Action: Moved by Commissioner Wood, seconded by Commissioner Downs, to direct staff to prepare the appropriate findings for a resolution of approval . Carried 4-1 (Commissioner Erwood was in opposition) . A FIVE MINUTE RECESS WASCALLED AT 8:35 P.M. C. Case No. P 86-35) - FRANZ TIRRE, Applicant Request for approval of a 12,600 sq. ft. office warehouse building on the north side of Lennon Place, 330 feet west of Eclectic. Mr. Joy explained that this project and the adjacent project to the west are providing a joint access to allow adequate circulation. He indicated that the project meets all code requirements and has received prel.iminary approval from the architectural commission. Staff recommended approval . Chairman Crites opened the public hearing and asked the applicant to address the commission. MR. FRANZ. TIRRE, 46-333 Burroweed, noted that the owner of the property was concerned with the condition requiring a reasonable assessment for Cook Street improvements including bridges at Interstate 10 and the Whitewater Channel . He questioned what the owner could expect as a "reasonable assessment" for these improvements. Mr. Diaz explained that there is a study in the process currently, but that at this time the city has no information as to the cost of the improvements. Commissioner Richards indicated that the owners being assessed will be the most served by the improvements. He noted that they attempt to involve the largest group of people affected to participate in the assessment . This includes the major entries and the beneficiaries thereof. 7 I MINUTES PALM DESERT PLANNING COMMISSION AUGUST 5, 1986 Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed project. Hearing no one the public hearing was closed. Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, adopting the findings as presented by staff. Carried 5-0 Moved by Commissioner Downs , seconded by Commissioner Erwood, adopting Planning Commission Resolution No. 1169, approving PP 86-35, subject to conditions. Carried 5-0 It was moved by Commissioner Wood, seconded by Commissioner Downs to suspend the agenda and hear Item E before Item D. Carried 5-0 E. Case Nos. CUP 86-5 and VAR 86-4 - RICHARD 8 MAY LEE, Applicants Request for approval of a conditional use permit and variance to allow the conversion of four existing standard rental units to eight senior citizen rental units under provisions of the Senior Housing Overlay Ordinance. I Mr. Diaz gave the background on this case and recommended denial of the proposed conditional use permit and variance. Chairman Crites- opened the public hearing and asked if the applicant wished to address the commission. MRS. MAY LEE. Pacific Palisades, explained that she had just received the staff recommendation therefore she requested a continuance to review staffs concerns. Commissioner Wood asked if there were any legal problems with continuing this. case. Mr. Erwin replied that the commission should ask if anyone_ wished to speak in regards to the project before continuing the case. Chairman Crites explained that they could continue it or discuss it at this time. MRS. LEE decided to discuss it at this meeting. She explained that the project conforms to the senior overlay code which would allow 12 units and they have only eight. MINUTES ARCHITECTURAL COMMISSION JULY 8, 1986 LOCATION: South side of Country Club 1600 feet east of Monterey. ZONE: Propose PR-5 Senior Housing Overlay Mr. Drell indicated that the project is to be 15 units per acre on a 7-1/2 acre site. He noted that the plans submitted were very preliminary and asked for comments. Chairman Gregory felt that the straight alley way, the roof line and the layout of the site plan were not very appealing. Commissioner Martin thought that there should be additional landscaping around the perimeter of the site. Commissioner Holden was concerned with the lack of solar protection on all elevations and indicated that it should be required. He felt that the project could be further developed showing some variation in the site plan. Chairman Gregory felt that the northern elevation roof line should be further studied. It was moved by Commissioner Martin, seconded by Commissioner McCrea to continue this case with the above discussion to be addressed at next submittal . Carried 4-0 2. CASE NO: 314 C APPLICANT (AND ADDRESS) : FRANZ TIRRE, 74-133 El Paseo, Suite K, Palm Desert, CA 92260. NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of a 12,600 square foot office warehouse. LOCATION: North side of Lennon, 330 feet west of Eclectic. ZONE: 5. 1 . Mr. Joy explained that staff was requiring a joint access easement between this project and the adjacent Bermuda Partners project to eliminate dead-end parking. Commissioner Martin questioned the need for the joint access. Mr. Joy explained that the fire marshal requires a 40' radius turn around on a parking lot over 150 feet deep. Mr. Tirre stated that he did not want the joint access and felt it would present a liability problem and provided no benefits to his project. He indicated that there was adequate space for a fire 5 MINUTES ARCHITECTURAL COMMISSION JULY 8, 1986 truck to turn around on the existing plan. He stated that he could provide a crash gate at the rear of the parking lot it necessary. Commissioner Martin noted that the building is to have a fire sprinkler system which seems to provide some mitigation to the problem. Mr. Diaz explained that staff attempts to eliminate dead-end parking isles whenever possible. Commissioner Martin questioned the amount of back up space allowed at the west elevation parking area. The applicant indicated that there was 26 feet between the buildings. Chairman Gregory was concerned with the trash area butting up to the property line and 'with the three foot wide planter area. He felt that the planter should be increased to five feet. Mr. Joy indicated that the gate could be relocated closer to the rear of the property when the joint access is put in. It was moved by Commissioner Holden, seconded by Chairman Gregory to grant preliminary approval subject to revised landscape plan and joint access easement. I would recommend that this section of the code be deleted as it is nearly impossible to enforce and would have a tremendous negative impact on the economic future of the city. As so directed, staff will begin to process a repair of this section of the ordinance and interpret section 25.34.010 as liberally as possible. RAMON A. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits , and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Applicant agrees to pay a future reasonable assessment for Cook Street improvements including bridges at Interstate 10 and the Whitewater Channel . 6. Payment of lizard mitigation fees in amount of $410.47 required prior to issuance of grading permit. 7. All future occupants of the building shall comply with parking requirements of the ordinance. Fire Marshal : I . Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating 3 PLANNING COMMISSION RESOLUTION NO. 1169 i pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 86-35 is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over 5000 square feet require a fire sprinkler system. 8. Provide emergency vehicle turn-around on driveways over 150 feet or provide joint traffic circulation with project to the west. Department of Public Works: 1 . Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 2. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4 PLANNING COMMISSION RESOLUTION NO. 1169 3. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 4. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 5. Landscaping maintenance on Lennon Place shall be provided by the property owner. 6. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 7. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 6. Size, number and location of driveways to public works specifications with only one ( 1 ) driveway approach to be allowed to serve this property. 9.
