Inspector Meyerhoff had written a correction involving use of U.S. Tile installed without the benefit of clips, nails, or methods of attachment. My examination of the project revealed lack of, or no nails at all , badly cracked tile, and no tile roof vent installations. In a discussion with you on October loth, and as per your proposal to use hurricane clips, I agreed to continue final inspections and release same pending initiation of roof repair during the interim. Again, I wish to emphasize that either nails, clips, or a method to secure tile must be installed along with the tile roof vent flashings. "Release" as used in this paragraph means release of utilities, and not a complete final or issuance of Certificate of Occupancy. The eight (8) houses of your tract, lots 29, 16, 42, 45, 46, 47, 48 and 30, will not be finalled and/or released until subject work is completed. Examination reveals that approximately fifteen (15) houses installed by Red Smith Roofing were nailed, and beyond that point, attachments were not used. EASEMENTS: Easements for utilities and other purposes are shown on the title report and subdivision map recorded in the Office of the Riverside County Recorder, Book 98, of Maps, Pages 39 through 42. RESTRICTIONS: This subdivision is subject to restrictions recorded in the Office of the Riverside County Recorder on March 2, 1979 as Instrument No. 42528. TAXES: Under the California Constitution, the maximum amount of property tax on real property that can be collected annually is one percent (1%) of the full cash value of the property. For the purchaser of a lot in this subdivision, the "full cash value" of - the lot will 'be the valuation, as reflected on the tax roll, determined by the county assessor as of the date of purchase of a lot or as of the date of completion of an improvement on the lot if that occurs after the date of purchase. CONDITIONS OF SALE: if your purchase involves financing, a form of deed of trust and note will be used. These documents contain the following provisions: An Acceleration Clause. This means that if you sell the property the lender may declare the entire unpaid balance immediately due and payable. A Late Charge. This means that if you are late in making your monthly pay- ment you may have to pay an additional amount as a penalty. A Prepayment Penalty. This means that if you wish to pay off your loan in whole or in part before it is due, you may be required to pay an additional amount as a penalty in accordance with the terms of the loan. REQUEST FOR APPROVAL of an 1.8-Month Time Extension for Tract .vo . 9377 , Mountain Back . Applicant . Mr. Beebe reported that this tract had previously been approved by the Council . They have already completed one unit , but have ,just run out of time . They have requested additional time on their Tract , and Staif recommends an 13-month extension . REQUEST FOR APPROVAL OF LANDSCAPE DEVELOPMENT PROJECT FOR COMMUNITY PARK EXTENSION (Contract No . 1019) . Mr. Bouman stated that this was a project for a 2-1/2 acre addition to the Communitv Park . It involves leveling of land , installation of a water system, installation of trees and the construction of a lawn . It will provide an open land area for soccer , touch football , etc. In Council ' s consideration of this matter , the Park & Recreation Com- mission has requested that the Council be aware that at one time , this portion of the Park had been considered , and a request made , for donation to the Christina Sinatra Youth Center for construction of a new facility . The Commission was not necessarily saying that wanted it there , but it is a potential site . Staff recommends proceeding with the project . Councilman Wilson stated that he did not feel that the site was large enough for the Youth Center . He felt that the Park & Recreation Commission should be directed to consider other sites . ( Councilman Brush stated that he did not feel that this was a good place for the new Center inasmuch as it is located very close to a new housing development . Councilman Brush moved and Councilman Wilson seconded to authorize the City Clerk to advertise for bids for Contract No. 1019. Motion carried unanimously with the members present . XIII . OLD BUSINESS A. REQUEST FOR APPROVAL of Parcel Map n11388 , Located in the Cahuilla Hills . Mr. Williams pointed out that this matter had been con- tinued from the meeting of May 11 , 1978 , in order for Staff to prepare more information relative to the Parcel Map . He reviewed the area in which the parcel lies , stating that the City ' s Zoning Ordinance can deal with future development there through the effective use of Conditional Use Permit procedures , parcel map procedures , and Design Review Board procedures . The present appli- cant is proposing no grading or cut and fill operations that would alter the natural contours of the land or result in a padding or staircase effect . Staff recommended that Council find that the Final Map is in conformance. Councilman Brush moved and Councilman Wilson seconded to approve the Parcel Map , n11388 , and authorized the City Clerk to certify and record. Motion carried unanimously with the memo sent . B. RESOLUTION NO. 78-69 - A RESOLTUION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING RESOLU- TION NO. 78-22 . Mr. Bouman stated that approximately 6 months ago , the Council had adopted Resolution No , 78-22 in which we agreed to have the County of Riverside administer some Federal Aif Off-System Funds for us . The agreement as set forth in the resolution was not worded exactly as the County wished it , and this resolution amended the wording. Councilman McPherson moved and Councilman Brush seconded to waive further reading and adopt Resolution No. 78-69 . Motion carried unanimously with the members present . B. CITY ATTORNEY Mr. Erwin stated that he had previously mentioned to Council that the State Retirement System needed a motion from them as to the amount of time he spent as City Attorney from the time of incorporation to the present , as well as com- pensation . Councilman McPherson moved and Councilman Wilson seconded that the City Council of the City of Palm Desert determines that from November 26 , 1973 , to June 30, 1974 , David J. Erwin spent approxi- mately 300 of his time in the position of City Attorney for the City of Palm Desert , and from July 1 , 1974 , through the present time , he spent approximately 250 of his time in said position of City Attorney. During that period of time , David J. Erwin received as compensation for general services the following sums : From November 21 , 1973 , to June 30, 1974 -, $1 , 000/month ; From July 1 , 1974 , to June 30, 1977 - $1 , 500/month; and From July 1 , 1977 , to the present - $1 , 650/month. Motion carried unanimously with the members present . C. MAYOR AND 14E!MBERS OF THE CITY COUNCIL Councilman Brush asked Staff for an update on the recon- struction of Monterey Road as he had received numerous calls from people who didn ' t understand why it had not been repaired by this time. Mr. Beebe responded that the plans and specifications are now in the hands of Caltrans and that it will take from two to four weeks for their approval and that of the Federal government . Then they will come back to us for legal notice and bids. D. Neighborhood and Public Facilities Requirement: Pursuant to the Sub- division Ordinance, the applicant is required to pay fees or dedicate land for neighborhood and public facilities. The proposed resolution recommends that the applicant be required to pay fees to meet this re- quirement. It is estimated that if the final map for this project were recorded today, the fee would be approximately $2,892. IV. DISCUSSION: The proposed tract involves a 49-lot subdivision on approxi- mately 9.5 gross acres. Thirty-nine of the lots are basically foot print lots of the units , the remaining 9 varying in size and shape and consider- ably larger in order to accomodate private swimming pools. Due to the shape of the project site, vehicular circulation will be limited to a street forty (40) feet in width that will form a one- way loop at the eastern portion of the site twenty (20) feet in width. The private street will form a "T"intersection with Portola, south of Santa Rosa Way. A twelve (12) foot wide emergency access road will extend from the one-way loop, southeasterly to the southeast corner of the property where it is proposed to tie in to the circulation system of the development to the south. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The com- putation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 .feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 08-77 is in accordance with the requirements prescribed by the Fire Marshal . The proposed resolution recommends that the applicant be required to pay fees to meet this re- quirement. It is estimated that if the final map for this project were recorded today, the fee would be approximately $2,892. ; IV. DISCUSSION: The proposed tract involves a 49-lot subdivision on approximately 10 gross acres. Thirty-nine of the lots are basically foot print lots of the units , the remaining 9 varying in size and shape and considerably larger in order to accomodate private swimming pools. Due to the shape of the project site, vehicular circulation will be limited to a street forty (40) feet in width that will form a one-way loop at the eastern portion of the site twenty (20) feet in width. The private street will form a "T" intersection with Portola, south of Santa Rosa Way. A twelve (12) foot wide emergency access road will extend from the one-way loop, southeasterly to the southeast corner of the property where it is proposed to tie in to the circulation system of the development to the south. The project area is located in an existing date grove with a number of. citrus trees also being located on the site. As a result of the date grove character, the site is part of a Natural Factor/Restricted Development Overlay Zone District. The applicant has indicated that the date grove character of the site will be preserved to the greatest extent possible. The applicant has developed a site plan which has overcome the design difficulties resulting from the shape of the site in that the proposed plan conforms to the requirements of the Zoning Ordinance with respect to setbacks, open space and parking. . Proposed recreationalGamenities include trio tennis courts and two swim- ming pools for common use.