SUBJECT: DISPOSITION OF LOT 61, TRACT 11791. SAGEWOOD SUBDIVISION

In response to your memo of July 26, I have contacted Jeff Molver regarding
the disposition of the subject lot. The following are responses to your three
concerns:
(1) What the original plans call for?
The original plans called for this lot to be utilized as a single-
family residential lot when the master storm drain system is installed.
(2) What are the costs of the change?
This is meaningless as the city is responsible for installing a storm
drain system that is functional . There were three different options, and
the option that we are providing is for two drain inlets in either side of
the future driveway for Lot 61 , as well as an easement along the north side
of the lot so that a storm drain can be installed to pick up the water from
Nolina Court and transmit it to the north/south storm drain located
immediately east of the Sagewood subdivision property line.
(3) Are all parties agreeable?
The city and the developer are agreeable as far as I am concerned. The
representatives from the homeowners association indicated that they may
consider purchasing the lot to make it into a "tot lot"; however, this
transaction will be outside the scope of our project. The city does not
have any responsibility to provide a "tot lot". The only responsibility the
city has is to install a functional drain system so that Lot 61 can . be
ultimately utilized for the construction of a residential housing unit.

I concur with your recommendation that the property in question
not be developed as a tot lot. The concern that I have at this
juncture revolves around what the members of the Sagewood
Homeowners Association board believes will occur with the
property. Are they of the opinion that the lot in question has
to be developed as a tot lot? I believe that they should be
notified that the lot can be developed with single-family
residential units.
The other concerns I have involve:
1 . What the original plans call for?
2. What are the costs of the change?
3. Are all parties agreeable?
I need this clarification before I will feel comfortable
authorizing any design changes or other action which was not
previously anticipated..

We have been negotiating with Michael Gallagher of the McBail Company
regarding the various possibilities for this lot. As you are aware,
Carlos Ortega lives immediately north of the lot, but you are probably
not aware that we have been discussing the desires of the Sagewood
Homeowners Association.
On June 20, 1988, Gregg Holtz and I met with three members of the board
to discuss their concerns. Those representatives were:
(1) Mr. Jeff Molever - President
(2) Ms. Molly Schecter - Vice President
(3) Ms. Geo J.Pack, Sr.- Secretary
They indicated several possibilities, one of which was to make that lot
into a tot lot for the neighborhood. After our discussions with
Michael Gallagher, as well as reviewing the possibilities with Willdan,
it is our feeling that the city should not purchase this lot, but
rather we should obtain a ten-foot easement along the north side of the
property so that we can connect to the storm drain that is going along
the east side of the .Sagewood subdivision. In this way, we can
eliminate the need for the city to maintain a tot lot, and we will have
provided storm water protection for the person who purchases or
develops the lot, as well as adjacent properties in the Sagewood
subdivision area.
We have discussed this briefly with Carlos Ortega, who is also the
property owner on the north side of Lot 61, but. we have not discussed
the matter with the property owner on the south side of Lot 61. In
view of the fact that the recommendation that the property be allowed
to be developed as a single-family residence unit, we do not see any
reason to make contact with that property owner at this point in time.
We have contact Ray Metzger to give us an appraisal of the lot, as well
as the ten-foot easement along the north side of the lot which would be
immediately south of Carlos Ortega's residence.

If this does not meet with your satisfaction, please contact me; other-
wise, we will proceed to make the necessary design changes to
accomplish the drain design based upon this memo, as well as negotia-

This letter follows receipt of your June 17 , 1988 letter, and our
meeting in your office on July 14 , 1988 , both pertaining to the
proposed Storm Drain Line to be extended through the above-
referenced lot .
Our position in this matter is as follows :
1 . The subject lot was conditioned to be vacant and
utilized as a storm drainage retention basin until such time as
an area storm drainage system was constructed.
2 . There are no, limitations on the Final Map for Tract
11791 limiting the use of lot 61, and we have paid taxes, as well
as Homeowner Association dues, for the past nine ( 9 ) years .
3 . We suggest the proposed Storm Drain Line could be
located along the north property line, and the Nolina Court inlet
redesigned to permit a driveway, thereby . allowing .the lot to be
developed.

4 . The development. of Lot 61 with a single-family home is
of benefit to the City and to the Sagewood Homeowners
Association.
5 . An alternative to the above would be for' the City to buy
the lot . After inquiring of certain local developers , we
estimate the current market value for an improved lot in an
attractive subdivision like Sagewood to be $45 , 000 .
We trust the above adequately outlines our position. Please call
if questions arise or further information is required.

We, at McBail Co . , would like to request the City
of Palm Desert for a delay in seeding the front lawns
for our Sage,,iood subdivision until the electrical power
has been tussled on by Southern California Edison.
As you know, Edison will not turn on the power until
the City has finaled the house. Therefore we are asking
for a final with the promise the lawn will be seeded
promptly upon receipt of power.
We are not requesting this for' all of the houses,
just for the ones the buyers will not be moving into
right away. A new lawn s;.ould be watered at least 4
times a day in the summer and without personnel on weekends
you can see our prob lem without the automatic system in use.
We would appreciate your consideration of our request.

Consideration of an Amendment to the Standard Conditions of Approval
and Special Conditions of Approval for Case No. TT 5565 in Order to
Permit Portola Avenue to Become a Private Roadway from its Intersection

Mr. Williams reported that Resolution 78-88 would amend certain Conditions
of Approval for Case No. TT 5565. He further stated that there would be

LARRY SPICER, Indian Wells, California, explained that this was rather a

Councilman McPherson moved and Councilman Brush seconded to waive further

D. CASE NO. TT 11791 , MCBAIL COMPANY Applicant: Consideration of a Request
for AP. of a ahtative Tract Map to create 101 Single-family P,esiden-
tial Lots and 3 Lots to Provide for a District Commercial Center, a Common
Recreation Area and Open Space from a 40 Acre Parcel located within the
P.C. (2) (Planned Commercial , District) and R-2 8,000 (8) (Single-family
Residential , 8,000 Sq. Ft. Min. Lot Area, 8,000 Sq. Ft. of Site Area(du)
Zones, Upon Annexation, at the Southeast Corner of Country Club Drive &
Monterey Avenue.
Mayor Mullins declared the Public Hearing Open.
Mr. Williams provided the Council with additional drawings of the
proposed Project. He stated that there would be a shopping Center (95,000
Sq. Ft. ) to include a Super Market, Gas Station and Retail shops. He
further stated that the Design Review Board had planned for high walls
around the property for protection in the blowsand area, and that the
buildings would face the parking lot for added protection against the
blowing sand. The common theme would be red tile roofs throughout, with
a 25 foot high buffer between Residential and Industrial . He stated that
Monterey and Country Club would be the two access points. The recommended
floor plan for two stories had been deleted, and the developers were in
the process of changing the design. He explained that there would be a
60 foot wide street meandering through the property with five cul -de-sacs.
The recreation area would include 2 tennis courts , swimming pool , jacouzi and
a small recreation building. Mr. Williams stated that this Project conforms
to the Zoning Ordinance and is suitable for the area, and therefore, the
Planning Commission, by Resolution 370 recommends approval . He added that
the Planning Commission had been split on the lot size issue.
Councilman Wilson questioned the Planning Commission ' s unanimous approval
even with the split on the Zoning.
Councilman Brush commented on the possible monotony- of having the roofs all
the same, whereas Mr. Williams explained that the roof design would not
be the same throughout, but that the red tile would tie it all together.
Councilman Nevibrande'r requested a drawing of the commercial section. She
also commented on the 1644 foot three bedroom House plan as being tight.
Mr. Williams responded that the issue of the house size had been discussed
many times.

