Alessandrn. Mr . Smith reviewed the salient points and outlined the roncerns expressers at the previous meeting. Commissioner Downs received clarification that two parking spaces could not be used as both parking spaces and a drive through. Mr. Smith further explained that 900 square feet of the landscaping was required, 1010 was being provided but that 250 feet was not on the subject property and on the lot to the east which is owned by the same person. Mr. Smith felt that if the city were to tie down the applicant to 140 feet of extra parking lot landscaping when that property develops, the city would come out even. Mr. Diaz noted that the 140 feet could not be credited to both. Chairman Crites expressed concern over the 8 1/2 foot employee parking spaces and opened the public testimony. MR. FRANK GOODMAN, 77-900 Avenue of the States, explained that three lots were consolidated which individually were undevelopable. He stated that since the last meeting he had received preliminary architectural commission approval . Mr. Goodman stated that the proposed parking lot was exactly like the city hall parking lot by the building department. Commissioner Downs informed Mr. Goodman that staff would not allow it anywhere else. Mr. Goodman indicated that he could obtain a lanr_'scape. easement to resolve that issue. Mr. Erwin stated that an easement could be tied to both properties. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION. Mr. Smith stated that the applicant would have to apply for a variance application to reduce the number of parking spaces . Mr. Diaz replied that it would require a modification in code and recommended that the parking modification be submitted to him for approval without further public hearing. Commission concurred. Action: Moved by Commissioner Wood, seconded by Commissioner Richards, adopting the findings as presented by staff. The development of the property shall conform substantially with exhibits on file with the department of environmental services. as modified by the followino conditions. 2. The development of the property described herein shall be sun ieCt to tha restriction; and limitations set forth herein which are in addition to all municipai ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. If lights are to be used, detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits: for approval ; lights to be down-shining box type to minimize glare. 6. Provide 3.5 foot high decorative masonry wall , berming and landscaping or combination thereof, in front of parking lot areas and exposed to streets (except driveways) . 7. All roof mounted mechanical equipment shall be screened from all sides with material similar to building walls. 8. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage stud by y the private engineer that is approved by the department of public works, 3. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final . 5. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet or a distance acceptable to the fire marshal from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water 'system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The. water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-43 is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific Plans for consideration and approval . 7. All buildings over 5000 square feet require an approved fire sprinkler system. 5 p' MINUTES PALM DESERT PLANNING COMMISSION JANUARY 21 , 1986 Action: Moved by Commissioner Wood, seconded by Commissioner Downs. approving the two year time extension of TT 19847-2 & 3 by minute motion. Carried 3-0. VI1 . PUBLIC HEARINGS A. Case PP 85-43 - FRANK GOODMAN 8 DOUG GRIFFITHS, Applicants Request for approval of a negative declaration of environmental impact and precise plan to allow construction of a commercial office building (one story) with 6298 square feet in the C- I (general commercial ) zone on 15.000 square feet located at the southeast corner of San Pablo and Alessandro. Mr. Smith outlined the staff report and indicated that the applicant had revised the site plan after receiving direction from the archi- tectural commission. Chairman Crites stated that he would prefer to continue this case as suggested by staff. Mr. Diaz indicated that the applicant had requested this case go before the architectural commission prior to planning commission approval , which was done. At that time, the architectural commission had concerns with the building and with the parking lot layout. He noted that the concerns of the architectural commission could impact the site plan design and that staff would recommend a two week continuance. Chairman Crites opened the public hearing and asked if the applicant wished to address the commission. MR. FRANK GOODMAN, 77-900 Avenue of the States, Palm Desert, explained that this site was previously three lots and that it is now one parcel . He indicated that speed was essential in completing this project and that he had completely worked over the plans which should address all of the architectural commission's concerns. He stated that the project meets all city requirements. 2 !'r MINUTES PALM DESERT PLANNING COMMISSION JANUARY 21 . 