PP 86-38 (RETT.E) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of August, 1988, hold a duly, noticed public hearing to consider the request of STUART EVEY for approval of a four-plex apartment project on a 13,500 square foot lot located at 73-525 Shadow Mountain Lane; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of conTu ity development has determined that the project is a class 3 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify their action: 1. The proposed use is of equal or higher design quality and of similar intensity and type as surrounding uses and, therefore, will not depreciate property values in the vicinity. 2. The proposed project will not endanger the public health, safety or general welfare. 3. The proposed project will not interfere with the use or enjoyment of Property in the vicinity by occupants thereof for lawful purposes. 4. The project is consistent with the zoning ordinance and general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Riverside County Department of Health Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 6. Projects shall pay school impact mitigation fees as arranged with the Desert Sands Unified School District. Deparbcnnt of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3 PLAMIWV OU4IISSICN RESOLUTION NO. 1305 3. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Shadow Mountain Drive shall be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of six foot wide sidewalk on Shadow Mountain Drive. 9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 10. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. 11. Six inch concrete curb shall border entire edge of parking lot. 12. Driveway approaches shall be a maximum of 30' wide as per City of Palm Desert standard drawing number 105. 13. The private engineer shall make provision for the complete and unrestricted drainage of the back and side yards to Shadow Muntain Drive, taking into account the proposed landscaping scheme. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 86-38 is in accordance with the requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. Case No. PPS 8(�-38-JREF LE) - STUART EVEY, Applicant Approval for a precise plan for a four-plex rental apartment rental apartment project within the R-3, 13,000 (3) zone at 73-575 Shadow Mountain Drive. Mr. Diaz outlined the staff report and aspects of the project. A plan was shown with the changes from the original plan. Commissioner Ladlow asked if these apartments were the same as the apartments down the street from this project. Mr. Diaz stated that these apartments are better than the others. There will be two car garages and opened parking areas on both sides of the complex. Chairman Erwood opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed. Mr. Diaz informed the commission that the applicant could not make tonight meetings. Chairman E rwood closed the public testimony. Action- Moved by Commissioner Whitlock, seconded by CcmIImissioner Ladlow, adopting the findings as presented by staff. Motion carried 4-0. MINUTES ARCHITECTURAL COMMISSION AUGUST 12, 1986 Ms . Sass explained the location and gave a description of the project. Chairman Gregory questioned the access for maintenance equipment into the atrium area. He felt the project had an attractive layout. Commissioner Cook was in favor of the conceptual plans. He indicated that it needed some additional solar protection but had good coverage on almost everything. Commissioner Drury was concerned with the area that the street looped was too consistent and needed some variation. Mr. Diaz suggested that they differentiate the buildings some by setting some back from the street where possible. Chairman Gregory recommended that the applicant look at making the patios larger. He felt that they would be used often, therefore they should provide more space. It was moved by Commissioner Cook, seconded by Commissioner Drury to grant preliminary approval subject to the following conditions. 1 . Minimum addition of solar protection to be provided. 2. The site plan suffers from front parking problems similar to other recent four-plex proposals. All eight parking spaces back out onto Shadow Mountain via two 31 foot curb cuts. Staff has proposed a redesign utilizing one double loaded central parking isle with side entry garages and open spaces. This will allow forward entry onto Shadow Mountain, eliminate one of the curb cuts and triple front landscape area. The plan can be accomplished with only a four foot decrease in building height. RECOMMENDATION: Grant preliminary approval to elevations and landscaping as amended. Recommend to applicant and planning commission redesign of front parking area using single curb cut. Case No. PP 86-38 EDWARDS CONSTRUCTION, Applicant. Request for approval of a precise plan. for a four-plex rental apartment project within the R-3, 13,000 (3) zone at 73-575 Shadow Mountain Drive. Mr. Drell outlined the salient points of the staff report, noting that the architectural commission required redesigning of the driveway, landscaping and full screening of the driveway. He indicated that the project meets all the requirements and recommended approval , subject to the conditions. Commissioner Wood asked for the reasoning behind the redesigning of the driveway. Mr. Drell replied that it was to avoid having any cars backing onto the street. Acting Chairman Richards opened the public testimony and asked if the applicant wished to address the commission. Acting Chairman Richards noted that the applicant was not present and asked if anyone present wished to speak in FAVOR -or—OPPOSITION to the proposed. There being no one, the public testimony was closed.
