The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. The development of the property described herein shall be subiect to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Applicant agrees to pay a future reasonable assessment for Cook Street improvements including bridges at Interstate 10 and the Whitewater Channel . 6. Payment of lizard mitigation fees in amount of $630.00 required prior to issuance of grading permit. 7. All future occupants of the building shall comply with parking requirements of the ordinance. 8. That the applicant file a parcel map to consolidate the two lots into one parcel . 3 I PLANNING COMMISSION RtaOLUTION NO. 1181 Department of Public Works: I . Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 2. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 3. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 4. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 5. Landscaping maintenance on Corporate Way and 42nd Avenue shall be provided by the property owner. 6. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 7. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. 8. Size, number and location of driveways to public works specifications with only three (3) driveway approaches to be allowed to serve this property. Fire Marshal : 1 . Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. 4 PLANNING COMMISSION RESOLUTION NO. 1181 b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 86-d0 is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over 5000 square feet require a fire sprinkler system. Am 5 MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 2, 1986 Mr. Diaz indicated that in this case staff had no concerns over the parking. Commissioner Downs agreed with staff. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, approving the findings as presented by staff. Carried 5-0. Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1180, approving PP 86-39, subject to conditions as amended. Carried 5-0. �J Case No. PP 86-40 - BREEZE AIR CONDITIONING, Applicant Request for approval of a 22,533 square foot . industrial/office building located in a service industrial zone at the west side of St. Charles Place, 275 feet north of Mediterranean (Lots 32 & 33, Tract 13915) . Mr. Smith outlined the salient points of the staff report and indicated that a determination was needed from the commission as to office areas in the industrial area becoming ancillary. Staff recommended approval . Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. RICK HOLDEN, representative, felt the issue was based on the parking. He asked for approval of the project as presented. Mr. Holden stated that twice as many parking spaces are required for office than for a sheet metal operation. Commissioner Richards indicated that the city has been having too many industrial projects turn up as offices. Commissioner Richards asked if staff felt there would be any parking problems. Mr. Smith replied no. Commissioner Downs stated that parking was a problem at all times during the day. He felt there was not enough parking on a square foot basis. Mr. Holden stated that 40% of the project would be office and that they would provide 4 spaces per every 1000 square feet for parking instead of 2 spaces per 1000 square feet. 20 r MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 2, 1986 Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. There being no one, the public testimony was closed. Chairman Crites asked if sheet metal was considered manufacturing or warehouse. Commissioner Down replied manufacturing. Mr. Holden noted that if 2 spaces were required per 1000 square feet that would equal 45 spaces and the project has proposed 50 spaces. Mr. Diaz indicated that if there wasn't enough parking provided, complaints would be coming in and noted that the city was monitoring the parking for Strother's development and felt there could be a reduction of office space required if problems were determined. Mr. Smith indicated that all future occupants complying with parking requirements of the ordinance was included as a condition of . approval . Action: Moved by Commissioner Richards, seconded by Commissioner Downs, approving the findings as presented by staff. Carried 5-0. Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1181 , approving PP 86-40, subject to conditions. Carried 5-0. MINUTES ARCHITECTURAL COMMISSION AUGUST 26, 1986 Mr. Wells indicated that they could use a vinyl tape for the fascia rather than the plastic. He explained that the tile would be very expensive. Commissioner Holden felt that the parapet wall should be widened to match the other wall or deleted. Chairman Gregory suggested the striping be removed from the roof of the canopy and it be stucco to match the other buildings. Moved by Commissioner Holden, seconded by Commissioner McCrea to grant approval subject to the following conditions. Carried 3-0-1 (Chairman Gregory abstaining) . 1 . Fascia band material to be upgraded. 2. Canopy to be flat with stucco band to match buildings. 3. Color samples to be submitted. 4. Sharp corners on the buildings to be softened. 5. Mr. Holden explained the project and noted that they were short on required parking spaces. ` Mr. Diaz stated that planning commission has shown concerns with project's that build as a warehouse and rent the space as office which requires additional parking. Commissioner Martin requested color and material samples. It was moved by Commissioner Martin, seconded by Chairman Gregory to grant preliminary approval . Staff feels the findings for approval can be justified for this precise plan. B. CONCERNS: This application might be described as "the straw that broke the camel 's back." Up until this time our review of projects in the industrial park have involved warehousing operations with small ancillary office areas. For these projects we have used a parking standard of two spaces per 1000 square feet. This is in accord with a revision to the parking ordinance in 1983 where it reads: "Manufacturing Plants and Kindred Uses. . . . . industrial uses of all types except a structure used exclusively for warehouse purposes shall provide two spaces for each 1000 square feet of gross floor area." This new standard was in addition to the then existing standard of one space per 1000 square feet. Our implementation has generally been to require two spaces per 1000 square feet except where a large warehouse operation is obvious. The plan before commission does not fit into the usual category. The plan contains a total of 22,533 square feet of which 8944 square feet (40%) is to be office. In our mind this is not ancillary to a warehouse operation and, therefore, should provide parking at the usual office standard of four spaces per 1000 square feet. The 9682 square feet of "warehouse" area contained in building 'A' to be used for sheet metal fabrication would appear to fall into the two space per, 1000 square feet category and, therefore, require 20 spaces. The 3502 square feet of warehouse area in building 'B' would appear to fall into the one space per 1000 square feet and, therefore, have a requirement of four spaces. Using this method of parking calculation the project has a total parking need of 60, whereas 50 are delineated on the plan. The applicant indicated that he used the typical two space per 1000 square feet over the total 22,533 square feet and added in some extra five spaces for the office area to arrive at the 50 spaces provided. Planning commission needs to discuss this situation and give staff direction as to the appropriate parking standard to be used for this and future cases. Specifically staff needs to know at what point office area ceases to be ancillary to an industrial use. Is it 10% or 15% or 20%?
