The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinance- and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a buildingpermit P t for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department City Fire Marshal Desert Sands Unified School District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Pay $628 per unit school , impact mitigation fee to the Desert Sands Unified School District or reach satisfactory agreement with said district prior to issuance of building permit. 6. Final plans must be approved by the architectural review commission and possible modification of off-street parking to achieve that, approval is granted. Department of Public Works: 1 . Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. i 3 i PLANNING COMMISSION RESOLUTION NO. 1143 3. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans submitted to the department of public works prior to the project final . 5. All private driveways shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Driftwood Drive shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of six foot sidewalk on Driftwood Drive. 9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 10. Size, number and location of driveways to public works specifications with only two (2) driveway approaches to be allowed to serve this property. 11 . Total amount of street frontage utilized as driveway shall not exceed 50%. Fire Marshal : 1 . Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: " I certify that the design of the water system in Case No. PP 86-13 is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over 5000 square feet require an approved fire sprinkler system. Coachella Valley Hater District: 1 . Area shall be annexed to Improvement District No. 54 and 80 of the Coachella Valley Water District for sanitation service. 5 j MINUTES PALM DESERT PLANNING COMMISSION MAY 6, 1986 that some foresight was needed. Mr. Diaz asked what additional wording could be added to condition #4. Commission added the words, "liquor license on existing and adjacent property." Case No. PP 85-34 - LARRY McMACHEN, Applicant Request for approval of a 8,000 square foot pool supply warehouse in a service industrial zone located at the northwest corner of Beacon Hill and Mediterranean. Mr. Joy outlined the salient points of the staff report and recommended approval . Chairman Crites opened the public testimony. MR. LARRY McMACHEN, applicant, felt they had made all the changes requested. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, Chairman Crites closed the public testimony. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, adopting the findings as presented by staff. Carried 4-0. Case No. PP 86 ID- JOHN DELLA, Applicant Request for approval of a precise plan of design for a triplex to be located in the R-3 zone 3 .s MINUTES PALM DESERT PLANNING COMMISSION MAY 6, 1986 located on the south side of Driftwood Street, some 90 feet west of Deep Canyon. Mr. Diaz outlined the salient points of the report noting that the architectural commission required the applicant to restudy the mansard roof and recommended modification of parking by one space to create, as in a PRD or PUD, a driveway in front of parking to eliminate barking out onto the street. Staff recommended approval subject to the modification of parking and final approval by the architectural commission. Chairman Crites opened the public testimony and asked the applicant to address the commission. i MR. JOHN DELLA, applicant, expressed concern over change to parking which would delete landscaping. He felt that it would result in a less attractive front and noted that backing onto I the street was not prohibited by ordinance. After further discussion, Commissioner Richards felt that proper language should be written to indicate that a possible modification of the off-street parking may be needed or the project be denied to .I allow the issue to be resolved between staff and the applicant. i Mr. Diaz stated that condition #6 would state, "Final plans must be y - - approved by the architectural commission and possible modification of off-street parking to achieve that approval is granted." Mr. Diaz outlined the salient points of the report noting that the architectural commission required the applicant to restudy the mansard roof and recommended modification of parking by one space to create, as in a PRD or PUD, a driveway in front of parking to eliminate backing out onto the street. Staff recommended approval subject to the modification of parking and final approval by the architectural commission. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. JOHN DELL.A, applicant, expressed concern over change to parking which would delete landscaping. He felt that it would result in a less attractive front and noted that backing onto the street was not prohibited by ordinance. He also noted that there should be additional screening on the west and south facing windows. Mr. Smith suggested that the size of the units be reduced to provide additional space for parking. Commissioner Martin objected to the front elevation. Commissioner Holden noted that the commission reviews the architecture and design of the building and felt that this was a box building. 5 MINUTES _ ARCHITECTURAL COMMISSION APRIL 22, 1986 Chairman Gregory felt that the building could be softened some by Putting additional planting in the parking area and in the front of the building. He suggested that the units have private yards and thought that the pool area was minimal and that planting should be added. Mr. Della indicated that he could add a small wall to provide private yards. Commissioner Martin thought that the plan needed restudy even though the project might be upgrading the area. He had concerns with the parking situation and also with the mansard roof. Chairman Gregory felt that the applicant should resubmit showing attention to Commissioner Martin's concerns and also his comments. He suggested that he provide additional landscaping in the front of the building and move the parking to a more suitable location. Commissioner Martin felt that there was more than one way of doing this project. He indicated that the planning commission would solve the parking problem and suggested that the front unit have a roof and the back units have flat roofs with parapets to hide all mechanical equipment. Moved by Commissioner Drury, seconded by Chairman Gregory to grant preliminary approval .subject to restudy of the mansard roof, landscaping, parking and pool areas. Vote 2-2 (Commissioner's Holden and Martin opposed) The vote therefore died and Chairman Gregory continued the case. 3. LOBLAND WARING - Awning Mark Beatty, Portals, presented drawings for an awning proposed for the Lobland Waring office. Commissioner Holden indicated that the property owner's association should approve this before coming to architectural commission. He felt that the awning did not tie-in to the building in any way. Commissioner Martin agreed and thought that the awning was too large for the office building. V. PROJECT DESCRIPTION: The applicant is requesting approval to construct a triplex on an 8840 square foot R-3 (3) zoned parcel . The zoning permits one unit per 3000 square feet of land area. Section 25.56. 