Dear Miss Sass :
The approval for this project expires on September 16 ,
1988 . I would like to extend the approval period for 6
months .
This project was in the State Architect ' s office for
plan check when Palm Desert put our property into a
moratorium . The State Architect placed our plans on hold and
continued to hold the plan check until they were provided
with proof the moratorium was over . The result was a severe
delay in obtaining our State building permit .
The final plan check approval was granted to us on
August 17 , 1988 . The State Inspector ' s office is now
assigning us an on-site full-time inspector . Upon our
hiring this qualified inspector , the State will issue us the
building permit . At the issuance of our permit , we will
record our loan and start construction .
I would anticipate 2 weeks to complete the hiring of the
inspector and 2 weeks to close our loan . Unfortunately , this
will put us just past our approval deadline . I would
appreciate your placing us on the Planning Commission agenda
before September 16 , 1988 , so we may be granted the
extension .

Request for approval of a conditional use permit
to allow a chiropractic clinic to occupy 3,000
square feet within an office complex at 72-880
Fred Waring Drive.
Mr. Diaz explained that medical offices larger than 2,000 square feet
required a different ratio of parking. He noted that Dr. Scans'
office has been in operation. Staff recommended .approval subject to
the condition on the resolution.
Commissioner Ladlow asked for and received clarification regarding
the parking and conditional use. Conni.ssioner Ladlow expressed
concern regarding office buildings being turned into other uses such
as this medical facility. Mr. Diaz indicated that the conditional
use permit offers protection by insuring that uses like the medical
office will have the required parking.
Vice Chairman Richards opened the public testimony and asked if the
applicant wished to address the connission.
DR. SOANS, 72-880 Fred Waring Drive Suite D, stated that he had
submitted all his comments to Mr. Drell of the planning staff

Dear Ray:
Northern Sphere Specific Area Plan is proceeding on schedule and we will
be making recommendations for ending the current moratorium by the end of
December. However, in the intervening time period, the above mentioned
project requires specific consideration concerning the processing of this
application for development approval.
It is our understanding that prior to the completion of our findings in
December, this project must secure a final certificate of need for health
care facilities from the State of California in order to proceed toward
construction. This imposed approval date by the State has been
established as November 1, 1986. Without further processing of this
applicant's plan, as the moratorium requires, this project will be
jeopardized and perhaps, invalidated.
Unlike other projects constrained by the moratorium which have final
approval and can proceed toward construction once the moratorium is lifted
or other applications submitted for development approval which do not lose
vested rights to develop as a result of the moritorium, the imposition of
the moratorium on this project would cause the loss of the required State
permit thereby preventing the project from proceeding. Also, vested
rights to develop gained as a result of submitting the plan prior to the
imposition of the moratorium would also be lost.
Therefore, it is our recommendation that the City continue the processing
of the plans for this project so that the certificate of need can be
obtained prior to the November 1, 1986 deadline. However, we also
recommend that no construction permits or other required documents be
issued to begin construction until the moratorium is lifted at a future
date.

D. ` Civic Center Master Piano ' '
Mr. Smith stated that Chairman Crites had expressed concern regarding
how the College of the Desert would fit into the plan and into the
review of the master plan. He Indicated that Chairman Crites
suggested looking at creating a Joint committee from COD and the city
to start from the beginning so that everyone Is aware of what is
being planned ( i .e. the sheriff's substation and library).
It was noted by Commissioner Richards that the site plan committee
was empowered to come up with a plan for the 62 acres to allow

A. DESCRIPTION OF SITE:
The property consists of two 5 acre parcels located on the north
side of Country Club Drive centered between Portola and Cook Street.
The land is vacant and consists of gently rolling dunes with sparse
desert scrub.

The proposed project exceeds open space requirements. Although the
minimum building separation at times is 10 feet, the average for the
project is 20 feet meeting the requirement while allowing for design
flexibility.
III. PROJECT DESCRIPTION:
A. GENERAL:
The proposed project would consist of two . separate projects, both
pertaining to housing for the elderly. The first part would be a 117
bed convalescent, or skilled nursing facility. Health care services
provided are licensed by the State of California Department of
Health and Care Services. This portion of the project has a building
coverage of 48,000 square feet, a little over one acre or 10% of the
entire site.