MIKE GALLAGHER, MCBAIL COMPANY, presented a brief explanation that the
majority of the homes were from 1800 to 2000 sq. ft. , with approximately
20_ of them at the 1644 so,. ft. size. In response to Councilman Brush' s

up the monotony.

Councilman Brush inquired as to the objection to two-story buildings and
Mr. Gallagher explained that it was mainly because of the heat.
MR. JOSEPH TOBIN, Indian Wells, California, Director of Development at the
Eisenhower Medical Center, addressed Council stating that one of the big
problems they have at Eisenhower in recruiting help is the availability of
adequate housing. He also stated that he felt this Development would
alleviate traffic problems for their employees , as they could form car-
pools to and from work. Therefore, Mr. Tobin declared they were in favor
of the development of this Project, as it would be a big help to the future
�i growth of Eisenhower Medical Center.
Councilman McPherson stated that the applicant should be commended on the
planning of the meandering streets with the Village atmosphere.
Councilman Brush moved and Councilman McPherson seconded to waive further
reading and adopt Resolution No. 78-89, Approving the Tentative Tract subject to the
Conditions of Approval . Motion carried unanimously.
E. CASE NO. CUP 04-78, HOPE LUTHERAN CHURCH , Appellant: Consideration of an
Appeal of a Condition of Approval of Conditional Use Permit CUP 04-78 which
Approved an over-all Development Plan for a Church-School Complex, Partially
Developed, at the Northeast Corner of Portola Avenue and Fairway Drive.
Specifically, the Appellant is Appealing Special Condition No. 2 which
would require Curbs, Gutters and Sidewalks along Portola.
Mr. Williams reviewed the Staff report, stating that the Planning Commission
had qranted relief on Underground utilities. He further stated that due to
the increase in traffic on Portola, the Planning Commission felt that this
request is not justified and recommend denying the appeal .
Mayor Mullins invited input in FAVOR of the appeal .
MILAN MILKOVICH, Palm Desert, addressed Council , stating that he felt -ne
requirements had changed from time to time and that Hope Lutheran Church had
been in compliance with the former plan, therefore, did not feel they
should be responsible for the expense of new curbs and gutters.

REV. DARYL BJERKE, 45-930 Panorama Drive, Palm Desert, Pastor of the Hope
Lutheran. Church, addressed Council reiterating what Mr. Milkovich had said.
He stated that Hope Lutheran Church had been very cooperative in the past,
and felt they had complied with the original requests of the Planning
Commission.
Mayor Mullins inquired as to when the Curbs and Gutters had been installed.
Rev. Bjerke replied that they had been put in 18 years ago when the parking
lot was put in.
Councilman Brush questioned whether there mould be room for sidewalks at
the location of Felloo-:ship Hall . Mr. Williams responded that there would be
enough room for Curbs and Gutters, possibly not sidewalks.
Mayor Mullins stated that everything possible should be done to make
Portola safe and widened .

The curb in question was measured to be 5'-, inches at Hope Lutheran Church

Dear Mr. Beede:
This letter follows the meeting held in your office on Wednesday,
February 21, 1979, attended by yourself, and Mssrs. Titera and
Figueroa of VTN Consolidated, Project Engineers, and Mr Steve
Bailey and the undersigned representing McBail Company. The meet-
ing was requested in order to resolve the problem of conducting
storm drainage off the subject site. This problem has, in part,
held up the submittal of the final development plans , for the
property. The objective of the meeting was to arrive at a method
which was acceptable to both the City and McBail Company.
As a result of the meeting, the following statements constitute
our understanding of the particular drainage situation, and the
proposed solution which was discussed and understood to be accept-
able to both the City of Palm Desert and McBail Company:
1. The City of Palm Desert, Public Works Department (City)
is in the process of developing a Master Storm Drainage Plan and
System (MSDS) for the drainage area which includes the McBail
property. The MSDS, being prepared by an engineering consultant,
is partially complete and should be concluded by June or July 1979.
The study has thus far proceeded to the extent that alternative
drainage systems have been prepared and line sizes determined.
2 . Preliminary MSDS study findings indicate that a +96"
storm drainage line will be required along the eastern boundary
of the McBail property, extending south from Country Club Drive.
Further, as that line continues south from the McBail property
to Hovley Lane and thence east along Hovley Lane to a daylight
point, the line diameter increases to +120 inches.

3. McBail is prepared to construct the storm drainage line
as generally described above to the extent of its per/acre storm
drainage fee assessment by the City. However, unless the storm
water in that line is picked up by another downstream segment of
the MSDS, there is a potential liability to the City and McBail
from the possible down-stream concentration of storm water on
local streets and private property.
4. At the present time, the City does not have the funds
necessary to construct the MSDS. Actual implementation of the
MSDS is expected to be carried out incrementally through improve-
ment requirements of various development projects as they are
approved by the City, in addition to the City' s use of accumulated
storm drainage fee assessments . In the interim, the City will
accept temporary solutions which will permit projects, such as
McBail ' s, to be developed.
5 . McBail and the City have agreed to a temporary method and
solution for meeting the storm drainage requirements of the subject
land and proposed development. The method allows McBail to utilize
one or more identified areas of the subject property as temporary
storm drainage retention basins. The combined capacity of these
basins shall be sufficient to contain at least the calculated off-
site storm water drainage of a storm of 10 year frequency.
6 . McBail has revised and submits under separate cover, the
final improvement plans for Tract 11791. The final plans include
the grading and drainage plan, depicting, in part, the two areas
to be utilized as temporary retention basins. They are described
as follows:
A. Lot 102 . Recreation Center. The storm drainage
areas include the ground area surrounding the tennis cour`_s,
pool and cabana facilities.
B. Lot 61. McBail agrees that this lot will not be de-
veloped for the intended use as . a single-family dwelling un-
til such time as the McBail land can be served by the MSDS .
The City agrees to permit McBail to develop said lot at that
time.
7. McBail agrees to pay to the City the required storm drain-
age fees on the basis of $1, 500 per acre . The City agrees to cre-
dit McBail with the agreed-upon amount McBail paid to the owner of
AP 621-190-050 for the 15 ft. storm drainage easement acquired by
N McBail prior to this agreement for the benefit of the City and
ultimately to be utilized in the MSDS.

8. The City agrees to size the storm drainage line serving
the McBail property in the MSDS without regard to McBail ' s tem-
porary use of lot 61 for a storm drainage retention basin. The
intent being that the drainage fees McBail pays to the City will
ultimately result in a storm drainage system serving McBail' s
property, to the extent that the land areas McBail agrees to uti-
lize as temporary retention basins can be released from such tem-
porary use and developed for the intended use.
We hope the above sufficiently outlines the conclusions and pro-
posals reached at the meeting, and adequately explains our pro-
posed temporary solution. Please advise if further information
is required.

said project , and this consideration has been determined to be an on-
going project; and,
WHEREAS, the City Council did take into consideration the Tenta-
tive Map as submitted, and the reports of the various reviewing agencies ;

3. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of anv
building permits . Prior to recordation of the final subdivision man ,

story limitation for buildings .

appurtenances as may be approved by the Director of Environmental

8. Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The sub-
divider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the
construe-period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with the re-
quired fire flows shall be installed as recommended by the Fire Mar-
shal .
10. All requirements of the City Fire Marshal shall be met as a part of
the development of this tract per attached memorandum.
11 . Drainage shall be subject to approval of the Director of Public
iWorks. Applicant shall provide engineered data as requested .
12 . All requirements of the Planning Commission action on related Case
No . DP 03-78 shall be met as a part of the development of this tract .
13 . The total number of lots shall be limited to 104 .

