(To be annexed to east end of Candlewood Apartments). APPLICANT: RICHARD OLIPHANT & ASSOCIATES 77-900 Avenue of the States Palm Desert, CA 92260 1. BACKGROUND: A. SUBJECT PROPERTY ZONING AND LAND USE: R3 (3)/Vacant B. ADJACENT ZONING AND LAND USE: North: O.P./Church South: R-3/Apartments East: R-I/Vacant West: R-3/Apartments C. GENERAL PLAN DESIGNATION: High density residential D. PREVIOUS APPROVALS: This project was previously approved In September of 1984 along with a parcel map to add certain area to this site from another property owned by the applicant. The applicant allowed the approvals to lapse and hence the need for this new hearing and decision. Commission may also recall at the same time in 1984 that the applicant wished to add three units to the existing 26 unit project located on the adjacent property. Commission did not approve these three additional units notwithstanding that staff recommended approval . On appeal to City Council , a development agreement was approved and the three units permitted. These units have not been built at this time. PP 86-46 continued II. DISCUSSION: The applicant is proposing to construct four, 836 square foot two bedroom apartment units on lot 32 as shown on the assessors map attached hereto. Lot 32, according to the assessor maps has dimensions of 110 feet by 82 feet or 9020 square feet. This lot by itself then would support three units in this R-3 (3) zone. Attached hereto is a reproduction of the original approved site plan for the 26 unit Candlewood Apartment project as approved by the Design Review Board and Planning Commission in February 1977. The zoning at that time was the same as It is today (R-3 (3)) . The site plan occupies all of present lot 46 and 35 as well as the northerly portion of Lot 1 . The 26 unit project required a minimum of 78,000 square feet of land area to support it in compliance with the zoning ordinance. The total area of parcels 46, 35 and 1 Is 80,000 square feet. This site plan delineates 26 covered parking spaces and 17 open parking spaces. Four open parking spaces and a hammerhead shaped parking turn-around area are shown on the easterly end of the 1977 site plan. The parking requirements for apartments have been amended several times since 1977 however, staff feels comfortable in saying that these four parking spaces would not have been delineated on the site plan unless they were absolutely necessary to meet the minimum code requirements in effect at that time. These four parking spaces become very important because the present four units proposed are to have their eight parking spaces (4 covered) on the same ground. Although the four proposed units are located on Lot 32, a careful review of the site plan indicates that the driveway, carports and open parking are located on parcels 46 and 35 which have a 1 ready been utilized as a part of the code requirement of the original 26 unit project. This same property was to be added to the area of Lot 32 as a part of the 1984 parcel map procedure. This major error in site planning should have been pointed out to commission before staff recommended approval of this same request in 1984. Fortunately, we have a second chance on this matter and will endeavor to do it right this time. CONCLUSION: The plans as submitted would appear to be in need of substantial review unless it can be shown that the four parking spaces delineated on the original site plan for the 26 unit apartment project were extra, non required spaces and that the property on which they are situated (some 6340 square feet) was not necessary in order to permit all of the original 26 units. The site plan then provided 26 carport spaces and 13 open spaces. In addition four more open spaces were provided. The applicant has provided staff with area calculations prepared by a land surveyor confirming that there is sufficient land area available to support the proposed four (4) units in addition to the existing 26 units. The applicant has provided staff with copies of grant deeds establishing a non-exclusive perpetual easement for roadway purposes to provide,; emergency access to the site from Larrea and Lantana. 111. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: the design of the use is not unattractive and will be compatible with other uses existing in the vicinity. 2.
