A. REQUEST FOR APPROVAL OF FINAL TRACT MAP for Tract 5565-3, Silver Spur
Associates , Applicant.
Mr. Clyde Beebe reported that this Tract consists of 52 lots , Tentative
Map approved at the August 25th meeting. He further stated that Sub-
divider had met all conditions of approval and signed all agreements .
Mr. Beebe also pointed out that the City is very aware of drainage
problems, and stated that drainage basically heads for the Clubhouse,
which has provisions for handling the water drainage. Staff recommends
approval .

Councilman McPherson moved, and Councilman Wilson seconded to waive
further reading and adopt Resolution No. 78-94, approving Final Tract Map for Tract
No. 5565-3. Motion carried on the following vote:
AYES: Brush, McPherson , Wilson & Mullins

A. REQUEST FOR APPROVAL OF FINAL TRACT MAP for Tract No. 5564, Silver Spur
Associates, Applicant,
Mr. Beebe reported that this Tract drains into the golf course and
Deep Canyon. He requested Council ' s approval by Resolution 78-95.
Councilman McPherson moved , and Councilman Wilson seconded to waive further
reading and adopt Resolution No. 78-95, approving Final Tract Map for Tract No. 5565.
Motion carried on the following vote:
AYES: Brush, McPherson, Wilson & Mullins

C. REQUEST FOR APPROVAL OF FINAL TRACT MAP for Trac No. 11207, mpton,
Russie and Root, Applicant;
Clyde Beebe reported that this Tract is unique, in that all improvements
except $1 ,000 worth had been completed in the years past.
Councilman McPherson moved, and Councilman Brush seconded to waive further
reading and adopt Resolution No. 78-96, approving. Final Tract Map for Tract No. 11207.
Notion carried unanimously.

X'J REPORTS AND REMARKS
A. CITY MANAGER
Mr. Bouman announced that he had received a letter from Steve Fleshman on
July 13 , 1978, addressed to the Mayor and City Council requesting that
the City Council assume jurisdiction over Design Review Case No. 72C. He
stated that Lher ('' -was some controversy with the Projen, located at the
i corner of Highways Ill and 74.

Councilman Brush questioned why the case should be called up.
Hr. Bouman replied that there was controversy over the quality of Archi-
tectural features .
Councilman Wilson suggested there be a full report from the Staff, and
Mr. Bouman said this would be included in the Aqenda package for the
July 27th meeting.
Councilman McPherson stated that he would abstain.
Councilman Brush asked what vote would be required to call , and David
r Erwin , City Attorney, replied that it would require a 3-1 vote or
majority.

You have also requested a letter stating whether or not the subject property
is within a geologic hazards special studies zone. There is no such zoning
district within the Palm Desert Zoning Ordinance. We do have a Seismic Haz-
ard Overlay Zoning District, but the subject property is not within this area.

dikes built and maintained by this District. This area may be considered
safe from stormwater flows except in rare instances.
The District will furnish domestic water and sanitation serviceSto said
area in accordance with the currently prevailing regulations of this
District.
There may be conflicts with existing District facilities which were in-
stalled as part of Tract 4997 improvements . We request the appropriate
public agency to withhold the issuance of a building permit until arrange-
ments have been made with the District for the relocation of these facilities .