The second part of the project consists of apartment style; one and
two bedroom units (645 square feet and 832 square feet respectively)
classified as "Residential facility - Group home - Adults" under
Section 81251 of Chapter 2 , Div. 6, Title 2 of California
Administrative Code. Services and/or care provided the resident are
in the form of assistance or guidance in the activities of daily
living. This facility will not provide "health care." Residential
care facilities are licensed through the State Department of Social
Services and limited to those aged 62 or over.
The 105 units designated as residential facilities cover most of the
balance of the site (64,288 square feet) . While the units are
designed to resemble independent self care, units there have
functional considerations inherent that should be noted. Efficiency
kitchen facilities are included, but it is required by contract that
residents eat two meals per day in the common dining area. Each
unit would have two beds, with two bedroom units intended for
couples who require separate rooms due to medical necessity and/or
apparatus. The units come furnished, which should assure appropriate
use.
Further facilities include a mall-like recreation building ( 19,000
square feet) with a gym, tv room, library, resident store, offices,
card room, occupational therapy, and assembly room.
A manager's unit and two guest units for short term use by families
of patients is provided. Outside recreational facilities consist of
a wading pool , game area, jacuzzis, gardens and patios.
B. ARCHITECTURE:
The style of architecture will be that of Luis Barringer, most known
for a style built in Mexico. While the style can be attractive, it
is questionable if it is appropriate for the desert area. Mitigation
can be achieved through the use of additional solar protection, and
a muting of accent colors. The architectural commission granted
preliminary approval of the landscape plan with conditions.
C. CIRCULATION, PARKING AND ACCESS:
Access is achieved through a reciprocal access easement off Country
Club Drive, which meanders north a length of 600 feet to reach the
project entrance. A perimeter road with parking stalls circles the
project . A secondary access road is designed to provide
ingress/egress to the project at the southern most border to connect
to a proposed road running east to Cook Street. The residential
facilities are L-shaped with sidewalk and a water theme attempting

to tie the different sections together. Additional parking stalls
are located south of the recreation building.
Parking is scheduled under "C" of City Ordinance 25.58.310 defined
for Health Uses. Convalescent and nursing homes, homes for the aged,
rest homes, children's homes and sanitariums. Under this use the
standard is one for every four beds in accordance with resident
capacity of the home as listed on the required license or permit.
The proposed project is therefore required 251/4 = 63 parking stalls
for patients. In addition two spaces per manager's unit and per
guest unit are required, bringing a total parking stall requirement
to 86 spaces - 100 spaces are provided in the plan.
IV. DISCUSSION:
The existing zone clearly allows the skilled nursing facility portion of
this project and can be approved without modification.
Of less clarity is the residential portion of the project. In the
industry's attempt to encourage the development of a more independent life
style though supervised facility, "group homes" have become a popular
alternative to skilled nursing for ambulatory elderly that need or choose
assistance in the activities of daily living. Health care, other than
emergency medial , is not provided. The concept is further realized in
this particular project by providing apartment rather than dormitory style
units.
While the attempt is to provide an efficiency style unit where "social
assistance" is available and the residents are contractually committed
to use common dining facilities more often than not, in practice residents
could live completely independent. A distinction between common apartment
living and institutional care becomes difficult and appropriate zoning
for density an issue in this case.
Staff recognizes that the industry is experiencing a sophistification
that is being reflected in a finer diversification of services and
facilities. While not wanting to support more dependent, less spacious
living quarters it is imperative that a distinction exist between uses to
determine an appropriate density standard.
In the past staff has determined that this type of facility would be
defined as "congregate care" and other projects of this type have been
defined as residential , subject to the requirements of the senior overlay
zone.

The following concerns have been evaluated:
1 . Is Social Service licensing (or any definitions of congregate care) a
strong enough criteria to recognize the project as institutional ?
At discretion of planning commission.
A. License recognizes number of beds, not units.
B. Rental rate is predicated on services provided.
2. Is it appropriate to build apartment style units for ambulatory
elderly at 12 d.u./acre?
Yes. The maximum density for PR is 18 d.u./acre.
3. If recognized as institutional , should the parking requirement
remain at the hospital bed standard, considering use by ambulatory
adults?
Yes. A. Units are two beds (even two bedroom) and would thus
discourage a different type of client.
B. Bus transportation is provided by the operator.
C. A field inspection of similar quality and consultation
with operators show a smaller percentage of residents own
or operate vehicles than the usual residential facilities.
D. A condition for bonding of future parking can be required
to assure provision if need is demonstrated at a later
date.
V. CONCLUSION:
With the applicant's attempt to reconfigure a previously approved project
(PP 84-28) to an east/west design layout, staff has become concerned with
appropriate zoning because:
1 . The applicant has modified the original site plan somewhat;
2. The Senior Overlay zone was not in existence when the project was
presented and approved before; and
3. Congregate care with social service rather than department of health
licensing has become the current state-of-the-art in care facilities.
Staff, therefore, requests direction from the planning commission as to
an appropriate interpretation of institutional use.