• In addition, a number of the proposed lots are large enough to accomodate private swimming pools. Staff is recommending `,the proposed tennis courts, if lighted, be recessed and that the applicant explore the possibility of heating the swimming pools with solar heating units. Other conditions of approval address walls required to achieve separation from adjacent developments, undergrounding of utilities and fencing around the pools. Staff is recommending also that a small mainte- nance structure be constructed for storage of maintenance equipment. TT 10202 WHEREAS, the Planning' Commission of the City of Palm Desert, California, did receive a verified application from Tirrie and Rimmer requesting approval of a 49-lot condominium subdivision on 9. 5 acres of land, located in the PR-5, N.. , Zone District and situated southeast of the intersection of Portola and Santa Rosa Way, and more particularly described as: APN 625-040-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7" , in that . and Environmental Assessment has been made, a Negative Declaration has been issued and the appeal period has expired; and, WHEREAS, .the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies ; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does comply with the adopted Palm Desert General Plan; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does substantially comply with the City of Palm Desert Code, and the State of California Subdivision Map Act, as amended. Full public improvements including traffic safety lighting on Portola shall be installed to City Standards as required by Ordinance and the City Engineer. 2. ' Access rights on Portola shall be offered to the City as a dedication. on the Final Map. 3. Prior to submittal of the Final Map, the applicant shall provide the. . City with a list of proposed street names with at least three alternatives.. The approval of the final street name shall be made by the Director of Environmental Services. 4. The development of the property described .herein shall be subject to . the restrictions and limitations set forth herein which are in .addition to all the requirements , limitations , and restrictions of all municipal ordinances and State and Federal statutes now in. force, or which here- after may be in force. 5. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and ,maintenance agreement to be entered into within the owners of .the units of the project. 6. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 7. The water system shall be signed by a registered civil engineer and ap- proved by the water company, with the following certification: "I certify that the design of the water system of Tract No. 10202 is in accordance with the requirements prescribed by the City Fire Marshal . " 8. Improvement plans for water and sewer system shall meet the requirements of the respective service districts. 9. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required for checking and approval , before construction of any improvements is com- menced. The subdivider shall submit the original drawings reviewed to reflect as-built conditions, prior to acceptance of the subdivision im- provements by the City or Special District. 11. All dedicated land and/or easements required by this approval shall be . granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 12. TT 10202, FRANZ TIRRIE AND RONALD: RIMM.ER, APPLICANT Request for approval .of a Tentative Tract Map for a 49-lot subdivision on approximately 9. 5 acres located at the southeast corner of .the inter- section of Portola Avenue and Santa Rosa Way, Mr. Williams reviewed the case pointing out the lots: vary in size from 22BI square feet to 4992 square feet. Further in compliance with Standard Condi- tion No. 13 the City' s Subdivision Ordinance. will. be met by paying a fee in , . an amount determined under the ordinance provisions. Also Special Condition No. 4 noted that the main street be widened out to 40' curb to curb in a 50' right-of-way. The area east of Lot No. 49 should be revised so that a secondary access would be provided to the subdivision as a part of the Re- vised Tentative Map as approved by the City Engineer. Further, the main street will be extended in accordance with the Revised Tentative Map. Mr. Cool: pointed out that Special Condition No. 5 is a carry over prior to the rewriting of Special Condition No. 4 and could be deleted. Mr. Williams indicated that Standard Condition No. 1 covers the sidewalks required on Portola. The staff recommends approval of Planning Commission Resolution No. 259 with the deletion of Special Condition No. 5. Chairman Berkey asked if ,there were any questions of Mr. Williams. Being none;: :the applicant was asked to speak. STEVE FLESHMAN, 74-133 E1 Paseo; Palm Desert; spoke to the Commission stating that the applicant had no specific objections but he would like to discuss the case. It was indicated that the project was designed to . be a private neighborhood and if the 40 foot streets are complied with it would add to the traffic in the area. Emergency access has been pro- vided as stated in the ordinance. Further making the streets 40' wide would burden the home owner in the project and there are already several through streets in the area. The applicant feels that making the street public would do away with the idea of family type neighborhood. Mr. Flesh- man Sndicated that if the ordinance states 32 