I. REQUEST: Request for approval of a Tentative Tract for a 20-lot sub-
division on approximately 5.2 acres of land located northerly of and ad-
jacent to Haystack Road, approximately 600 feet westerly of the inter-
section of Haystack Road and Portola Avenue - PR-3 Zone District.
II . STAFF RECOMMENDATION: Deny the request by Planning Commission Resolution
No.
Justification:
1 . .Tentative Tract Map 10428 does not contain information required
under Sections 26.5-4.02, .04, .06, .20, and .27 of the City of
Palm Desert Subdivision Ordinance.
2. The design or improvement of the proposed subdivision is not con-
sistent with applicable General and Specific Plans.
3. The site is not physically suitable for the type of development
proposed.
4. The site is not physically suitable for the proposed density of
development.
III . BACKGROUND:
A. Location: Northerly of and adjacent to Haystack Road, approximately
600 feet westerly of the intersection of Haystack Road and Portola
Avenue.
B. Size: Approximately 5.2 acres
C. No. of Units: 20
D., Density: 3.84 dwelling units per acre
E. Type of Units: Single family detached
F. EIR Finding: A Negative Declaration was issued and filed on June
27, 1977 and the appeal period has expired.
G. Existing Zoning: PR-3
H. General Plan: Low Density Residential (3-5 dwelling units per acre)
I. Proposed Lots : Nineteen lots will be 92'x118' and the lot adjacent
to the Deep Canyon Stormwater Channel , Lot 20, will be considerably
larger.
IV. DISCUSSION:
Approval' of this case is contingent upon approval of the related change of
zone request, Case No. CZ 07-77. Approval of Case No. CZ 07-77 would change
the zone on the subject property from PR-3 to R-1 , 10,000 thereby making it
possible to subdivide the property in the manner proposed. The proposed tract
involves 20, R-1 , 10,000 lots, each having approximately 10,800 square feet,
except for Lot 20 which is irregularly shaped and considerably larger due to
its location adjacent to the storm channel .

The subject property is located in an area that is highly flood prone.
Staff believes the PR-3 zoning, which would permit clustered development,
would have much more flexibility in confronting the runoff and drainage
problems associated with the site than the .R-1 , 10,000 zoning which involves
a lot configuration more susceptible to flood damage. The lot configuration
for a tract in a PR-3 zone would also more easily mitigate, any possible
adverse impacts in the area of aesthetics than the lot configuration dic-
tated by the R-1 , 10,000 zone. The preservation of scenic views must be
considered with regard to any proposed development along Haystack.
Aside from lot. configuration, staff noted. a number of informational defi-
ciencies with regard to the tract map, itself. Examination of county records
at City Hall indicate the ommission of a portion of the subject site from
the tract map. It goes without saying that maps for any proposed land-
division must include the entire parcel which is being subdivided. Other
deficiencies are pointed out in the justification section with appropriate
references with regard to specific requirements of the Subdivision Ordi-
nance unmet.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL, DENIAL OF A TENTATIVE
MAP TO ALLOW FOR DEVELOPMENT OF A 20-LOT SINGLE-FAMILY
SUBDIVISION ON 5.2 ACRES OF LAND, GENERALLY LOCATED
NORTHERLY OF AND ADJACENT TO HAYSTACK ROAD, APPROXIMATELY
600 FEET WESTERLY OF THE INTERSECTION OF HAYSTACK ROAD
AND PORTOLA AVENUE. CASE NO. TT .10428
WHEREAS, the Planning Commission of the City of Palm Desert, did receive
a verified application from GEORGE GRAZIADIO, requesting approval of a Tentative
Tract for 20 single family residences on 5.2 acres of land, located in the R-1 ,
10,000 zone and situated northerly of and adjacent to Haystack Road, approximately
600 feet westerly of the intersection of Haystack Road and Portola Avenue, more
particularly described as :

WHEREAS, said application had complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-7" , in that
a Negative Declaration was made by the Director of Environmental Services on
June 27, 1977, and the appeal period has expired, and;
WHEREAS, the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies and;
WHEREAS, the Planning Commission did find that the subject Tentative Map
as submitted, and the reports of the various. reviewing agencies and;
WHEREAS, the Planning Commission did find that the subject Tentative Map
does not substantially comply with the City of Palm Desert Code (County Ordinance
Number 460) , and the State of California Subdivision Map Act, as amended;
WHEREAS, the Planning Commission did find that the subject Tentative Map
does not comply with. the adopted General Plan, and;
NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows : 1 ) that the above recitations are true and correct and
constitute the findings of the commission in this case; 2) that it does hereby
recommend denial to the City Council of the City of Palm Desert of the above de-
scribed Tentative Map No. 10428.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning
Commission held on the day of 1977 by the following vote,

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved by the California Public utilities Commission.
The developer will be required to deposit the full cost of these facili-
ties under certain conditions as outlined in the above nentioned tariffs.
These facilities will he underFTolnd unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the asihetic �
impact of trenching and cannot co:.^_nent on this subject except to state
that the distribution facilities •,rill to placed in a joint trench with
other utilities wherever possible.

