O. 2100-1 45-275 Prickly Pear Lane Palm Desert, California 92260 Dear Clyde: Our survey party has checked the road grades on Sierra Madre South and the bu.ilding pad grades adjoining Sierra Madre South in the Monterey Country Club development, The information the survey party obtained clearly supports our contention that the grade of all improvements has been constructed in accordance with the grading plan approved and signed by yourself. Enclosed are copies of the curb grade sheets that were u.sed by the con- tractor for the construction of the curbs. The grade of the curbs, as shown on the curb sheets, were taken directly from the approved grad- ing plan. In view of evidence obtained by the field party and that evidence confirm- ed by the curb grade sheets enclosed herewith, I certify to you that the grade of the curbs and other improvements on Sierra Madre South and the adjoining building pads have been done in accordance with the approved plans. ET AL 42-000 Bob Hope Dr. Rancho Mirage, CA 92270 Description of Project: Request for approval of a Tentative Tract Map to create 107 lots for residential uses, water well site, buffer areas , a pool and a maintenance building on approximately 240 acres located north of the Whitewater Storm Channelcbetween Monterey j a_nd Portota where sl 66 lots were previouy proposed. Finding: Project is exempt from further documentation under the provisions of the State guidelines for the im- plementation of CEQA. Justification: A Notice of Exemption was filed for this project on December 12 , 1977. The applicant is now proposing 107 lots rather than 66 lots . This change in the number of lots will not affect the proposed develop- ment in any physical manner, but is merely for legal purposes. Any interested citizen may appeal this determination to the Planning Commission within eight (8) days of the date of the posting of public notice by filing an appeal in accordance with Resolution No. 77-7 with the Department of Environmental Services located at 45-275 Prickly Pear Lane, Palm Desert, California. If no appeal is filed within said time, this determination shall be final. TT1145-1 Standard Conditions : I . The development of the property described herein shall be suhj<-ct to the restrictions and limitations set forth herein which are in addition to all the requirements , limitations , and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force . 2 . Full public improvements including traffic safety lighting as re- quired by Ordinance and the Dir. of Fil tic Works shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives . The approval of the final street name shall be made by the Director of Environ- mental Services. 4. Access rights on Portola & Monterey shall be offered to the City as a dedication on the Final Map . 5 . The C.C . 8R. ' s for this development shall be submitted to the Cit , Engineer for review and approval prior to the issuance of any building permits . Prior to recordation of the final subdivision map, the- applicant shall submit to the Dir . of Public 'Works : a. The document to convey title . b . Covenants and restrictions to be recorded. C . management and maintenance agreement to be entered into with the owners of the units of the project . 6. Improvement plans for water and sewer system shall meet the re- quirements- of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert , without cost to the City- and free of all liens and encumbrances. 9 . All on-site utilities , including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services . 10. Complete plans and specifications shall be submitted as required by Ordinance to the Dir. of Public. Works for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 11 . In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . II` 12 . Prior to recordation of the Final Map, the developer shall furnish - the original and three (3) copies of the water system plan to the Fire Marshal for review. 13 . All requirements of the City Fire Marshal shall be met as a part of the development of this tract . 14 . The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification : "I certify that the design of- the water system of Tract No. 11454 is in accordance with the requirements prescribed by the City Fire Marshal . Blowsand protection shall be provided in areas that do not have existing tree plantings. 5. Lot ' X' shall be extended to provide a drainage easement for storm waters. 6. CHUCK ROWE, San Diego , and representative of Union 76 , addressed Council showing pictures he had taken which indi- cated the station could not be seen from the Highway with- out these high ground signs . lie stressed their importance on the business of the station . Councilman Brush asked why the request was for one year , and what was the station going to do after the year . Mr . Rowe responded that the year ' s extension was all that was ( allowed , and they would probably then come back for another Il extension if this one were granted. Councilman McPherson stated that the intent of the Sign Ordinance was to allow signs for identification purposes , not for advertising. It was his feeling that these parti- cular signs were for advertising. He also stated that the angle from which the pictures were taken did not present an accurate view of how well the signs could be seen from Highway 111 . Councilman Wilson pointed out that the Frontage Road con- version is going to be accomplished in the very near future , and this will probably eliminate the problem of being able to see the station. Councilman Wilson moved and Councilman Newbrander seconded to waive further reading and adopt Resolution No. nanimously . B. REQUEST FOR APPROVAL of Final ract A4ap 11454-1 nrise Corporation., Applicant . Mr. Beebe reported that this was for the portion of Desert Squire located on Monterey Avenue . The Subdivision Agreement has been filed with the City . There are other certain require- ments that must be met , but the developer has 60 days after approval to comply. Staff recommended approval . Councilman McPherson moved and Councilman Wilson seconded to waive further reading and adopt Resolution No . 