feet and then the builder is not allowed to build 32 foot streets then the ordinance should be changed. Also, 20 feet is provided in front of each driveway and parking is available on the street plus there are 25 parking spaces in bays throughout the complex. The intent of the project was to have no parking on the streets. Chairman Berkey asked if there were any questions by the Commissioners. He then asked about the emergency access and if the required was not widened. Mr. Fleshman stated he had no objection to the emergency access only to the widening of the street. He noted that if this development is tied into other projects it would cause further traffic problems. Chairman Berkey asked if there was anyone present wishing to speak in FAVOR of of in OPPOSITION to the project. Being no one, he closed the Public Hearing and asked if there were any questions by the Commissioners. Chairman Berkey asked if this was being required as a public street and the necessity for it. TT 10202 (Continued) Mr. Cool: spoke to the Commission indicated that there is one area in town that has private streets and is now, due to the cost of, maintaining the streets , asking the Council to make the streets public. Mr. Cook emphasized that pri: vate streets are not able to take advantage of the gas tax for maintenance costs. Also, it is not the intent to extend the street through to Deep Canyon t :but to create an access to the area for police, or to create a second way .out of the development. . Chairman Berkey questioned the loop road. Mr. Cook stated that it would tie in to the street with-land to the east and would be a segment of a local residential street pattern. Chairman Berkey asked if there was a connection with Goleta? Mr. Cook indicated that it did not connect with. Goleta. Commissioner Kryder pointed out that if it i:s. intended or emergency use,. why is it necessary to continue the 40' width all the way through. Mr. Cool: verified that it would be a continuation of the street pattern as it is. Commissioner Kryder then noted that if made into a 40' loop it would eliminate a couple of homes. Mr. Cook confirmed that it would. Commissioner Kryder questioned the necessity for this. Mr: Cook explained that it creates another exit for the residents and an access road for police making their appointed rounds , allowing them a different route. Commissioner Kelly asked if this would not also be access for fire equipment. Mr. Cook confirmed this: as being so. Commissioner Kryder asked if the widening of the existing or proposed 12 foot road would not serve for the purpose required. Mr. Cook pointed out the way it is shown now it would encourage the people 'coming from the east to come out this way and this should be avoided. Chairman Berkey asked if a .crash gate would go up. Mr. Cook indicated not if it is a public street. He also noted that crash gates are difficult for the police to get through. Commissioner Reading commented that if this was a private street and several years later it was dedicated to the City wouldn't it have to meet certain re- quirements? Mr. Cook stated that would depend on the City Council . Chairman Berkey asked if there were any further questions. Mr. Fleshman talked in reference to Commissioner Kryder's question and noted that the applicant does not want the street widened. Commissioner Kryder stated that he was aginst the widening. Mr. Fleshman continued by noting that the property to the east is zoned the same as this parcel and if this street is made public the developer of the property to the east may not agree with the street being public. Mr. Williams pointed out that access has to .go to the east or the north some where around Lot No. 45. Mr. Cook feels the whole area should be looked into. 'Chairman Berkey asked Mr. Williams to address himself to Mr. Fleshman 's state ment about the road going through the property to the east and commenting it to being a public street. Mr. Williams indicated that there has to be a road through to the east as it has been in the plans for the last three years.. Chairman Berkey asked what would happen to the property to the east if they wanted a private condominium. Mr. Williams indicated that they Mould have to more it to one of the edges also Catalina was designed as a public street but it has remained private. Mr. Cook indicated that it had been dedicated. Commissioner Snyder noted that if there were other public streets why this one in question had to be a public street. Mr. Williams pointed out that a secondary connection is needed -for this sub- division for fire access. Commissioner Shyder pointed out that cases covered earlier have had private. streets and now this case has to have dedicated streets. Mr. Cook then noted that the other parcels being larger had better internal circulation with better access, but being that this is a narrow parcel suffi- cient access is. more difficult to achieve. Chairman Berkey pointed out that several streets including Catalina , Avenue 44, . and Goleta provided traffic circulation. Mr. Cool: noted that this is not needed for access from Deep Canyon to Portola, but is strictly for internal traffic problems. Chairman Berkey indicated that the real need for this street should be pointed out at this time from a public standpoint. Mr. Cool, pointed