This letter is not to be interpreted as a contractual co mitment to
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of. gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a .particular project. If you desire further

RE: Tentative Tract No. 10428
Provide the following fire protection in accordance:
1 . Install a water system capable of delivering 1500 GPM, fire flow from
any fire hydrant for a two hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operat-
ing pressure in the supply main from which the flow is measured at the
time of measurement.
2. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction..
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to recordation of the final map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
4. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify that the design of the water system in Tract No. 10428
is in accordance with the requirements prescribed by the Fire Marshal . "
Upon approval , the original plan will be returned to the developer.

Dear Ms. Gilligan:
This office is legal counsel for Messers. Ellis Jacobs
and Philip Sussman who are recipients of the Notice of
the Public Hearing to be held before the Palm Desert
City Council on Thursday, August 25, 1977 at 7:00 p.m.
Our clients are the joint owners of those certain
condominimum premises located in the Marrakesh Country
Club having an address of 47404 Marrakesh Drive, Palm
Desert, California. Those premises are located im-
mediately across the fence from the proposed new sub-
division.
Our clients have asked that our office correspond with
you and that our letter be presented at the time of
the hearing before the City Council seeking to have
the decision of the City Council postponed until such
time as our clients, and the other adjacent owners of
existing town house and condominimum units can be given
the opportunity to more fully study and determine whether
the proposed sub-division will adversely affect their
property interests within the city. In particular our
clients are distressed over the fact that this matter is
coming before the Council in the "off season" when most
or all -of the adjacent property owners are absent from
their property because of the extreme weather conditions
in Palm Desert during the summer. If a delay in the
decision of the council could be postponed until such
time as the property owners in the Country Club are
given a fair opportunity to reach a determination as
to whether their ownership interest will be affected
by the action requested by the developer on behalf of
the council, the interest of all parties would then be
properly placed before the council.

In this regard, it is suggested that the decision in regard
to granting the requested approval be delayed until November
or December of 1977 at which time, our clients would be in
a position to either make a presentation of any objections
they might have or seek to urge approval. In the interest
of justice and fairness to those which have invested sub-
stantial sums within the City limits of Palm Desert, it
is urged that this recommendation be accepted. Thank you.

At the August 2, 1977 Planning Commission Meeting, the Commission concurred
with the Staff' s opinion that the change of zone from PR-3 to R-1 10,000
ought to be denied, resulting in an almost automatic denial of the tentative
tract which must conform with the present PR-3 zoning.
The Commission believed the applicant had shown no cause for a change of zone
and. agreed with staff that the PR-3 zoning would offer more flexibility in
dealing with any possible adverse impacts.

I. REQUEST:
A change of zone from PR-3 (Planned Residential-Maximum of Three Dwelling
Units to the Gross Acre) Zone District to R-1-10,000 (Single-Family Resi-
dential-10,000 Square Foot Lots Minimum) on approximately 5.2 acres of
land located northerly of and adjacent to Haystack Road approximately
600 feet westerly of the intersection of Haystack Road and Portola Avenue.
II . HISTORY:
This matter was continued from the Planning Commission meeting of July 5, 1977
to allow the Commission to weigh all the input received on this request. Since
that meeting a number of letters in opposition (see attached) have been submitted.
III, STAFF RECOMMENDATION:
Deny the change of zone request. by Planning Commission Resolution No. 266.
Justification is based upon the following:
1 . Request is not consistent with the objectives of the Zoning Ordinance
in that:
a. Proposed zone would not foster a harmonious workable relationship
with the land uses adjacent to the property being considered
on the basis that the development as R-1 lots would not be com-
patible to the existing development to the north, possible develop-
ment of property to the west, the potential public park site to
the east, or the traffic on Haystack Road.
b. Development of the proposed property under the existing zoning
would seem to be the most appropriate and most beneficial to the
City as a whole.
c. The requested zoning would increase the density which does not
appear appropriate for the size, shape, and configuration of the
property under consideration.
d. Increased density on the property in question does not appear con-
sistent with sound standards of public health and safety from the
standpoint of the property being located adjacent to a major traffic
carrier.
e. The proposed zoning would not appear to provide for adequate privacy
and open space for the ultimate dwellings on the property.
f. The proposed re-zoning would increase traffic congestion in the area.
The proposed re-zoning would result in an increase in hazards and
noise congestion for the ultimate residents.
g. The proposed re-zoning would result in an increase in noise, odors;
dust, dirt, and other objectionable influences on the ultimate
occupants of dwellings on the property.
h. The proposed re-zoning would not encourage superior site planning
and environmental design.
2. The City, in developing the Zoning Map, reviewed this property specifi-
cally. In light of its unique shape and relationship to a major street,
it was felt that an R-1 designation would not allow for the necessary
site design and mitigation measures to ,make the property conducive to
development which would be compatible with these constraints and still
provide for an adequate living environment for the ultimate occupants.
Therefore, the existing zoning of Planned Residential was applied to the
property on the basis that it does provide for flexibility to allow

