APPLICANT: JAMES FETRIDGE for Nancy Gravette 73-965 Highway III , Suite B Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE: The property is a flat. vacant site at the southwest corner of Las Palmas and San Gorgonio. B. ADJACENT ZONING AND LAND USE: North: R-2/Apartments South: R-3/Apartments East: R-3/Vacant West: R-2/Single Family C. GENERAL PLAN LAND USE DESIGNATION As per Palma Village Plan: High Density Residential 18 du/acre 11. PROJECT DESCRIPTION: A. GENERAL The applicant is proposing to construct 3 apartment units along with .3 garage spaces and 3 open parking spaces. No additional on site amenities are proposed. B. SITE DESIGN AND PARKING The 3 units are oriented toward San Gorgonio and located centrally on the property. At the west side of the site a low profile flat roofed garage for 3 vehicles is proposed while at the east end of the site 3 uncovered parking spaces are delineated adjacent to Las Palmas. STAFF REPORT PP 85-42 The applicant is the owner of the existing apartment complex located immediately south of the property and is proposing to construct a new pool on that site which wi I I be available to residents of the proposed units. C. ARCHITECTURE The project architecture will be spanish in nature with exterior materials consisting of stucco walls, wood trim and tile roofing. The applicant will be required to obtain approval of the city architectural commission. D. UNIT TYPE AND MIX The development will be one story structures with a maximum height of 14 feet. All of the units wi l l have 2 bedrooms. Two of the units will be 729 square feet in area while the third unit will be 996 square feet. Ill . STAFF CONCERNS: Staff has the following concerns: 1 . The two, 2 bedroom, 729 square foot units do not comply with the minimum 800 square feet required for 2 bedroom apartment units. 2. The parking situation ( ie: split locations) is undesirable at best. 3. The lack of amenities on this specific site could be a problem. IV. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and not incompatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by occupants thereof for lawful purposes. 2 STAFF REPORT PP 85-42 Justification: Existing uses in the immediate area are single fami Iv to the west and multi -family developments. Residential units are permitted n the t i he R-3 zone. Development of the type proposed P should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The project, as conditioned, is designed 1n a manner that will not endanger the public peace, health, safety or general welfare. Staff feels these findings can be justified in this case. Environmental Review: Construction of 3 apartment units is a class 3 categorical exemption for the purposes of CEQA. No further documentation is necessary. V. CONCLUSION: As discussed under staff concerns there are some problems. The matter of the units size could be addressed by changing the second bedroom to a den. The parking can not be changed unless a major revision to 2 story development were done. The lack of amenities can be addressed if installed on the adjacent property. This will require a lot consoli- dation with the property to the south or execution of a mutual access agreement to swimming pool . VI . STAFF RECOMMENDATION: Staff recommends: A. CASE NO. PP 85-42 WHEREAS, the Planning Commission of the City of Palm Desert. California, did on the 7th day of January. 1986 hold a duly notice public hearing to consider the request by JAMES FETRIDGE for a precise plan of design and negative declaration of environmental impact to allow construction of 3 apartment units on an 8170 square foot lot in the R-3 zone located at the southwest corner of San Gorgonio and Las Palmas, more particularly described as: APN 627-092-014 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89" in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested person desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design. 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of the property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case. 2. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural review and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null , void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contem- plated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. That prior to issuance of building permit the owner (developer) provide the City with evidence that he has paid the required school mitigation fee ($628/unit) to the Desert Sands Unified School District. 7. That the applicant obtain approval of Palm Desert Disposal for provision of trash service: 8. That a six (6) foot high wall be provided along the west property line. 3 PLANNING COMMISSION RESOLUTION -NO. 9. That the applicant consolidate the property with the lot to the south or that an agreement guaranteeing in perpetuity access to the swimming pool for all units. be executed and recorded. Department of Public Works: 1 . Drainage and signalization fund fees. as required by city ordinance, shall be paid prior to grading Permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting and street. reconstruction, as required by ordinance and the director of public works, shall be installed in accordance -with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineerina department and a standard inspection fee shall be paid prior to any permit issuance. 6. Landscapina maintenance on Las Palmas Avenue and San Gorgonio Way shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of curb and gutter, matching paving and sidewalk on San Gorgonio Way and sidewalk on Las Palmas Avenue. 9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 10. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to service this property. 11 . Utility at northwest corner of property shall be undergrounded as per Southern California Edison's recommendation. 12. Asphalt curb on San Gorgonio Way must be removed and replaced with concrete curb and gutter as per city standards no 102. 4 PLANNING COMMISSION RESOLUTION NO. City Fire Marshal : I . Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-42 is in accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. EARTH b. The soil on the site, which is vacant, will be over-covered by virtue of construction, paving and landscaping. This activity on the proposed site would not have a negative impact on the environment and no mitigation measures are necessary. e. This proposal may result in temporary wind erosion of soil due to construction. Mitigation of impacts will occur by compliance with city requirements for watering during grading and construction phases. 3. WATER b. This proposal will result in a change in absorption rates, drainage patterns and the rate and amount of surface runoff by virtue of development. Compliance with applicable grading ordinances at time of development will mitigate any adverse impacts. 16. TRANSPORTATION/CIRCULATION a. The 3 units could generate up to 10 trips per unit per day. That would amount to 30 trips per day for the project. Trip distribution will be on San Gorgonio. As mitigation measures street dedications, where applicable, and street improvement will have to be provided. 