out that this is a 13,000 foot cul-de-sac which is not a good thing and you need access on the other end. . ChairmanT erkey stated that there is one provided and it is a private street with al2' wide street leaving to the south. Mr. Fleshman then pointed out some facts about the previous case which was settled with a 20 foot wide emergency with a crasli gate. Mr. Williams indicated there was no crash gate. Mr. Fleshman then asked if the Commission would like the crash gate removed and keep the road at 20 feet. lie then pointed out that their only concern was that it remain a private neighborhood . De then ,asked if Condition No. 4 could be reworded and then iron out the problem at staff level . Chairman Berkey pointed out that if it was not resolved at this time it would have to be. continued. Mr. Williams indicated that there were sidewalk on both sides: Further the. issue before the board is whether the street shou•ldVe offered for public. Chairman Berkey asked if there were any further questions before the Public Hearing is closed. The Public Nearing was declared closed and Chairman Berkey asked for the pleasure of the Commission. , Chairman Berkey asked for a motion. Commissioner Reading moved that sentence . 1 of Special Condition No. 4 be deleted and Special Condition No. 5 be deleted, motion was seconded by Commissioner Kryder; motion carried (4-1 ) , with the follow- ing vote: AYES: KRYDER, SNYDER, BERKEY, READING NOES: KELLY Chairman Berkey noted that Commissioner Kelly voted no as she voted no .on the Development Plan and gave the same reasons for this vote. H. CASE NO. TT 10428, GEORGE GRAZIADIO, APPLICANT. Request for consideration of a Tentative -Tract for a 49-lot subdivision on approximately 9. 5 acres located at the southeast corner of the inter- section of Portola Avenue and Santa Rosa Way. Mr. Williams explained that this is a request for a Tentative Map for a 20-lot subdivision on property presently zoned PR-3 a matter discussed earlier for rezoning to R-1 ,10,000. Chairman Berkey questioned whether this case should be continued since the Development Plan was continued. Mr. Williams pointed out that this must be by the consent of the applicant to continue or the Commission must act on a Tentative Tract within 50 days of receipt. Chairman Berkey asked if the applicant would give his •consent. Mr. Ricciardi gave his consent. Chairman Berkey noted a motion by Commissioner- Snyder to continue the case to August 2nd, the motion was seconded by Commissioner Reading; motion unanimously carried (5-0). VII. OLD BUSINESS Mr. Williams pointed out that a review of the Plaster Calendar for the College of the Desert Specific Plan had been submitted for review. It was noted that as a result of comments made at Study Session , the calendar should be reviewed and up- dated and brought back to the next Study Session on July 20th. Mr. Williams asked the Chairman to verify that he had reopened the Public Hearing and continued the hearing to August 2nd. Chairman Berkey confirmed Mr. Williams assumption. C SE 110. TT 10202, FRANZ IRRIE AND RONALD RIMMER, APPLICANT quest for approval of a Tentative Tract Map for a 49-lot subdivision on approximately 9. 5 acres located at the southeast corner of the inter- . section of Portola Avenue and Santa Rosa Way. Mr. Williams reviewed the case pointing out the lots vary in size from 2281 square feet to 4992 square feet. Further in compliance with Standard Condi- tion No. 13 the City' s Subdivision Ordinance will be met by paying a fee in an amount determined under the ordinance provisions. Also Special Condition No. 4 noted .that the main street be widened out to 40' curb to curb in a 50' right-of-way. The area east of Lot No. 49 should be revised so that a secondary access would be provided to the subdivision as a part of the Re- vised Tentative Map as approved by the City Engineer. Further, the main street will be extended in accordance with the Revised. Tentative Map. Mr. Cook pointed out that Special Condition No. 5 is a carry over prior to the rewriting of Special Condition No. 4 and could be deleted. Mr. Williams indicated that Standard Condition No. 1 covers the sidewalks required on Portola. The staff recommends approval of Planning Commission Resolution No. 259 with the deletion of Special Condition No. 5. Chairman Berkey asked if there were any questions of Mr. Williams. Being none, the applicant was asked to speak. SIEVE FLESHMAN, 74-133 E1 Paseo, Palm Desert, spoke to the Commission stating that the applicant had no specific objections but he would like to discuss the case. It was indicated that the project was designed, to be a private neighborhood and if the 40 foot streets are complied with it would add to the traffic in the area. Emergency access has been pro- vided as stated in the ordinance. Further making the. streets 40 ' wide would burden the home owner in the project and there are already several through streets in the area. The applicant feels that making the street public would do away with the idea of family type neighborhood. Mr. Flesh- man indicated that if the ordinance states 32 feet and then the builder is not allowed to build 32 foot streets then the ordinance should be changed. Also, 20 feet is provided in front of each driveway and parking is available on