an R-1-20,000, or an R-1-43,560 appropriate for the property. In some
minds the answer may be affirmative for one of these other less dense
R-1 type zones. However, in close review of the problems that relate to
this property and its placement in the neighborhood, it would appear that
even an R-1-43,560 square foot lot would not be an appropriate vehicle
for development of the property in question for the following reasons:
a. Physical characteristics of the property and particularly its narrow-
ness which would not allow for sufficient size house to relate to a
one acre size lot.
b. An R-1 designation does not provide sufficient flexibility to allow
for the appropriate development of the property .in question.
The alternative that ought to be seriously considered by the Planning
Commission is the potential designation of the property in question as
Open Space. The intent of the General Plan-Land Use Designation of ranges
of densities is to provide for development that is compatible to the
existing conditions in the neighborhoods. A range epitomizes the potential
of three, four, five, or even higher densities in some areas being offset
by lower densities in other areas. The outcome of such an approach is a
mix of housing that falls within the range specified in the General Plan
and meets the other concepts expressed in the housing element and scenic
highways, design elements, etc. Due to the location and physical problems
of the property, it may be appropriate to consider it as potential open
space or -0- density.

development and yet mitigate the constraints that relate to the physical
configurations of the property.
3. The density designation of three units to the gross acre which exists
on property at this time may have been misconstrued by the applicant.
The intent of the existing zoning was to encourage development of the
property in question with the larger parcel to the west to allow for
an overall development of all the property on the north side of Hay-
stack Road and a uniform overall project taking into consideration the '
unique characteristics of the property in question. As a result of
the overall design, the property in question could have been developed
as a major open space element of the overall project or fewer units
than the zone designation would indicate. Such development would
better uniform to the physical limitations of the subject property.
4. Given the physical characteristics of the property in question its
relationship to existing development and potential development in the
area, little justification appears to exist to increase the density as
requested by the applicant through the re-zoning.
IV. BACKGROUND:
A. Property Size: 5.2 acres
B. Existing Zoning: PR-3
C. Existing Zoning in the Area: North - PR-3
South - R-1-10,000
East - Open Space
West - PR-3
D. Environmental Considerations : This project has been reviewed by the
staff and a Negative Declaration has been issued determining that said
project will not create a significant impact on the environment. The
appeal period expires on July 5, 1977.
V. DISCUSSION OF ISSUES:
By the applicant's re-zoning request, he is in essence asking to develop
the property in question as a standard R-1 subdivision, which from a design
standpoint is not considered the appropriate. The Planning Commission must
wrestle as a part of the consideration of this request with the issue of
whether there are other better alternative methods of developing this pro-
perty versus the applicant's concept of a standard R-1 subdivision.
The staff believes that it will be the applicant's contention that the pro-
posed re-zoning will result in development along the subject property that
is in conformance with existing development along the south side of Haystack.
Said development is known as the Portola Estates which is presently being
completed. Said project while it has many amenities which make it an over-
all acceptable project, is a classic example of what should not be done with
the subject property. The result of the re-zoning would be as reflected
on the related Tentative Tract Map, individual lots, 92 foot wide, extending
along Haystack Road. Under the Ordinance requirements of the City, said
property would have to drain to Haystack which would require the individual
pads to be raised to higher than 1% of the crown of the street. The result
would be in staff's estimation an inappropriate development of the property
in question. This situation is vastly different than the Portola Estates
project which is on the uphill side of Haystack Road and which allowed for
grading to more closely conform to the existing terrain. Further, the re-
lationship of the property in question to the existing development to the
north, the Marrakesh project, and the natural slope to the northeast would
not appear to make this property conducive to a standard subdivision design
unless easements to drain through the Marrakesh project could be obtained.
The final concern that must be weighed by the Commission is whether other
alternative zones exist to apply to the property in question. In other
words, if an R-1-10,000 request is not appropriate, is an R-1-15,000, or

Provide the following fire protection in accordance:
1 . Install a water system capable of delivering 1500 GPM fire flow from
any fire hydrant for a two hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operat-
ing pressure in the supply main from which the flow is measured at the
time of measurement.
2.. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to recordation of the final map, the developer shall furnish the
orioinal and three (3) copies of the water system plan to the Fire
Marshal for review.
4. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify that the design of the water system in Tract No. 10428

intent is to notify you that the Southern California Gas Company has
facilities in the araa where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in

The General Telephone Company will pro-ride the telephone distribution
facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved by the California Public utilities Commission.
The developer will be required to deposit the full cost of these facili-
ties tinder certain conditions as outlined in the above mentioned tariffs.
These facilities will he underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the asthetic
-impact of trenching and cannot cor._ ent on this subject except to state
that the distribution facilities wilt be placed in a joint trench with

Gentlemen:
Please be advised that we, the undersigned, are opposed
to a zone change for the property located south of
Marrakesh Development and fronting on Haystack Road.
It is our feeling that it will cause additional speed
and traffic conditions that are hazardous and annoying
to present residents of Haystack. In addition, we are
concerned about further loss of view to the north.
Contrary to statements by the traffic expert at the July
5 , 1977, Planning Commission meeting, further development
will not automatically slow traffic. Examples to support
this are Fairway Drive , Avenue 44, and Grapevine, where
speed is not controlled by posted limits or residential
development on both sides of the streets.
Is there ANY possibility that "bumps" such as are in
Silver Spur, could be installed at perhaps three intervals
along the course of Haystack Road, if such installation is
supported by property owners ?