1986 Mr. Smith indicated that the case would be continued to February 4 so that the applicant is not unduly delayed. DESCRIPTION OF SITE: The property is located at the southeast corner of San Pablo and Alessandro some 150 feet north of Highway Ill . The property is vacant. B. ADJACENT ZONING AND LAND USE: NORTH: C-I/ACROSS ALESSANDRO, EXISTING COMMERCIAL BUILDING SOUTH: C-l/ON FRONTAGE ROAD, COMMERCIAL BUILDING EAST: C-I/VACANT WEST: C-I/ACROSS SAN PABLO, EXISTING COMMERCIAL BUILDING C. GENERAL PLAN LAND USE DESIGNATION: Core area commercial . 11. PROJECT DESCRIPTION: A. GENERAL: The single story 18 foot high structure will contain 6298 square feet and is designed to house one tenant (General Escrow) . B. SITE DESIGN, PARKING AND ACCESS: The site is served by two streets and one alley. The building has been located at the northwest corner of the lot and provides the required five foot setbacks. STAFF REPORT CONTINUED Parking will be provided on the south and east sides of the building. On the east side seven parking spaces are provided with access from Alessandro while on the south side 15 parking spaces are provided with access from the 20 foot wide alley which enters from San Pablo. The alley is unimproved east of this site. The dead end parking situation in both locations is undesirable. The 6298 square foot building has a requirement of 25 parking spaces while 22 have been provided. The applicant is relying on the parking code provision which reads, "one parking space for each 250 square foot of floor area, exclusive of stairways, elevators, landings, and mechanical rooms, not exceeding 15 percent of the gross floor area." If the 15% reduction were utilized, then 22 parking spaces would be required. At this point in time staff does not have a floor plan but considering this is a single story building then there can be no stairways, elevators or landings. There may be a mechanical room although most of the equipment would probably be roof mounted. In any case the mechanical room would need to account for 15% of 6298 square feet (945 square feet) . C. ARCHITECTURE: The building has been designed with the extensive use of glass at the street level and a heavy fascia (parapet) across the top. A similar appearing building was constructed on Highway III in 1985. The architecture was reviewed by the architectural commission at its January 14, 1986 meeting and was not approved. The concerns expressed were that the applicant was building to the maximum at the expense of on-site amenities without any special architectural return. One commissioner described the architecture as "boring, cumbersome and brutal ." Commission also directed staff to review closely compliance with code section 25. 58. 100, Landscaping Requirements in Parking Lots. This code section, 25.58. 100, reads: 25. 58. 100 Landscaping requirements. A minimum of fifteen percent of the total off-street open parking area shall be landscaped with a mixture of trees, shrubs, ground cover, other plant material and hardscape material . A minimum of one-third of the required landscaping shall be distributed within the interior of the parking facility and the remaining two thirds of the required landscaping shall be provided as peripheral planting on the exterior edges of the 2 STAFF REPORT CONTINUED parking area. All landscape areas shall be well maintained in perpetuity. The plans indicate that 5928 square feet are covered in asphalt. Therefore, 888 square feet of landscaping is required in the parking area. The plans indicate that a total of 1255 square feet of lot area will be landscaped. The landscaped areas near the parking lots total 465 square feet while the remainder of the 1255 square feet is in the required setback areas at the corner of the building and the intersection of San Pablo and Alessandro. Planning Commission should determine whether the plan as submitted complies with the intent of section -25.58. 100. D. In order that this building would comply with all code provisions planning commission would need to make a couple of liberal interpretations on code sections (i .e. the 15% parking reduction for mechanical areas and the landscaped areas in the parking lots) . If these interpretations are made then the case could be approved and staff has delineated in section III B. the necessary findings which could be adapted by commission. if commission concurs with the architectural commission and staff that the site is being over built and the quality of development 3 STAFF REPORT CONTINUED should be improved then the commission could continue the case until February 18, 1986 to allow the applicant to study the concerns and revise the plans accordingly. B. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is not unattractive and will be compatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff is not prepared to recommend approval of the findings based on the current plan; however, if commission is satisfied with the plan you may adopt the findings then approve the project. C. ENVIRONMENTAL REVIEW: The director of community development has determined that the proposed project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared. The water service installation charges will be as follows: a. One 1?-inch water meter service $1 ,150.00 at $1 ,150.00 each b. Frontage fee for 150 feet at $1 ,800.00 $12.00 /foot TOTAL $2,950.00 4. All meter and installation charges must be paid before installation work will begin. 5. An approved 12-inch backflow prevention device shall be installed as part of the plumbing. 6.