78-60, approving the Final Tract Map for Tract No. 11454-1 , effective upon annexation . Motion carried unanimously. XIV. ORAL COMMUNICATIONS None XV. REPORTS AND REMARKS A . CITY MANAGER 1 . Mr. Bouman reported that the Annexation ( 4) for Desert Squire had been approved , and the City Clerk had received verbal notice of this two days prior to the meeting . 2 . Mr. Bouman stated that pursuant to Council ' s direction for the City Manager and Staff to proceed with prepara- tion for the southside fire station , Staff felt that the City should proceed at once with architectural specifications. Resolution No . 78-61 has been prepared to authorize the City Manager to negotiate for these architectural services and further appropriates a sum of $15 , 000 from the New Construction Tax Fund to cover the anticipated costs. Because this is a new and exciting venture , He suggested that the Council be in on the architect selection . He assured that he would keep the Council advised and involved. Councilman Newbrander moved and Councilman McPherson seconded to waive further reading and adopt Resolution No . 78-61 ; carried unanimously . Chairman Berkey declared the Public Hearing open and asked if the applicant would like to speak at this time . GREG ERICKSON , representing J. M. Peters Co. , addressed the Commission and noted that for the catch basins to be operable and completed by recordation of the map is not feasible because of the heavy equipment that will be used during the completion of the project . Some discussion followed as to whether the case should be con- tinued until the catch basin question was solved. Mr. Williams suggested that Mr. Erickson and Mr . Beebe take time at this time to discuss the issue and try to solve it now. Commissioner Snyder noted that he would not approve any changes with regard to the retention basins because this has been a problem from the start of the whole project . Chairman Berkey suggested that Mr . Erickson and Mr. Beebe take time now to discuss and the case would be held over until later in the meeting. G. The following stipulations are set forth as pledges of the City Staff: 1 . Sunrise Company will be relieved of requirements to widen and improve the easterly side of Monterey Avenue. The City will undertake such improve- ments adjacent to the Desert Squire Project, with design geared to providing four moving lanes of traffic south of Clancy Lane and two moving lanes of traffic north of Clancy Lane. There will be left and right turn lanes at the Clancy Lane intersection. For the present, we will utilize only as much of the 99-foot right-of-way as is necessary, thus sparing the row of Oleanders until further widening may be needed at a future time. 2. City improvements to the easterly side of Monterey Avenue will include a reengineering and reconstruction of the Whitewater River Channel crossing so as to prevent the erosion of the roadway which takes place on the down- stream side of the crossing. Further, the City will schedule improvements and widening of the east side of Monterey from Parkview to the Whitewater Channel . The entire widening project, from Parkview to the north line of the Desert Squire property, will be scheduled for funding in the 1978-79 capital budget. If Desert Squire's construction program requires construc- tion of Monterey before July 1 , 1978, we feel a mutually satisfactory funding program can be worked out. 3. The City will make a negative declaration of an updated environmental impact report which has previously been submitted to and accepted by the County. 4. The City will provide, if necessary, a full-time building inspector on the project site. There will be no Performance Bonds required for the private streets in the development. 6. No interior or exterior sidewalks , horsetrails , or bicycle trails will be required; there will be no requirements to provide additional parking for recreational vehicles; and no swimming pool fencing will be required. 7. With respect to the project, no improvements will be required on Portola. 