Gentlemen:
This is to inform you that we, the undersigned, are opposed to a
zone change for the property located South of Marrakesh Country Club
and fronting on haystack Road. We do not support the proposed project
because it increases the housing density and will aggravate the traf-
fic, drainage and flooding problems already existent on Haystack Road.
Additionally, we do not support elevating the lot pads creating a fur-
ther loss of view and flooding problems for existing housing located
on the southside of Haystack Road. Also, we do not support housing
that is substantially lesser in value and quality than the existing
homes on Haystack Road. We were unable to attend the public hearing
concerning this matter held on July 5, 1977, but we can assure you we
will be present when the matter is considered again on August 2, 1977.
It is our understanding that a traffic expert advised the Planning
Commission during the July 5, 1977, meeting that further development
would automatically slow traffic on Haystack Road. We are glad someone,
and we hope it is the City of Palm Desert, that is finally acknowledging
the traffic and speed problem that has existed on Haystack Road for se-
veral years. We expressed our concern to the City of Palm Desert sever-
al years ago about this problem and after many months, a crosswalk was
finally installed at Moon Lane and Haystack Road for school children and
a 40 MPH speed limit was posted. When Haystack Road was resurfaced, the
crosswalk was never replaced. Additionally, the flood destroyed several
40 MPII signs and the crosswalk signs, which have not been replaced.

Further, development along Haystack Road will not slow traffic, it
will crate more traffic. haystack Road is rarely patrolled and it is
an every day occurrence to observe cars traveling 60 to 70 miles per
hour any time during the day. More residents means more cars, more peo-
ple and more children living on an already hazardous street increasing
,the likelyhood of a serious accident.
We would like to suggest that stop signs be placed on Haystack Road,
at Moon Lane, Marlbouro ,Street, and Alamo Drive, that the speed limit be
reduced to 30 miles per hour and that the Sheriff spend more time patrol-
ing Haystack Road.

Marrakesh Development immediately north of Haystack Road. That we
support the Planning Cormission's position regarding the application for
this self same property.
We strongly feel it would result in a speed and traffic condition, not only
annoying to present residents but would more importantly result in extremely
hazardous traffic conditions. We do not believe that the statement made
by the traffic expert at the meeting would hold water, e. g. Fairway Drive,
Grapevine, Avenue 44, etc. It's well known that speed is not well controlled
by residential development there despite posted limits.
In as much as we in good faith purchased our present home, one element
of which was that it had "a view" as described by the licensed builder
(Portola Homes, George Holstein, President).
We thank you for your consideration and are hopeful you will stand firm in
our discussion to protect our environment.

Commissioner Kryder noted that the fire control issue is very important and
questioned again how it can be resolved.
Mr. Bouman pointed out that the problem already exists and that the project
in question could enhance the problem. Further, the Riverside County Fire
Department report shows this problem is top of the list.
Mr. Cipriani stated that the Fire Marshal 's memorandum had not been retracted.
as far as he was aware.
Commissioner Snyder questioned the applicant as to whether he is ready to
comply with the four conditions the Fire Marshal had requested be added to
the list of conditions of approval in the event that the Commission decided
to proceed with the project and requested that the four conditions be added
to the special conditions of approval .
Mr. Shayler indicated that the applicant would comply and that any further
delay of the case would be a hardship on the developer.
The Commission agreed that since the two issues have been brought to the
attention of the City Council , they would not be shirking their duties.
Chairman Berkey covered the conditions with Mr. Cipriani noting the changes
to Standarrd Conditions No. 2 and 18, the deletion of Standard Conditions No. 6, 12,
14, and 16, the changes to Special Conditions No. 2, 5, and 8 and the addition of the
Fire Marshal ' s conditions and the City Engineer's conditions. A motion was made by
Commissioner Snyder, seconded by Commissioner Kryder to approve Planning Commission
Resolution No. 265 with the conditions as stated; carried unanimously (3-0).
B. CASE NO. C/Z 07-77, GEORGE GRAZIADIO, APPLICANT
Request for a change of zone from PR-3 (Planned Residential-Maximum of
Three Dwelling Units to the Gross Acre) Zone District to R-1 10,000
(Single-Family Residential-10,000 Square Foot Lots Minimum) on approxi-
mately 5.2 acres of land located northerly of and adjacent to Haystack
Road approximately 600 feet westerly of the intersection of Haystack Road
and Portola Avenue.
Mr. Cipriani reviewed the case stating that the matter was continued from the
Planning Commission meeting of July 5, 1977 so that the Commission could weigh
all the input received on this request and since that meeting a number of letters
in opposition had been received. Further staff has not received any additional
information which would cause a change in the staff's position regarding this
case and staff still feels the PR zone offers more flexibility than the R-1 with
regard to mitigating possible adverse impacts relative to traffic, drainage,
scenic view preservation, etc. In conclusion, staff is still recommending
denial for the reasons stated in the Staff Report under Section III and also
the proposed rezoning would not encourage superior site-planning and environ-
mental design.
There being no questions from the Commissioners at this time, Chairman Berkey
declared the Public Hearing open.
ROBERT A. RICCIARDI , 73-700 Highway, 111 , Palm Desert, (representing the
- applicant) spoke to the Commission and reiterated his statements given
at the last public hearing on this case and noted a letter from Marrakesh
(Exhibit A) . He also noted that with a R-1 zone each property owner would
be responsible for his area, with PR zone all owners would be responsible
for all common areas.
Chairman Berkey asked if there was anyone present who would like to speak in
FAVOR of the project. Being no one, he then asked if there was anyone wishing to
speak in OPPOSITION to the project. Being no one he declared the public hearing
closed and asked for a motion. Commissioner Kryder moved, Commissioner Snyder seconded
that the request be denied by Planning Commission Resolution No. 266; carried unani-
mously (3-0) .

