen parking with special attention given to Cook Street. 7. Six foot meandering sidewalk required along Cook Street. 8. Prior to Issuance of a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquisition of land for a lizard preserve in the Coachella Valley. i 3 I PLANNING COMMISSI_. Fire Marshal: 10. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. ll . Install Riverside County super fire hydrants so that no point of any building is more than 200 feet or a distance acceptable to the fire marshal from a fire hydrant measured along approved vehicular travel ways. a, exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 12. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 13. The water system plan shall be signed by a registered civil engineer and approved by the- .water company with the following certification: "I certify that the design of the water system in PP 85-27 is in accordance with the requirements prescribed by the fire marshal ." 14. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 15. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 16. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 18. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 20. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 21 . APPLICANT: ED MARK 247 La Paz Way Palm Desert, CA 92260 I. BACKGROUND: A. ADJACENT ZONING AND LAND USE: NORTH: S. I ./VACANT SOUTH: S. I ./VACANT EAST: S. I ./INDUSTRIAL BUILDINGS WEST: S. I ./MINI-WAREHOUSES B. GENERAL PLAN LAND USE DESIGNATION: Service industrial . C. SITE DESCRIPTION: The site has previously been rough graded and improved with curb and gutter as part of the subdivision's improvements. Also partially located on the site is a landscaped slope that was installed as part of the subdivision. The balance of this landscaped area is public right-of-way maintained by the association. II . PROJECT DESCRIPTION: The buildings proposed are both single story and contain a mixture of office and light industrial space. The site plan is designed so that offices will face all street frontages with parking located between the buildings and the street. The rear of the buildings face each other with a 30 foot wide alley separating the two structures. Staff's concern with this site plan is that together with the height differential between Cook Street and the parking lot, extensive landscaping will be required to screen the lot. This is listed as a STAFF REPORT CONTINUED condition of approval . The applicant has also agreed to install sidewalk on Cook Street. A joint access driveway is shown and requires a reciprocal easement. The applicant also owns the adjacent lot and plans to construct an identical project on this lot also. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: I . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared. 2 STAFF REPORT CONTINUEU IV. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-2 7 is in accordance with the requirements prescribed by the Fire Marshal . " 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6.