A. ST 11207 - COMPTON RUSSIE AND ROOT: Request for
prf a T ative Tract Clap Creating a 10-Lot Subdivi-
sio - nit Condominium Project To Be Located on a
1 . 53 Acre Parcel on the Nest Side of Verba Santa Drive and
South of Pitahaya.
Mayor i.lullins declared the Public Hearing open .
Mr. Williams reviewed the Staff Report for Council stating that
as the subject parcel is located in a highly developed area
and only involved approximately 1-1/2 acres , no major issues
ever arose during the review of either the Development Plan
for this project or the Tentatitve Tract . The one minor
issue that was brought to the attention of the Commission
was the question of having the street private or public .
Staff pointed out that as the streets at both ends of the
subject street are private , the subject street should also
� . remain private. Further , as any sidewalks installed would
not be connected to any public streets and as a need for side-
walks in the subject area could not be demonstrated, Staff
was not recommending that sidewalks be installed. The
Staff recommended approval of the Tentative Tract "lap by
Resolution No. 77-117, subject to ,conditions .
Mayor Mullins invited input in FAVOR of the project .
MR. CHARLES ROOT, 45-360 Ocotillo, addressed Council as one
of the developers , stating his concurrence with the Planning
Staff and Commission and expressing his sincere thanks to
the Staff for their cooperation. He pointed out that this
project was an ettention of Montecito and that due to ill-
ness, the original developer had been unable to complete
these 9 units .
Mayor Mullins invited input in OPPOSITION to the project and none
was offered. The :Mayor declared the Public Hearing closed .
Councilman Brush moved and Councilman Wilson seconded to waive
further reading and adopt Resolution No . 77-117 , approving the Tentative
( :.lap, subject to compliance with conditions. Motion carried unanimously
with the members present .
B. CASE NO. TT 11215 - PORTOLA GOLF RANCHOS : Request for Approval
of a Tentative Tract `:Iap to Create 201 Lots Within an Existing
Mobile Home Subdivision Generally Located East of Portola
Avenue and South of Avenue 42 in the R-M Zone .
Mayor Mullins declared the Public Hearing Open .
Mr. Williams advised that the City Clerk had received a
telephone request from 1r. Frank Hamerschlag , Engineer for
the project , requesting a continuance of the hearing until
the next meeting inasmuch as the developers could not be
present for this meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND APPROVING A TENTATIVE MAP TO ALLOW
FOR DEVELOPMENT OF A 10-LOT SUBDIVISION TO CON-
STRUCT 9 CONDOMINIUM UNITS ON A 1 . 53-ACRE PARCEL
LOCATED ON THE WEST SIDE OF VERBA SANTA DRIVE AND
SOUTH OF PITAHAYA.

WHEREAS, the City Council of the City of Palm Desert , did receive
a `verified application from COMPTON, RUSSIE and ROOT requesting approval
of a Tentative Map to allow for development of a 10-lot subdivision on
1..53 acres of land, located in the PR-6 zone and situated on the west
side of Verba Santa Drive and south of Pitahaya more particularly de-
scribed as :

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
77-71 , in that a Negative Declaration was made by the Director of Envi-
ronmental Services on July 26, 1977, for Case No. DP 09-77, a related
case, and the appeal period has expired, and;
WHEREAS, the City Council did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies, and;
WHEREAS, the City Council did find that the subject Tentative Map
does substantailly comply with the City of Palm Desert Code, and the
State of California Subdivision Map Act, as amended;
WHEREAS, the Planning Commission did find that the subject Tentative
Map does comply with the adopted General Plan ;
NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of
Palm Desert as follows : 1) that the above recitations are true and
correct and constitute the findings of the Commission in this case ;
2) that it does hereby approve the above described Tentative Map No.

STANDARD CONDITIONS OF APPROVAL

RESOLUTION NO, 77-117
1. The development of the property desc,ibed herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statues
now in force , or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
3. The C.C. &R' s for this development shall be submitted to the City
Engineer for review and approval prior to the issuance of any
building permits . Prior to recordation of the final subdivision
map, the applicant shall 'submit to the City Engineer :
a. The document to convey title.
b . Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
4. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
5. Area shall be annexed to appropriate Improvement Districts having
{{{ jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
7. All on-site utilties, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
S, Complete plans and specifications shall be submitted as required
by Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision im-
provements by the City.
9. In order to maintain reasonable fire-protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings . An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
Marshal.
10. Prior to recordation of the Final Map , the developer shall furnish
the original and three ( 3) copies of the water system plan to the
Fire Marshal for review.
L 11. All requirements of the City Fire Marshal for Development Plan
DP 09-77 shall be met as a part of the development of this tract .
12. The water system shall be signed by a registered civil engineer and
approved. by the water company with 'the following. certification : "I
certify that the design of the water system of Tract No. 11207 is
in accordance with the requirements prescribed by the City Fire
Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Appli-
cant shall provide engineered data as requested.