Il D. CASE NO. CUP 12-77, DIANE LOHMAN, APPLICANT
Request for approval of a Conditional Use Permit to operate a 700 square
foot restaurant in the Plaza Taxco II commercial complex to be located
at the southwest corner of Highway Ill and Sage Lane.
Mr. Cipriani reviewed the case noting that the parking requirement might be
adjusted.
Chairman Berkey asked if there were any questions from the Commission, being
none he declared the Public Hearing open.
CURT DUNHAM, 73-210 E1 Paseo, Suite 2F, Palm Desert, (representing the
applicant) spoke to the Commission indicating that the applicant agreed
with the staff's recommendations.
Chairman Berkey asked if there was anyone present who whould like to speak in
FAVOR of the project. Being no one, he then asked if there was anyone wishing to
speak in OPPOSITION to the project. Being no one, he declared the public hearing
closed and asked for a motion. Commissioner Snyder moved, Commissioner Kryder se-
conded that the Commission approve Planning Commission Resolution No. 268; carried
unanimously (3-0) .
E. CASE NO. CUP 10-77, PORTOLA GOLF RANCHOS, LTD. , APPLICANT
Request for approval of a Conditional Use Permit to build and operate
a 201-lot mobilehome subdivision and 9-hole golf course as a part of the
final phase of the Portola Country Club (formerly known as the Sun King
project) and located on 63 acres of land east of Portola extended and
south of 42nd Avenue extended.
Mr. Freed reviewed the case emphasizing the staff's concern on the perimeter
treatment of the project, that a right-of-way might be needed in the future
and the need for a buffer on the east side which borders on a sand dune.
Chairman Berkey questioned the 10 foot border along the fairways and the gates
leading to Rebecca Street not being free flow.
Mr. Freed indicated that the Design Review Board process would handle the border
issue and the gates are not compatible.
Chairman Berkey declared the Public Hearing open.
FRANK HAMERSCHLAG, 1007 S. Palm Canyon, Palm Springs, (representing the
applicant) spoke to the Commission addressing himself to several of the
conditions, requesting changes in Standard Condition No. 3, 8, and 13
and that Condition No. 6- be deleted.
Chairman Berkey asked if there were any questions from the Commission at this
time. Being none, he asked if there was any present wishing to speak in FAVOR of
the request.
TERRY HACKETT, 48 Canyon Island Dr. , Newport Beach, (legal council for
the applicant) spoke noting the beauty of the project and that the pre-
sent residents are all pleased with it. He also questioned the 33 feet
of land needed by the City and the requirement for more vehicle parking.

I. REQUEST: Request for approval of a Tentative Tract for a 20-lot sub-
division on approximately 5.2 acres of land located northerly of and ad-
jacent to Haystack Road, approximately 600 feet westerly of the inter-
section of Haystack Road and Portola Avenue - PR-3 Zone District.
II . STAFF RECOMMENDATION: Deny the request by Planning Commission Resolution

Justification:

III. BACKGROUND:
A. Location: Northerly of and adjacent to Haystack Road, approximately
600 feet westerly of the intersection of Haystack Road and Portola
Avenue.
B. Size: Approximately 5.2 acres
C. No. of Units: 20
D. Density: 3.84 dwelling units per acre
E. Type of Units : Single family detached
F. EIR Finding: A Negative Declaration was issued and filed on June
27, 1977 and the appeal period has expired.
G. Existing Zoning: PR-3
H. General Plan: Low Density Residenta L (3-5 dwelling units per acre)
I . Proposed Lots: Nineteen lots will be 92'x118' and the lot adjacent
to the Deep Canyon Stormwater Channel , Lot 20, will be considerably
larger.
IV. DISCUSSION:
Approval of this case is contingent upon approval of the related change of
zone request, Case No. CZ 07-77. Approval of Case No. CZ 07-77 would change
the zone on the subject property from PR-3 to R-1 , 10,000 thereby making it
possible to subdivide the property in the manner proposed. The proposed tract
involves 20, R-1 , 10,000 lots, each having approximately 10,800 square feet,
except for Lot 20 which is irregularly shaped and considerably larger due to
its location adjacent to the storm channel .