Special Conditions :

include an 8 ' slightly meandering bike path and intensive landscap-

11. Cul-de-sac at the end of "H" Street shall be shortened to provide

1 . Install a water system capable of delivering 1500 GP%1 fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yeilo•v,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final_ map, the developer shall furnish the original
and three (3) copies of. the water system plan to 'the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification : "I certify that the

Mr. Williams reviewed the Staff Report and noted a map showing
the proposed zoning and ci.rculati.on pattern . He also referred to a
letter received from Mr. Urrsch and his request for an average of
R- 1-7 , 500 sq . It . as a zoning designation .
Chairman Berkey asked what the time restraints were on this mat-
ter . Mr . Williams noted that: the Commission could deliberate indefi-
nently . Chairman Berkey asked for further reasoning with regard to
the R-2-8 , 000 zone designation . Mr. Williams noted that it is adja-
cent to commercial and it is better to develop the commercial and re-
sidential together to help form a buffer for the rest of the develop-
ment .

Beach , owner of 40 acres on �l
/ the southwest , soutinvest corner of Section 9 , told
1�5 the Commission of his conversation with the various
neighbors in the area of his sand dunes and how
they and he were in favor of the Open Space desig-
nation being changed. He also noted that the sand-
dunes are being destroyed by 4 things : the sage
brush, dune buggies , adjacent developments , and
the City protecting them. Mr . McDonald stated that
the whole area should be reserved as a sand dune
preserve or none of it .
AIR. RAFF, owner of 3 . 95 acres, a homestead parcel
located on Monterey and Hovely Lane , asked to have
it clarified how the proposed zoning would affect
the small landowner such as himself . Mr . Williams
stated that as the pre-zoning was being done as a
single project , individual property owners would be
exempt from the minimum site area required to obtain
a Change of Zone to the P-R zone . As a result , in-
dividual property owners would be able to develop
under the PR zone no matter what acreage they owned
once the pre-zoning is approved for the entire area .
He further stated that this zoning designation would
limit the .area to condos and residential homes . Chair-
man Berkey noted that the staff would then be the co-
ordinator for all the property in the area . Air. Raff
stated that he must dedicate land for road use . Air .
Williams noted that since Hovely Lane already exists
that there should be no problem.
RICHARD ARNOLD , 73-722 Santa Rosa, an adjacent developer
told of his experiences in other areas with sand dunes,
and he noted that adjacent development would stop the
sand dunes from being sand dunes as it takes sand to
make sand dunes .
EUNICE PIERSON, representing Mr. Hirsch , noted that
Air. Hirsch would appreciate further consideration of
his request for 8 , 000 sq . ft . average per lot .
SID HANDY, Aster Drive , 18 year resident , spoke in op-
position to a open space in the middle of the City .
AIRS . JOHN QUINN, stated she had a petition with 5G-58
signatures against the open space zoning , noting that
it is a poor concept .
DENNIS HEALY , Attorney for Air . McDonald, spoke in op-
position to the open space zoning and presented pictures
of the sand dunes in the area .
JIM AICKEE , 73-506 Joshua Tree , owner at Portola Country
Club , stated his opposition to the open space zoning..

RICHARD GUELICH , Santa Cruz, noted the extensive work
that the Staff had put into the report on the pre-
zoning and he noted his concern for the ability of the
City to maintain the open space .
Chairman Berkey stated that he felt the case should be continued
for further review. Commissioner Kelly stated that more input is needed
on the utilities in the area and the maintenance of the sand dunes .
Commissioner Kryder indicated more information was needed on the traffic
situation . Commissioner Snyder asked that Staff be able to answer the
questions regarding maintenance of the open space and alternatives to
an open space zoning designation .
On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the Commission continued Case C/Z 01-78 to June 14 , 1978 for
further review and study ; carried unanimously (4-0) . .

had approved a previous extension of one year .

sioner Snyder asked why the delay . Mr . Holden stated
that there was a problem with funding due to the size
of the interior of the restauant . Further, the only
problem that now exists is the line-of-site problem
but that should be resolved with the Redevelopment
plans for that area of the City.

required by Ordinance and the Director of Public works , shall be
installed in accordance with City standards .
3. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits . Prior to recordation of the final subdivision map ,

tion period, the subdivider shall maintain passable vehicular access
to all buildings . An adequate number of fire hydrants with the re-
quired fire flows shall be installed as recommended by the Fire Mar-

II. STAFF RECOMMENDATION :

Justification:
1 . The subject Tentative Map does substantially comply with Chapter 26 of
the City of Palm Desert Municipal Code, and the State of California
Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General Plan and
the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development proposed.

will not have a significant adverse effect on
the environment.

IV. DISCUSSION:
One of the principal concerns with regard to this project, due to its
location , is blowsand and appropriate methods of controlling it. Special
Condition No. 1 requires that blow-sand protection be provided on all sides
of the project, yet the condition allows flexibility as to the means neces-
sary to control the sand. Special Condition No. 5 requies a 6 foot block
wall on the north side of Lots 13-20, Lot 102 and Lots 36-41 which represent
the northern portion of the residential tract. Special Condition No. 11
involves both right-of-way required on Monterey Avenue and landscaping
which will serve as a means of blowsand control on the western portion of
the tract along Monterey.
Traffic circulation will be no problem in the area. Ingress and egress shall
be restricted onto Monterey Avenue except at 'A' Street. . A $15,000 contri-
bution toward the signalization of the intersection of Country Club Drive
and Monterey i.s being required. Dedication is being required along Monterey
to provide for a 34 foot half width and a 16 foot parkway which shall include
an 8' .slightly meandering bike path. Special Condition No. 12 requires one
minor change. with regard to circulation, the cul -de-sac at the end of 'H'
Street is to be shortened to provide a minimum of 35 feet of frontage for
Lots 47 & 48. Public improvements required include sidewalks on Monterey and
Country Club Drive; those adjacent to the commercial area to be 10 feet in
width.
Staff has received a letter from the City of Rancho Mirage regarding Case
No. DP 03-78, the commercial portion of the project under discussion. Some
of the comments , however, actually pertain to the tentative tract map pre-
sently being discussed. The City of Rancho Mirage's first comment pertains
to the proximity at which residential and commercial uses would be located
in this project and this is said not to be a good mix. Staff believes this
comment is invalid as there will be a 20 foot buffer with a block wall be-
tween the. residential and commercial portions of the project. The Planning
Commission has previously approved a project with mixed uses , the El Paseo
Village project on the south side of E1 Paseo between Sun Lodge and Lupine
and believed the two uses were compatible on a much smaller site than the
present site. Projects done elsewhere, including one in Palm Springs, in-
dicate that residential projects adjacent to well-designed commercial pro-
jects can be highly successful .
The City of Rancho Mirage also contends that many of the residential lots are
irregular and too small in area. The Staff believes that the irregular shaped
lots and flag lots create a much more interesting residential tract and pro-
vide the developer with flexibility to provide interesting and diverse site
plans and landscaping. With regard to density, at 3.5 du/acre the proposed
project does not exceed Rancho Mirages 's recommended 3.0 du/acre significantly.
In addition , the developer is providing a large common recreation area which
will adequately compensate for some of the area lacking in the individual
lots.
The City of Rancho Mirage also contends that Monterey and Country Club should
have traffic signals. This concern is being addressed as previously indicated
by Special Condition No. 8

IV. DISCUSSION (Cont. )
The present Tentative Tract Map contains revisions required by the
Commission at the May 17th meeting. The "H" Street cul -de-sac has
been shortened, the 4' x 20' landscape easements along Monterey Avenue
deleted, and a number of lot lines adjusted to create 8,000 square
feet minimum lots for all lots. More detailed calculations of lot
areas will be made by the Department of Public Works at the final map
review stage, but Special Condition No. 12 guarantees that the 8,000
square feet minimum will be adhered to. The Revised Tentative Map
submitted indicates that all lots will be a minimum of 8,000 square feet.