14. All requirements of the Planning Commission action on the Develop-
ment Plan DP 09-77 shall be met as a part of the development of
this tract .
15. The total number of lots shall be limited to 10.
1 16. The applicant shall have twelve ( 12) months from the date of the approval or .conditional approval of the tentative map for filing of
the final map unless an extension of time of up to eighteen ( 18)
months is granted by a Resolution of the City Coundil.
SPECIAL CONDITIONS
1 . Existing street entrance in center of project shall be replaced
with standard curb and gutter.
2. Curb and gutter shall be installed on a 25 foot radius at south
end of existing roadway.
3. Applicant shall install a water system capable of delivering 2500
GP14 fire flow from any fire hydrant for a two hour duration in ad-
dition to domestic supply. The computation shall be based upon a
minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
4. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction .
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green .
B. Curbs shall be painted red 15 feet in either direction from
each hydrant .
5• In compliance with Article 26. 15 of the City ' s Subdivision Ordinance,
the public facilities requirement shall be met by the paying of a fee
lin an amount determined under the Ordinance provisions.

C. REVIEW OF MAJOR ISSUES- DISCUSSED BY THE PLANNING COMMISSION:
As the subject parcel is located in a highly developed area and only involves
approximately 12 acres, no major issues ever arose during the review of either
the Development Plan for this project or the Tentative Tract. The one minor
issue that was brought to the attention of the Commission was the question of
having the street private or public. Staff pointed out that as the streets
at both ends of the subject street are private, the subject street should
also remain private. Further , as any sidewalks installed would not be con-
nected to any public streets and as a need for sidewalks in the subject area
could not be demonstrated, staff was not recommending that sidewalks be
installed.

OF A TENTATIVE MAP TO ALLOW FOR DEVELOPMENT OF A

GENERALLY LOCATED ON THE WEST SIDE OF VERBA SANTA
DRIVE AND SOUTH OF PITAHAYA.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did receive a verified application from COMPTON, RUSSIE,
AND ROOT requesting approval of a 10-lot condominium subdivision on
1. 5 acres of land, located in the PR-6 Zone District and situated
on the west side of Verba Santa Drive and south of Pitahaya, and more
particularly described as :

WHEREAS , said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
Number 77-711 , in that an Environmental Assessment has been made , a Nega-
tive Declaration has been issued and the appeal period has expired; and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing
agencies; and,
WHEREAS, the Planning Commission did. find that the s>>bject Tenta-
tive Map does comply with the adopted Palm Desert General Plan; and,
WHEREAS, the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with the City of Palm Desert Code, and
the State of California Subdivision Map Act , as amended.
NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the

12. The water system shall be signed by a registered civil engineer and

I. REQUEST:
Request for approval of a tentative tract map for a 10-lot condominium
project on approximately 1 .5 acres located on the west side of Verba
Santa Drive and south of Pitahaya in the PR-6 zone district.
II. STAFF RECOMMENDATION:
By Planning Commission Resolution No. 285 , forward a recommendation of
approval to the City Council subject to compliance with conditions.
Justification is based upon the following:
1 . The subject tentative map does comply with the adopted Palm Desert
General Plan.
2. The subject tentative map does substantially comply with the City
of Palm Desert Code and the State of California Subdivision Map
Act, as amended.
III. BACKGROUND:
A. Discussion of Specifics of Proposed Development: Please review the
Development Plan
No. DP 09-77 for
the details of the
proposed project.
B. Proposed Lots: Lots 1 through 9 are footprint lots of the units con-
taining 1827 square feet. Lot 10 includes the remain-
ing portion of the subject parcel consisting of the
common area.
C. Proposed Streets: No streets are proposed for the subject tentative
tract as access will be provided by Verba Santa
Drive which presently exists.
D. Neighborhood and Public Facilities Requirement: Pursuant to the Sub-
division Ordinance,
the applicant is re-
quired to pay fees or
dedicate land for neigh-
borhood and public facil-
ities. The proposed re-
solution recommends that
the applicant be required