The subject property is located in an area that is highly flood prone.
Staff believes the PR-3 zoning, which would permit clustered development,
would have much more flexibility in confronting the runoff and drainage
problems associated with the site than the R-1 , 10,000 zoning which involves
a lot configuration more susceptible to flood damage. The lot configuration
for a tract• in a PR-3 zone would also more easily mitigate any possible
adverse impacts in the area of aesthetics than the lot configuration dic-
tated by the R-1 , 10,000 zone. The preservation of scenic views must be
considered with regard to any proposed development along Haystack.
Aside from lot configuration, staff noted a number of informational defi-
ciencies with regard to the tract map, itself. Examination of county records
at City Hall indicate the ommission of a portion of the subject site from
the tract map. It goes without saying that maps for any proposed land-
division must include the entire parcel which is being subdivided. Other
defic•i-encies are pointed out in the justification section with appropriate
references with regard to specific requirements of the Subdivision Ordi-
nance unmet.

WHEREAS, the Planning Commission of the City of Palm Desert, did receive
a verified application from GEORGE GRAZIADIO, requesting approval of a Tentative
Tract for 20 single family residences on 5.2 acres of land, located in the R-1 ,
10,000 zone and situated northerly of and adjacent to Haystack Road, approximately
600 feet westerly of the intersection of Haystack Road and Portola Avenue, more
particularly described as:

of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that
a Negative Declaration was made by the Director of Environmental Services on
Jun6 27, 1977, and the appeal period has expired, and;
WHEREAS, the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies and;
WHEREAS, the Planning Commission did find that the subject Tentative Map
as submitted, and the reports of the various reviewing agencies and;
WHEREAS, the Planning Commission did find that the subject Tentative Map
does not substantially comply with the City of Palm Desert Code (County Ordinance
Number 460) , and the State of California Subdivision Map Act, as amended;
WHEREAS, the Planning Commission did find that the subject Tentative Map

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of

Gentlemen:
This is to inform you that we, the undersigned, are opposed to a
zone change for the property located South of Marrakesh Country Club
and fronting on Haystack Road. We do not support the proposed project
because it increases the housing density and will aggravate the traf-
fic, drainage and flooding problems already existent on Haystack Road.
Additionally, we do not support elevating the lot pads creating a fur-
ther loss of view and flooding problems for existing housing located
on the southside of Haystack Road. Also, we do not support housing
that is substantially lesser in value and quality than the existing
homes on Haystack Road. We were unable to attend the public hearing
concerning this matter held on July 5, 1977, but we can assure you we
will be present when the matter is considered again on August 2, 1977.
It is our understanding that a traffic expert advised the Planning
Commission during the July 5, 1977, meeting that further development
would automatically slow traffic on Haystack Road. We are glad someone,
and we hope it is the City of Palm Desert, that is finally acknowledging
the traffic and speed problem that has existed on Haystack Road for se-
veral years. We expressed our concern to the City of Palm Desert sever-
al years ago about this problem and after many months, a crosswalk was
finally installed at Moon Lane and Haystack Road for school children and
a 40 MPH speed limit was posted. When Haystack Road was resurfaced, the
crosswalk was never replaced. Additionally, the flood destroyed several
40 MPH signs and the crosswalk signs, which have not been replaced.

Further, development along Haystack Road will not slow traffic, it
will create more traffic. Haystack Road is rarely patrolled and it is
an every day occurrence to observe cars traveling 60 to 70 miles per
hour,any time during the day. More residents means more cars, more peo-
ple and more children living on an already hazardous street increasing
the likelyhood of a serious accident.
We would like to suggest that stop signs be placed on Haystack Road,
at Moon Lane, Marlbouro Street, and Alamo Drive, that the speed limit be
reduced to 30 miles per hour and that the Sheriff spend more time patrol-
ing Haystack Road.

It is our feeling that it will cause additional speed
and traffic conditions that are hazardous and annoying
to present residents of Haystack. In addition, we are
concerned about further loss of view to the north.
Contrary to statements by the traffic expert at the July
5 , 1977, Planning Commission meeting, further development
will not automatically slow traffic. Examples to support
this are Fairway Drive, Avenue 44, and Grapevine, where
speed is not controlled by posted limits or residential
development on both sides of the streets.
Is there ANY possibility that "bumps" such as are in
Silver Spur, could be installed at perhaps three intervals
along the course of Haystack Road, if such installation is
supported by property owners ?

