This report is now public and does recommend the alternative which would result in a major channel along the east side of Cook Street through the property under consideration. The approval of the proposed subdivision without provision for this proposed channel could seriously affect implementation of the recommendation of the Bechtel Report. In review of the tract map for a proposed development at the north- east corner of Cook Street and 44th Avenue, the Planning Commission have directed me to notify you that the area proposed to be developed is shown as a possible alternate storm channel location in the pre- liminary study developed by the Bechtel Corporation under contract with the Coachella Valley County Water District. The channel would connect the Deep Canyon channel to the Whitewater channel and would extend down Cook Street between the cities of Indian Wells and Palm Desert. The approval of this proposed subdivision would preclude this alter- native. The Commission suggests that serious consideration be given to the effects of this action at this stage. If the County proposes to act on this tract regardless of this possible problem, it is suggested that the following requirements be applied to this tract: 1 . A decorative 6 foot high masonry wall , landscaping and 8 feet wide concrete bikeway be installed along the full frontage of the project on Cook Street and 44th Avenue to ultimately connect up with a bikeway system being developed within Palm Desert along 44th Avenue and Cook Street. That the intersection of Book Street and 44th Avenue be designed so as to provide for a corner cutback of approxi- mately 2,000 sq. ft. which should be landscaped to guarantee adequate night distance. 3. Traffic safety lighting should be provided on along the frontages of the project on Cook Street and 44th Avenue. 4. The developer should be required to enter into an agreement to participate in the construction of a traffic signal at the corner of 44th Avenue and Cook Street in the amount of 25% of the cost, at such time as warrants merit of installation of said signal . 5. Perimeter fencing or walls should be installed along the north and east property lines of the development. 6. Access rights on Cook Street and 44th Avenue should be granted to the County. 7. It is suggested that the Applicant review the proposed Archi- tectural Plans of the proposed houses with the Staffs of the cities of Indian Wells and Palm Desert prior to submittal for Building permits. DISCUSSION : With frontage on two major streets, the applicant will be dedicating additional right-of-way to provide 55-foot half-width streets on Cook and 44th. Water, sewer, and curb and gutter will be provided throughout the project. Storm- water drainage will be provided by surface streets. No other improvement data is indicated on the submitted map although other requirements could be imposed as part of the subdivision process. The staff recommends that the following comments be forwarded to the County: 1 . A decorative 6 foot masonry wall , landscaping, and an 8 foot wide concrete bikeway should be installed along the full frontage of the project on Cook Street and 44th Avenue. 2. The applicant should discuss proposed ,arthitectural. elevations, materials, and landscaping with the planning staffs of Palm Desert and Indian Wells for comments. 7. Abandon all other access rights onto Cook and 44th. The perimeter walls and landscaping, especially on Cook Street and 44th Avenue, are needed for aesthetic as well as noise mitigation purposes. The open land- scaped area at the corner will preserve line-of-sight and should add a dis- tinctive design element to what is already a busy intersection. The need for street lights and a traffic signal are already obvious. The bikeway system would be a continuation .of a program planned for the City of Palm Desert. In addition to the physical improvements, the staff is concerned with the design of the homes proposed for th.iscsubdivisioha The last thing the City would want to see immediately adjacent to its boundary is a standard tract with uniform colors and design. The architecture should reflect the desert environment and should provide as much variety as possible. To discuss these and other .possible design suggestions, the staff recommends thatthe applicant meet with the .City's DesignvReview Board on a voluntary basis to go over these matters. While the City has no authority to impose its design concepts upon the developer, it is also true that as a functional matter, this project will rely on the adjacent cities for circulation, recreation , and commercial services and should seriously consider their comments. ...............I. NEW BUSINESS (Continued) County Referral TT 0805, LEWIS HOMES Request for comments on a 130-lot R-1 subdivision at the northeast corner of Cook Street and 44th Avenue. Mr. Williams explained the proposal to the Commission and listed 7 recom- mendations that the staff felt should be forwarded to the County. He also indicated, however, that before these items would be considered, the County should be advised that the project lies within the right-of-way alignment of a possible storm drain channel being considered adjacent to Cook Street which would connect the Deep Canyon Stormwater Channel with the Whitewater River Storm Channel . A minute motion was made by Commissioner Kelly and seconded by Commissioner Reading to forward the expressed comments to the Riverside County Planning Commission, with particular emphasis on the storm drain issue. Motion unanimously approved (5-0) . C. County Referral Tentative PM No. 10526, Amended No. 1 , BOB GURLEY Request for a tentative parcel map to divide an existing 5-acre parcel into a 3-acre and a 2-acre parcel located on the north side of Jaguar Road in the Cahuilla Hills. Mr. Williams discussed the project and indicated that the project was in a re- latively level area and had road access. Since it would not have an adverse impact, the staff suggested that the County be advised that the project conforms to the Land Use map of the Palm Desert General Plan. A minute motion was made by Commissioner Kelly and seconded by Commissioner Read- ing to direct staff to forward the Commission 's comments to the Riverside County Planning Commission. Motion approved unanimously (5-0) . D. County Referral C/Z 2251-3, FRED MOTTLE Request for a change of zone from R-1 to R-T-8700 for a 156-acre parcel located at the southwest corner of Country Club Drive and Washington St. Mr. Williams explained that the project was in conflict with the Land Use Element of the Palm Desert General Plan and contrary to the provisions of the Circulation Element of the General Plan. For those reasons, the staff recommended denial of the project. A minute motion