IV. DISCUSSION:
The tract being proposed involves no new street construction. All ten of
the proposed lots will be provided with access from Verba Santa Drive
which presently exists. Minor modifications will have to be made to the
present improvements along Verba Santa Drive as required by Special Con-
ditions Nos. 2 and 3 primarily to accomodate the proposed driveway con-
figuration. . Special Condition No. 3 is being required in order to improve
maneuverability for motorists travelling south on Verba Santa Drive. Staff
i,s recommending that the public facilities requirement be met by the paying ,
of a fee which in this case will amount to 5% of the market value of 1 .53
acres at the time the final map for the tract is recorded.

VI . PUBLIC HEARINGS
Chairman Berkey explained the Public Hearing procedures to
those present and announced that prior to this meeting, the Commission
had met in a Study Session for the purpose of clarifying the staff ' s
recommendations. No decisions were reached.
A. CASE NO. TT 11207 - COMPTON, RUSSIE and ROOT, Applicant

Mr. Williams reviewed the staff report pointing out that it
was a request for 9 condominium lots and 1 common lot with
sixteen Standard Conditions and five Special Conditions. He
noted that there was no need for sidewalks as the street would
not be public. He also noted the late response received from
the C.V.C.W.D.
Chairman Berkey asked if the Commission had any questions of
staff at this time . Being none, he declared the Public Hearing open
and asked if the applicant cared to speak at this time. The applicant
not being present, Chairman Berkey asked if there was anyone wishing
to speak in FAVOR or OPPOSITION of the project . Being no one he de-
clared the Public Hearing closed and asked for the pleasure of the Com-
mission.
It was moved by Commissioner Snyder and seconded by Commissioner
Kryder that the case be approved by Planning Commission Resolution No. 285;
carried unanimously (5-0) .
B. CASE NO. CUP 06-77 - C. G. DUNHAM, Applicant
Mr. Williams noted that the applicant was not present at this
time and asked that the case be reviewed later in the meeting.

C. CASE NO. TT 11215 - PORTOLA GOLF RANCHOS, LTD. , Applicant
Request for approval of a Tentative Tract Map to create
201 lots within an existing mobile home subdivision generally
located east of Portola Avenue and south of 42nd Avenue in
the R-M zone.
Mr. Williams reviewed the project , noting the proposed interior
streets , .the windbreak, and the nineteen Standard Conditions and
eleven Special conditions.
Some discussion followed regarding the wind break on the west ,
the improvement of the streets now or later, blowsand problem
and maintenance of streets. Mr. Cook noted that there were no
dead-end streets and improving the streets would give adequate
sand control.
Chairman Berkey declared the Public Hearing open and asked if the
applicant wished to speak at this time :
DUKE DOBRIENNER, 42-500 Portola, representing the applicant ,
spoke to the Commission noting his concern for the location
of four holes of the proposed golf course and the need for
the completion of 42nd Avenue. He stated that he-was in
negotiation with the owners of the property on three sides -
to obtain land and then dedicate 20 acres to the City. He then

facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved by the California Public Utilities Com-:fission:
The developer will be required to deposit the full cost of these facili-
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme Or unusual conditions
arise. No single subdivision will affect the telephone rates as rates _
are developed over a large base. We have no expertise on the esthetic
impact of trenching and cannot comment on-this subject except to state
that the distribution facilities will be placed in a joint trench with
other utilities wherever possible.