The General Telephone Company will pro-ride the telephone distribution
facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved by the California Public Utilities Commission.
The developer will be required to denosit the full cost of these facili-
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will he underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the asthetic
impact of trenching and cannot comment on this subject except to state
that the distribution facilities will be placed in a joint trench with
other utilities wherever possible.

Despite the fact that the southerly side of Haystack is R-1 , Haystack is not
a good location for R-1 . Traffic on this street will be heavy enough and fast
enough to be hazardous for repetitive driveway openings. Let's not compound a
bad situation.
The change of zone should be denied.
SUBJECT: Public Works Comments -_ Tentative Tract 10428
These comments will only pertain if the zoning .is changed to R-1 .
1 . Install full public improvements including street widening, curb, gutter,
sidewalk and traffic safety lighting as required by Ordinance and the City
Engineer.
2. Provide an additional 10 feet of right-of-way for storm drain purposes
along the full Haystack frontage,
3. . Install a storm drain along the full Haystack frontage in conformance with
the Proposed Master Drainage Plan. (Approximately Q 475 CFS)

RE: Tentative Tract No. 10428
Provide the following fire protection in accordance:
1 . Install a water system capable of delivering 1500 GPM fire flow from
any fire hydrant for a two hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operat-
ing pressure in the supply main from which the flow is measured at the
time of measurement.
2_ Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to recordation of the final map, the developer shall furnish the
oriainal and three (3) copies of the water system plan to the Fire
Marshal for review.
4. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify that .the design of the water system in Tract No. 10428
is in accordance with the requirements prescribed by the Fire Marshal . " .
Upon approval , the original plan will be returned to the developer.

DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOM-
MENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP
TO ALLOW FOR DEVELOPMENT OF A 20-LOT SINGLE FAMILY SUBDIVI-
SION ON 5.2 ACRES OF LAND, GENERALLY LOCATED NORTHERLY OF

WHEREAS, the Planning Commission of the City of Palm Desert, did receive
a verified application from GEORGE GRAZIADIO, requesting approval of a Tentative
Tract for a 20-lot single-family i subdivision on 5.2 acres of land, located in
the R-1 , 10,000 zone and situated northerly of and adjacent to Haystack, Road,
approximately 600 feet westerly of the intersection of Haystack and Portola more_
particularly described as:

WHEREAS, said applicati In had complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77=7% in a
Negative Declaration was made by the Director of Environmental Services on June
27, 1977, and the appeal period as expired, and;
WHEREAS, the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies and;
WHEREAS, the Planning Commission did find that the subject Tentative Map
does substantially comply with the City of Palm Desert Code. (County Ordinance
Number 460) , and the State of Cayifornia Subdivision Map Act, as amended;
WHEREAS, the Planning Commission did find that the subject Tentative Map
does comply with the adopted General Plan, and;.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows: 1 ) thatlthe above recitations are _true and correct
and constitute the .findings of the commission in this case; 2) that it does
hereby recommend approval to thelCity Council of the City of Palm Desert of the
above described Tentative Map Nod 10428, subject to fulfillment of the following
conditions (copy attached) :
FURTHER, BE IT RESOLVED that the recommended Conditions of Approval do
include a recommendation to the City Council that they require compliance to

CONDITIONS OF APPROVAL

' I . STANDARD CONDITIONS: ,
1 . All improvements shall conform to the requirements of the City Standard
Specifications and the City Engineer.
2. Tract shall be processed in accordance with all applicable provisions
of Ordinance 125, the Subdivision Ordinance.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all the requirements , limitations, and restrictions of all municipal
ordinances and State and Federal statutes now in force, or which here-
after may be in force.
4. Prior to approval of the final map and improvement plans, a grading plan
of the tract shall be submitted to the City Engineer for approval .
5. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings , and adequate fire hydrants with required fire flows shall be
installed as recommended by the Fire Department.
6. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. TT 10428 is
in accordance with the requirements prescribed by the City Fire Marshal . "
7. Improvement plans for water and sewer system shall meet the requirements
of the respective service districts.
8. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services.
9. Complete plans and specifications shall be submitted as required for
checking and approval , before construction of any improvements is com-
menced. The subdivider shall submit the original drawings revised to
reflect as-built conditions, prior to acceptance of the subdivision
improvements by the City of Special District.
10. All dedicated land and/or easements required by this approval shall' be
granted to the City of Palm Desert, without cost to the City and free
of all liens and encumbrances.
11 . All required public improvements and dedications shall be made as a
part of the Final Map on the property shown as Tract No. 10428.
12. Install full public improvements as required by ordinance and the City
Engineer.
' 13. In compliance with Article 26.15 of the City's Subdivision Ordinance,
the public facilities requirement shall be met by dedicating land in
an amount determined under the Ordinance provisions, specifically 5
percent of the total land area of the subdivision which is 7 acres.
14. Dr'ainage shall be subject to approval of the C-ity Engineer. Applicant
shall provide engineering data as requested.