VI. RECOMMENDATION:
If the planning commission interprets social service licensing of group
home facilities, or congregate care, as an institutional use then the
project can be approved as presented in the PR zone;
Alternatively, if the planning commission determines the original
application preceded Senior Overlay zoning then the project can be
approved as institutional with conditions applied similar to the S.O.
zone.
If the planning commission interprets congregate care as a residential
use, then staff should be directed to prepare necessary resolutions and
the development agreement required for Senior Overlay zoning.

TRANSMITTAL LETTER
On September 2nd the planning commission considered a substantially
modified proposal consisting of 344 senior units ( 15 units per acre) . In
addition to a 38% reduction in units per acre density, the three story
buildings . have been eliminated. All buildings fronting onto Fred Waring
Drive and adjacent to future single family uses have been reduced to one
story. The basic site plan concept, amenities and architecture remain
unchanged. Open space and parking have been increased. The plan meets
all senior overlay and planned residential zone standards with one
exception. The plan contains . some interior courtyards with building
° separation of 10 feet. The planning commission considered these spaces
part of the courtyards and therefore acceptable. The commission added a
condition requiring tennis court and two additional swimming pools. The
vote recommending approval was 5-0.

C. ANALYSIS:
The application involves three issues.
1 . Site Suitability - When the senior overlay was discussed in Palma
Village Plan proximity to the senior center and commercial facilities
was considered relevant. Projects in the Palma Village area were
assumed to be small with limited on-site facilities. The proposed
project, although not within walking distance of the senior center,
contains more extensive facilities on-site. In addition, transpor-
tation will be provided to the senior center and commercial
facilities.. Given these mitigating factors the site may be deemed
appropriate. The site was identified in the Housing Element as
potentially suitable for high density affordable housing.

Ms. Sass explained that the proposal was for reconfiguration of an
already approved project and outlined the changes that had been
made.
Mr. Dick Oliphant, applicant, further explained the architecture and
design of the proposed project and indicated that the architecture
was done by Luis Berrigone the famous architect. Mr. Norm Shoan .
reviewed the site plan and pointed out how the different sections
work together. A sidewalk and water treatment areas are provided
throughout the project which create a natural environment.
Mr. Larry Ryan, Morse Consulting, explained the various amenities
which include a pool and spa area and large recreation and dining
areas. He noted that there were trees located at the areas where
the walkways meet with the roads that provide screening.

AUGUST 12, 1986
Commissioner Drury questioned the amount of parking spaces provided
and if the project would be built all at once, Mr. Oliphant
indicated that 85 parking spaces were required and 105 are provided
for. He noted that the buildings would be built all at one time.
Commissioner Cook was appreciative of the architecture but felt it
was inappropriate for the desert area. He noted that there was no
provision for solar protection on any of the buildings which was not
adequate in this area.
Mr.. Shoan indicated that the windows would hot be exposed to the sun
very often and he felt that the cooling effect of the water would
provide a calm atmosphere. He noted that the wa 1 Is had deep
recesses and the windows will be pulled back.
Commissioner Cook stated that the recesses were not apparent in the
plans and indicated that the sun control needed to be addressed. He .
noted that the two commissioners that were absent would probably
agree with his comments.
Commissioner Drury questioned if the colors indicated on the plans
were the actual colors to be used. Mr. Oliphant explained that
these were . the colors to be used and that they had been toned down
from the original architects design. The bright colors are used to
emphasize the entrances and other architectural points.
Chairman Gregory felt that a less graphic landscape plan needed to
be submitted showing details of shrubs and trees.
It was moved by Commissioner Drury, seconded by Commissioner McCrea
to grant conceptual approval subject to the addition of solar
protection on all buildings, the colors being muted and a revised
landscape plan. Carried 4-0

Department of Community Development:
1 . The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null , void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, .or
which hereafter may be in force.
A. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
- Public Works Department
Palm Desert Water & Services District
Evidence of said permit or clearance from the above agencies shall. be
presented to the department of building and safety at the time of .issuance
of a building permit for the use contemplated herewith.
5. The operator will acquire and maintain social service licensing under
title 22 of California Administrative Code, and provide services as
described in the application.
Department of Public Works:
1. Drainage and signalization fund feed, as required by city ordinance,
shall be paid prior to grading permit issuance.
2. Drainage facilities shall be provided, per Ordinance No. 218 and the
Master Drainage Plan, to the specifications of the director of public
works.

3. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.
4. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in

required by ordinance, to the director of public works for checking and
approval before construction of any improvements is commenced. The
engineer shall submit "as-built" plans submitted to the department of
public works prior to the project final.
6. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the city engineer for checking and approval
before construction of any improvements Is commenced. The engineer shall
submit "as-built" plans prior to the acceptance of the improvements by the
city.
7. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
8. Landscaping maintenance on Country Club Drive shall be provided by the
homeowner's association.
9. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the city engineer for checking and approval prior to
Issuance of any permits.
10. Dedication of 55 feet of right-of-way on Country Club Drive shall be done
prior to issuance of any permits and approval of plans. .
11 . Installation of curb and gutter, matching paving and 8 foot meandering
sidewalk on Country Club Drive.
12. Waiver of access to Country Club Drive except at approved locations shall
be granted on the final map.
13. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
grading permit issuance.
14. Full improvement of interior streets based on private street standards as
established In accordance with Chapter 26, Section 26.40.040, C.P.D. Code.
15. Installation of sewers to serve this project.

16. Size, number and location of driveways to public works specifications
with only one driveway approach to be allowed to serve this property.
17. Complete parcel map shall be submitted as required by ordinance to the

,a plans and the issuance of valid encroachment permits by the department of
public works.
19. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of

20. Applicant agrees to pay a future reasonable assessment for Cook Street
improvements including bridges at Interstate 10 and the Whitewater
Channel .
Fire Marshal-
1. Install a water system capable of delivering 3500 GPM fire flow from any
fire hydrant for a three hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of measurement.
2. Install Riverside County super, fire hydrants so that no point of any
building is more than 200 feet from a fire hydrant measured along approved
vehicular travel ways.

It was a pleasure speaking to you this morning and I hope that I was
able to answer some of your questions regarding the Country Club Care
Center proposal .
I would again like to assure you that our intent has been and still
remains to develop a licensed facility for the aged to be operated in
association with the skilled nursing facility.
I am a consultant in long term care facility development and administration
and am not interested in the development of apartment buildings. I do
however, feel that apartments and condos for the elderly would be a
desireable zoning for an area near this proposed project.
As a long time health planner and still an active member of the Executive
Committee of the local Inland Counties Health Systems Agency, I firmly
believe in the planning process and assure you that no project planned
by me will violate any of the local planning and zoning ordnances.
I decided to .copy the entire portion of Title 22 pertaining to Community
Care Facilities. It contains sections which govern the operation as
well as the licensing of the facilities. Thought perhaps this would give
you a better picture of the programs.

Dear Mr. Diaz,
The following fire protection requirements are in accordance with the Uniform Fire
Code and Life Safety Code standards.
1. Install a water system capable of delivering 3500 GPM fire flow from any fire
hydrant for a 3 hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the sup-
ply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 200 feet from a fire hydrant measured along approved vehicular
travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each hydrant.
c, hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three copies of the water system plan to the Fire Marshal for review. Upon
approval, one copy will be sent to the Building Department and the original will
be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the design
of the water system in PP 86-37 is in accordance with the requirements prescribed
by the Fire Marshal".
S. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
6. Additional fire protection requirements may be necessary when the applicant submits
specific plans for consideration and approval.
7. All buildings over 5000 square feet require an approved fire sprinkler system.
8. All plans shall be submitted to and approved by the State Fire Marshals Office.
9. A 50 foot turning radius is required on all roadway turns.
10. An approved supervised fire sprinkler system is required in all buildings over
5000 square feet.

11. An approved fire alarm system is required.
12. A secondary emergency vehicle access is .required.
13. Must provide emergency vehicle access, 20 foot minimum, all weather surface,
to within 150 feet of all portions of all buildings.
14. Any cul-de-sac over 150 feet long must have a 50 foot radius turn around.

This is in reference to the application for site approval and Negative ;I
Declaration for the Desert Sun Care Center, Country Club Drive (Nr. Cook) , j
submitted by Architect Lorand West on behalf of Neufeld Investments Ltd.
This project is designed to provide Long Term Care facilities for the
elderly, i.e. , Residential Care, Adult Day Health Care, Skilled Nursing
Care„ Intermediate Nursing Care.
All of the above services and facilities are licensed and regulated by
the State of California. Residential Care Facilities are licensed-by d
the State Department of Social Services. The other Care Facilities are
licensed by the State Department of Health Care Services. Regulations
controlling the operation of both types of facilities are covered in
Title 22, California Administrative Code.
Lhe "licensed" Residential Care Facility should not be confused with
ilar facilities for the elderly which are called "Retirement Homes" ,
nior Housing" etc. . These unlicensed facilities for the elderly do
vide similar services, however, they are unlicensed and are not '
ervised by any Agency.
Since the elderly to whom this proposed facility will cater will .be
leaving their homes where they have lived independently for many years
and moving into a facility where there will be a certain amount of
regulation, it has been imperative to design the proposed facility
in such a way as to provide as much independence as possible. The
proposed design will provide this independence while still providing
the safety and care for the resident. ,
\ —� As a matter of clarification, there are several classifications of - S '
licensed residential facilities in California. The official classification
of the proposed facility will be "Residential Facility - Group Horw