This is to report to you that on April 26, 1978, the Planning Commission of
the City of Rancho Mirage discussed Case DP-03-78 as transmitted by your
office. The location of the project is on the southeast corner of Country
Club and Monterey and consists of 40 acres to be used for a commercial develop-
ment and single family development.
I am aware that your request was to have the information returned to your
office by April 25, 1978, but because the Planning Commission did not meet
until April 26, 1978, their recommendation is being sent to you at this time.
Attached you will find a letter dated April 21 , 1978 from Mr. William Probert,
City Manager, addressed to Mayor Ed Mullins , asking for an extension of time
to allow the Planning Commission an opportunity to comment.
The. City Planning Commission recommends denial of Case DP-03-78 subject to
the following reasons as outlined in staff report dated April 20, 1978.
1 . The commercial activity being proposed so close to the proposed use by
single family residences is not a good mix.
2. The plan shows Monterey Avenue as having a 50' dedication for a half width
street. The City's General Plan indicates Monterey as a 55 ' half width
street with an ultimate full width dedication of 1101
.
3. The lot size as provided in the residential area is a minimum 8,000 sq.ft.
and the Commission feels this minimum is too small and should at least be
compatible with the City' s minimum of 10,000 sq. ft. Plany of the lots
within the residential development are irregular in shape and have street
frontages as small as 20 ' . This does not meet the City's minimum design
standards and the Commission feels this small frontage causes problems in
the future and is not good design. The density of the residential project
is 3.5 units per acre, exceeding the density of 3 units per acre per City
of Rancho Mirage requirements. It is not a desirable density.
4. Monterey and Country Club should have signals at this location.

Mr . Williams reviewed the Staff Report and noted a map showing
the proposed zoning and circulation pattern . He also referred to a
ler.ter ' received from Sir. Hirsch and his request for an average of
R-1-7, 500 sq . ft . as a zoning designation .
Chairman Berkey asked what the time restraints were on this mat-
ter . Mr. Williams noised that the Commission could deliberate indeCi-
nently. Chairman Berkey asked for further reasoning with regard to
the R-2-8 , 000 zone designation . Mr. Williams noted that it is adja-
cent to commercial and it is better to develop the commercial and re-
sidential together to help form a buffer for the rest of the develop-
ment .

Chairman Berkey declared the Public Hearing and asked if ._�
there was anyone wishing to speak on the matter .
F. N. 11CDONALD, Long Beach , owner of 40 acres on
/ the southwest , southwest corner of Section 9 , told
'£he Commission of his conversation with the various
neighbors in the area of his sand dunes and how i
they and he were in favor of the Open Space desig-
nation being changed. He also noted that the sand-
dunes are being destroyed by 4 things : the sage
brush , dune buggies , adjacent developments , and
the City protecting them. Mr . McDonald stated that
the whole area should be reserved as a sand dune
preserve or none of it .
11R. RAFF, owner of 3 . 95 acres , a homestead parcel
located on Monterey and Hovely Lane , asked to have
it clarified how the proposed zoning would affect
the small land owner such as himself . Mr . Williams
stated that as the pre-zoning was being done as a
single project , individual property owners 'would be
exempt from the minimum site area required to obtain
a Change of Zone to the P-R zone . As a result , in-
dividual property owners would be able to develop
under the PR zone no matter what acreage they owned
once the pre-zoning is approved for the entire area.
He further stated that this zoning designation would
. limit the area to condos and residential homes . Chair-
man Berkey noted that the staff would then be the co-
ordinator for all the property in the area . Mr. Ruff
stated that he must dedicate land for road use . Mr .
Williams noted that since Hovely Lane already exists
that there should be no problem.
RICHARD ARNOLD . 73-722 Santa Rosa, an adjacent developer
told of his experiences in other areas with sand dunes ,
and he noted that adjacent development would stop the
sand dunes from being sand dunes as it takes sand to
make sand dunes .
EUNICE PIERSON, representing Mr. Hirsch, noted that
Mr . Hirsch would appreciate further consideration of
his request for 8 , 000 sq . ft . average per lot .
SID HANDY, Aster Drive , 1S year resident , spoke in op-
position to a open space in the middle of the City .
MRS . JOHN QUINN, stated she had a petition with 56-58
signatures against the open space zoning , noting that
it is a poor concept .
DENNIS HEALY, Attorney for `Ir . McDonald , spoke in op-
position to the open space zoning and presented pictures
of the sand dunes in the area.
JIM 1(CKEE , 73-500 Joshua Tree , owner at Portola Country
Club , stated his opposition to the open space zoning.

GEORGE MARZICOLA , President of Country Club Property
Owners Association , noted he is generally in agreement
with the proposed zoning and annexation . lie stated
that the extension of streets and the improvements
of others should be taken into consideration with a
bridge considered on Cook Street . Further he noted
that the Association is opposed to annexations because
of the Excise Tax involved.
RICHARD GUELICH, Santa Cruz , noted the extensive work
that the Staff had put into the report on the nre-
zoning and he noted his concern for the ability of the
City to maintain the open space .
Chairman Berkey stated that he felt the case should be continued
for further review. Commissioner Kelly stated that more input is needed
on the utilities in the area and the maintenance of the sand dunes .
Commissioner Kryder indicated more information was needed on the traffic
situation . Commissioner Snyder asked that Staff be able to answer the
questions regarding maintenance of the open space and alternatives to
an open space zoning designation .

On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the Commission continued Case C/Z 01-73 to June 14 , 1978 for
further review and study ; carried unanimously (4-0) .