160 (c) of the municipal code provides ". . . if after dividing the area of a site in a residential district by the site area required per dwelling unit, a remainder equal to or greater than ninety percent of the area required for an additional dwelling unit may be located on the site. . ." 90% of 3000 is 2700 square feet, when one subtracts 6000 square feet from 8840 square feet, the remainder is 2840 square feet, which is greater than 90% so the third unit is permitted. Because the site is adjacent to R-I zoned property the applicant is limited to a single story structure. The proposed development complies with this requirement. PP 86-18 CONTINUED The plans have been reviewed by the architectural commission. The commission asked the applicant to restudy the mansard roof, landscaping, parking and pool area ( landscaping) . Concern was raised over the front elevation, particularly the uncovered parking area; the commission felt that it might be better to modify the parking requirements by one space and permit a redesign of the parking area so a portion would be parallel to the street. Staff concurs with this recommendation. The project as submitted complies with all code requirements, a minor modification of one parking space could be granted by the commission as part of the slight adjustment process. III. ANALYSIS: All required findings for precise plan approval can be made affirmatively in this case if the conditions set forth in the resolution of approval are imposed. The required findings are: I . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The project is an infill proposal that may encourage improvement of the parcels that are in a state of lower maintenance in the area. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: Applicant is merely requesting the right to develop his parcel within the limits of the Palm Desert Municipal Code. 3. The proposal is consistent with the city's adopted general plan. Justification: The project meets all development standards of the City of Palm Desert. IV. Mr. Smith suggested that the size of the units be reduced to provide additional space for parking. Commissioner Martin objected to the front elevation. Commissioner Holden noted that the commission reviews the architecture and design of the building and felt that this was a box building. 5 MINUTES ARCHITECTURAL COMMISSION APRIL 22, 1986 Chairman Gregory felt that the building could be softened some by putting additional planting in the parking area and in the front of the building. He suggested that the units have private yards and thought that the pool area was minimal and that planting should be added. Mr. Della indicated that he could add a small wall to provide private yards. Commissioner Martin thought that the plan needed restudy even though the project might be upgrading the area. He had concerns with the parking situation and also with the mansard roof. Chairman Gregory felt that the applicant should resubmit showing attention to Commissioner Martin's concerns and also his comments. He suggested that he provide additional landscaping in the front of the building and move the parking to a more suitable location. Commissioner Martin felt that there was more than one way of doing this project. He indicated that the planning commission would solve the parking problem and suggested that the front unit have a roof and the back units have flat roofs with parapets to hide all mechanical equipment. Moved by Commissioner Drury, seconded by Chairman Gregory to grant preliminary approval subject to restudy of the mansard roof, landscaping, parking and pool areas. Vote 2-2 (Commissioner's Holden and Martin opposed) The vote therefore died and Chairman Gregory continued the case. 3. LOBLAND WARING - Awning Mark Beatty, Portals, presented drawings for an awning proposed for the Lobland Waring office. Gentlemen, The plan and design that I am sumitting to the city of Palm Desert, along with my application for a permit to construct a Tri-Plex on Driftwood St., I feel is a very unique m d practical one. Hince one of the units of this Tri-Flex will be my full time home, and because I have always had great pride in my home,, I have spent a great deal of time making a survey as to what has been constructed on this particular street, and the streets adjacent and how well they blend in. Although this particular block is zoned for multiple units, further down the street in the next block it is zoned for single family dwelb.ngso I wanted my home and units to affect a home type feeling with the utmost in privacy for all concerned, and at the same time blend in with the existing multiple units. Due to the fact that the zoneing is R-3, which entitles me to build three units, the required parking is two spots for each unit. In working with my designer and doing several plans, we came to the conclusion that we could not get six parking spaces other than the way that we finally seattled on without giving up the swimning pool. Since the lots in that particular area are 85xl05 and taking into consideration the set-backs, that only leaves a building site of 65x75 for actual structures and parking. I did not feel that I wanted a home without the swimning pool due to the extreeme hot weather in the summer. We spent many hours trying to come up with a plan that was attractive and at the same time meet the requirements.
