A frontage fee of $15. 00 per foot will be imposed along the Alley. 2. The District will install a 12-inch water meter and service at a cost of $1 ,350 each. 3 . The water service installation charges will be as follows : a. One lk-inch water meter and service $1 , 350 at $1 ,350 each b. Frontage fee for 120 feet at $15.00/foot 1 , 800 TOTAL $3, 150 4 . All meter installation charges and frontage fees must be paid before installation work will begin. t t 5. CASE NO: PP 86-17 WHEREAS, the Planning Commission of the City of Palm Desert, California. did on the 6th day of May, 1986 hold a duly noticed public hearing to consider a request by LAWRENCE AND CAMILLE TODD for approval of a negative declaration of environmental impact and precise plan of design to allow construction of a 6794 (gross) , 5775 square foot (net) commercial building within the general commercial zone located on the north Highway Ill Frontage Road between Las Palmas Avenue and San Clemente Avenue. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community development has determined that the project will have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to exist to justify their actions: 1. The precise plan is consistent with the intent and purpose of the general commercial zoned and the Palm Desert General Plan. 2. . The project's design will not depreciate or unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The project will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert. California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case. 2. A negative declaration of environmental impact is hereby approved. 3. Precise Plan 86-17 on file in the department of community development is hereby approved subject to the attached conditions. PLANNING COMMISSION RESOLUTION NO. 1146 CONDITIONS OF APPROVAL CASE NO. PP 86-17 Depa nt of Co m unity Development I . The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. The development of the property described herein shall be, subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contem- plated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 6. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 7. Applicant shall record an agreement guaranteeing that the property will voluntarily be part of a future parking assessment district established to serve the area. Department of Puplic Works: I . Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 3 PLANNING COMMISSION RESOLUTION NO. 1146 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final . S. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 6. All private driveways, parking lots and the alley shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 7. Landscaping maintenance in the alley and on Palm Desert Drive North, shall be provided by the property owner. 8. Existing utilities in the alley and on Palm Desert Drive North shall be undergrounded per each respective utility district's recommendation. 9. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to Issuance of any permits. 10. Installation of curb, concrete valley gutter and matching paving in the alley and eight foot sidewalk on Palm Desert Drive North. 11 . Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 12. Installation of sewers to serve this project. 13. Size, number and location of driveways to public works specifications with only one driveway approach to be allowed to serve this property. 14. Any permit issuance shall be subject to the waiver, of parcel map .first being approved and recorded. 4 PLANNING COMMISSION RESOLUTION NO. 1146 15. Applicant shall submit complete improvement plans for one-half of the alley right-of-way. Plans shall be checked and approved prior to issuance of the grading permit. 16. Parking shall not be permitted within the alley. City Fire Marshal • I . Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marsha I for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 86-17 is in accordance with the requirements prescribed by the fire marshal ". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. Chairman Crites felt that if the five percent (57.) was not a large issue, the building could be reduced by five percent. Commissioner Downs noted that there has always been more than one ingress and egress and expressed concern for fire hazards. Commissioner Erwood agreed with Commissioner Downs. Action: Moved by Commissioner Downs , seconded by Commissioner Richards, adopting the findings for the precise plan as presented by staff. j Carried 4-0. Case No. PP�- LARRY AND CAMILLE TODD, Applicants I I Request for approval of a negative declaration of environmental impact and precise plan for a 6794 square foot (gross) , 5775 square foot (net) commercial building on .38 acres within the C-1 , General Commercial zone located on the north Highway III frontage road between Las Palmas Avenue and San Clemente Avenue. Mr. Drell outlined the salient points of the staff report and recommended approval . Chairman Crites opened the public testimony and asked the applicant to address the commission. 6 MINUTES PALM DESERT PLANNING COMMISSION MAY 6, 1986 MR. BERNARD LEUNG, architect, stated that there were no problems meeting the parking requirement and felt that the building was nice looking and would upgrade the property. Mr. Leung stated that he would prefer having a third compact parking space than one foot of landscaping. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, adopting the findings as presented by staff. Carried 4-0. Case No. ZOA 86-4 - CITY OF PALM DESERT, Applicant Request for approval of an amendment to section 25.28.030 (General Commercial District) of the code of the city of Palm Desert relating to convenience stores and liquor selling establishments. Mr. Diaz outlined the salient points of the amendment. After discussion, Mr. Erwin noted that evaluation would be on a case by case basis, and only after a factual determination that a nuisance exists. Chairman Crites asked if all uses in the zone would be effected, such as mortuaries. Mr. Erwin concurred. Commissioner Richards felt that this was doing something after the fact and noted that the city can already regulate hours of operation. Mr. Erwin explained that the amendment would allow the commission and council a course of action if a business changes or becomes in any way offensive to the public and gives some authority not to eliminate the use. Commissioner Richards asked if actual data would be obtained before the recommendation. Mr. Erwin concurred. Commissioner Erwood expressed disagreement with the amendment on the grounds that it was intrusive. DISCUSSION: The project will provide much needed new construction on north Highway 111 . It complies with all C-1 ordinance standards with one exception. Applicant is proposing that three of the 23 required parking spaces be compact. The ordinance specifies that only 109 or two spaces be compact. PP 86-17 These spaces have been situated so that they are 1 i ke 1 y to be the last , occupied. Staff does not consider this to be a severe problem due to the potential for future development of a large common use parking facility as recommended by the Palm Village Specific Plan. As a condition of approval applicant would be required to agree to participate in a future parking assessment district servicing the area. III. FINDINGS: 1 . The precise plan is consistent with the intent and purpose of the general commercial zoned and the Palm Desert General Plan. 2. The project's design will not depreciate or unreasonably interfere with the use or enjoyment of property in the vicinity. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP96-17 is in accordance with the requirements prescribed by the Fire Marshal . " 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed., operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7.