Mr. Williams reviewed the case and noted that the Commission
had approved a previous extension of one year .

he was available to answer any questions . Commis-
sioner Snyder asked why the delay . Mr . Holden stated
that there was a problem with funding due to the size
of the interior of the restauant . Further , the only
problem that now exists is the line-of-site problem
but that should be resolved with the Redevelopment
plans for that area of the City.

the subject property and weighs the environmental impacts of said project ,
and this consideration has been determined to be an on-going project ; and,
WHEREAS , the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies; and,
WHEREAS , the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Subdivision Map Act ,

CONDITIONS OF APPROVAL

Standard Conditions :
1 . The development of the property' described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal, ordinances and State and Federal statutes
now in force, or which hereafter may be in force .
2. Full public improvements including traffic safety lighting as
required by Ordinance and the Director of Public works , shall be
installed in accordance with City standards .
3. The C.C. &R' s for this development shall be submitted to the Director
of Public works for review and approval prior to the issuance of any
building permits . Prior to recordation of the final subdivision map ,
the applicant shall submit to the Director of Public works :
a. The document to convey title .
b. Covenants and restrictions to be recorded including a single
story limitation for buildings .
C. management and maintenance agreement to be entered into with
the owners of the units of the project .
4. Improvement plans for water and sewer system shall meet the require-
ments of the respective service districts .
5. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
7. All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services .
8. Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public works for checking and approval
before construction of any improvements is commenced. The sub-
divider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings . An adequate number of fire hydrants with the re-
quired fire flows shall be installed as recommended by the Fire mar-
shal .
10. All requirements of the City Fire marshal shall be met as a part of
the development of this tract per attached memorandum.
11 . Drainage shall be subject to approval of the Director of Public
Works . Applicant shall provide engineered data as requested.

12 . All requirements of the Planning Commission action on related Case
No. DP 03-78 shall be met as a part of the development of this tract .

F. Environmental Finding: The Director of Environmental Services has
determined on April 24, 1978 that the project
will not have a significant adverse effect on
the environment.

Telephone - General Telephone Co.
IV. DISCUSSION:
One of the principal concerns with regard to this project, due to its
location, is blowsand and appropriate methods of controlling it. Special
Condition No. 1 requires that blow-sand protection be provided on all sides
of the project, yet the condition allows flexibility as to the means neces-
sary to control the sand. Special Condition No. 5 requies a 6 foot block
wall on the north side of Lots 13-20, Lot 102 and Lots 36-41 which represent
the northern portion of the residential tract. Special Condition No. 11
involves both right-of-way required on Monterey Avenue and landscaping
which will serve as a means of blowsand control on the western portion of
the tract along Monterey.
Traffic circulation will be no problem in the area. Ingress and egress shall
be restricted onto Monterey Avenue except at 'A' Street. . A $15,000 contri-
bution toward the signalization of the intersection of Country Club Drive
and Monterey is being required. Dedication is being required along Monterey
to provide for a 34 foot half width and a 16 foot parkway which shall include
an 8' slightly meandering bike path. Special Condition No. 12 requires one
minor change with regard to circulation, the cul-de-sac at the end of 'H'
Street is to be shortened to provide a minimum of 35 feet of frontage for
Lots 47 & 48. Public improvements required include sidewalks on Monterey and
Country Club Drive; those adjacent to the commercial area to be 10 feet in
width.
Staff has received a letter from the City of Rancho Mirage regarding Case
No. DP 03-78, the commercial portion of the project under discussion. Some
of the comments , however, actually pertain to the tentative tract map pre-
sently being discussed. The City of Rancho Mirage's first comment pertains
to the proximity at which residential and commercial uses would be located
in this project and this is said not to be a good mix. Staff believes this
comment is invalid as there will be a 20 foot buffer with a block wall be-
tween the residential and commercial portions of the project. The Planning
Commission has previously approved a project with mixed uses , the El Paseo
Village project on the south side of El Paseo between Sun Lodge and Lupine
and believed the two uses were compatible on a much smaller site than the
present site. Projects done elsewhere, including one in Palm Springs , in-
dicate that residential projects adjacent to well-designed commercial pro-
jects can be highly successful .
The City of Rancho Mirage also contends that many of the residential lots are
irregular and too small in area. The Staff believes that the irregular shaped
lots and flag lots create a much more interesting residential tract and pro-
vide the developer with flexibility to provide interesting and diverse site
plans and landscaping. With regard to density, at 3.5 du/acre the proposed
project does not exceed Rancho Mirages's recommended 3.0 du/acre significantly.
In addition , the developer is providing a large common recreation area which
will adequately compensate for some of the area lacking in the individual
lots.
The City of Rancho Mirage also contends that Monterey and Country Club should
have traffic signals. This concern is being addressed as previously indicated
by Special Condition No. 8

The present Tentative Tract Map contains revisions required by the
Commission at the May 17th meeting. The "H" Street cul -de-sac has
been shortened, the 4' x 20' landscape easements along Monterey Avenue
deleted, and a number of lot lines adjusted to create 8,000 square
feet minimum lots for all lots. More detailed calculations of lot
areas will be made by the Department of Public Works at the final map
review stage, but Special Condition No. 12 guarantees that the 8,000
square feet minimum will be adhered to. The Revised Tentative Map
submitted indicates that all lots will be a minimum of 8,000 square feet.

This is to report to you that on April 26, 1978, the Planning Commission of
the City of Rancho Mirage discussed Case DP-03-78 as transmitted by your
office. The location of the project is on the southeast corner of Country
Club and Monterey and consists of 40 acres to be used for a commercial develop-
ment and single family development.
I am aware that your request was to have the information returned to your
office by April 25, 1978, but because the Planning Commission did not meet
until April 26, 1978, their recommendation is being sent to you at this time.
Attached you will find a letter dated April 21 , 1978 from Mr. William Probert,
City Manager, addressed to Mayor Ed Mullins , asking for an extension of time
to allow the Planning Commission an opportunity to comment.
The City Planning Commission recommends denial of Case DP-03-78 subject to
the following reasons as outlined in staff report dated April 20, 1978.
1 . The commercial activity being proposed so close to the proposed use by
single family residences is not a good mix.
2. The plan shows Monterey Avenue as having a 50 ' dedication for a half width
street. The City's General Plan indicates Monterey as a 55 ' half width
street with an ultimate full width dedication of 110' .
3. The lot size as provided in the residential area is a minimum 8,000 sq. ft.
and the Commission feels this minimum is too small and should at least be
compatible with the City' s minimum of 10,000 sq. ft. Many of the lots
within the residential development are irregular in shape and have street
frontages as small as 20' . This does not meet the City's minimum design
standards and the Commission feels this small frontage causes problems in
the future and is not good design. The density of the residential project
is 3.5 units per acre, exceeding the density of 3 units per acre per City
of Rancho Mirage requirements. It is not a desirable density.
4. Monterey and Country Club should have signals at this location.

renderings of the proposed units . He noted that the subdivision con-
tains pedestrian access to the commercial development .
Commissioner Snyder asked 'now many 2 story units there would
be? Mr . Gallagher noted that there would be 45 and in answer to
a question by Commissioner Kryder as to whether they would be spread
out, he stated that they would be.
Commissioner Kryder asked if the Design Review Board had had
any comments on the pool and jacuzzi area. He noted that there would
be children in the area and perhaps the applicant should consider an
area for children in the major pool area or a wading pool in the
recreation center area. Commissioner Kelly asked if there would be
a fence. Mr. Williams noted that it is mandatory .
Commissioner Fleshman and Commissioner Kelly noted their objec-
tion to the 2 story units and asked if the applicant had anything to
say on this issue .

