On the basis of your concerns regarding pad height, the Public Works Department has reviewed the proposed grading plan in an effort to determine the feasibility of reducing the pad heights. In reviewing the proposed grading plan, we have determined that Section 27.28. 150(A) and (6) of the Palm Desert Municipal Code applies to this develop- ment. This section, in essence, allows for building pads to be set at street grade or lower providing certain conditions are met. In light of this fact, we have recommended to the project engineer that the pads on the east side of the project (adjacent to your development) be lowered eighteen ( 18) inches and those on the west side be lowered twelve ( 12) inches. In response to your discussions with the project general contractor and the alleged alternatives presented to the Engineering Department, we respectfully must disagree with these assertions. No such alternatives were discussed with members of this department and, therefore, no alternatives could be rejected. The final concern expressed in your letter of July 7, 1986, pertains to the drainage Swale along the east. property line of the subject property. The majority of the swale will be grass lined with only small sections where cross flow exists Improved with a four-inch gunite finish. In addition to the swale, the developer is proposing a retaining wall abutting your existing block wall . He complimented his colleagues on picking the differences out and not being snowed by staff. He felt that sometimes he only gets a one-sided version on some of those things. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. JAMES FETRIDGE, architect, conceded that he could enlarge that second bedroom which is referred to as a den. He noted that the plans provided for that, so one wall could be extended to get closer to the 800 square feet. He stated that when he drew the plan he thought he had 800 square feet. He felt that the parking was brought about because the lot size is in a contingency of diminishing return because it is a corner lot and setbacks on two sides and with two bedrooms and providing two parking spaces we have provided three in the garage and three open or uncovered. Those on the Las Palmas Street side of it, which is contiguous to property already owned by Ms. Gravette, they have on the adjacent property already provided the same type of parking and would continue the theme. Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed project. There being no one, the public testimony was closed. Action: Moved by Commissioner Richards, seconded by Commissioner Wood, adopting the findings as presented by staff. Carried 5-0. Case No PP 85-40 - AL VANDERVELDEN, Applicant Request for approval of a negative declaration of environmental impact and precise plan of design to allow eight residential apartment units on a 26,700 square foot property in the R-3 zone located at the northwest corner of Shadow Hills Road and Driftwood Drive. 9 MINUTES PALM DESERT PLANNING COMMISSION JANUARY 7, 1986 Mr. Smith outlined the salient points of the staff report and clarified that the number of units being discussed was eight and not ten. He noted several concerns and recommended a continuance as stated by the applicant. Commissioner Downs asked for and received clarification regarding the utility easement. Chairman Crites o ened the public testimony. MR. VANOERVELDEN asked commission for a one month continuance. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. FRANK DANIEL, president of the Mountain Villas Homeowners Association, submitted a letter voicing concerns regarding Shadow Hills Road being a country lane, Driftwood Drive being extremely congested because of recent apartment buildings, parking problems, and drainage because of water accumulation where Shadow Hills Road and Driftwood Drive intersect to drain through his property on an easeway and also the elevations and landscaping. Commissioner Downs noted that if there is a drainage problems, he could contact public works. Mr. Daniel replied that the water just spills across the road and when a recent project drained their swimming pool it flooded all the property along the front and stated that he had his gardeners working on the drainage as it comes through the property, but was worried about adding to the problem. Commissioner Wood asked to whom Mr. Daniel 's concerns should be addressed. Commissioner Richards noted that we are working on a continuance. Chairman Crites stated that he can come to the next meeting and see if the issues have been attended to by the applicant and staff. MR. GEORGE BOOKER, Driftwood, stated that he had the same concerns. Mr. Smith concurred that there was a drainage problem in the area and stated that the public works department was taking note of the concerns. Mr. Gaugush stated that it was part of the assessment district 83-1 which should help mitigate the parking problem. Chairman Crites asked that staff address the issue of both parking on Driftwood and Shadow Hills when the case comes back. 10 MINUTES PALM DESERT PLANNING COMMISSION JANUARY 7, 1986 Action: Moved by Commissioner Richards, seconded by Commissioner Downs, continuing PP 85-40 to February 4, to allow staff to address the issues of the site plan, elevations, drainage, and parking. NANCY CREEK, Applicant Request for approval of a conditional use permit to allow use of a 1200 square foot commercial building for a veterinary hospital within the general commercial zone at 74-004 Highway Ill . Mr. Drell outlined the staff report and recommended approval . Commissioner Wood stated that the reference to the project not being detrimental to the public health, welfare or materially injurious, that it was strictly an opinion of the staff and asked for the reasons behind that opinion. Mr. Drell replied that it was based upon the one experience this city has had with a veterinary clinic and noted that state regulations would insure that the statement is true. Chairman Crites opened the public testimony and asked if the applicant wished to address the commission. There was no response. Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Carried 4-1 (Commissioner Wood voting no. ) Commissioner Wood stated that he was shocked that the commission was passing something like this in view of all of the statements made by citizen groups and all local groups to put this type of facility on the frontage road when the city is trying to improve the frontage roads and upgrade them and then put this type of facility in the middle of all the offices. Commissioner Richards asked what the difference between a veterinarian hospital or what problems it could create being any different than a store that sold fans. Driftwood Drive now exists as a very narrow street , with a great number of cars parked thereon. 3. The condition of both streets is deplorable. We realize you will require off-street parking At this new complex , but recent history shows that most tenants fill their garages with items other than cars , and park on the street . The recently completed 4-plexes on Driftwood Dr . has added to the problem by increasing the traffic on both streets , and by tenants parking on the narrow streets . Please, we ask you to consider these items , and take mitigating measures to prevent any further problems before granting any approval for additional apartments. APPLICANT: AL VANDERVELDEN 4300 E. La Palma Anaheim, CA I. BACKGROUND: A. DESCRIPTION OF SITE: The property is a flat vacant site at the northwest corner of Shadow Hills Road and Driftwood Drive. B. ADJACENT ZONING AND LAND USE: North: /Edison Sub Station South: R-3/Apartments East: PR-6/Multi-family West: R-3/Apartments C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 du/acre 11. PROJECT DESCRIPTION: The property is composed of the two lots on the north side of Shadow Hills Road. The two lots are split by an easement in front of Edison for their overhead lines. A. GENERAL: The applicant is proposing to construct 8 residential apartment units on two existing lots (4 on each lot) . The 2 story structures wi l l each contain two 1000 square foot units, one over the other. Each unit is provided with two parking spaces, one covered and one open. STAFF REPORT PP 85-40 The four (4) units on each lot have been proposed in locations which comply with the lot setback requirements. A single driveway will provide access to both portions of the project. As well , a single swimming pool will serve both lots. A mutual access agreement will have to be executed for both the driveway and the swimming pool . B. SITE DESIGN, CIRCULATION AND PARKING: The site is divided by a utility easement granted in favor of Edison to provide service from the power substation located on the property to the north. The access driveway has been located beneath this easement. The driveway is "L" shaped. Parking is provided on the west side of the first leg and on both sides of the second leg. A total of 16 parking spaces are provided of which 8 are garage spaces. Four buildings, each containing two 1000 square foot dwelling units are spread throughout the site. C. ARCHITECTURE: The architecture as presently proposed will probably not be accept- able to the architectural commission. Staff forsees the necessity of considerable improvement in the elevations before they are deemed acceptable to the architectural commission. The applicant has been advised of this concern. D. CONCERNS: The site is large enough to support up to 10 units. Only eight units are proposed. The site plan is such that even with 8 units the only on-site amenity is a swimming pool . In discussions with the applicant one of the primary considerations in limiting the development to 4 units on each lot was that 5 or more units on a property must be designed to accommodate the handicapped. This is a building requirement (Title 24) . Limiting the number of units to 8 would appear to have severely impacted the quality of development. As mentioned earlier the elevations are unacceptable. In addition it is felt that a much more satisfactory site plan could have been provided notwithstanding that the plan as proposed complies with/or can be made to comply with code. Staff has spoken with the applicant to urge that he revise the plan with a view to improve site efficiency and improved elevations. As of the writing of this report revised plans have not been received. 2 STAFF REPORT PP 85-40 Given that the project complies with code, staff have prepared findings necessary for approval however, commission may wish to continue the matter in order to allow the applicant to attempt to revise the plans to make a more acceptable project. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The project will be reviewed through the architectural commission and the elevations will be redesigned to comply with city standards and not be incompatible with other uses existing in the vicinity. 2. The precise plan wi l l not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Existing uses in the immediate area are multi-family develop- ments. Apartments are permitted in the R-3 zone. Development of the type proposed should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The project, as conditioned, is designed in a manner that will not endanger the public peace, health, safety or general welfare. Staff feels these findings can be justified in this case. Environmental Review: Several environmental impacts were identified in the initial study. It is felt that adequate means are available to mitigate these environmental impacts. Appropriate conditions will be imposed on the development to mitigate any adverse environmental impacts. With the imposition of these conditions the project will not have a significant impact on the environment and a negative declaration of environmental impact has been prepared. 