I . REQUEST:
Request for approval of a tentative tract map for a 10-lot condominium
project on approximately 1 .5 acres located on the west side of Verba
Santa Drive and south of Pitahaya in the PR-6 zone district.
II. STAFF RECOMMENDATION:
By Planning Commission Resolution No. 285 , forward a recommendation of
approval to the City Council subject to compliance with conditions.
Justification is based upon the following:
1 . The subject tentative map does comply with the adopted Palm Desert
General Plan.
2. The subject tentative map does substantially .comply_wi.th .the City_ _
of Palm Desert Code and the State of California Subdivision Map
Act, as amended.
TI GACKGROUND:
A. Discussion of Specifics of Proposed Development: Please review the
Development Plan
No. DP 09-77 for
the details of the
proposed project.
B. Proposed Lots: Lots 1 through 9 are footprint lots of the units con-
taining 1827 square feet. Lot 10 includes the remain-
ing portion of the subject parcel consisting of the
common area.
C. Proposed Streets: No streets are proposed for the subject tentative
.tract as access will be provided by Verba Santa
Drive which presently exists.
D. Neighborhood and Public Facilities Requirement: Pursuant to the Sub-
division Ordinance,
the applicant is re-
quired to pay fees or
dedicate land for neigh-
borhood and public facil-
ities. The proposed re-
solution recommends that
the applicant be required
to pay fees to meet this
requirement based upon 5%
of the market value of the

IV. DISCUSSION:
The tract being proposed involves no new street construction. All ten of
the proposed lots will be provided with access from Verba Santa Drive
which presently exists. Minor modifications wi:ll have to be made to the
present improvements along Verba Santa Drive as required by Special. Con-
ditions Nos. 2 and 3 primarily to accomodate the proposed driveway con-
figuration. Special Condition No. 3 is being required in order to improve
maneuverability for motorists travelling south on Verba Santa Drive. Staff
is�tgcommendi,ng)that the public facilities requirement be met by the paying
of a fee which in this case will amount to 5% of the market value of 1 .53
acres at the time the final map for the tract is recorded.

OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FIND-
INGS AND RECOMMENDING TO THE CITY COUNCIL APPROVAL
OF A TENTATIVE MAP TO ALLOW FOR DEVELOPMENT OF A
10-LOT CONDOMINIUM SUBDIVISION ON 1. 5 ACRES OF LAND,
GENERALLY LOCATED ON THE WEST SIDE OF VERBA SANTA
DRIVE AND SOUTH OF PITAHAYA.

WHEREAS, the Planning Commission of the City of Palm Desert ,
California, did receive a verified application from COMPTON, RUSSIE,
AND ROOT requesting approval of a 10-lot condominium subdivision on
1. 5 acres of land, located in the PR-6 Zone District and situated
on the west side of Verba Santa Drive and south of Pitahaya, and more
particularly described as :
Portion of SE 4 of. Sec. 19, T55, A6E
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
Number 77-7" , in that an Environmental Assessment has been made , a Nega-
tive Declaration has been issued and the appeal period has expired; and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing
agencies ; and,
WHEREAS, the Planning Commission did find that the subject Tenta-
tive Map does comply with the adopted Palm Desert General Plan ; and,
WHEREAS, the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with the City of Palm Desert Code , and
the State of California Subdivision Map Act , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows :
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case;
2 . That it does hereby recommend approval to the City Council of
the City of Palm Desert , California, of the above described Tentative Map
No. 11207, subject to the fulfillment of the attached conditions of ap-
proval.
FURTHER, -BE IT RESOLVED that the recommended Conditions of Approval
do include a recommendation to the City Council that they require com-
pliance to Article 26. 15 of the City' s Subdivision Ordinance by the pay-
ment of a fee as specified by recommended Special Condition of Approval
No. 6.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 11207
RESOLUTION NO. 23_5__
1 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statues
now in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
3. The C .C. &R' s -ror this development shall be submitted to the City
Engineer for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer :
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
4. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
5. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
7. All on-site utilties, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
8. Complete plans and specifications shall be submitted as required
by Ordinance to the City Engineer, for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of, the subdivision im-
provements by the City.
9. In order to maintain reasonable fire-protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings . An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
Marshal.
10. Prior to recordation of the Final Map , the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review.
11. All requirements of the City Fire Marshal for Development Plan
DP 09-77 shall be met as a part of the development of this tract .
12. The water system shall be signed by a registered civil engineer and
approved by the water company with the following certification : "I
certify that the design of the water system of Tract No. 11207 is
in accordance with the requirements prescribed by the City Fire
Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Appli-
cant shall provide engineered data as requested.