the street plus there are 25 parking spaces in bays throughout the complex. The intent of the project was to have no parking on the streets . Chairman Berkey asked if there were any questions by the Commissioners. He then asked about the emergency access and if the required was not widened. Mr. Fleshman stated he had no objection to the emergency access only to the widening of the street. He noted that if this development is tied into other projects it would cause further traffic problems. Chairman Berkey asked if there was anyone present wishing to speak in FAVOR of of in OPPOSITION to the project. Being no one, he closed the Public Hearing and asked if there were any questions by the Commissioners. Chairman Berkey asked if this was being required as a public street and the necessity for it. TT 10202 (Continued) Mr. Cook spoke to the Commission indicated that there is one area in town that has private streets and is now, due to the cost of maintaining the streets , asking the Council to make the streets public. .Mr. Cook emphasized that pri- vate streets are not able to take advantage of the gas tax for maintenance costs. Also, it is not the intent to extend the street through to Deep Canyon but to create an access to the area for police, or to create a second way out of the development. Chairman Berkey questioned the loop road. Mr. Cook stated that it would tie in to the street with land to the east and would be a segment of a local residential street pattern. Chairman Berkey asked if there was a connection with Goleta? Mr. Cook indicated that it did not connect with Goleta. Commissioner Kryder pointed out that if it is intended or emergency use, why is it necessary to continue the 40' width all the way through. Mr. Cook verified that it would be a continuation of the street pattern as it is. Commissioner Kryder then noted that if made into a 40' loop it would eliminate a couple of homes. Mr. Cook confirmed that -it would. Commissioner Kryder questioned the necessity for this. , Mr. Cook explained that it creates another exit for the residents and an access road for police making their appointed rounds, allowing them a different route. Commissioner Kelly asked if this would not also be access for fire equipment. Mr. Cook confirmed this as being so. Commissioner Kryder asked if the widening of .the existing or proposed 12 foot road would not serve for the purpose required. Mr. Cool, pointed out the way it is shown now it would encourage the people coming from the east to come out this way and this should be avoided. Chairman Berkey asked if a crash gate would go up. Mr. Cook indicated not if it is a public street. He also noted that crash gates are difficult for the police to get through. Commissioner Reading commented that if this was a private street and several years later it was dedicated to the City wouldn' t it have to meet certain re- quirements? Mr. Cool: stated that would depend on the City Council . Chairman Berkey asked if there were any further questions. Mr. Fleshman talked in reference to Commissioner Kryder's question and noted that the applicant does not want the street widened. Commissioner Kryder stated that he was aginst the widening. Mr. Fleshman continued by noting that the property to the east is zoned the same as this parcel and if this street is made public the developer of the property to the east may not agree with the street being public. The applicant is trying to create a 48 unit neighborhood and will comply with the widening of the road if the Commission insists , but the applicant cannot agree with having the road go straight through. TT 10202 (Continued) Chairman Berkey questioned whether or not Special Condition No. 4 should ; be deleted. Mr. Williams pointed out that access has to go .to the east or the north some where around Lot No. 45. Mr. Cook feels the whole area should be looked into. Chairman Berkey asked Mr. Williams to address himself to Mr. Fleshman 's state- ment about the road going through the property to the east and commenting it to being a public street. Mr. Williams indicated that there has to be a road -through to the east as it has been in the plans for the last three years. Chairman Berkey asked what would happen to the property to the east if they wanted a private condominium. Mr. Williams indicated that they would have to move it to one of the edges , also Catalina was designed as a public street but it has remained private. Mr. Cook indicated that it had been dedicated. Commissioner Snyder noted that if there were other public streets why this one in question had to be a public street. Mr. Williams pointed out that a secondary connection is needed for this sub- division for fire access. Commissioner Snyder pointed out that cases covered earlier have had private streets and now this case has to have dedicated streets. Mr. Cook then noted that the other parcels being larger had better internal circulation with better access, but being that this is a narrow parcel suffi- cient access is more difficult to achieve. Chairman Berkey pointed out that several streets including Catalina, Avenue 44, and Goleta provided traffic circulation. Mr. . Cool; noted that this is not needed for access from Deep Canyon to Portola, but is strictly for internal traffic problems. Chairman Berkey