This agreement,made as of this---day of---,1986 between the City of
Palm Desert, a California municipal corporation(hereinafter"CITY")
and L&T Development Co.,(hereinafter"DEVELOPER")provides: EXHIBIT"2"
Recitals AFFORDABLE HOUSING INCOME AND RENT SCHEDULE—1988
1.DEVELOPER Is owner of certain real property located within the City Income Rent
of Palm Desert,California,which property is described in Exhibit 1,at. Lower—$15,000 Lower-T$375
tached hereto and made a part hereof (hereinafter "PROPERTY").
DEVELOPER has applied for and been granted approval of a precise
plan/conditional use permit(PPICUP 86.12)to construct 20 conven-
tional senior housing units on the PROPERTY.
2.As a condition of said approval,CITY and DEVELOPER have agreed
that 20%of units associated with the project be set aside for lower in-
come occupants subject to restrictions necessary to Insure the con-
tinued occupancy of said units by lower Income senior citizen
households. These units shag hereafter be referred to as "AFFOR.
DABLE SENIOR UNITS."
3.DEVELOPER and CITY desire to futher memorialize and Implement
the conditions of acid approval and do hereby agree to the following
terms and conditions. -
4.As used herein,the fallowing terms shall be defined as: -
A. SENIOR CITIZEN HOUSEHOLD — Maximum two person
household of which one member Is 62 years of age or older.
B.CONVENTIONAL SENIOR HOUSING—Rental or ownership units
designed and restricted to healthy ambulatory senior citizens who re-
main capable of performing most activities associated with indepen-
dent daily life.Other than having smaller units and possessing design
features and recreational amenities more compatible with a less active
lifestyle conventional senior housing resembles standard housing.
C. LOWER INCOME SENIOR CITIZEN HOUSEHOLD — Senior
Citizen Households whose gross income does no exceed 80% of the
median income for a one person household for Riverside County based
upon financial and demographic data received from the United States
Department of Housing and Community Development(HUD)or its suc.
cessor agency.This Information Is Included In Exhibit"2"and shall be
up dated automatically as current data is obtained from HUD.If in the
future,more relevant data is made available specifically applicable to
senior citizens by(HUD)or other officially recognized agencies,such
data shall become the basis of this agreement. ."
Agreement
1.DEVELOPER has been conditionally granted permission by the CITY
to construct 29 rental conventional senior housing units on the PRO-
PERTY by Precise PlanrAndnlonal Use Permit 86-12 Planning Comma.
Sion Resolution NO.--. As a condition of said approval DEVELOPER
hereby agrees to reserve and make affordable four studio units for
lower income senior citizen households.
2.Monthly rents for the AFFORDABLE SENIOR UNITS shall not exceed
30%of the maximum gross monthly income as shown for lower income
households in Exhibit"2."
3.The DEVELOPER or his assigned management agent shall be respon.
sible for determining eligibility of prospective tenants.Prior to opening
the project the DEVELOPER shall submit for approval a plan to the CITY
describing the procedure for determining and enforcing eligibility re-
quirements.This plan Shall Include annual qualification by all eligible
houueholds and a annual audit at the DEVELOPERS'S cost by the CITY
or Its assigned agents determining compliance with all aspects of this
agreement.
4.The DEVELOPER shall not discriminate on the basis of race,creed,
sex or national origin.
5.The provisions of this agreement shall run with,burden and bind the
DEVELOPER and his successors. The provisions hereof shall be en-
forceable by appropriate legal action brought by the CITY.In the event
legal action is brought to enforce any provision hereof,the prevailing
party shall be entitled to reasonable attorney's fees together with other

The following fire Protection requirements are in accordance with the Uniform Fire
Code and Life Safety Code standards.
1 . Install a water system capable of delivering 3�vGPM fire flow from any fire
hydrant for a 3 hour duration in addition to domestic supply. The computation
shall be based—upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement. Fire flow require-
ments will depend on built-in fire protection provisions of buildings .
2. Install Riverside County super fire hydrants so that no point of any building is
more than IVO feet from a fire hydrant measured along approved vehicular travel ways .
a. exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each hydrant.
c. hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three copies of the water system plan to the Fire Marshal for review. Upon
approval , one copy will ,be sent to the Building Department and the original will
be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and approved by
the water company with the following certification: "I certify that the design of the
water system in PP $6- 16 is in accordance with the requirements prescribed by
the tire Marshal ."
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
6. Additional fire protection requirements may be necessary when the applicant submits
specific plans for consideration and approval .
7. All buildings over 5000 square feet require an approved fire sprinkler system.

Mr . Drell explained that this was a Palma Village revitalization
project and recommended approval .
Commissioner Wood asked about the land next to the proposed project.
Mr. Drell replied that it was duplex, and noted that it was for sale.
Chairman Crites opened the public_ testimony and asked if anyone
wished to speak regarding this project. There being no one, the
public testimony was closed.
Commissioner Wood noted for the record that the owner of the duplex
was notified of the public hearing but did not attend to present
testimony.

Moved by Commissioner Downs, seconded by Commissioner Wood, adopting
the findings as presented by staff. Carried 3-0.

Mr. Drell explained that the request was for a cabinet/woodworking
shop.
Chairman Crites opened the public testimony and asked if the
applicant wished to address the commission.
MR. CRAIG RICHARDSON questioned the requirement for installation
of four feet of sidewalk along St. Charles Place, which would
eliminate a good portion of the existing landscaping.
Mr. Gaugush explained that the condition was placed on all projects
on exterior streets based on direction from the city council .

Staff noted that on the site plan the installation of sidewalk would
not interfere with the present landscaping, but recommended the
applicant to verify the property line.

