DISCUSSION: On June 17th the planning commission approved a precise plan and conditional use permit for a six unit, age 62 minimum. senior apartment project with the following condition. 8. Project shall pay school fees of $628 per unit or as arranged with the Desert Sands Unified School District. All recent correspondence with the school district continues to indicate that they want fees for all residential projects including those limited to seniors. Mr. Schmitz argues that since condition no. 6 limits occupants to age 62 and over, the project could not impact the public schools. Prepared by Reviewed and Approve by , 1� RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA. DENYING AN APPEAL AND AFFIRMING CONDITION NO. 8 OF PLANNING COMMISSION RESOLUTION NO. 1153 RELATING TO SCHOOL IMPACT FEES. CASE NO: PP/CUP 86-27 WHEREAS, the City Council of the City of Palm Desert, California, did on the 14th day of August, 1986 hold a duly noticed public hearing to consider an appeal by HARRY SCHMITZ of planning commission condition no. 8, resolution no. 1153 requiring payment of school impact fees for a six unit senior apartment project. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said city council did find the following facts to exist to justify their actions. 1 . Condition No. 8 requiring school impact fees for all residential projects regardless of age restrictions is consistent with city policy and analysis of potential impacts conducted by the Desert Sands Unified School District. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: I . That the above recitations are true and correct and constitute the findings of the council in this case. 2. That the appeal of condition no. 8, Planning Commission Resolution No. 1153 is denied. Case No. PP 86-24 - ROSENBLUM E PECK, Applicants Request for approval of a negative declaration of environmental impact and a precise plan for an eight unit apartment project within the R-3 zone located on the north side of San Gorgon i o Way between Las Flores Avenue and Las Palmas Avenue. Mr. Drell outlined the salient points of the staff report and recommended approval . Vice Chairman Erwood opened the public testimony and asked the applicant to address the commission. MR. WENDEL VEITH, architect, concurred with staff's findings. Vice Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Action: Moved by Commissioner Wood, seconded by Commissioner Downs adopting the findings as presented by staff. Carried 4-0 Moved by Commissioner Wood, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1152. approving PP 86-24, subject to conditions. Carried 4-0 F. Case No. PP/CUP 86-27 - HARRY SCHNITZ. Applicant Request for approval of a precise plan/conditional use permit for a six unit senior citizen apartment project located within the R-3 Senior Overlay zone on the east side of San Rafael , 300 feet north of San Gorgonio Way. Mr. Drell gave an outline of the proposed project and indicated that the mein concern was with the parking area. He explained that the architectural commission supported the use of shade trees rather than any type of carport or garage for the shading of the parking spaces. He noted that there was adequate space for three carports to be added. 8 - _J MINUTES PALM DESERT PLANNING COMMISSION JUNE 17, 1986 Commissioner Downs noted that he had looked at this site and found that the closest sewer hook up was approximately 350 feet away and up hill from the site. Vice Chairman Erwood opened the public testimony and asked the applicant to address the commission. MR. HARRY SCHMITZ, applicant. explained that the previous property owner was allowed to go with septic tanks which the water district approved at that time. He requested the use of septic tanks for his project. He indicated that the architec- tural commission felt that trees would provide adequate protection for the parking spaces. He stated that the neighbors around the site felt that project would enhance the area. He asked if garages would be acceptable which would require a variance. Mr. Schmitz questioned the need to pay school impact fees since this was a senior project. Vice Chairman Erwood asked if any one wished to speak In FAVOR or OPPOSITION to the proposed project. I VALERIE HALL, apartment manager, explained that she managed the apartment across the street from the proposed project .and she felt that the project would be an asset to the neighborhood. Vice Chairman declared the public testimony closed. Commissioner Richards questioned if there would be any future extension of the sewers in this area. He felt that garages would be acceptable. Mr. Holtz indicated that there had been some discussion about creating an assessment district to install sewer system and curb and gutter together in that area. Commissioner Richards felt that the applicant should be bound to join any future assessment district in that area. He stated that he did not feel trees would be acceptable for the purpose of shading the parking area and noted that three carports is reasonable. Commissioner Downs noted that a variance would not be required for the three carports.. Mr. Drell explained that the school district has determined that all developments must pay the school fee therefore, the city includes this condition unless some other agreement is worked out between the applicant and the school district. 