CASE NOS. PP 86-29, PMW 86-11 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of July, 1986, hold a duly noticed public hearing to consider the request of FRANK GOODMAN for above mentioned request; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have a significant adverse impact on the environmental and a negative declaration is hereby certified; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said precise plan and parcel map waiver: 1 . The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall continence within one year from the date of final approval unless an extension of time Is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department City Fire Marshal Palm Desert Water & Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Applicant shall install a landscaping strip between the parking area and property line, as well as provide large canopy shade trees in the parking lot area. Department of Public Works: 1. Drainage and stgnalization fund fees, as required by city ordinance, shall be paid prior to grading permit Issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3 PLANNING COMMISSION RESOLUTION NO. 1159 3. Full public Improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete Improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on San Carlos Avenue, Alessandro Drive, and the alley shall be provided by the property owner. 7. Existing utilities in the alley and on the western property line shall be undergrounded per each respective utility district's recommendation. 8. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 9. , Installation of sidewalk on Alessandro Drive and San Carlos Avenue. 10. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. il . Size, number and location of driveways to public works specifications with only one ( 1) driveway approach to be allowed to serve this property. j12. Any permit issuance shall be subject to the waiver of parcel map first being approved and recorded. 13. Applicant shall complete right-of-way vacation of the southwest corner of San Carlos and Alessandro prior to the issuance of- any permits associated with this project. City Fire Marshal : 1. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a . three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow Is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. i 4 i I PLANNING COMMISSION RESOLUTION NO. 1159 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 86-29 is In accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over 5000 square feet require an approved fire sprinkler system. 5 aw MINUTES PALM DESERT PLANNING COMMISSION JULY 1, 1986 Moved by Commissioner Richards, seconded by Commissioner Wood, adopting Planning Commission Resolution No. 1158, approving PP 86-28 and TT 21718, subject to conditions as amended. Carried 5-0. E. Case Nos 268PP 9 and PMW 86-11 - FRANK GOODMAN, Applicant Request for approval of a 7,000 square foot commercial building at the southwest corner of Alessandro and San Carlos. Mr. Diaz outlined the salient points of the staff report and explained that on condition #9 under public works conditions the words "four feet" should be deleted. I Commissioner Downs did not agree that there could be excessive parking that should be replaced with landscaping. Mr. Diaz explained that he did not believe that necessary parking was being deleted. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. RICHARD OLIPHANT, 77-900 Avenue of the States, explained that he was representing Mr. Goodman and he felt that the project would be attractive and agreed to the conditions of approval . Commissioner Wood asked for clarification regarding the parking and landscaping. Mr. Oliphant explained that they had extra parking spaces that the ordinance did not require. Chairman Crites stated that he would like to see a large green strip of landscaping provided between the parking area and property line, as well as large canopy shade trees in the parking area. Mr. Oliphant agreed to those items being added as conditions of approval . I Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Action: Moved by Commissioner Downs,. seconded by Commissioner Erwood, adopting the findings as presented by staff. Case No. ZOA 86-4 - CITY OF PALM DESERT, Applicant Request for approval of an amendment requiring a conditional use permit for convenience stores and liquor selling establishments in all zones. Mr. Diaz explained that the ordinance had been revised as commission requested and noted that the condition regarding hours of operation had been deleted. Staff recommended approval . Commissioner Wood noted that he was in favor of anything that would tighten up convenience store operation. Commissioner Erwood asked if this ordinance would apply to existing businesses. Mr. Diaz replied no, only businesses coming in after the ordinance was adopted. Commissioner Downs asked that if a business changed ownership it would then be subject to this ordinance. Mr. Diaz replied no. Mr. Diaz explained that if a nuisance was determined, It would come under a different code section. i Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. BACKGROUND: The site is adjacent to the project currently under construction undertaken by the same applicant and across the street from the Wise Athletic Club and a two-story office building recently construction by Frank Urrutia. If . DISCUSSION- The project is intended to be a replica of the structure the applicant has under construction presently to create a complex. The site was previously approved for a two-story structure with more landscaping surrounding the building so that this application has the same general site plan except that the building footprint is larger while the parking number is the same. The architectural commission reviewed the plan at their meeting June 24 and recommended shifting the building slightly to create more landscaping between the street and structure and eliminating some excess parking with landscaping, partially in response to the concerns raised by Frank Urrutia. Justification: The consolidation into one parcel for this development will comply with all applicable requirements and will allow one integrated development. B. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use can be attractive and will be compatible with other uses existing in the vicinity. 2. The precise plan wi l l not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare.