popular but there are alternatives available .
He also noted that he agreed with the pool area
idea.
Commissioner Fleshman stated that there are very few 2-
story homes in the community and he wondered if the applicant had
considered the heat loss and the cooling efficiency in 2-story
homes.
Chairman Berkey noted that it is the desire of the community
to have single-story homes rather than 2-story .
Commissioner Fleshman asked about the type of roofing tile
to be used. Mr. Gallagher noted it would be barrel tile .
Commissioner Kryder asked about the widths of the proposed
streets and if it would be sufficient . He also noted that a Special
Condition should require that the traffic signal proposed be opera-
tive prior to the completion of the project . Commissioner Kelly
asked what the schedule was for the signal and if anyone else was
contributing to its cost . Mr . Beebe stated that it is 5th on the
list of signals proposed and that it would probably not be operative
for 2 to 3 years , but perhaps left turn pockets would be helpful
prior to the signal being put in . He also noted that there was
no one else contributing at this time. Commissioner Kryder again
noted his objection to approving the project without a condition
mandating traffic control improvements being completed prior to `
the completion of the project . Mr. Beebe suggested a Special Con- (t
dition No. 13 which would read : Subject to approval of the Director
of Public Works, adequate traffic safety provisions shall be made and
methods of improving traffic circulation in the vicinity shall be
provided at the intersection of Monterey and Country Club.
Commissioner Fleshman questioned the perimeter wall ' s design .
Mr. Williams noted that it would be slumpstone with a meandering
bikepath and 8 feet of landscaping. Commissioner Fleshman stated
that the wall on ➢4onterey should be other than straight . Some dis-
cussion followed with regard, to the s(rthern-and eastern wall and whether
it should meander; what type of landscaping it would have and how
much; why is there windbreak protection on the south.
Chairman Berkey noted that the applicant does have flexibility ,
to place a fence on the south and east side rather than a wall . Mr .
Williams noted that this was correct. Mr . Gallagher noted that he would
like to have some flexibility. Mr. Beebe noted that the sidewalk
must remain in the public right-of-way .
Chairman Berkey asked if there was anyone wishing to speak
in FAVOR or in OPPOSITION to the project . Being none, he declared
the Public Hearing closed and asked for the pleasure of the Commission .
Commissioner Fleshman stated that he still had questions
regarding the fencing on the south and east sides . Mr . Williams
noted that the Design Review Board will approve the blow sand pro-
tection measures. Commissioner Fleshman suggested a change to
Condition No. 5 adding "conforming to Exhibit A, sheet 4 of the sub-
mitted plans" and replace "concrete" with "decorative" . On Condition
No. 10, delete the last two lines .

the room due to a possible conflict as he has in the past worked with
Mr. Ballew.
Mr . Williams reviewed the Staff Report and noted that the pro-
posed concept would allow for the dividing up of Ironwood ( local)
traffic from through traffic. The proposal would also discourage
the use of Portola as a by-pass to Highway 74 .
Chairman Berkey declared the Public Hearing open and asked
if anyone wished to speak in FAVOR or in OPPOSITION to the proposal .
JOHN BALLEW, addressed the Commission and noted that
Mesa View would better serve the area and that Ironwood
has been looking at the circulation system and Portola ' s
role for some time . He noted that an indepth study was
put into the location of the park and the proposed fire
station in addition to circulation and traffic. He also
noted that this alternative will better serve the City
and that most of the area residents seem in agreement .
SHIRLEY SPORK, 73010 Somera Drive , indicated her concern
with the added traffic that would be dumped onto Alamo
and that she would like the Planning Commission to con-
sider improving Chia Drive as an additional access road
to Portola.
Mr. Williams noted that the proposed General Plan Amendment
would have the potential of reducing the amount of traffic on Alamo
and he also noted that Chia is proposed to be extended.
' LARRY SPICER, Silver Spur Assoc . , mentioned that the
Silver Spur Ranchers Assoc. had indicated to him that
they are in favor of the proposal .

IV. DISCUSSION:
One of the principal concerns with. regard to this project, due to its
location, is blowsand_and appropriate methods of controlling it. Special
Condition No. l.r�quire's that blow-sand protection be provided on all sides
of the project, yet the condition allows flexibility as to the means neces-
sary to control the sand. Speciarl. Condition No. 5 requies a 6 foot block
wall on the north side of Lots 13-20, Lot 102 and Lots 36-41 which represent
the northern portion of the residential tract. Special Condition No. 11
involves both right-of-way required on Monterey Avenue and landscaping
which will serve as a means of blowsand control on the western portion of
the tract along Monterey.
Traffic circulation will be no problem in the area. Ingress and egress shall
be restricted onto Monterey Avenue except at 'A' Street. A $15,000 contri-
bution toward the signalization of the intersection of Country Club Drive
and Monterey is being .required. Dedication is being required along Monterey
to provide for a 34 foot half width and a 16 foot parkway which shall include
an 8' slightly meandering bike path. Special Condition No. 12 requires one
minor change with regard to circulation, the cul -de-sac at the end of 'H'
Street is to be shortened to provide a minimum of 35 feet of frontage for
Lots 47-& 48. Public improvements required include sidewalks on Monterey and
Country Club Drive; those adjacent to the commercial area to be 10 feet in
width.
Staff has received a letter from the City of Rancho Mirage regarding Case
No. DP 03-78, the commercial portion of the project under discussion. Some
of the comments, however, actually pertain to the tentative tract map pre-
sently being discussed. The City of Rancho Mirage's first comment pertains
to the proximity at which residential and commercial uses would be located
in'-.this project and this is said not to be a good mix. Staff believes this

WHEREAS , said application has complied with the requirements of
the "City of Palm Desert Environmental duality Procedure Resolution No.
78-32 in that the. Director of Environmental Services has developed an
expanded initial study on the Prezoning Case No . C/Z O1-78 which includes
the subject property and weighs the environmental impacts of said project ,
and this consideration has been determined to be an on-going project ; and,
WHEREAS , the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies; and,
WHEREAS , the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Subdivision Map Act ,
as amended; and,
WHEREAS , the Planning Commission did find that the subject Tenta-
tive Map does comply with the adopted General Plan and the Palm Desert
Zoning Ordinance; and,
WHEREAS, the Planning Commission did find that the site is
physically suitable for the type of development proposed; and,
WHEREAS, the Planning Commission did find that the site is
physically suited for the proposed density of the development ; and ,
WHEREAS , the Planning Commission did find that the design of the
subdivision and the proposed improvements are not likely to cause sub-
stantial environmental damage or serious health problems.
NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the
City of Palm Desert , as follows :
1 . That the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2 . That it does hereby recommend that the applicant pay a fee
in an amount determined under the Ordinance provisions in order to com-
ply with Article 26. 15 of the City ' s Subdivision Ordinance regarding
the public facilities requirement ;

CONDITIONS OF APPROVAL
CASE NO. TT 11791
Standard Conditions :
1 . The development of the property described herein shall be subject '
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force .
2 . Full public improvements including traffic safety lighting as
required by Ordinance and the Director of Public Works , shall be
installed in accordance with City standards .
3. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits . Prior to recordation of the final subdivision map ,
the applicant shall submit to the Director of Public Works :
a. The document to convey title .
b. Covenants and restrictions to be recorded including a single
story limitation for buildings .
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
4. Improvement plans for water and sewer system shall meet the require-
ments of the respective service districts .
5. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
7. All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
8. Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval
before construction of any improvements is commenced. The sub-
divider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings . An adequate number of fire hydrants with the re-
quired fire flows shall be installed as recommended by the Fire Mar-
shal .
10. All requirements of the City Fire Marshal shall be met as a part of
the development of this tract per attached memorandum.
11 . Drainage shall be subject to approval of the Director of Public
Works . Applicant shall provide engineered data as requested.
I} 12. All requirements of the Planning Commission action on related Case
No. DP 03-78 shall be met as a part of the development of this tract .
13 . The total number of lots shall be limited to 104 .
14. The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen ( 18)
months is granted by a Resolution of the City Council .