Section 81251 of Chapter 2, Div 6, Title 22, California Administrative
Code States the policy regarding these facilities. "It is the policy ofr"�'���

Every group home shoul provide services in such a way that each resident
is encouraged to move toward more independent functioning and to sustain

his functioning at a high level of self-care should he choose to remain
in the facility."
Services and care provided to the elderly include:

Food Service
Briefly put the services and/or care provide the resident with assistance
or guidance in the activities of daily living. Although a qualified person
will be available to provide for emer en ds, the
facility will not provide "health care". Health. Care will be provided
in the proposed Skilled Nursing Facility on the same site.
The proposed community activity building as a part of the residential
facility will provide the site for all resident activities and will
assist in keeping the resident an integral part of the community by
bringing community activities to them.

Outside recreational facilities would consist of a wading pool, outside game
area, jacuzzis, walking therapy course, a garden area, and outside patio
areas. Attached are several letters from the applicant further explaining
the proposed operation.
B. SITE DESIGN, CIRCULATION, AND PARKING:
Since the site is narrow (330 feet) and deep (1274 feet), circulation would be
provided around the perimeter of the site with the buildings in the center.
The access to the street would be through two driveways near the easterly
and westerly property lines. There will be control gates that are in the
inner part of the site and will only be used at night.
The convalescent facility would be located near the front of the site-with
the residential facility occupying the balance of the site. The community
care recreation building is located near the middle of the residential
facility. Both portions of the project would be constructed in phases to
coincide with anticipated needs.
On-site parking is provided throughout the site based on one space per four
beds, two per manager's unit, and one per guest unit.
Required parking: 86 spaces
Provided parking: 100 spaces
Staff has had some doubts as to whether this would be enough parking for
the residential care residents since they are non ambulatory and are
permitted to leave the facility. . The applicant and a medical consultant
have indicated that due to the age of the residents (62 years and older) and
the fact that they are under some care and supervision they do not own cars
or drive. Further; bus transportation is provided by the facility operators.
A field inspection of a similar facility in Palm Springs has shown that one
space per four beds should be sufficient.
As a precaution, staff is recommending a condition be recorded to require
that additional parking, for which there is room, be provided by the
applicants should a parking problem occur.
C. ARCHITECTURE:
The architectural style of the project would be spanish with exterior
materials consisting of stucco walls and clay tile roofs.
The convalescent facility would be one story in height with maximum height
being 18' 6". The residential care units would be one story at 12 feet high
with the community care recreation building partially two stories with the
maximum height 30 feet.
D. DEVELOPMENT STANDARDS:
The project has been designed as a residential condominium for the most
part. A six foot high_ aw 11 would b d-around the project with no
building closer than 35 feet to a property line. Fourty-two percent (42%) of
the site would be in landscaping which exceeds the 40% required for 7-18
unit per acre residential projects. .The building heights as previously noted
comply with the PR zone requirements. Maximum building coverage would
be 31%, which is below the 40% for residential projects of less than 7 units
per acre. One standard that is not met is that setbacks between buildings be
20 feet. The project has 10 foot minimum building separation with an
average exceeding 20 feet. Therefore, this is acceptable to staff.

The proposed project would consist of two subprojects, both pertaining to

facility while the second would be a 210 bed "residential facility - group
home - adults." The convalescent facility would be basically a full care
(registered nurses at all times and medical doctors available immediately)
operation for the elderly most of which are non ambulatory. The group
home which is described as a long -term: care facility for the elderly, 62
years or older, would be for those leaving their homes where they have lived
independently for many years and now need a residence where there would
be some independence with.regulation. Eiaeki Gaut, which would have two
. beds, would have cooking facilities, or if they wish they could eat in
common dining room provided in a community care recreation building
`Other facilities in the mall-like recreation building would include a gym, tv
room, library, resident store, offices, card room, occupationary therapy, and

for short term use by families of patients on the second floor.

