PP 86-1 r: WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of June, 1988, hold a duly noticed public hearing to consider a request for approval of a precise plan to allow construction of 10 ,apartment units on .57 acres at the south side of Fred Waring Drive, 125 feet west of San Pascual; and ' WHEREAS, 'said application has � f complied with the requirements of the City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of community development has determined that the project has been previously assessed and a negative declaration has been approved; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said commission did find the following facts and reasons to justify �• {I their actions: 1. The design quality of the precise plan exceeds that of surrounding properties and, therefore, will not depreciate property values in the vicinity. 2• The type and intensity of use are consistent with the property's zoning and Palma Village Specific Plan designation and are similar to adjacent uses. 3. The precise plan will not unreasonably interfere with the use of properties in the, vicinity nor will it endanger the public peach, health, safety or general welfare. The development of the property shall conform substantially with exhibits on file with the department of co runity development, as modified by the s following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. .' Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. . Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health lPalm Desert Architectural Connission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of.a building permit for the use contemplated herewith. 5.. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. i 6. Applicant shall pay applicable impact fees to the Desert Sands Unified School District. 7. Applicant agrees to maintain the landscaping required to be installed pursuant to these conditions. Applicant will enter into an agreement to maintain said landscaping for the life of the project, which agreement shall be notarized and which agreement shall be recorded. It is the specific intent of the parties that this condition and agreement run with the land and bind successors and assigns. 3 I PLANNING CCM4ISSION RESOLi1PICN NO. 1288 Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance,. to the director of public works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineering department and a. standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Fred Waring Drive shall be provided by the property owner. 1 i 7. Complete grading plans and specifications shall be submitted, as required I by ordinance, to the director of public works for checking and approval prior to issuance of any permits. f( 8. Installation of six foot wide meandering sidewalk on Fred Waring Drive. 9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 10. . Size, number and location of driveways to public works specifications with f only one driveway approach to be allowed to serve this property. 11. Grading permit issuance shall be subject to the waiver of parcel map first being approved and recorded. 12. Any and all off-site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. 13. The .: computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main fran which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. :2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any buildings. 3. Prior to issuance of a building permit, the developer shall furnish the `i original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4.: The water system plan shall be signed by a registered civic engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 86-1 is in accordance with the-requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Architectural design will remain Spanish mediterranean with off-white stucco, light brown trim and red the roofs. Commissioner Sullivan indicated that while there was plenty of open area on the east side of the project, there was very little on the west side for backyard area. He further indicated that he did not understand the motive for the walkway on the west side. The applicant indicated that there was no real purpose for it, but i another entrance into the project and is 5 feet wide. The applicant a indicated that it could be reduce to 3 feet or eliminated to create additional open space area on the west. Another concern of the commission was that once inside the project all people will see is asphalt and garages. There is plenty of 1 landscaping, but it is all in the open area located on the outside I of the project. The three bedroom unit was the dominated architectural element fronting onto Fred Waring Drive. It was spanish in style with a series of arches and tile roof. The style of the interior units was also spanish but with less detail. While still spanish in style, the overall architectural quality has been substantially improved. Also, the landscape open space has been increased due to the deletion of the larger unit.
