Mirage, stated that she works at the Glass Table and felt that people cane from Palm Springs to patronize the restaurants on the block and use the parking; she indicated that she had on occasion worked until 8:00 p.m. and had not seen a problem.with the parking and was in favor of the proposal. Chairman Erwood closed the public testimony. Commissioner Richards noted that this long-time owner has suffered through many city changes in the frontage road and indicated that he was in favor of the proposal. Action: Moved by Commissioner Richards, seconded by Commissioner Ladlow, adopting the findings as presented by staff. Carried 4-0-1 (Commissioner Downs abstained). Moved by Commissioner Richards, seconded by Commissioner Ladlow, adopting Planning Camdssion Resolution No. 1312, approving CUP 88-7 subject to conditions. Mr. Joy outlined the salient points of the staff report. Camiissioner Ladlow asked for and received clarification regarding the storage of toxic chemicals, informing commission of a recent accident. Mr. Diaz explained that the city was exempted and that the regulations are handled by the fire marshal and the state. Commissioner Downs noted that condition numbers 6 and 13 seem to cover that issue. Chairman Erwood opened the public testimony and asked if the applicant wished to address the commission. 5 MINUTES PALM DESERT PLANNING CX-MISSION OCIOBER 4, 1988 MR. JIM FETRIDGE, agent, informed commission that he was present to answer questions. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Commissioner Downs stated that he felt the fire marshal and city staff covered all pertinent regulations fully in the imposed conditions. Case No. TT 23982 - BARCON DEVELOPMENT; Applicant Request for approval of a 16 lot single family subdivision located southwest of Portola Avenue and Hovley Lane. Mr. Joy outlined the salient points of the staff report and indicated that he reviewed a grading plan and did- not perceive any adverse impacts on the surrounding neighbors due to grading. Chairman Erwood opened the public testimony and asked if the applicant wished to address the commission. MR. DENNIS FREEMAN, 68-713 Perez Road, stated that he was present to answer any questions. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. ARTIE SWEITZ, a member of the Casa Blanca Homeowners Association, requested clarification regarding height and the possibility of a crosswalk being installed at Hovley and Portola. The Fire Department is required to set a minimum fire flow for the remodel or construction of all commercial buildings per Uniform Fire Code Section 10.301C. 2. Provide, or show there exists a water system capable of providing a potential fire flow of 3000 gpm and the actual fire flow available from any one hydrant connected to any given water main shall be 1500 gpm for 2 hours duration at 20 psi residual operating pressure. 3. A fire flow of 3000 gpm for a 3 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the Job site. 4. The required fire flow shall be available from a Super hydrant(s) (6" x 4" x 2-1/2" x 2-1/2") , located not less than 25' nor more than 150' from any portion of the buildings(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel " type. 5. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval , the original will be returned. One copy will be sent to the responsible inspecting authority.. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed by a Registered Civil Engineer and may be signed by the local water company with the following certification: "I certify that the design of the water system is in accordance with . the requirements prescribed by the Riverside County Fire Department. 6. Comply with Title 19 of the California Administrative Code. 7. Install a complete fire sprinkler system per NFPA 13. The post Indicator valve and fire department connection shall be located to the front, not less than 25' from/the building and within 50' of an approved hydrant. 8. SITE DESCRIPTION: The site is within the Palm Desert Business Center and is improved with curb and gutter and rough graded as part of the subdivisions original improvements. The site is irregularly shaped due to its northwest corner not being 90 degrees. II. PROJECT DESCRIPTION: The project's applicant, Gonzalo Mendoza, currently operates a similar warehouse in the Valley Industrial Park, across Cook Street and wishes to move into his own building in the business center. The lot which is proposed to be built on is a difficult one due to its irregular shape. It is due to this that the applicant has had to design the structure with loading doors facing directly onto street frontages which is a first for this subdivision and was ground's for that property owner's association to approve the preliminary plans though in conflict with their CC&R's. ANALYSIS: A. FINDINGS FOR APPROVAL: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be ocripatible with other residential and industrial uses existing and proposed in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. The Fire Department is required to set a minimum fire flow for the remodel or construction of all oammercial buildings per Uniform Fire Code Section 10.301C. 2. Provide, or show there exists a water system capable of providing a potential fire flaw of 3000 gpm and the actual fire flow available fran any one hydrant connected to any given water main shall be 1500 gpm for 2 hours duration at 20 psi residual operating pressure. 3. A fire flow of 3000 gpm for a 3 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 4. The required fire flow shall be available fran a Super hydrant(s) (6" x 4" x 2-1/2" x 2-1/2"), located not less than 25' nor more than 150' from any portion of the buildings(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type. 5. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Deparbiient for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval, the original will be returned. One copy will be sent to the responsible inspecting authority. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed by a Registered Civil Engineer and may be signed by the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department. 6. Ccmply with Title 19 of the California Administrative Code. 7. Install a complete fire sprinkler system per NFPA 13. The post indicator valve and fire department connection shall be located to the front, not less than 25' frcm the building and within 50' of an approved hydrant. 8. SITE DESCRIPTION: The site is within the Palm Desert Business Center and is improved with curb and gutter and rough graded as part of the subdivisions original improvements. The site is irregularly shaped due to its northwest corner not being 900. II. PROJECT DESCRIPTION: The project's eventual owner, Gonzalo Mendoza, currently operates a similar warehouse in the Valley Industrial Park, across Cook Street and wishes to move into his own building in the business center. The lot which is proposed to be built on is a difficult one due to its irregular shape. It is due to this that the applicant has had to design the structure{;S with loading doors facing directly onto street frontages which is a first for this subdivision and was ground's for that property owner's association to approve the preliminary plans though in conflict with their CC 8 R's. Staff has worked with the applicant to obtain as much landscaping as possible on the site while adding some extra spaces and cut down on the asphalt area. The purpose for this being the adjacent apartment zoning across Beacon Hill . The northern most spaces have been conditioned to be for employee parking only, to minimize noise generation in this area. PP 85-34 When the project goes on to the architectural commission, it will be required to raise the parapets to screen the roof top equipment and eliminate the need for added screening. The project will also be required to provide canopy type trees to shade the parking lot. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other residential and industrial uses existing and proposed in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B.