8. The row of power poles along the north side of the Desert Squire property are deemed by the Southern California Edison Company unable to be buried because of the high voltage they carry. Accordingly, there will not be requirements to underground said line. Please understand that the above stipulations are based on discussions that I have had with the City Council and that the Council is , in principle, in full agreement. You must realize, of course, that the total project is subject to a review process by the City's Design Review Board, the Planning Commission, and the City Council , and that undoubtedly, some questions will be raised during that process. However, you have my assurance that based on my discussions and understanding with officials of the City as of this date, I anticipate no major problems or obstructions to the formal execution and processing of both the development and e annexation. The existing line has two transmission circuits at 115KV as well as two distribution circuits at 33KV and 12KV. Undergrounding of the two 115 KV circuits represents a serious problem to the Edison Company. Not only would the cost of such conversion be exorbitant, but there are some very real technical problems associated with this kind of accomplishment. To date we do not have a satisfactory solution to undergrounding voltages in excess of 66 KV . The undergrounding of only the distribution facilities would not eliminate the overhead line. In addition, it might be necessary to either remove the existing tamarisk trees which are located on our easement, or secure an alternate easement to accommodate new underground facilities in three separate conduit systems. We feel that it would be economically impractical to convert the existing line to underground. Please let me know if you should wish to discuss this matter further or if we may provide additional information. The existing line has two transmission circuits at 115KV as well as two distribution circuits at 33KV and 12KV. Undergrounding of the two 115 KV circuits represents a serious problem to the Edison Company. Not only would the cost of such conversion be exorbitant, but there are some very real technical problems associated with this kind of accomplishment. To date we do not have a satisfactory solution to undergrounding voltages in excess of 66 KV. The undergrounding of only the distribution facilities would not eliminate the overhead line. In addition, it might be necessary to either remove the existing tamarisk trees which are located on our easement, or secure an alternate easement to accommodate new underground facilities in three separate conduit systems. We feel that it would be economically impractical to convert the existing line to underground. Please let me know if you should wish to discuss this matter further or if we may provide additional information. DISCUSSION: The subject Tentative Tract requires only minor modifications which are enumerated in the Special Conditions of Approval . Special Condition No. 1 responds to the requirement of providing emergency access to Portola Avenue which was a Special Condition of the related Development Plan, DP 12-77. Special Conditions No. 2 and No. 3 which require a storage lane at the entrance of Clancy Lane extended and the relocation of Lot 'K' and Lot 'G' entrances are being required for traffic safety purposes. Special Conditions No. 4 and No. 5 address the blowsand problem at the site and drainage at the eastern portion of the tract. Lot 'X' would have the dual role of providing emergency access and drainage. The Commission should note the attached letter from Kermit Martin of the Southern California Edison Company. In that letter Mr. Martin in- dicates that the utility company believes it would be economically im- practical to convert the existing overhead utility line along the north side of the subject tract to underground. The existing line has two transmission circuits at 115KV as well as two distribution circuits at 33KV and 1ZKV. Undergrounding of the two 115 KV circuits represents a serious problem to the Edison Company. Not only would the cost of such conversion be exorbitant, but there are some very real technical problems associated with this kind of accomplishment. To date we do not have a satisfactory solution to undergrounding voltages in excess of 66 KV. The undergrounding of only the distribution facilities would not eliminate the overhead line. In addition, it might be necessary to either remove the existing tamarisk trees which are located on our easement, or secure an alternate easement to accommodate new underground facilities in three separate conduit systems. We feel that it would be economically impractical to convert the existing line to underground. Install Riverside County super fire hydrants located at each street intersection = (a) but not greater than 500 feet apart in any direction. A. Exterior.surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red_15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The existing line has two transmission circuits at 115KV as well as two distribution circuits at 33KV and 12KV. Undergrounding of the two 115 KV circuits represents a serious problem to the Edison Company. Not only would the cost of such conversion,be exorbitant, but there are some very real technical problems associated with this kind of accomplishment. To date we do not have a satisfactory solution to undergrounding voltages in excess of 66 KV. The undergrounding of only the distribution facilities would not eliminate the overhead line. In addition, it might be necessary to either remove the existing tamarisk trees which are located on our easement, or secure an alternate easement to accommodate new underground facilities in three separate conduit systems. We feel that it would be economically impractical to convert the existing line to underground. Please let me know if you should wish to discuss this matter further or if we may provide additional information.