The following should be considered as conditions of approval :
(1) Drainage and signalization fund fees, as required by City ordinance, shall be
paid prior to rocordation of the final map.
(2) Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the Director of Public Works.
(3) Additional storm drain construction shall be contingent upon a drainage study
by the private engineer.
(4) Full public improvements, including traffic safety lighting, as required by
ordinance and the Director of Public Works, shall be installed in accordance
with City standards.
(5) Complete improvement plans and specifications shall be submitted, as required
by ordinance, to the City Engineer for checking and approval before construc
tion of any improvements is commenced. The subdivider shall submit "as-built"
plans prior to acceptance of the subdivision improvements by the City.
(6) Landscaping maintenance on, Country Club Drive shall .be provided by the lisme�
owner's
(7) Existing utilities on Country Club Drive shall be undergrounded.
(8) Traffic safety striping on Country Club Drive shall be provided to the specif-
ications of the Director of Public Works. A traffic control plan must be sub-

ordinance to the City Engineer for checking and approval prior to issuance of
any permits.
(10) Dedication of 11 feet of right-of-way on Country Club Dr. shall be done prior
to issuance of any permits and approval of plans.
(11) Installation of curb and gutter at 43 feet from centerline, matching paving and
sidewalk on Country Club Drive.

(12) Offsite improvement plans to be approved by Public Works Department and a
surety posted to guarantee the required offsite improvements prior (to this
map recording) or (building permits being issued) which ever occurs first.
(13) Installation of one-half landscaped median in Country Club Drive or cash
payment for one-half the cost of landscaped median at the option of the
Director of Public Works.
(14) Size, number and location of driveways to Public Works specifications.
(15) Only 2 driveway approach(es) will be allowed to serve this property. Size
and location to Public Works specifications.

projected load growth which Edison is planning to meet in this

Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to
major sources of electrical supply, we expect to meet our electri-
cal requirements for the 'next several years.
Our total system demand_ is expected to continue to increase
annually; however, excluding any unforeseen problems , our plans
for new generation resources indicate that our ability to serve
all customer loads. during peak demand periods will be adequate
during the decade of the 80 ' s .
Current conservation efforts on the part of Edison 's customers
has resulted in energy savings . Optimization of conservation
measures in this project will contribute to .the overall energy

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 2nd day of October, 1984, hold a duly noticed public hearing to consider the request of
NEUFELD INVESTMENTS for approval of a negative declaration of environmental impact,
precise plan of design, and parcel map waiver to allow construction of a 117 bed
convalescent (non-ambulatory) facility and 210 bed (105 units) residential care (retirement)

WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have an adverse impact on the environment and a negative declaration
of environmental impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
4. The resulting parcels comply with applicable requirements as to area,
improvement and design, floodwater drainage control, appropriate improved
public roads, sanitary disposal facilities, water supply availability,
environmental protection, and other requirements of the municipal code.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of

1. That the above recitations are true and correct and constitute the findings
of the commission in this case.

Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits (Case
No. PP 84-28) on file with the department of environmental services, as modified
by the following conditions.
2. Construction of the total development may be done in phases; however, each
individual phase shall meet or exceed all municipal code requirements to the
degree that the city could consider each phase as a single project.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
5.. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:

Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a. building permit
for the use contemplated herewith.
6. Prior to issuance of a building permit, the applicant shall provide mitigation
measures in the form of fees of $750 per acre for a Fringe-Toed Lizard (UMA
INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be
used for acquisition of land for a lizard preserve in the Coachella Valley.
7. Applicant shall pay fees per city ordinance to provide fire suppression facilities;
fees to be paid upon issuance of building permit.
8. Parking lot lighting system shall be designed to comply with municipal code
requirements with light standards to be maximum 20 feet high. Lights to be down-
shining box type light. Plans, specifications, computer lighting print-out to be
approved by city during architectural review process.

PLANNING COMMISSION RESOLUTION NO.
14. Drainage facilities shall be provided, per Ordinance No. 218 and the Master
Drainage Plan, to the specifications of the Director of Public Works.
15. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
16. Full public improvements, including traffic safety lighting, as required by
ordinance and the director of public works, shall be installed in accordance with
city standards.
17. Complete improvement plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval before construction of
any improvements is commenced. The subdivider shall submit "as-built" plans prior
to acceptance of the improvements by the city.
18. Landscaping maintenance on Country Club Drive shall be provided by the owners.
19. Existing utilities on Country Club Drive shall be undergrounded.
20.. Traffic safety striping on Country Club Drive shall. be provided to the
specifications of the director of public works. A traffic control plan must be
submitted to and approved by the director of public works before placing pavement
markings.
21. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
22. Dedication of 11 feet of right-of-way on Country Club Drive shall be done prior to
issuance of any permits and approval of plans.
23. Installation of curb and gutter at 43 feet from centerline, matching paving and
sidewalk on Country Club Drive.
24. Offsite improvement plans to be approved by public works department and a surety
posted to guarantee the required offsite improvements prior to this map recording
or building permits being issued, whichever occurs first.
25. Installation of one-half landscaped median in Country Club Drive or cash payment
for one-half the cost of landscaped median at the option of the director of public
works.
26. Size, number and location of driveways to public works specifications.
27. Only two driveway approaches will be allowed to serve this property. Size and
location to public works specifications.
28. Full public improvements, including traffic safety lighting, as required by
ordinance and the director of public works, shall be installed in accordance with
city standards.
29. Installation of sewers to serve this project.
City Fire Marshal:
30. Install a water system capable of delivering 3000 GPM fire flow from any fire
hydrant for a three (3) hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure in
the supply main from which the flow is measured at the time of measurement.
Fire flow requirements will depend on built-in fire protection provisions of
buildings.
31. Install Riverside County super fire hydrants located at each intersection:
a. but not greater than 400 feet apart in any direction.

