The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within twelve months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission Palm Desert Water and Services District City fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Any trees removed for sidewalk installation along Hovley Lane shall be either relocated or replaced in same area. 6. Additional landscaping required adjacent to suite entrances including two trees to provide some parking lot shading. 7. Payment of lizard mitigation fees required prior to grading permit Issuance. B. Applicant agrees to pay reasonable assessment to the city to construct bridqes on Cook Street at the Whitewater Channel and Interstate 10 interchanges. 9. The parking area shall be screened by a 42" high masonry wall and/or mounding along Beacon Hill to the satisfaction of the architectural commission. Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 4. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to any permit issuance. 5. Landscaping maintenance on Beacon Hill and Hovley Lane shall be provided by the property owner. 6. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 7. Installation of sidewalk on Beacon Hill and Hovley Lane. 8. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 9. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. 10. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 11 . Any permit issuance shall be subject to the waiver of parcel map first being approved and recorded. 12. Provision of a 4800 cubic foot on-site retention basin as per Tract 13915 grading plan. 13. Four foot wide curb side sidewalk shall be installed along Hovley Lane and Beacon Hill . City Fire Marshal : 1. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protec- tion provisions of buildings. _.. 2 Install . Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of. hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-35 is in accordance with the requirements prescribed by the fire marshal ". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. BACKGROUND A. ADJACENT ZONING AND LAND USE: ` North: PR 5/condominium project South: S. I ./vacant, proposed project East: AHDPR-18/vacant, proposed 104 unit apartment project West: S. I ./vacant B. GENERAL PLAN LAND USE DESIGNATION: Service Industrial C. SITE DESCRIPTION: The site has previously been graded as part of the subdivision improvements being part of the Palm Desert Business Center. The property is improved with curb and gutter along both street frontages while the Hovley Lane frontage is also improved with grass and trees between the curb and a 6 foot wall five foot setback from the property line in an area with a total width of 12.5 feet. I1. PROPERTY DESCRIPTION The single story project is comprised of two separate structures totaling 35,000 square feet. There is a single and double row of parking along the street frontage (Beacon Hill ) along with additional parking in front of other suite entrances and a small amount in the rear of the site. There is complete circulation around the site with no truck openings directly facing the Beacon Hill frontage. The project is across Hovley Lane from the Vista Del Montanas condominium development. The project is also across Beacon Hill from an approved apartment project site. When the apartment zoning was approved with the accompanying site plan, care was taken so that no extreme mitigation measures would be necessary when the industrial property developed. The only mitigation measure staff is requiring then is that the parking lot , be screened by a solid 42" block wall instead of by landscaping as elsewhere in the park. This should more effectively screen the parking lot and block some of the noise. The existing Vista Del Montanas should not be impacted due to the existing center median on Hovley, perimeter walls and trees as mentioned earlier. A public works condition requires installation of sidewalk along Hovley Lane while a planning department condition of approval further states that any trees removed by the sidewalk installation should also be relocated or replaced. Staff is requiring some additional landscaping adjacent to suite entrances to soften the elevations, including tree wells to provide additional shading. The project requires a retention basin for runoff water with this pit to be located in the area between the street and the parking lot. III. ANALYSIS A. FINDINGS NEEDED FOR APPROVAL OF A PARCEL MAP WAIVER: 1 . The planning commission shall grant a waiver, provided that it finds that the proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvements and design, floodwater drainage control , appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection and other requirements of this title. Justification: The consolidation into one parcel for this development will comply with all applicable requirements and will allow one integrated development. B. FINDINGS OF APPROVAL OF PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial and residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land, while conditions of approval mitigate any potential impacts. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of community development. has determined that the proposed project will not have an adverse on the environment and a negative declaration of environmental impact has been prepared. IV. RECOMMENDATION - Staff feels the proposed project is acceptable and recommends: A. Adoption of the findings. B.