was made by Commissioner Kelly and seconded by Commissioner Read- ing to direct staff to forward a recommendation of denial for the stated reasons to the County Planning Commission. Motion approved unanimously (5-0) . IX. DESIGN REVIEW BOARD ITEMS A. Consideration of an appeal by Dr. Santiago Fernandez of Case No. 303SF, a new single family residence on Santa Margarita Avenue. Mr. Williams indicated that the applicant was appealing 4 conditions imposed by the staff on a new single family residence. Condition No. 6 called for a new landscape plan to make the unit compatible to the neighborhood. Condition No. 8 called for a concrete driveway to ensure that the project would be compatible with the desert climate. Condition No. 10 asked that the front garden wall be slumpstone instead of stucco to maintain the architectural theme. Condition No. 13 joo� 21 INTEROFFICE MEMORANDUM City of Palm Desert TO: City Manager FROM: Director of Environmental Services SUBJECT: Inquiry made by the City Council regarding DATE: Sept. 19, 1977 the projects occuring along the east side . of Cook Street At the study session of Sept. 15th, inquiries were made by the City Council re- garding the status of projects along the east side of Cook Street in relationship to the recently published Bechtel .Report. Carlos Ortega has asked me to provide you with a status report on any projects in this area. To my knowledge there are three projects being contemplated along the east side of Cook Street between Fairway Drive and the Whitewater Channel . These projects are as follows : IN THE CITY OF INDIAN 'WELLS The City of Indian Wells has reviewed and approved a tentative tract for a project at the north east corner of the intersection of Cook Street and Fairway Drive which I have previously discussed with you. In response to an inquiry from the Planning Director of the City of Indian Wells, I wrote the attached letter on the project back in May. It is my understanding that the project has been approved by both the Planning Commission and the. City Council of the City of Indian Wells with total disregard to my recommendations regarding the actual design of the project. As you might recall this is a 118 unit condominium located on approximately 40 acres. In discussion with Mr. Wilcox of the Planning Department of the City of Indian Wells, the applicants have gone no further than receiving their approval on the tentative tract. THE COUNTY OF RIVERSIDE At the regularly scheduled meeting of the Palm Desert Planning Commission of August 30, a tentative .tract known as 10805 to be located at the northeast corner of the intersection of 44th Avenue and Cook Street was reviewed. Please note the attached letter which is the result of that review. The request is for 130 lots on approximately 42 acres. Said project is to be a_.standard R-1 9,000 subdivision. In review of the status of the project with the County of Riverside they have indicated that it is still in process and that they have not received approval by the Planning Commission. However, they further indicated that our concern with regards to the material contained in the Bechtel Report would be acted upon only if the water district were to place a dedication as requirement on the project. Mr. Bushman of the County Planning Dept. has indicated they have received the standard letter from the water district indicat- ing that the property was subject to flood only in rare instances and no mention of the findings of the Bechtel Report. RUMORED PROJECTS It has been rumored that a major project is in design on property located immediately east of Cook Street between Highway 111 and 44th Avenue. I have no details on this project and we have not been notified of its consideration by the City of Indian Wells. _z_ I am prepared to review the first two projects with you or the City Council at study session if you so desire. Schmitz Director of Building & Planning City of Indian Wells Indian Wells, Ca. 92260 Re: Tract No. 10,055 Dear Mr. Schmitz: Per your request, I have reviewed Tract No. 10,055 and do have the following comments which are based on both of our cities concerns with drainage and the fact that both cities feel the location of the proposed project is critical to any good solution. 1 . I would recommend that the proposed main entrance be placed on Cook Street. 2. In addition, the proposed tennis facilities should be located in the first three hundred feet off Cook Street. 3. No units should be located within three hundred feet of Cook Street. 4. An drainage easement should be obtained for the full frontage and on Cook Street of a 300 ft. width. 5. An emergency entrance should be provided off Fairway. If these recommendations are implemented they would have little effect on the project, but would not prelude the possible ultimate development of a drain- age channel adjacent to Cook Street which would be very similar to the entrance to El Dorado. Since our Planning Commission does not meet prior to your consideration of this matter I have been unable to review these recommendations with them. II. STAFF RECOMMENDATION: Direct staff to forward -comments to the Riverside County Planning Commission. III . BACKGROUND: A. Location: Southwest corner of Country Club and Washington B. Size: 156 acres C. Total Number of Units : 780 D. Density: 5 du/acre E. Palm Desert General Plan: Very Low Density Residential (1-3 du/acre) IV. DISCUSSION: In this case, the Palm Desert General Plan provides for a lower land use density than the County General Plan. This does not necessarily prohibit projects greater than 3 du/acre, it simply requires that the average density for the entire neigh- borhood indicated on the Land Use Map not exceed 3 du/acre. However, since the area involved is quite substantial , it would appear unlikely that the other pro- perty owners involved would be willing to reduce their existing zoning to conform to an average density of 3 du/acre. The staff therefore recommends that the County be notified that the existing and proposed zoning may not be in confor- mance to the Palm Desert General Plan Land Use Map. A second aspect of the project that may not conform to the Palm Desert General Plan is the location of Country Club Drive. One of the most important recommen=e ' ,:,J dati:ons of the Circulation Element is the re-alignment of Country Club Drive southeast toward 42nd Avenue. This creates a single thoroughfare connecting Bermuda Dunes, Palm Desert Country Club and. Palm Desert Greens. The staff is also concerned in this case with the lack of proper environmental documentaion. The size and location of the proposed project makes it likely that i.t may have a significant adverse impact and that an EIR should have been prepared as a part of the Change of Zone process.