VII1 . MISCELLANEOUS
A. Request of Coachella Valley Television concerning zoning on
property at 74-555 Country Club Drive.
Mr. Diaz outlined the request and indicated that the city did
not have a record of the land being a separate parcel .
Ms. Louise Miller of Coachella Valley Television explained that
they would like to have a variance because they have a buyer.
Mr. Diaz explained that a use variance could not be granted
because of state law, and didn't believe that it could be
parceled off.
Ms . Miller indicated that she would look further into the
matter.
B. Clarification from city attorney regarding schools of massage.
Mr. Diaz explained that a letter of clarification had been
received from the city attorney' s office and that anyone
wishing to operate a school of massage would have to meet the
requirements of the ordinance.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND
PRECISE PLAN OF DESIGN AND FOR A 11 ,984 SQUARE
FOOT INDUSTRIAL BUILDING LOCATED ON .58 ACRES IN
THE PALM DESERT BUSINESS CENTER.
CASE NO. PP 86-16
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 15th day of April , 1986 hold a duly notice public hearing to
consider the request by RICHARDSON 8 SONS PROPERTIES for approval of a negative
declaration of environmental impact and precise plan for a 11 ,984 square foot
industrial building located within the Palm Desert Business Center.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89" in that the director of community development has
determined that the project will not have an adverse impact on the environment
and a negative declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, of all interested person desiring to be heard, said
commission did find the following facts and reasons to exist to justify their
actions.
1 . The design of the precise plan complies with all requirements of the
service industrial zone and will not depreciate property values in
the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity and will not endanger the
public peace health, safety or general welfare. All adjacent uses
and development are similar to the proposed project.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1 . That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That a negative declaration of environmental impact is hereby
approved.
3. Precise Plan 86-16 on file in the department of community development
is hereby approved subject to the attached conditions.

CONDITIONS OF APPROVAL
CASE NO. PP 86-16
Department of Community Development:
1 . The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless a time extension is granted, other-
wise said approval shall become null , void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use contem-
plated by this approval , the applicant shall first obtain permits and/or
clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Riverside County Department of Health
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Trash provisions shall be approved by applicable trash company and city
prior to issuance of building permit.
6. Applicant shall pay $384 fringe-toed lizard mitigation fee prior to
issuance of a grading permit.
7. Applicant agrees to a reasonable assessment for bridges on Cook Street at
Whitewater Channel and Interstate 10.
8. Retail and office uses shall be limited to those areas shown on the
precise plan floor plan.

Department of Public Works:
1 . Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.
2. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
3. Complete improvement plans and specifications shall be submitted, as
required by ordinance to the city engineer for checking and approval
before construction of any improvements is commenced. The engineer shall
submit "as-built" plans prior to acceptance of the improvements by the
city.
4. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
5. Landscaping maintenance on St. Charles Place shall be provided by the
property owner.
6. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the city engineer for checking and approval prior to
issuance of any permits.
7. Installation of four foot sidewalk on St. Charles Place or as determined
by the director of public works.
8. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
grading permit issuance.
9. Size, number and location of driveways to public works specifications
with only one driveway approach to be allowed to serve this property.
10. Applicant shall provide 1200 cubic feet of on-site storm water retention
area as per the approved grading plan for Tract 13915.
11 . Applicant shall' secure reciprocal ingress and egress easements from lots
16 and 18 prior to final occupancy.
City Fire Marshal :
1 . Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a 3 hour duration in .addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating

pressure in the supply main from which the flow is measured at the time of
measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 200 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome
Yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 in either direction from each hydrant.
C. hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building permit, the developer shall furnish the
original and three copies of the water system plan to the fire marshal for
review. Upon approval , one copy will be sent to the building department
and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company with the following certification: "I certify
that the design of the water system in PP 86-16 is in accordance with the
requirements prescribed by the fire marshal".
5. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval .
7. All buildings over 5,000 square feet require an approved fire sprinkler
system.

I.. BACKGROUND:
The project is located within the heart of the Palm Desert Business
Center. All surrounding properties are industrial . The building will be
a combination of 16' one story and 24' two story elevations. The building
owner and main tenant operate a custom cabinetry business. The building
complies with required parking (24 required, 25 provided) setbacks and
landscaping.
II. FINDINGS:
1. The design of the precise plan complies with all requirements of the
service industrial zone and will not depreciate property values in
the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity and will not endanger the
public peace health, safety or general welfare. All adjacent uses
and development are similar to the proposed project.
III. RECOMMENDATION:
Approve findings, negative declaration of environmental impact and
Precise Plan 86-16 subject to conditions.

1. Aoolicant's Environmental Information Form
The Environmental Information form must be submitted with the filing o
application, so that an environmental determination can be made. Shou

2. Filing Fee
Resolution 79-7 of the City of Palm Desert Municipal Code requires a filin
dependent upon the type of development.
3. Application
The attached application must be completed as indicated on the form
authorization of legal owner to process the Precise Plan. (Notarization)
4. Supporting Statements

5. Legal Description
Application will not be considered complete until legal description is approv

6. 300-Foot Radius Map
The 300-foot radius map must be prepared to the attached specifications
folded to 8S4" x 13" maximum size.
7. Property Owner's List
The property owner's list must be typed in duplicate on gummed labels available in
the Department of Environmental Services. This list must have the names and
mailing addresses of all property owners within or partially within the 300-foot
radius map. It must be prepared from the latest equalized assessment rolls of the
Riverside County Assessor. All names must be numbered to correspond wit'
numbers on the required radius map. The 3rd list does not have to be on gur
labels.
8. Precise Plan
Precise Plan drawings must be prepared to the following specifications and f
to maximum 8S4" x 13" size.
I. Format
A. Title as follows: Name, address, and phone number of applicant.