9 MINUTES PALM DESERT PLANNING COMMISSION JUNE 17, 1986 Action: Moved by Commissioner Richards, seconded by Commissioner Downs adopting the findings as presented by staff. Senior Housing C. PROJECT DATA: Pro.iect Ordinance Requirement Lot 11 ,000 sq. ft. Number of Units 6 studios 6 maximum Unit Size 600 sq. ft. 450 sq. ft. ANALYSIS: The project complies with all basic standards of the R-3 and 5.0. zones. The S.O. zone allows a land intensity of 7.56 persons on the I1 ,000 square foot site. Using the 1 .25 per studio unit standard, the site yields six units. PP/CUP 86-27 The project was reviewed by the architectural commission on May 27 where the preliminary approval was granted. The main Issue of discussion involved design of the parking lot. The senior overlay does not specify how much of parking should be covered. The applicant is not proposing any carports or garages and will be relying on 48" box specimen shade trees to cover the parking area. There is sufficient room within the front setback for three carports. Additional carports would require a front setback variance. The architectural commission determined that the shade trees could adequately cover the lot if the number and size of the trees were increased. From a design perspective, the commission preferred the trees over carports In this case. Other than the age 62 limitation, there will be no rental control on these units. The senior overlay rent limits only apply to projects ten units or larger. The age 62 minimum will simply be a condition of the precise plan and must be recorded as a deed restriction. Since no development agreement is required final approval rest with the planning commission. III. FINDINGS: 1 . The proposed use and design of the project is of similar intensity and type as surrounding uses and will not depreciate values in the vicinity. 2. The proposed project will not interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The project wi l 1 not endanger the public health, safety or general welfare. 4. The project is consistent with the zoning ordinance, general plan and specifically implements senior housing goals contained within the housing element. IV. CASE NO: PP/CUP 86-27 WHEREAS; the Planning Commission of the City of Palm Desert, California, did on the 17th day of June. 1986 hold a duly noticed public hearing to consider a request by HARRY SCHMITZ for approval of a precise plan and conditional use permit to allow construction of a six unit conventional senior citizen apartment project on the east side of San Rafael Avenue, 300 feet north of San Gorgonio Way. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community develop- ment has determined that the project is a class 3 categorical exemption. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to exist to justify their actions. 1 . The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contem- plated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 6. A deed restriction shall be added to the property limiting occupants to a minimum age of 62 years. The city shall have the ability to audit the property owner's rental records at any time to insure compliance. 7. Applicant shall provide a minimum of three covered parking spaces. B. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Improvement plans for water systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final . 5. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the ' improvements by the city. 6. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 7. 1 Landscaping maintenance on San Rafael Avenue shall be provided by the property owner. 8. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 9. Dedication of five feet of right-of-way on San Rafael Avenue shall be done prior to issuance of any permits and approval of plans. 10. Installation of six foot sidewalk on San Rafael Avenue. 11 . Applicant shall agree to participate in any future assessment districts for the use of sewers. City Fire Marshal : 1 . Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. . 2. Applicant Request for approval of a precise Plan/conditional use permit for a six unit senior citizen apartment project located within . - the R-3 Senior Overlay zone on the east side of . San Rafael , 300 feet north of San Gorgonio Way. I I Mr. Drell gave an outline of the proposed project and indicated that the main concern was with the parking area. He explained that the architectural commission supported the use of shade trees rather than any type of carport or garage for the shading of the parking spaces. He noted that there was adequate space for three carports to be added. i 8 i i i I , MINUTES PALM DESERT PLANNING COMMISSION JUNE 17, 1986 Commissioner Downs noted that he had looked at this site and found that the closest sewer hook up was approximately 350 feet away and up hill from the site. Vice Chairman Erwood opened the public testimony and asked the applicant to address the commission. MR. HARRY SCHMITZ, applicant, explained that the previous property owner was a 1 1 owed to go with septic tanks which the water district approved at that time. He requested the use of septic tanks for his project. He indicated that the architec- tural commission felt that trees would provide adequate protection for the parking spaces. He stated that the neighbors around the site felt that project would enhance the area. He asked if garages would be acceptable which would require a variance. Mr. Schmitz questioned the need to pay school impact fees since this was a senior project. Vice Chairman Erwood asked if any one wished to speak in FAVOR or OPPOSITION to the proposed project. VALERIE HALL, apartment manager, explained that she managed the apartment across the street from the proposed project and she felt that the project would be an asset to the neighborhood. Vice Chairman declared the public testimony closed. Commissioner Richards questioned if there would be any future extension of the sewers in this area. He felt that 'garages would be acceptable. Mr. Holtz