14. All requirements of the Planning Commission action on the Develop-
ment Plan DP 09-77 shall be met as a part of the development of
this tract .
15. The total number of lots shall be limited to 10.
16. The applicant shall have twelve ( 12) months from the date of the
approval or conditional approval of the tentative map for filing of
the final map unless an extension of time o.f up to eighteen ( 18)
months is granted by a Resolution of the City Coundil.
SPECIAL CONDITIONS
1. Exi,sting street entrance in center of project shall be replaced
with standard curb and gutter.
2. Curb and gutter shall be installed on a 25 foot radius at south
en& of existing roadway.
3. Applicant shall install a water system capable of delivering 2500
GPM fire flow from any fire hydrant for a two hour duration in ad-
dition to domestic supply. The computation shall be based ;upon a
minimum of 20 psi residual operating pressure in the supply main -
from which the flow is measured at the time of measurement.
4. Install Riverside. County super fire hydrants"located at each street
intersection ( a) but not greater than 400 feet apart in any direction .
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green .
B. Curbs shall be painted red 15 feet in either directi.on from
each hydrant .
5• In compliance with Article 26 . 15 of the City ' s Subdivision Ordinance,
the public facilities requirement shall be met by the paying of a fee
in an amount determined under the Ordinance provisions.

I. REQUEST:
Request for approval of a Development Plan to construct 9 condominium
units on a 1 .5 acre parcel on the west side of Verba Santa Drive and
south of Pitahaya.
II. STAFF RECOMMENDATION:
Approve by Planning Commission Resolution No. 271 , subject to compliance
to conditions. Justification is based upon the following:
1 . The proposed development is consistent with the City's adopted
General Plan.
2. The proposed use is similar to and compatible with those existing
on adjacent and nearby properties.
3. The design or improvement of the proposed development will be
consistent with the Palm Desert Zoning Ordinance.
4. The site is physically suited for both the type of development
proposed and the proposed density.
5. The design of the development and the proposed improvements are
not likely to cause substantial environmental damage or have a
serious effect on the public health, safety, or general welfare.
III . BACKGROUND:
A. Location: The subject property is located on the west side of Verba
Santa Drive and south of Pitahaya.
B. Size: Approximately 1 .53 acres
C. Total No. of Units: 9
D. Density: 5.9 units per acre
E. Coverage: Approximately 45% of the net area will be covered by
structure .or paving.
F. EIR Finding: An Environmental Assessment form was prepared for the project
and a Negative Declaration was filed on July 26, 1977 and the
appeal period has expired.

IV. DISCUSSION:
The failure of the applicant to achieve the 20' required setback between
buildings is the only area of noncompliance with the Zoning Ordinance.
Due to the shape of the parcel , the setback requirement may be difficult
to achieve, but the PR Zone offers flexibility in this regard. Overhead
utility service lines exist adjacent to the .subject parcel on the lots
to the west. Since these lines cannot be required to be undergrounded as
the lots on which they are located are already developed, Staff is requir-
ing the applicant to agree to participate in any future undergrounding
district which may be formed. The applicant has expressed agreement to
such a condition.

serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved by the California Public Utilities Com :issi.on.
The developer will be required to deposit the full cost of these facili-
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the asthetic
impact of trenching and cannot comment on this subject except to state
that the distribution facilities will be placed in a joint trench with
other utilities wherever possible.
