PP 86-20 and A�3J- ROB COTY, Applicant Request for a five unit apartment project located at the northeast corner of San Pascual and Santa Rosa. Mr. Drell outlined the salient points of the staff report explaining that the main Issues were parking and the east property line. The applicant Is proposing to reduce the side yard setback from 10 feet to five feet on the east property line. The building has been oriented east-west which provides less building on the elevation facing the adjacent property. The parking that was to back onto the street has been deleted. He noted that an additional five foot dedication was required and that this plan provided more architectural advantages and recommended approval . Vice Chairman Erwood opened the public testimony and asked the applicant to address the commission. MR. ROB COTY, 41-557 Armanac Court, Palm Desert, concurred with the staff report and conditions. Commissioner Richards asked the applicant if he had contacted the owner of the adjacent property. Mr. Coty replied that the owner of the adjacent apartments resided out of town and only had a post office box number. Commissioner Richards asked If he had been notified. Mr. Drell replied that he had. Vice Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. . There being no one, Vice Chairman Erwood closed the public testimony. 2 I MINUTES PALM DESERT PLANNING COMMISSION JUNE 17, 1986 i Commissioner Richards expressed concern that the adjacent property owner was not present. Mr. Diaz stated that he had been notified. r Mr. Drell informed commission that the adjacent neighbor built in an R-2 zone with a five foot setback, which would be the same as was proposed for this project. Action: Moved by Commissioner Wood, seconded by Commissioner Downs adopting the findings as presented by staff. Case No. VAR 86-2 =' HASSAN ZAREMEJAD, Applicant Request for approval of a side yard setback variance from 30 feet combined to 20 feet for a new house proposed on the east side of Verba Santa, 420 feet north of Ironwood Street. Mr. Joy out iIned the salient points of the staff report, noting that the zoning and setbacks were set prior to city standards. He explained that the applicant was requesting a reduction of the eq 9 side yard setbacks, but informed commission that 20 feet is standard. -He indicated that Mr.' Frank UrrutIa and 'the property owners across the street expressed opposition. Mr. Joy informed ' commission that It was approved by the property owners association and recommended approval . Commissioner Wood asked why staff was over ruling the objections for the setbacks, Mr. Joy replied that a 10,000 square foot lot requires a 20 foot combined setback. Mr. Diaz asked •if Mr. Urruita's property meets the current setback requirements. Mr. Joy replied that he has 23 feet combined which is less than the code requirement of 30 feet. Vice Chairman Erwood opened the public testimony. MR. HASSAN 'ZARENEJAD, owner, stated that the staff report = covered the issues. He indicated that the setback of 30 feet was established for R-3 zoned property. - He explained that a number of these lots have been divided in half, with an 80 foot lot having a 30 foot setback would be difficult. CASE NO: PP 86-20 8 VAR 86-3 WHEREAS, the Planning Commission of the City of Palm Desert, California. did on the 17th day of June. 1986 hold a duly noticed public hearing to consider a request by ROB COTY for approval of a five unit apartment project located on a 13,000 square foot lot within the R-3 S.O. zone at the northeast corner of Santa Rosa Way and San Pascual Avenue. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community develop- ment has determined that the project is a class 3 categorical exemption. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to exist to justify their actions. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The proposed use is of higher design quality and of similar intensity and type as surrounding uses and therefore will not depreciate property values in the vicinity. 2. The proposed project will not endanger the public health, safety or general welfare. 3. The proposed project will not interfere with the use or enjoyment of property in the vicinity by occupants thereof for lawful purposes. 4. The project is consistent with the zoning ordinance (except for approved variance) the general plan and specifically implements the neighborhood improvement goals of the Palm Village Specific Plan. FINDINGS FOR APPROVAL OF VARIANCE: 1 . The strict enforcement of the ten foot side yard requirement would significantly restrict the livability of the proposed units or result in an alternative design which would be more detrimental to the adjacent property owner. 2. The additional five foot right of way dedication required of this property further restricts site planning alternatives relative to other properties in the vicinity. PLANNING COMMISSION RESOLUTION NO. 1150 3. The strict interpretation of the ordinance in this case would severely restrict the property owners ability to develop the five units allowed by the zone and meet the other goals and objectives of the ordinance. 4. The site plan permitted by the variance allows development of a higher quality project with a net benefit to the public health, safety. and general welfare. NOW. THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case. 2. Precise Plan 86-20 and VAR 86-3 are hereby approved subject to attached conditions. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contem- plated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 6. Projects shall pay school impact mitigation fees of $628 per unit or as arranged with the Desert Sands Unified School District. Department of Public Works: 1 . Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drai.n construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3 PLANNING COMMISSION RESOLUTION NO. 1150 3. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted. as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on San Pascual and Santa Rosa shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Dedication of five feet of right-of-way on Santa Rosa and San Pascual shall be done prior to issuance of any permits and approval of plans. 9. Installation of curb, gutter and matching paving and sidewalk on Santa Rosa and sidewalk on San Pascual . 10. Close unused driveway on San Pascual with full height curb and gutter. 11 . Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 12. ANALYSIS: The project consists of a two story flat roofed southwestern pueblo style building containing five apartments. Parking is located off of San Pascual on the north side of the lot. The current proposal represents a substantial revision of the plan originally presented to the architectural commission. Although the PP 86-20 9 VAR 86-3 original plan was in technical compliance with the zoning ordinance, the architectural commission identified several design problems which necessitated revision of the site plan as well as architecture. The lot, after five foot right of way dedications on both San Pablo and Santa Rosa measures 79.25' (Santa Rosa frontage) X 149' (San Pascual frontage) . In the original design the building's length ran north-south consistent with the length of the lot. This orientation resulted in three problems. 1 . The front of the building facing west, could not be protected from the intense afternoon summer sun. Normally the pueblo style works best with a south exposure where the large overhangs can shade the building and glass during most summer hours. 2. The rear parking area width was restricted forcing three open spaces to be located in the front setback backing out onto Santa Rosa. 3. The property to the east was exposed to the maximum length of two story elevation. The architectural commission recommended that the building be rotated 90% to face south solving the solar exposure problem, providing room in the parking lot for an additional three spaces and reducing the length of the two story elevation facing the adjacent property from 75 feet to 42 feet. The revision was facilitated by reducing the total building length to 64 feet narrowing each unit to 20 feet in width. Unfortunately the new plan requires the granting of a side yard variance reducing the eastern building setback from 10 feet to 5 feet. The situation is further complicated by the additional five foot right of way dedication. The architectural commission felt that the significant overall improvement of the project justified the variance. The benefits to the adjacent property owner of the substantially shorter two story exposure far outweigh the possible sight line benefits of the additional five foot setback. Heavy landscaping will be required to further soften the impact. D. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The proposed use is of higher design quality and of similar intensity and type as surrounding uses and therefore will not depreciate property values in the vicinity. 2 PP 86-20 8 VAR 86-3 2. ANALYSIS: The project consists of a two story flat roofed southwestern pueblo style building containing five apartments. Parking is located off of San Pascual on the north side of the lot. The current proposal represents a substantial revision of the plan originally presented to the architectural commission. Although the 1 { PP 86-20 E VAR 86-3 original plan was in technical compliance with the zoning ordinance, the architectural commission identified several design problems which necessitated revision of the site plan as well as architecture. The lot, after five foot right of way dedications on both San Pablo and Santa Rosa measures 79.25' (Santa Rosa frontage) X 149' (San Pascual frontage) . In the original design the building's length ran north-south consistent with the length of the lot. This orientation resulted in three problems. 1 . The front of the building facing west, could not be protected from the intense afternoon summer sun. Normally the pueblo style works best with a south exposure where the large overhangs can shade the building and glass during most summer hours. 2. The rear parking area width was restricted forcing three open spaces to be located in the front setback backing out onto Santa Rosa. 3. The property to the east was exposed to the maximum length of two story elevation. The architectural commission recommended that the building be rotated 90% to face south solving the solar exposure problem, providing room in the parking lot for an additional three spaces and reducing the length of the two story elevation facing the adjacent property from 75 feet to 42 feet. The revision was facilitated by reducing the total building length to 64 feet narrowing each unit to 20 feet in width. Unfortunately the new plan requires the granting of a side yard variance reducing the eastern building setback from 10 feet to 5 feet. The situation is further complicated by the additional five foot right of way dedication. The architectural commission felt that the significant overall improvement of the project justified the variance. The benefits to the adjacent property owner of the substantially shorter two story exposure far outweigh the possible sight line benefits of the additional five foot setback. Heavy landscaping will be required to further soften the impact. D. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The proposed use is of higher design quality and of similar Intensity and type as surrounding uses and therefore will not depreciate property values in the vicinity. 2 J PP 86-20 d VAR 86-3 2. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP is in accordance with the requirements prescribed by the Fire Marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7.