indicated that there had been some discussion about creating an assessment district to install sewer system and curb and gutter together in that area. Commissioner Richards felt that the- applicant should be bound to join any future assessment district in that area. He stated that he did not feel trees would be acceptable for the purpose of shading the parking area and noted that three carports is reasonable. Commissioner Downs noted that a variance would not be required for the three carports. ANALYSIS: The project complies with all basic standards of the R-3 and S.O. zones. The 5.0. zone allows a land intensity of 7.56 persons on the 11 ,000 square foot site. Using the 1 .25 per studio unit standard, the site yields six units. PP/CUP 86-27 The project was reviewed by the architectural commission on May 27 where the preliminary approval was granted. The main issue of discussion involved design of the parking lot. The senior overlay does not specify how much of parking should be covered. The applicant is not proposing any carports or garages and will be relying on 48" box specimen shade trees to cover the parking area. There is sufficient room within the front setback for three carports. Additional carports would require a front setback variance. The architectural commission determined that the shade trees could adequately cover the lot if the number and size of the trees were increased. From a design perspective, the commission preferred the trees over carports in this case. Other than the age 62 limitation, there will be no rental control on these units. The senior overlay rent limits only apply to projects ten units or larger. The age 62 minimum wi 1 I simply be a condition of the precise plan and must be recorded as a deed restriction. Since no development agreement is required final approval rest with the planning commission. III. FINDINGS: 1. The proposed use and design of the project Is of similar intensity and type as surrounding uses and will not depreciate values in the vicinity. 2. The proposed project will not interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The project will not endanger the public health, safety or general welfare. 4. The project is consistent with the zoning ordinance, general plan and specifically implements senior housing goals contained within the housing element. IV. RECOMMENDATION: Approve findings and adopt Planning Commission Resolution No. _ approving PP/CUP 86-27 subject to conditions. ZONE: R-3 Mr. Drell explained that there was some concern with the parking spaces backing onto the street. He also felt that some restudy of the east elevation should be done and that the landscape plan was conceptual . Commissioner Martin felt that the project had some good points but thought that the site plan and parking problem needed some restudy. He recommended that the balconies be solid. Commissioner Cook was concerned with a two story building having only a five foot setback from property line. He suggested that the building be situated with a north-south exposure and that the building provide an additional ten feet in the rear parking area. Mr. Drell explained that the will need some covered parking and also a six foot setback. Commissioner Holden suggested that a large tree be placed by each parking stall to provide shading. Chairman Gregory recommended that they building be pushed back about one foot to give room for wells for an evergreen type tree to be a 48" box minimum. Moved by Commissioner Holden, seconded by Commissioner Martin to approve this case subject to the parking spaces being effectively shaded. Carried 4-0-1 (Commissioner Cook abstaining) . IV. DISCUSSION ITEMS: 1. ROBINSON'S - TOWN CENTER Mr. Diaz presented a new plan for the Robinson's store and asked for - comments from the commission. Commissioner Martin indicated that he liked the new plan. He suggested that some type of shade structure be provided in the front of the store for customers. Moved by Commissioner Martin, seconded by Commissioner McCrea to approve the new plan. Carried 5-0 V. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contem- plated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 6. A deed restriction shall be added to the property limiting occupants to a minimum age of 62 years. The city shall have the ability to audit the property owner's rental records at any time to insure compliance. 7. Applicant shall provide a minimum of three covered parking spaces. 8. Project shall pay school fees of $628 per unit or as arranged with the Desert Sands Unified School District. 3 PLANNING COMMISSION RESOLUTION NO. 1153 Department of Public Works: 1 . Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Improvement plans for water systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final . 5. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. Landscaping maintenance on San Rafael Avenue shall be provided by the property owner. 8. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 9. Dedication of five feet of right-of-way on San Rafael Avenue shall be done prior to issuance of any permits and approval of plans. 10. Installation of six foot sidewalk on San Rafael Avenue. 11 . Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 12. Installation of septic tanks and pits as approved by the department of building and safety. 13. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. 4 PLANNING COMMISSION RESOLUTION NO. 1153 14. Applicant shall agree to participate in any future assessment districts for the use of sewers. City Fire Marshal : I . Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 86-27 is in accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6.