6. No ingress or egress to any of the lots shall be provided from
Monterey Avenue excepting at "A" Street .
7. Traffic safety lighting shall be provided at "A" Street at both
ends thereof.
8 . Applicant shall make a $15, 000 contribution towards the signalization
of the intersection at Country Club Drive and Monterey.
9. All drainage shall be engineered and approved by the Director of
Public Works .
10. Applicant shall dedicate sufficient land along Monterey Avenue to
provide for a 34 foot half width and a 16 foot parkway which shall
include an 8' slightly meandering bike path and intensive landscap-
ing.
11. Cul-de-sac at the end of "H" Street shall be shortened to provide
at least 35 feet of frontage for Lots 47 & 48. Lots 46 - 50 shall
be adjusted to incorporate the additional land area so that none `
of the lots shall be less than 8 , 000 sq. ft . lL
12. All residential lots shall be a minimum of 8 , 000 sq. ft . and all
development shall conform to all requirements of said Zone District .
13. Subject to approval of the Director of Public Works, adequate traffic

Provide the following fire protection:
1 . Install a water system capable of delivering 1500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. .prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 11791 is in accordance with the
requirements prescribed by the Fire Marshal . " Upon approval , the original plan
will -be returned to the developer.

Dear Mr. Williams:
This is to report to you that on April 26, 1978, the Planning Commission of
the City of Rancho Mirage discussed Case DP-03-78 as transmitted by your
office. The location of the project is on the southeast corner of Country
Club and Monterey and consists of 40 acres to be used for a commercial develop-
ment and single family development.
I am aware that your request was to have the information returned to your
office by April 25, 1978, but because the Planning Commission did not meet
until April 26, 1978, their recommendation is being sent to you at this time.
Attached you will find a letter dated April 21 , 1978 from Mr. William Probert,
City Manager, addressed to Mayor Ed Mullins , asking for an extension of time
to allow the Planning Commission an opportunity to comment.
The City Planning Commission recommends denial of Case DP-03-78 subject to
the following reasons as outlined in staff report dated April 20, 1978.
1 . The commercial activity being proposed so close to the proposed use by
single family residences is not a good mix.
2. The plan shows Monterey Avenue as having a 50' dedication for a half width
street. The City's General Plan indicates Monterey as a 55' half width
street with an ultimate full width dedication of 110' .
3. The lot size as provided in the residential area is a minimum 8,000 sq.ft.
and the Commission feels this minimum is too small and should at least be
compatible with the City' s minimum of. 10,000 sq. ft. Many of the lots
within the residential development are irregular in shape and have street
frontages as small as 20' . This does not meet the City's minimum design
standards and the Commission feels this small frontage causes problems in
the future and is not good design. The density of the residential project
is 3.5 units per acre, exceeding the density of 3 units per acre per City
of Rancho Mirage requirements. It is not a desirable density.
4. Monterey and Country Club should have signals at this location.

II . STAFF RECOMMENDATION:
Recommend approval of the Tentative Tract Map ,to the City Council by Plan-
ning Commission Resolution No. _
Justification:
1 . The subject Tentative Map does substantially comply with Chapter 26 of
the City of Palm Desert Municipal Code, an'd the State of California
Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General Plan and
the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development proposed.
4. The site is physically suited for the proposed density of the develop-
ment.
5. The design of the subdivision and the proposed improvements are not
likely to cause substantial environmental damage or serious health pro-
blems.

-determined on April 24, 1978 that the project
will not have a significant adverse effect on
the environment.

IV. DISCUSSION:.
One of the principal concerns with regard to this project, due to its
location, is blowsand and appropriate methods of controlling it. Special
Condition No. 1 requiresthat blow-sand protection be provided on all sides
of the project, yet the condition allows flexibility as to the means neces-
sary to control the sand. Special Condition No. 5 requies a 6 foot block
wall on the north side of Lots 13-20, Lot 102 and Lots 36-41 which represent
the northern portion of the residential tract. Special Condition No. 11
involves both right-of-way required on Monterey Avenue and landscaping
which will serve as a means of blowsand control on the western portion of
the tract along Monterey.
Traffic circulation will be no problem in the area. Ingress and egress shall
be restricted onto Monterey Avenue except at 'A' Street. A $15,000 contri-
bution toward the signalization of the intersection of Country Club Drive
and Monterey is being required. Dedication is being required along Monterey
to provide for a 34 foot half width and a 16 foot parkway which shall include
an 8' slightly meandering bike path. Special Condition No. 12 requires one
minor change with regard to circulation, the cul -de-sac at the end of 'H'
Street is to be shortened to provide a minimum of 35 feet of frontage for
Lots 47 & 48. Public improvements required include sidewalks on Monterey and
Country Club Drive; those adjacent to the commercial area to be 10 feet in
width.
Staff has received a letter from the City of Rancho Mirage regarding Case
No. DP 03-78, the commercial portion of the project under discussion. Some
of the comments, however, actually pertain to the tentative tract map pre-
sently being discussed. The City of Rancho Mirage 's first comment pertains
to the proximity at which residential and commercial uses would be located
in this project and this is said not to be a good mix. Staff believes this
comment is invalid as there will be a 20 foot buffer with a block wall be-
tween the residential and commercial portions of the project. The Planning
Commission has previously approved a project with mixed uses , the El Paseo
Village project on the south side of El Paseo between Sun Lodge and Lupine
and believed the two uses were compatible on a much smaller site than the
present site. Projects done elsewhere, including one in Palm Springs, in-
dicate that residential projects adjacent to well-designed commercial pro-
jects can. be highly successful .
The City of Rancho Mirage also contends that many of the residential lots are
irregular and too small in area. The Staff believes that the irregular shaped
lots and flag lots create a much more interesting residential tract and pro-
vide the developer with flexibility to provide interesting and diverse site
plans and landscaping. With regard to density, at 3.5 du/acre the proposed
project does not exceed Rancho Mirages 's recommended 3.0 du/acre significantly.
In addition, the developer is providing a large common recreation area which
will adequately compensate for some of the area lacking in the individual
lots.
The City of Rancho Mirage also contends that Monterey and Country Club should
have traffic signals. This concern is being addressed as previously indicated
by Special Condition No. 8

IV. DISCUSSION (Cont. )
The present Tentative Tract Map contains revisions required by the
Commission at the May 17th meeting. The "H" Street cul -de-sac has
been shortened, the 4' x 20' landscape easements along Monterey Avenue
deleted, and a number of lot lines adjusted to create 8,000 square
feet minimum lots for all lots. More detailed calculations of lot
areas will be made by the Department of Public Works at the final map
review stage, but Special Condition No. 12 guarantees that the 8,000
square feet minimum will be adhered to. The Revised Tentative Map
submitted indicates that all lots will be a minimum of 8,000 square feet.