b. install Riverside County super fire hydrants so that no point of any building
is more than 200 feet from a fire hydrant measured along approved
vehicular travel ways.
C. exterior surface of hydrant barrels and heads shall be painted chrome

d. curbs shall be painted red 15 feet in either direction from each hydrant.
e. hydrants shall not be located closer than 25 feet to any building.
32. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department, and the original will be
returned to the developer.
33. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in PP 84-28 is in accordance with requirements prescribed by
the fire marshal."
34. Prior to delivery of combustible materials to the building site, the.required water
system shall be installed, operating and delivering the required flow.
35. Plans shall.be submitted to and approved by the State Fire Marshal's Office.
36. A 50' turning radius is required on roadway turns.
37. An approved, supervised automatic fire sprinkler system is required in buildings S,
R, and C.
38. An approved fire alarm system is required.
39. Fire lanes are required.
40. Emergency vehicle or second access must be provided, other than main entrance.
41. Additional fire protection requirements may be necessary when applicant submits

his development of the property would promote neighborhood
improvement. He also indicated that some incentive was needed.
Commissioner Richards asked Mr. Lahey if he planned to developed the
property in the near future. Mr. Lahey replied maybe In four-five
months.
Chairman Crites closed the public testimony.
Commissioner Richards Indicated that while it was a difficult
decision for staff to decide, he was persuaded to agree with the
applicant. Commissioner Whitlock was concerned about creating a
precedent. Chairman Crites stated that he was not persuaded by the
applicant because of the lot size. Commissioner Erwood agreed with
Commissioner Richards because the closer lots were smaller.
Commissioner Richards stated that the city was trying to promote
development in this area and noted that it would be for single
family development, which the city would like to have develop.
Commissioner Richards indicated that he would like to condition the
approval with a time frame, but felt it might be difficult for the
applicant.
Mr. Diaz indicated that if this variance was granted for 1200 square
feet, it might be difficult later on to deny 1300 square feet to
subdivide.
Chairman Crites also noted that the size of the lot would not
preclude development of that lot.
Action:
Moved by Commissioner Richards, seconded by Commissioner Erwood,
instructing staff to prepare a resolution of approval for adoption
at the September 16, 1986 meeting. Carried 3-2 (Chairman Crites and
Commissioner Whitlock voting no. )

Ms. Sass outlined the salient points of the staff report and
described the amenities . Staff asked for commission
direction/determination for institutional uses.
Chairman Crites asked if the project met all requirements of the
senior overlay zone. Ms. Sass replied no
Chairman Crites opened the public testimony and asked if the
applicant wished to address the commission.
MR. DICK OLIPHANT, applicant, felt the project needed
careful consideration and noted that the property in
question has been previously approved but wished to
Improve and create a more liveable facility for seniors.
He noted that if the proposed project was not acceptable,
they would build the original project. He indicated they
would be licensed by the State of California and informed
commission that plans had to be submitted by November 1 ,
1986 or the certificate for nursing would expire. Mr.
Oliphant described the amenities that would be provided by
the project and stated that it would be controlled by the
State Department of Social Services. He indicated that it
was an institutional facility under Title 22 and nursing by
State of California. He requested approval as an
institutional use.
Commissioner Whitlock asked if the applicant was considering the
whole project as institutional . Mr. Oliphant replied yes.
Commissioner Richards asked if staff could create a category . for
institutional use. Mr. Diaz replied yes, but expressed concern for
similar projects in other zones asking for institutional use (i .e.
R-1 ) which would not be allowed.
Commissioner Downs noted that the applicant was not asking for a
zone change. Commissioner Richards suggested approval without the
senior overlay. zone. Commissioner Erwood indicated the project
could be allowed with a license requirement; Mr. Diaz replied that
Charter Communities was asking for the same thing but in a different
zone.
Chairman Crites asked commission what would be done with project
that are half and half because all fall under Title 22.