17. c. The project will have an incremental impact on school facilities. School impact fees of $628 per unit will be assessed to finance new facilities. 23. LIGHT AND GLARE There will undoubtedly be some new lighting provided for safety, security and aesthetic reasons. Case No. <1P JAMES FETRIDGE, Applicant Request for approval of a precise plan of design and negative declaration of environmental impact to allow three residential apartment units on a 8175 square foot property in the R-3 zone located at the southwest corner of San Gorgonio and Las Palmas. Mr. Smith outlined the salient points of the report and recommended approval . Commission asked for and received clarification regarding installation of a pool , the one bedroom/one den variation and discussed parking. Chairman Crites felt that the intent of the ordinance was clear as to a minimum of 800 square feet. Commissioner Richards commented that while this shows a weakness in the structure and showed the availability of staff to provide answers when they want to provide them, he felt that the size of the discrepancy of 10% variance was small and the lot was small with three units on a piece of property. He felt that when dealing with small pieces of property in town it might behove commission to be a little lenient and that 729 was somewhat in the intent. Chairman Crites noted that Palm Desert prides itself on its standards and the kind of things it allows in the city, but staff says in their report that the parking is undesirable at best. Mr. Smith replied that the only way to solve that problems would be to put in two story structures in a neighborhood that is basically one story and staff was not prepared to suggest that as a viable alternative. Staff indicated that it would have been more concerned regarding the 800 square feet if the applicant had come in with a one and one request at this size in order that he only need provide a one and one half parking spaces per unit. He has provided the full two parking spaces per unit and its meeting all the other requirements. Most applicants would have come in and referred to a one and one - one bedroom and a den at this size. What they submitted to us was a two bedroom and was obliged to bring it to the commission's attention and felt that he provided a realistic response to that concern. Commissioner Richards commented regarding undesirable parking that it was this commission in the past that passed the structure on E1 Paseo behind Jenson's with no parking. 8 I d MINUTES PALM DESERT PLANNING COMMISSION JANUARY 7, 1986 Commissioner Wood noted that the parking was always going to be a problem,' but felt in this case that the pluses overcame the minuses. He complimented his colleagues on picking the differences out and not being snowed by staff. He felt that sometimes he only gets a one-sided version on some of those things. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. JAMES FETRIDGE, architect, conceded that he could enlarae that second bedroom which is referred to as a den. He noted that the plans provided for that, so one wall could be extended to get closer to the 800 square feet. He stated that when he drew the plan he thought he had 800 square feet. He felt that the parking was brought about because the lot size is in a contingency of diminishing return because it is a corner lot and setbacks on two sides and with two bedrooms and providing two parking spaces we have provided three in the garage and three open or uncovered. Those on the Las Palmas Street side of it, which is contiguous to property already owned by Ms. Gravette, they have on the adjacent property already provided the same type of parking and would continue the theme. Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed project. There being no one, the public testimony was closed. DESCRIPTION OF SITE: The property is a flat, vacant site at the southwest corner of Las Palmas and San Gorgonio. B. ADJACENT ZONING AND LAND USE: North: R-2/Apartments South: R-3/Apartments East: R-3/Vacant West: R-2/Single Family C. GENERAL PLAN LAND USE DESIGNATION As per Palma Village Plan: High Density Residential 18 du/acre II. PROJECT DESCRIPTION: A. GENERAL The applicant is proposing to construct 3 apartment units along with 3 garage spaces and 3 open parking spaces. No additional on site amenities are proposed. B. SITE DESIGN AND PARKING The 3 units are oriented toward San Gorgonio and located centrally on the property. At the west side of the site a low profile flat roofed garage for 3 vehicles is proposed while at the east end of the site 3 uncovered parking spaces are delineated adjacent to Las Palmas. STAFF REPORT PP 85-42 The applicant is the owner of the existing apartment complex located immediately south of the property and is proposing to construct a new pool on that site which wi 1 I be available to residents of the proposed units. C. ARCHITECTURE The project architecture will be Spanish in nature with exterior materials consisting of stucco walls, wood trim and tile roofing. The applicant will be required to obtain approval of the city architectural commission. D. UNIT TYPE AND MIX The development will be one story structures with a maximum height of 14 feet. All of the units will have 2 bedrooms. Two of the units will be 729 square feet in area while the third unit will be 996 square feet. III. STAFF CONCERNS: Staff has the following concerns: I . The two, 2 bedroom, 729 square foot units do not comply with the minimum 800 square feet required for 2 bedroom apartment units. 2. The parking situation ( ie: split locations) is undesirable at best. 3. The lack of amenities on this specific site could be a problem. IV. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and not incompatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by occupants thereof for lawful purposes. 2 STAFF REPORT PP 85-42 Justification: Existing uses in the immediate area are single family to the west and multi-family developments. Residential units are permitted in the R-3 zone. Development of the type proposed should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The project, as conditioned, is designed in a manner that will not endanger the public peace, health, safety or general welfare. Staff feels these findings can be justified in this case. Environmental Review: Construction of 3 apartment units is a class 3 categorical exemption for the purposes of CEQA. No further documentation is necessary. V. CONCLUSION: As discussed under staff concerns there are some problems. The matter of the units size could be addressed by changing the second bedroom to a den. The parking can not be changed unless a major revision to 2 story development were done. The lack of amenities can be addressed if installed on the adjacent property. This will require a lot consoli- dation with the property to the south or execution of a mutual access agreement to swimming pool . VI. STAFF RECOMMENDATION: Staff recommends: A.