Dear Mr. Ricciardi :
I have reviewed the tentative site plan for Tract 10428 that you provided
me on Tuesday. Said plan reflects a red -:n"e—nrTmber of lots to 16
and indicates a typical house layout. As I .indicated in our meeting last .
week I had hoped that some major revisions would mitigate the staff's con-
cern with this project to the extent that we could support a project on
the subject property. Unfortunately I see nothing in the site plan to change
my position. I , therefore, cannot in any way support the development of the
property in question as a standard single family subdivision for the reasons
expressed in the staff reports reviewed by the Planning Commission at their
meeting of July 5, 1977.
If you would allow me to take this opportunity, I. would like to indicate to
you that I have a strong feeling that you have misinterpreted the City staff's
responsibility in reviewing this proposed project. I get the impression that
you perceive our responsibility as being more of a developer's advocate. In
other words I think that you believe the staff should accept the type of
development proposed no matter what it is and to make recommendations that
quarantee said development conform to all the standards established by the
City. In reality, I believe our responsibility is to not support developments
which in our judgement are not good for the community. To do otherwise would
result in a disservice to the Planning Commission and the. community.
As a person heavily involved in the development of the City's Zoning Ordinance
and Map, and with your knowledge of the problems that relate to the property
in question, I would think that you would understand the staff concerns in
this matter. Since this is not the case, I would suggest that we allow the
Planning Commission and/or the City Council weigh the merits of your proposal
as it was originally submitted. To make further modifications of the project
at this stage would do nothing more than confuse the issue which could result
in further continuance.
I hope that this letter clarifies my position in this matter.

Chairman Berkey asked if Mr. Williams had any suggestions at this time.
Mr. Williams pointed out that the applicant and the City Engineer had agreed
that the streets would be curb to curb 40' and 50' .
Mr. Fleshman stated if the streets are private they don 't need to be 50' .
Mr. Williams indicated that there were sidewalks on both sides. Further the
issue before the board is whether the street should be offered for public.
Chairman Berkey asked if there were any further questions before the Public
Hearing is closed. The Public Hearing was declared closed and Chairman Berkey
asked for the pleasure of the Commission..
Chairman Berkey asked for a motion. Commissioner Reading moved that sentence
1 of Special Condition No. 4 be deleted and Special Condition No. 5 be deleted,
motion was seconded by Commissioner Kryder; motion carried (4-1 ) , with the follow-
ing vote:

NOES: KELLY
Chairman Berkey noted that Commissioner Kelly voted no as she voted no on the
Development Plan and .gave the same reasons for this vote..
H. CASE 140. TT 10428, GEO GE GRAZIADIO, APPLICANT
Request for consideration of a Tentative Tract for a 49-lot subdivision
on approximately 9. 5 acres located at the southeast corner of the inter-
section of Portola Avenue and Santa Rosa Way.
Mr. Williams explained that this is a request for a Tentative Map for a 20-lot
subdivision on property presently zoned PR-3 a mattes- discussed earlier for
rezoning to R-1 ,10,000.
Chairman Berkey questioned whether this case should be continued since the
Development Plan was continued.
Mr. Will iams pointed out that this must be by the consent of the applicant: to
continue or the Commission must act on a Tentative Tract within 50 days of receipt.
Chairman Berkey asked if the applicant would give his consent.
Mr. Ricciardi gave his consent.
Chairman Berkey noted a motion by Conmiissioner Snyder to continue the case to
August 2nd, the motion was seconded by Commissioner Reading; motion unanimously
carried (5-0) .
VII . OLD BUSINESS
Mr. Williams pointed out that a review of the Master Calendar for the College
of the Desert Specific Plan had been submitted for review. It was noted that as
a result of comments made at Study Session, the calendar should be reviewed and up-
dated and brought back to the next Study Session or. July 20th.

RE: Tentative Tract No. 10428
Provide the following fire protection in accordance:
1 . Install a water system capable of delivering 1500 GPM- fire flow from
any fire hydrant for a two hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operat-
ing pressure in the supply main from which the flow is measured at the
time of measurement.
2. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to recordation of the final map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
4. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify that the design of the water system in Tract No. 10428
is in accordance with the requirements prescribed by the Fire Marshal . "
Upon approval , the original plan will be returned to the developer.

Provide the following fire protection in accordance:
1 . Install a water system capable of delivering 1500 GPM fire flow from
any fire hydrant for a two hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operat-
ing pressure in the supply main from which the flow is measured at the
time of measurement.
2. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to recordation of the final map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
4. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify that the design of the water system in Tract No. 10428
is in accordance with the requirements prescribed by the Fire Marshal . "
Upon approval , the original plan will be returned to the developer.

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved bl, the California Public Utilities Commission.
The developer will be required to deposit the full cost of these facili-
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
