PREVIOUS HEARING: This request was previously heard at the November 19 hearing. At that time, the issue of access from the Galleria property to the west came up. Additionally, it was noted that Mr. Foxx, the Galleria owner felt the project was not designed properly for retail usage but it could be revised to be. Therefore, the planning commission continued this request in order to see whether the concerns could be resolved. B. PREVIOUS PERTINENT CASES: 90 C - JANICE 'SCHOEN - design review case for same 10,750 square foot commercial complex approved on August 16, 1978. Approval expired on August 16, 1984, TT 17725 - JANICE SCHOEN - tentative tract map to allow condominium commercial spaces for 10,750 square foot building. Approval has expired. B. DESCRIPTION OF SITE: The site is presently vacant and void of any significant vegetation. The site slopes upward slightly from north to south. Across the rear is a block wall and row of power poles. C. ADJACENT ZONING AND LAND USE: NORTH: C-I/COMMERCIAL SOUTH., R-3 (4)/RESIDENTIAL EAST: C-I/VACANT WEST: C-I/COMMERCIAL STAFF REPORT CONTINUED D. GENERAL PLAN LAND USE DESI(INATiON: Core area commercial . PROJECT DESCRIPTION: A. GENERAL: The proposal is to construct a retail /office building of approximately 10,750 square feet. The building would be partially two stories. This building is the same structure previously approved for Janice Schoen. E . 51TE DESIGN, PARKING, CIRCULATION: The building would be located on the front part. of the site with parking in the rear. There would be no vehicular access to El Paseo. The parking area at the rear is designed to utilize access from the properties to the east and west. The developed property to the west was conditioned at the time of approval to grant a vehicular easement to the sub ect property when it developed. When the property to the east is deve I noed, it w i l l be required to tie its parking lot in and grant reciprocal easements. Therefore, eventually the parking areas between Ocotillo Drive and Sage Lane will be tied together and curb cuts onto El Paseo will be eliminated. As required in the original approval, all weather access to Sage Lane is recommended to provide complete access to the parking area. Thirty-seven ( 37) parking spaces are provided which is the minimum required after deducting for mechanical rooms, stairways, etc. The currently proposed handicapped stalls may need some revisions. C. ARCHITECTURE: The structure would be somewhat spanish in nature with exterior materials consisting of stucco walls, wood Trim and siding and a tile roof. The building is a partial two story building, which is designed to look like a tall one story building. The maximum height allowed is 30 feet which includes the clock tower. D. LANDSCAPING: Typical landscaping will be provided on the site. Along the rear, a ' seven foot landscape strip will be provided for buffering purposes. Street trees would be provided along El Paseo. 2 STAFF REPORT CONTINUED III . ANALYSIS: A. REQUIRED FINDINGS AND JUS1IFiCATION FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vir_ init.v. Justification: The design of the use is attractive and will be compatible with other commercial and residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land along El Paseo in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land although easements for access will be required. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all rode requirements and is well design, and therefore will not be detrimental to the public peace, health. safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of community development has determined that the proposed project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared for adoption. The development of the property shall conform substantially with exhihits (Case No. PP 85-37) on file with the department of community development, as modified by the following conditions. 2. Construction of a , portion of said project shall commenre within two years from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void, and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural" Commission Coachella Valley Water District Riverside County Department of Health City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. All weather vehicular access shall be provided to Sage Lane to satisfaction of the city. 7. Six foot block wall or equivalent shall be provided along rear property line. 8. Maximum building height shall be 30 feet including clock tower. 9. Final Palm Desert Property Owner's Association approval shall be obtained prior to submission of plans to department of building and safety. 10. Box size trees shall be provided along rear property line to provide buffer from residential properties. 11 . Street trees shall be provided as determined necessary during architectural review process. 3 PLANNING COMMISSION RESOLUTION NO. Department of Public Works: 1 . Drainage fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvement plans and specifications shall be submitted, as required by ordinance and the director of public works. shall be installed in accordance with city standards. - 4. Complete improvement plans and specifications shall be submitted. as required by ordinance, to the' city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans submitted to the department of public works prior to the project final . 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on El Paseo shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of sidewalk on El Paseo 9. offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to permit issuance. 10. Applicant must secure reciprocal ingress and egress easement from property owners on east and west sides prior to grading permit issuance. Fire Marshal : The following fire protection requirements are in accordance with the Uniform Fire Code and Life Safety Code standards. I . Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time 4 • PLANNING COMMISSION RESOLUTION 140. of measurement. Fire flow requirements will depend on built- in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 85-37 is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible . materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. PP 85-37 ENVIRONMENTAL EVALUATION CHECKLIST COMMENTS AND POSSIBLE MITIGATION MEASURES (CATEGORIES PERTAIN TO ATTACHED CHECKLIST) . 1 . EARTH b. The development of the property will result in compaction and overcovering of the existing soil which consists primarily of sand and gravel . C. The site will be graded and the surface relief features changed by paving, planting and construction of buildings. Mitigation Measures: b & c Development of property shall conform with city regulations and ordinances pertaining to grading and drainage. 3. WATER - Conditions and Impacts b. Because of the grading and development anticipated, it can be expected that there will be changes in absorption rates, drainage patterns, and the rate and amount of surface water runoff. Mitigation Measures: Compliance with grading ordinances shall be required. 10. NOISE - Conditions and Impacts Due to construction it can be expected that there may be a temporary increase in the noise levels. Once construction is completed, noise levels should return to prer_onstruction levels. Mitigation Measures: Compliance with city regulations regarding noise levels and working hours shall be enforced. 16. TRANSPORTATION/CIRCULATION: Development of the property will generate some new traffic. Approximately 437 trips per day can be expected with traffic utilizing both Sage Lane and Ocotillo Drive equally. It may be lower depending on how much office usage takes place. The majority of the traffic would exist at the site and use E1 Paseo, unless they lived in the area to the south. 11 INITIAL STUDY CONTINUED Mitigation Measures: Widening and improvement of Sage Lane and access to both Ocotillo Drive and Sage Lane will be adequate to handle anticipated traffic. 23. LIGHT AND GLARE With the development of the property it ran be expected that there will be new lighting systems provided throughout the site. This could create spillover and glare onto surrounding properties. Mitigation Measures: Parking lot lighting v li htin system shall be designed to comply with municipal code requirements with light standard heights to be determined. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than2oo feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than q,�_ feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 95-3 7 is in accordance with the requirements prescribed by the Fire Marshal . " 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over5000 square feet require an approved fire sprinkler system. Case No. PP 85-37 - DIANE STEWART, Applicant Request for approval of a negative declaration of environmental impact and precise plan of design to allow construction of a 10,750 square foot commercial building on .6 acres in the C-1 8 r MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 19, 1985 I ' zone (general commercial district) located on the south side of El Paseo, approximately 225 feet west of Sage Lane. Mr. Sawa outlined the request and background of the proposed. He explained that a problem had come up which the applicant would address. 1 Chairman Crites opened the public testimony and asked the applicant to address the commission. j MS. DIANE STEWART, applicant, stated that she accepted the conditions as presented by staff. She explained that after talking to Mr. Foxx regarding the easement, he indicated that he would grant the easement under the condition that she adopt his retail philosophy and landscaping. She stated that her plans were already completed and requested a continuance while this matter was being re-examined. Commissioner Richards inquired as to staff's feelings regarding the adjacent easement. Staff indicated that the applicant had no access without the easement: Mr. Smith explained that as a condition of the conditional use permit for the Foxx property, Mr. Foxx was required to participate in a mutual easement. Ms. Stewart stated that the easement was drafted and submitted to the city clerk but never filed. Mr. Phillips explained the legalities involved. Ms. Stewart indicated that she had been told that because it was a conditional use permit condition, it was an on-going condition and she felt the city was in a position to help. Mr. Phillips stated that the city can enforce the conditions of the conditional use permit. Chairman Crites suggested a 30 day continuance to allow the matter to be settled with or without city involvement. Commissioner Erwood suggested that staff determine whether the conditions of the conditional use permit were in compliance with city regulations. Chairman Crites stated that if the commission were comfortable with that, it would be considered a part of the motion. Mr. Phillips felt that it should be determined whether or not Mr. Foxx was informed by anyone about the easement to the east. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. 9 MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 19, 1985 Commissioner Richards suggested to the applicant that since Mr. Foxx had tried many ideas for his project and has been successful , she 1 might wish to incorporate some of Mr. Foxx's suggestions. Mr. Phillips tated that the commission would have to adopt an amendment statin that the planning commission may, by resolution, permit other uses which are similar and no more objectionable than those enumerated in this section (Ord. 96 S1 (part) , 1975: Exhibit A 525.20-2) . Commission determined t at an ordinance amendment could be processed concurrent with any appli ation that might be received.