3 STAFF REPORT PP 85-40 IV. CONCLUSION: The project is designed in a manner which is not unacceptable provided the conditions as recommended by staff are implemented. V. STAFF RECOMMENDATION: Staff recommends: A. EARTH b. The soil on the site, which is vacant, will be over-covered by virtue of construction, paving and landscaping. Mitigation of impacts will occur by compliance with city requirements for watering during grading and construction phases. 3. WATER b. As mitigation measures street dedications, where applicable, and street improvement will have to be provided. 17. c. The project will have an incremental impact on school facilities. School impact fees of $628 per unit will be assessed to finance new facilities. 23. LIGHT AND GLARE There will undoubtedly be some new lighting provided for safety, security and aesthetic reasons. Discussion with the Cit.y Attorney indicates that since the drainage easement is a city easement it would be feasible to allow the project in question to utilize the easement for site drainage . Unfortunately , as I explained in our telephone conversation on 4-24-87, there appears to be a failure, on the part of` the contractor , to meet all of the agreed terms presented-.by ,the. planning commission and your office. First , we were advised by. .the Planning commission that a security partition of at least six 'feet in height was required between the project and our complex and we agreed to allow our existing wall to be raised to meet these requirements with the proviso that the wall be properly stressed and painted to match our existing interior decor. This is basically the same understanding we had with planning commission , regarding our wall that separates Mountain Villas from the Hotel properties. Second , your letter of July 14 , 1986 confirmed that a drainage Swale would exist along the east property protection against the undermining of the wall . N6 such protection has been provided and dirt has been piled some 12 to 18 inches above our wall foundation creating an even greater threat to the wall stability and redoing the security height of the wall to as low as 4 1/2 feet. In discussion with the Contracting Superintendent on 4-24-1987 , I was given the impression that final approval had been given by the city and that there was no intent on the part of the contractor to increase the wall height , provide the wall reinforcement , or paint the portion of the wall that had been added. We would be grateful to any assistance you can provide to assure that all requirements of your office are achieved. La Palma Anaheim, CA 1. BACKGROUND: January 7, 1986 planning commission considered this application. Based on the staff request, the applicant requested a continuance to allow him to revise his plans. Commission heard testimony from several area residents expressing specific concerns (see minutes) . A copy of the January 7, 1986 staff report is attached. The concerns can basically be summarized as follows: 1 . Drainage problems 2. Street parking problems 3. Excessive traffic problems Staff had also expressed concern regarding the quality of development. 1I. CURRENT PROJECT DESCRIPTION: The plan as previously described, remains basically unchanged except that plans., better depicting the development have been received. The applicant is still proposing to construct 8 residential apartment units on two existing lots (4 on each lot) . The two story structures will each contain two 1000 square foot units, one over the other. Each unit is provided with two parking spaces, one covered and one open. III. CONCERNS EXPRESSED ON JANUARY 7, 1986 Drainage - Public Works has been investigating the drainage situation in the area. Public Works has determined that this site can be developed without adversely impacting the area. A memo from public works is attached and an oral description will be available at the meeting. STAFF REPORT PP 85-40 Street Parking Problems - This whole area is part of the assessment district work which is underway in other areas of the south side. This work will include installation of curb and gutter and street widening to uniform width. The county lane atmosphere on Shadow Hills Road will change to a typical residential street and allow for proper street parking where necessary. In addition the applicant, at the suggestion of staff, has agreed to change the garages to carports. This should assure that the on site parking is available for that purpose. Other situations in the city have proved this point. IV. CONCLUSION: It is felt that the assessment district work should improve the drainage, parking and traffic situation in the neighborhood. In addition, to assure that the on site parking is utilized, carports will be used. The colored landscape plan provides a better indication of the site layout and extent of open space. Staff's only concern at this time involves the elevations of the units but it is felt that the applicant is on the right track and by the time he obtains approval of the architectural commission the buildings will be compatible with the city's standard. ASSOCIATE PLANNER FROM : JOSEPH GAUGUSH , ASSOCIATE CIVIL ENGINEER SUBJECT : PP 85-40 , AL VANDERVELDEN DATE : January 29 , 1986 In response to the concerns expressed by the Planning Commission at the January 7 , 1986 meetinu with respect .to the above re- ferenced project the foilowing comments are provided : Parkina/Trafr" ir_ : Assessment District 83- 1 ( city wide curb and gutter installation ) includes Driftwood Drive , Shadow Hills Road and Sagebrush Drive . Work on Driftwood Drive consists of curb and gutter installation and match-up paying . This'-work will increase the street width from the current 26 -+ feet to a full 36 feet . Shadow Hills Road and Sagebrush Drive also will be widened from their current 20/26 feet to a full 36 feet . This we feel , should help mitigate the traffic and parking problems in this particular area . Since the project in question is providing all code required parking onsite , no additional impact with respect to street parking should be anticipated . Drainage : When Tract 11883 ( Mountain Villas ) was developed a 10 ' wide drainage easement was dedicated to, and accepted by , the city . . This easement is along the east , north and a portion of the west property lines . The west property line of Tract 11883 is coincident with the east property line of the project in question . The grading and street improvements for Tract 11883 were designed to utilize the drainage easements by means of cross-gutters and curb breaks on Driftwood/Shadow Hills and onsite drainage swales . A recent field inspection indicates that rocks have been placed blocking the opening in the peri - meter wall necessary for positive drainage to occur . By blocking the drainage route the local drainage problems have been increas- ed . A letter is being sent to the Mountain Villas Homeowners Association requesting that the blockage be removed to allow for proper drainage . Discussion with the City Attorney indicates that since the drainage easement is a city easement it would be feasible to allow the project in question to utilize the easement for site drainage . As far as the overall area drainage is concerned , Assessment District 83- 1 curb and gutter work should improve the control of surface water . In addition . the Toro Peak Branch and Deep Canyon Branch of the City' s Master Drainage Plan will substantially improve the area drainage . Unfortunately , at the present time adequate funding for the installation of these systems is not available and no schedule for installation exists . a MINUTES PALM DESERT PLANNING COMMISSION JANUARY 7, 1986 Mr. Smith outlined the salient points of the staff report and clarified that the number of units being discussed was eight and not ten. He noted several concerns and recommended a continuance as stated by the applicant. Commissioner Downs asked for and received clarification regarding the utility easement. Chairman Crites ooened the public testimony. MR. VANDERVFLDEN asked commission for a one month continuance. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. MR. FRANK DANIEL, president of the Mountain Villas Homeowners Association, submitted a letter voicing concerns regarding Shadow Hills Road being a country lane, Driftwood Drive being extremely congested because of recent apartment buildings, parking problems, and drainage because of water accumulation where Shadow Hills Road and Driftwood Drive intersect to drain through his property on an easeway and also the elevations and landscaping. Commissioner Downs noted that if there is a drainage problems, he could contact public works. Mr. Daniel replied that the water just spills across the road and when a recent project drained their t swimming pool it flooded all the property along the front and stated that he had his gardeners working on the drainage as it comes through the property, but was worried about adding to the problem. Commissioner Wood asked to whom Mr. Daniel's concerns should be addressed. Commissioner Richards noted that we are working on a continuance. Chairman Crites stated that he can come to the next meeting and see if the issues have been attended to by the applicant and staff. MR. GEORGE BOOKER, Driftwood , stated that he had the same concerns. Mr. Smith concurred that there was a drainage problem in the area and stated that the public works department was tak:inq_ note of the concerns. Mr. Gaugush stated that it was part of the assessment district 8. -1 which should help mitigate the parking problem. Commissioner Wood stated that the reference to the project not being detrimental to the public health, welfare or materially injurious, that it was strictly an opinion of the staff and asked for the reasons behind that opinion. Mr. Drell replied that it was based upon the one experience this city has had with a veterinary clinic and noted that state regulations would insure that the statement is true. Chairman Crites opened the public testimony and asked if the applicant wished to address the commission. There was no response. Driftwood Drive now exists as a very narrow street , with a great number of cars parked thereon. 3. The condition of both streets is deplorable. We realize you will require off-street parking at this new complex , but recent history shows that most tenants fill their garages with items other than cars , and park on the street . The recently completed 4-plexes on Driftwood Dr . has added to the problem by increasing the traffic on both streets , and by tenants parking on the narrow streets . Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to recordation of the final map. 11 . Size, number and location of driveways to public works specifications with only one driveway approach to be allowed to serve this property. 12. Complete parcel map waiver shall be submitted as required by ordinance to the city engineer for checking and approval and be recorded before issuance of grading permit. PLANNING COMMISSION RESOLUTION NO. City Fire Marshal : 1 . Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built- in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-40 is in accordance with the requirements prescribed by the fire marshal ". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . APPLICANT: AL VANDERVELDEN 4300 E. La Palma Anaheim, CA I. BACKGROUND: A. DESCRIPTION OF SITE: The property is a flat vacant site at the northwest corner of Shadow Hills Road and Driftwood Drive. B. ADJACENT ZONING AND LAND USE: North: /Edison Sub Station South: R-3/Apartments East: PR-6/Multi-family West: R-3/Apartments C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 du/acre II . PROJECT DESCRIPTION: The property is composed of the two lots on the north side of Shadow Hills Road. The two lots are split by an easement in front of Edison for their overhead lines. A. GENERAL: The applicant is proposing to construct 8 residential apartment units on two existing lots (4 on each lot) . The 2 story structures will each contain two 1000 square foot units. one over the other. Each unit is provided with two parking spaces, one covered and one open. STAFF REPORT PP 85-40 The four (4) units on each lot have been proposed in locations which comply with the lot setback requirements. A single driveway will provide access to both portions of the project. As well , a single swimming pool will serve both lots. A mutual access aareement will have to be executed for both the driveway and the swimming pool . B. SITE DESIGN, CIRCULATION AND PARKING: The site is divided by a utility easement granted in favor of Edison to provide service from the power substation located on the property to the north. The access driveway has been located beneath this easement. The drivewav is "L" shaped. Parking is provided on the west side of the first leg and on both sides of the second leg. A total of 16 parking spaces are provided of which 8 are garage spaces. Four buildings, each containing two 1000 square foot dwelling units are spread throughout the site. C. ARCHITECTURE: The architecture as presently proposed will probably not be accept- able to the architectural commission. Staff forsees the necessity of considerable improvement in the elevations before they are deemed acceptable to the architectural commission. The applicant has been advised of this concern. D. CONCERNS: The site is large enough to support up to. 10 units. Only eight units are proposed. The site plan is such that even with 8 units the only on-site amenity is a swimming pool . In discussions with the applicant one of the primary considerations in limiting the development to 4 units on each. lot was that 5 or more units on a property must be designed to accommodate the handicapped. This is a building requirement (Title 24) . Limiting the number of units to 8 would appear to have severely impacted the quality of development. As mentioned earlier the elevations are unacceptable. In addition it is felt that a much more satisfactory .site plan could have been provided notwithstanding that the plan as proposed complies with/or can be made to comply with code. Staff has spoken with the applicant to urge that he revise the plan with a view to improve site efficiency and improved elevations. As of the writing of this report revised plans have not been received. 2 STAFF REPORT PP 85-40 Given that the project complies with code. staff have prepared findings necessary for approval however, commission may wish to cont i nue the matter i n order to a I I ow the aop 1 i cant to attempt to revise the plans to make a more acceptable project. 111 . ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The project will be reviewed through the architectural commission and the elevations will be redesigned to comply with city standards and not be incompatible with other uses existing in the vicinity. 2. The precise plan wi I I not unreasonably interfere with 'the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Existing uses in the immediate area are multi-family develop- ments. Apartments are permitted in the R-3 zone. Development of the type proposed should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The project, as conditioned, is designed in a manner that will not endanger the public peace, health, safety or general welfare. Staff feels these findings can be justified in this case. Environmental Review: Several environmental impacts were identified in the initial study. It is felt that adequate means are available to mitigate these environmental impacts. Appropriate conditions will be imposed on the development to mitigate any adverse environmental impacts. With the imposition of these conditions the project will not have a significant impact on the environment and a negative declaration of environmental impact has been prepared. 3 STAFF REPORT PP 85-40 IV. CONCLUSION: The project is designed in a manner which is not unacceptable provided the conditions as recommended by staff are implemented. V. STAFF RECOMMENDATION: Staff recommends: A. EARTH b. The soil on the site, which is vacant, will be over-covered by virtue of construction, paving and landscaping. This activity on the proposed site would not have a negative impact on the environment and no mitiaatien measures are necessary. e. This proposal may result in temporary wind erosion of soil due to construction. Mitigation of impacts will occur by compliance with city requirements for watering during grading and construction phases. 3. WATER b. This proposal will result in a change in absorption rates. drainage patterns and the rate and amount of surface runoff by virtue of development. Compliance with applicable grading ordinances at time of development will mitigate any adverse impacts. 16. TRANSPORTATION/CIRCULATION a. The 8 units could generate up to 10 trips per unit per day. That would amount to 80 trips per day for the project. Trip distribution will be on Shadow Hills Road toward Highway III and on Driftwood to Deep Canvon and on to Highway 111 . As mitigation measures street dedications, where applicable, and street improvement will have to be provided. 17. c. The project will have an incremental impact on school facilities. School impact fees of $628 per unit will be assessed to finance new facilities. 23. LIGHT AND GLARE There will undoubtedly be some new lightina provided for safety. security and aesthetic reasons.