Commissioner Richardsstated that it appeared to be a straight
nursing home.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed.
MR. GEORGE MARZICOLA expressed concern for the five acre
parcels that have private easements. He felt that the city
needed to look to the future. Mr. Marzicola outlined the
background on how the easements/right-of-ways were granted by
the government in 1959. He indicated they were considered
collector streets and stated that there would be no way to
.utilize existing access if they were cut off from Country Club.
He suggested moving the project 330 feet east to allow access.
Mr . Diaz stated that he did not believe it was the city's
responsibility to provide access to land locked parcels unless there
was a recorded easement. He also noted there was a moratorium in
effect for the north sphere area.
MR. CHARLES HAVER, 74-396 Highway ill , stated that no building
has taken place since 1975 and felt development was needed, but
not if it would be injurious. He felt that access should not
be eliminated.
Mr. Diaz felt that the city should not place itself in the position
of assuring access to land locked parcels. Mr. Erwin confirmed that
It would not be appropriate and was not a responsibility of the city.
Mr. Marzicola stated that the city has a responsibility for the well
being of all its citizens, with the ultimate concern for traffic
flow, storm drain, and emergency vehicle access.
MR. ROBERT BARTON, Charter Communities, stated that he was not
speaking in opposition to the project, but wished to express /
concern over the lack of consistency within the city. He
stated that his project that has been approved has five levels
governed by Title 22 and the Department of Social Services and
the Department of Health and appealed to the commission to keep
a consistency within the city policy and licensing.
Mr. Oliphant noted that Mr. Marzicola would have access to Cook
Street. He asked that the commission consider that when the altius
project is built access would be provided.

Commissioner Downs felt that the project met all the guidelines for
institution use in the PR zone and was in favor of the project.
Commissioner Richards stated that the nursing home appears to be
compatible at this time. He noted that the city was in the middle
of a study with an outside consultant evaluating what should be
constructed in the north sphere. He indicated that this would be
the first project In this location. He also noted that a
convalescent/nursing home was being provided and not apartments.
Commissioner Richards felt the project was compatible with the
altius project and indicated that the Marzicola easement problem
would be solved with that land is developed. Institutional was
recommended without the senior overlay zone.
Chairman Crites stated 'that the area is under a moratorium and asked
what would happen if the project was approved and did not conform
with the consultant's recommendation of what should be built. Mr.
Diaz replied that the commission could rehear projects that have
obtained approval and then disapprove them, unless a building permit
has been issued. Mr. Erwin indicated that the commission could
Initiate the hearings.
Chairman Crites expressed concern for approving projects while
definitions have not been made. He felt that this project should
not be used as a definition just because it was submitted first.
Commissioner Erwood felt that it was a strict interpretation of a
nursing home. Chairman Crites indicated that a portion of the
project was not hospital and provided kitchens. Chairman Crites
felt that because commission was dealing with senior housing, they
would be setting standards as well as approving a project.
Commissioner Richards stated that this was the closest description
to a convalescent use that he had seen presented.
Chairman Crites felt that long-term problems might be created. Mr.
Diaz stated that if commission instructed staff to prepare a
resolution of approval this would allow two weeks for staff to meet
with the city attorney.
Action:
Moved by Commissioner Richards, seconded by Commissioner Downs,
instructing staff to prepare a resolution for approval , approving
C.T.K.O. as an "institutional" use. Carried 4-1 (Chairman Crites

Department of Community Development:
1 . The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null , void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:

14. Full improvement of interior streets based on private street standards as
established in accordance with Chapter 26, Section 26.40.040, C.P.D. Code.

CITY OF PALM. DESERT, CALIFORNIA, APPROVING A
PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF
A 117 BED SKILLED NURSING FACILITY AND 210 BED
CONGREGATE CARE FOR THE ELDERLY ON 10 ACRES IN
THE PR-5 ZONE NORTH OF COUNTRY CLUB DRIVE
BETWEEN PORTOLA AVENUE AND COOK STREET.
CASE NO. PP 86-37
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on ,the 2nd day of September, 1986, hold a duly noticed public hearing and
continued public hearing on September 16, 1986, to consider the request of
C.T.K.O: for the above mentioned project; and
WHEREAS, said application has complied with the requirements of the "City
of Palm' Desert Procedure for implementation of the California Environmental
Quality Act, Resolution No. 80-89, " 1n that the director of community
development has determined that the project has been previously assessed in
connection with Case No. PP 84-28 and no further documentation is deemed
necessary' ; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to Justify granting approval of said precise plan:
1 . The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
3. Th
e precise plan will not endanger the public peace, health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert; California, as follows:
1 . That the above recitations are true and correct and constitute the
findings of the commission In this case;
2. That approval of Precise Plan 86-37 is hereby granted for reasons
subject to the attached conditions.
