MR . DON STAGE , 1313 Sandpiper, asked for and received clarification regarding location and elevation. Chairman Crites closed the public testimony. Commissioner Wood commented on the streets being private and gated. Chairman Crites asked about the drainage issues and conditions. Mr. Drell replied that it was covered in the present conditions. Commission noted that the additional condition would be that all streets remain private. Mr. Fox indicated concurrence. Action: Moved by Commissioner Richards, seconded by Commissioner Wood, adopting the findings as presented by staff. Carried 4-0. Moved by Commissioner Richards, seconded by Wood, adopting Planning Commission Resolution No. 1127, approving HDP 86-1 , subject to conditions as amended. Carried 4-0. B. Case NosI1 and PMW 86-4 - LEN COR, Applicant Request for approval of a 19,401 square foot office/warehouse building and a three lot consolidation located in service industrial zoning on the north side of Lennon Place, 250 feet east of Corporate Way. Mr. Joy outlined the salient points of the staff report noting the added landscaped planter and two-way drive. Staff recommended approval of the project. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. BILL WARNER, representative, expressed agreement with the staff report, findings and conditions of approval . Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. 3 4 MINUTES PALM DESERT PLANNING COMMISSION MARCH 18, 1986 Action: Moved by Commissioner Wood, seconded by Commissioner Erwood, adopting the findings as presented by staff. MISCELLANEOUS A. Discussion of rear setbacks and proposed 45' parking easement for professional office lots on west side of Monterey Avenue south of Fred Waring Drive. Mr. Charles Martin, representing owners from Fred Waring Drive to Sonora, gave a presentation indicating that the 45' easement requirement created a hardship for those property owners and requested some type of action from the commission. After discussion commission determined that this would be taken into consideration when each case was brought the planning commission for review. .. i IX. ORAL COMMUNICATIONS NONE. X. COMMENTS A. Mr. Diaz stated that he would like a planning commissioner to participate on the committee to select a consultant for the civic center 60 acre plan. Chairman Crites appointed Commissioner Richards to that position. B. Mr. Diaz explained that D 8 D (Raffles) was called up by council because of Councilmember Benson's concern about the development of this key piece of property. After discussion Mr. Diaz explained that it was a matter of location rather than any objection to commission's action. C. SITE DESCRIPTION: The site is improved with curb, gutter, preliminary grading and parkway landscaping as part of the subdivision's improvements. B. ADJACENT ZONING AND LAND USE: North: S. I ./vacant, future post office South: S. I ./vacant East: S. I ./vacant West: S. I ./approved office/warehouse complex C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial 11 . PROJECT DESCRIPTION: The project involves construction of a building parallel to the street that crosses two property lines thereby necessitating a three lot consolidation. The site plan indicates a single row of parking (30 spaces) between the building and street in addition to an open U-shaped area behind the structure that the applicant has stated is intending to be either parking or an open storage area. The applicant also shows in his plans a planned mezzanine area above future suites if desired by the occupants. The applicant has clarified +; , PP 86-I1 a PMW 86-4 that the mezzanine area will not have windows and that due to occupancy requirements as set forth in the uniform building code can only be used as warehouse or storage space. Whether or not the mezzanine is provided for the tenant, it must be included in the parking calculations. If outdoor storage is provided, which the applicant has stated is a possibility, it can reasonably be assumed that it would eliminate the 12 spaces in the U-shaped area. Other parking modifications staff is required is to provide two landscape islands within the parking lot to replace two spaces and break-up a continuous row of 30 spaces. The new added condition staff is requiring of industrial buildings that "all future occupancy comply with parking requirements" also applies to this project. A waiver will be filed that consolidates the three lots into one lot that will enable the project to be built as currently designed. FINDINGS NEEDED FOR APPROVAL OF A PARCEL MAP WAIVER: I . The planning commission shall grant a waiver, provided that it finds that the proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvements and design, floodwater drainage control , appropriate improved public roads, sanitary disposal facilities, water supply availability environmental protection and other requirements of this title. Justification: The consolidation into one parcel for this development will comply with all applicable requirements and will allow one integrated development. B. FINDINGS FOR APPROVAL OF PRECISE PLAN: I . The design of the precise plan will not substantially depreciate property values in the vicinity. 2 PP 86-I1 8 PMW 86-4 Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners ' would not be deprived the use of their land. 3. . The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of community development has determined that the proposed project will not have an adverse on the environment and a negative declaration of environmental impact has been prepared. IV. RECOMMENDATION: Staff feels the proposed project is acceptable and recommends: A. Adoption of the findings. B.