indicated that the real need for this street should be pointed out at this time from a public standpoint. Mr. Cook pointed out that this is a 13,000 foot cul-de-sac which is not a good thing and you need access on the other- end. y Chairman Berkey stated that there is one provided and it is a private street with a12 ' wide street leaving to the south. Mr. Fleshman then pointed out some facts about the previous case which was settled with a 20 foot wide emergency with a crash gate. Mr. Williams indicated there was no crash gate. Mr. Fleshman then asked if the Commission would like the crash gate removed and keep the road at 20 feet. He then pointed out that their only concern was that it remain a private neighborhood . lie then asked if Condition No. 4 could be reworded and then iron out the problem at staff level . Chairman Berkey pointed out that if it was not resolved at this time it would have to be continued. Mr. Williams pointed out that the applicant and the City Engineer had agreed , that the streets would be curb to curb 40' and 50' : Mr. Fleshman stated if the streets are private they don 't need to be 50' . Mr. Williams indicated that there were sidewalks on both sides. Further the issue before the board is whether the street should be offered for public. Chairman Berkey asked if there were any further questions before the Public Hearing is closed. The Public Hearing was declared closed and Chairman Berkey asked for the pleasure of the Commission. : Chairman Berkey asked for a motion. Commissioner Reading moved that sentence I of Special Condition No. 4 be deleted and Special Condition No. 5 be deleted, motion was seconded by Commissioner Kryder; motion carried (4-1 ) , with the follow- ing vote: AYES: KRYDER, SNYDER, BERKEY, READING NOES: KELLY Chairman Berkey noted that Commissioner Kelly voted no as she voted no on the Development Plan and gave the same reasons for this vote.- H. CASE NO. TT 10428, GEORGE GRAZIADIO, APPLICANT Request for consideration of a Tentative Tract for a 49-lot subdivision' on approximately 9. 5 acres located at the southeast corner of the inter- section of Portola Avenue and Santa Rosa Way. Mr. Williams explained that this is a request for a Tentative Map for a 20-lot subdivision on property presently zoned PR-3 a matter discussed earlier for rezoning to, R-1 ,10,000. Chairman Berkey questioned whether this case should be continued since the Development Plan was continued. Mr. Williams pointed out that this must be by the consent of the applicant to continue or the Commission must act on a Tentative Tract within 50 days of receipt. Chairman Berkey asked if the applicant would give his consent. Mr. Ricciardi gave his consent. Chairman Berkey noted a motion by Commissioner Snyder to continue the case to August 2nd, the motion was seconded by Commissioner Reading; motion unanimously carried (5-0) .. VII . OLD BUSINESS Mr. Williams pointed out that a review of the Master Calendar for the College of the Desert Specific Plan had been submitted for review. It was noted that as a result of comments made at Study Session, the calendar should be reviewed and up- dated and brought back to the next Study Session on July 20th. Proposed Lots : Proposed lots vary in size from as small as 2,281 square feet to as large as approximately 4,992 square feet which includes the proposed units, garages & private patios. Thirty-nine of the lots are basically foot print lots of the units , the remaining 9 varying in size and shape and considerably larger in order to accomodate private swimming pools. C. Proposed Streets: The onlv proposed interior street is to be forty ( 40 ) feet in width until it reaches the Eastern portion of the project where it splits to form a one-way loop twenty (20) feet in width. D. Neighborhood and Public Facilities Requirement: Pursuant to the Sub- division Ordinance, the applicant is required to pay fees or dedicate land for neighborhood and public facilities. The proposed resolution recommends that the applicant be required to pay fees to meet this re- quirement. It is estimated that if the final map for this project were recorded today, the fee would be approximately $2,892. IV. DISCUSSION: The proposed tract involves a 49-lot subdivision on approxi- mately 9. 5 gross acres. Thirty-nine of the lots are basically foot print lots of the units , the remaining 9 varying in size and shape and consider- ably larger in order to accomodate private swimming pools. Due to the shape of the project site, vehicular circulation will be limited to a street forty (40) feet in width that will form a one- way loop at the eastern portion of the site twenty (20) feet in width. The private street will form a "T"intersection with Portola, south of Santa Rosa Way. A twelve (12) foot wide emergency access road will extend from the one-way loop, southeasterly to the southeast corner of the property where it is proposed to tie in to the circulation system of the development to the south. l Case No. :.. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The com- putation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 .feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. . 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 08-77 is in accordance with the requirements prescribed by the Fire Marshal .
