CASE NO. PP 85-33 I WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of November, 1985, hold a duly noticed public hearing to consider the request of R.K. DEVELOPMENT for above named project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of community development has determined that the project will not have a significant environmental impact and a negative declaration is hereby certified. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said precise plan: I 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. 4. The proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control , appropriate improved public roads, sanitary disposal facilities , water supply availability, environmental protection and other requirements of this title. That the above recitations are true and correct and constitute the findings of the commission ,in this case; 2. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Additional landscaping at suite entrances required. 6. Shallow spaces in parking lot between buildings shall either be clearly marked as compact car stalls or eliminate spaces and expand remaining spaces. 7. Provide curbed landscaped strip between rows in above mentioned lot. 8. Prior to issuance of , a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquisition of land for a lizard preserve in the Coachella Valley. i 3 PLANNING COMMISSION RESOLUTION NO. 1099 - . rk - 9. Applicant agrees to join an assessment district that would provide a reasonable assessment for the construction of a bridge over the Whitewater Channel and extension of Interstate 10 on Cook Street. Department of Public Works: 1 . Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans submitted to the department of public works prior to the project final . 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Sego Lane and Beacon Hill shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of four foot curbside sidewalk on Sego Lane and Beacon Hill . .9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 10. Size, number and location of driveways to public works specifications with only two (2) driveway approaches to be allowed to serve this property. 1 l . Any permit, issuance shall be subject to the waiver of parcel map first being approved and recorded. 12. Raised planter strips to divide abutting parking facilities. 4 PLANNING COMMISSION RESOLUTION NO. 1099 13. Provide no parking signs in intersection to the department of public works specifications. I Sheriff's Department: 1 . Directed lighting required along rear of buildings. 2. Lighting required on overhanging ceilings above doorways. Fire Marshal : 1 . Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 85-33 is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to . delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. Continued Case No. ZOA 85-7 - CITY OF PALM DESERT, Applicant Zoning ordinance amendment listing 'recreational vehicle parks as a conditional use in the R-1-11 and PR zones and establishing minimum standards for their development. Mr. Drell outlined the standards in the report and recommended approval . Commissioner Wood clarified that the amendment would allow for recreational vehicle park plans to be submitted to the city for consideration. Chairman Crites asked if it could be required that large canopy shade trees be provided. Mr. Drell replied yes. Mr. Smith suggested this be applied at the architectural review level . Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the case. There being no one, the Chairman Crites closed. the public testimony. Commissioner Wood noted that there was no harm in having this amendment and it also provided safe guards. Action: Moved by Commissioner Wood, seconded by Commissioner Downs, adopting the findings as presented by staff. DEVELOPMENT, Applicant Request for approval of a 44,000 square foot office/industrial complex located in a service industrial zone in the Cook Street Industrial Park at the corner of Beacon Hill and Sego Lane. 11 MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 5, 1985 I Mr. Joy outlined the request and recommended approval with the k additional condition that the applicant would agree to a reasonable assessment for the bridge over the Whitewater Channel on Cook and f extension of Interstate 10. Chairman Crites opened the public testimony. MR. BOB RICCIARDI , 45-275 Prickly Pear Lane - architect, stated that he did not want to install the sidewalk, but would like to put in landscaping. Mr. Ricciardi stated that in regard to the landscaping around the entrance poles, he would work with staff to avoid violation of handicap standards. Commissioner Downs asked Mr. Ricciardi if he was willing to join an assessment district as mentioned above. Mr. Ricciardi replied yes. i Commissioner Richards informed the applicant that the city council had directed that sidewalks be required, noting that the applicant could appeal the condition at a city council meeting. i Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. i Commissioner Richards commended the applicant for providing parking spaces beyond what was required. GENERAL PLAN LAND USE DESIGNATION: Service industrial . C. SITE DESCRIPTION: The site is improved with curb and gutter along the street frontages. The east and south property lines are improved with a chain link fence, while a six foot retaining wall is parallel to the east property line, set back approximately 10 feet, and borders the Coachella Valley Water District water treatment plant. 11 . PROJECT DESCRIPTION: The project involves construction of two separate structures (31 ,642 square feet and 10,444 square feet) on a portion of a lot that extends along the entire length of Sego Lane, running from Beacon Hill to Cook Street and the industrial park entrance (refer to attached map) . The existing structures surrounding this development are both located on this same lot. The site plan for the project shows complete circulation around the structures with parking in the front along side the street, adjacent to STAFF REPORT CONTINUEu the sides of the structures and in a small lot between the structures. (The spaces in the small lot as drawn are too shallow and will be mentioned later in report. ) The amount of landscaping for this project is deficient per plans submitted and results from elimination of indentations in the buildings that were present in other buildings the applicant has constructed. Staff is requiring that additional landscaping be provided adjacent to the entrances. The project as submitted is approximately 30 spaces over the required amount when including the loading spaces in the calculations. The applicant is providing this extra amount since he is constructing some suites that may be strictly for office purposes while most of the suites will have truck openings in the rear for the warehouse/manufacturing use and a small office in front. The shallow spaces between the buildings can be designated as compact spaces and also comply with a public works condition of approval by providing landscaped strip between the two rows or by eliminating some of these spaces and expand the remaining ones to meet minimum dimensions for a regular sized stall . The building elevations indicate the same type of structures as built elsewhere in the park with 16 foot building height and tile mansards above door and window openings in front. 111 . ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. STAFF REPORT CONTINUE�- Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of community development has determined that the proposed project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared. IV. RECOMMENDATION: Staff feels the proposed project is acceptable and recommends: A. Adoption of the findings. B.