California, did receive a verified application from the MCBAIL COMPANY,
requesting approval of a Tentative Tract Map to create 101 single-
family, residential lots and 3 lots to provide for a District Commercial
Center , a common recreation area and open space from a 40 acre parcel
located within the P.C. (2) (Planned Commercial , District ) and R-2 8 , 000
(Single-family residential , 8, 000 sq. ft . of site area/du) zones , Upon
Annexation , at the southeast corner of Country Club Drive and Monterey
Avenue, more particularly described as :

WHEREAS , said application has complied with the requirements of
the "City of Palm Desert Environmental duality Procedure Resolution No .
78-32 in that the Director of Environmental Services has developed an
expanded initial study on the Prezoning Case No . C/Z 01-78 which includes
the subject property and weighs the environmental impacts of said project,
and this consideration has been determined to be an on-going project ; and,
WHEREAS , the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies; and,
- WHEREAS , , the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with Chapter 26 of the City of Palm

Standard Conditions :
1 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
I addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force .
2 . Full public improvements including traffic safety lighting as
required by Ordinance and the Director of Public Works , shall be
installed in accordance with City standards .
3. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits . Prior to recordation of the final subdivision map ,
the applicant shall submit to the Director of Public Works :
a. The document to convey title .
b. Covenants and restrictions to be recorded � w -

c. Management and maintenance agreement to be entered into with
the owners of the units of the project .
4. Improvement plans for water and sewer system shall meet the require-
ments of the respective service districts.
5. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert ,. without cost to the City
and free of all liens and encumbrances.
7 . All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services .
8. Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval
before construction of any improvements is commenced. The sub-
divider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construc-
tion period , the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with the re-
quired fire flows shall be installed as recommended by the Fire Mar-
shal .
10. All requirements of the City Fire Marshal shall be met as a part of
the development of this tract per attached memorandum.
11 . Drainage shall be subject to approval of the Director of Public
Works . Applicant shall provide engineered data as requested.
Ir 12. All requirements of the Planning Commission action on related Case
No. DP 03-78 shall be met as a part of the development of this tract .
13 . The total number of lots shall be limited to 104'.
14 . The applicant shall have twelve ( 12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen ( 18)
months is granted by a Resolution of the City Council .

Provide the following fire protection:
1 . Install a water system capable of delivering 1500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
_ A. Exterior surface of hydrant barrels and heads shall be painted
and the tops and nozzle caps shall be painted green. chrome yellow,
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 11791 is in accordance with the
requirements prescribed by the Fire Marshal . " Upon approval , the original plan
will be returned to the developer.

Dear Mr. Williams:
This is to report to you that on April 26, 1978, the Planning Commission of
the City of Rancho Mirage discussed Case DP-03-78 as transmitted by your
office. The location of the project is on the southeast corner of Country
Club and Monterey and consists of 40 acres to be used for a commercial develop-
ment and single family development.
I am aware that your request was to have the information returned to your
office by April 25, 1978, but because the Planning Commission did not meet
until April 26, 1978, their recommendation is being sent to you at this time.
Attached you will find a letter dated April 21 , 1978 from Mr. William Probert,
City Manager, addressed to Mayor Ed Mullins , asking for an extension of time
to allow the Planning Commission an opportunity to comment.
The City Planning Commission recommends denial of Case DP-03-78 subject to
the following reasons as outlined in staff report dated April 20, 1978.
1 . The commercial activity being proposed so close to the proposed use by
single family residences is not a good mix.
2. The plan shows Monterey Avenue as having a 50 ' dedication for a half width
street. The City's General Plan indicates Monterey as a 55 ' half width
street with an ultimate full width dedication of 110' .
3. The lot size as provided in the residential area is a minimum 8,000 sq.ft.
and the Commission feels this minimum is too small and should at least be
compatible with the City's minimum of 10,000 sq. ft. Many of the lots
within the residential development are irregular in shape and have street
frontages as small as 20' . This does not meet the City's minimum design
standards and the Commission feels this small frontage causes problems in
the future and is not good design. The density of the residential project
is 3.5 units per acre, exceeding the density of 3 units per acre per City
of Rancho Mirage requirements. It is not a desirable density.
4. Monterey and Country Club should have signals at this location.

for the reasons outlined in the report by staff.

GEORGE MARZICOLA, President of Country Club Property
Owners Association , noted he is generally in agreement
with the proposed zoning and annexation. He stated
that the extension of streets and the improvements
of others should be taken into consideration with a
bridge considered on Cook Street . Further he noted
that the Association is opposed to annexations because
of the Excise Tax involved.
RICHARD GUELICH, Santa Cruz, noted the extensive work
that the Staff had put into the report on the pre-
zoning and he noted his concern for the ability of the
City to maintain the open space.
Chairman Berkey stated that he felt the case should be continued
for further review. Commissioner Kelly stated that more input is needed
on the utilities in the area and the maintenance of the sand dunes .
Commissioner Kryder indicated more information was needed on the traffic
situation . Commissioner Snyder asked that Staff be able to answer the
questions regarding maintenance of the open space and alternatives to
an open space zoning designation . /
On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the Commission continued Case C/Z 01-78 to June 14, 1978 for
further review and study; carried unanimously (4-0) .

Mr. Williams reviewed the case and noted that the Commission
had approved a previous extension of one year.
Chairman Berkey declared the Public Hearing open and asked the
applicant if he wished to speak at this time:
RICHARD HOLDEN, representing the applicant , stated
he was available to answer any questions . Commis-
sioner Snyder asked why the delay . Mr. Holden stated
that there was a problem with funding due to the size
of the interior of the restauant . Further, the only
problem that now exists is the line-of-site problem
but that should be resolved with the Redevelopment
plans for that area of the City.

Pursuant to your request, we are enclosing herewith a copy of
Chapter 25.18 and 25.24 of the Palm Desert Municipal Code which
describe the R-2 and PR districts respectively. It can be noted
from a comparison of the two districts that they differ generally
only in purpose. The R-2 district provides a conventional approach
to land development, while the PR district provides greater flexi-
bility with regard to standard zoning requirements.
With respect to your query about the letters du, please be advised
that they refer to dwelling unit.

has initiated proceedings to annex approximately 1,050 acres of land
located generally adjacent to and north of the existing City limits at
the request of property owners of the said territory has been received.
I am a property owner of parcel 621-190-047-0 within the above area
proposed for annexation. According to the legal notice dated April 24,
1978, forwarded with the above referenced letter, my parcel. is scheduled
to be rezoned to PR-5 (Planned Redid.ential, max. 5 du/acre' upon annex-
ation. The parcel of acreage contiguous and north of my parcel is sche-
duled to be rezoned, R-2 (Single-family Residential, 8,000 sq. ft. min,
lot area, min. 8,000 sq. ft./du) upon annexation.
Please advise by return mail the difference between the PR-5 and R-2 zon-
ing codes, and what the letters du represent. Also if a copy of the reg-
ulation describing these zoning codes is available, please forward same.
In paying my 1977-78 tax bill in full in December 1977, I incorporated my
new mailing address. Subsequently on April 5, 1978, I informed the
Assessorts Office by certified ,mail dated April 5, 1978, return receipt
rquested, which was received on April 7, 1978, of my current mailing ad-
dress. Apparently this address change still has not been taken care of as

That the undersigned, being the owner of all the property and
premises situated in the County of Riverside, State of California, described as
follows.:

Does hereby establish the following restructions upon the use and enjoyment
of the. lots in said subdivision.
(1) Said lots shall be known and described as "Residential .Building
Lots" and used for those purposes only.
(2) No structure shall be erected, altered, placed or permitted to
remain on any of said lots, other than one detached single-family
dwelling; not to exceed- two stories in height, and private garage
and storage room, one story in height. One lot may be combined
with a part of a contiguous lot with one or more contiguous lots
and be construed as one lot within the meaning of these restrictions.
(3) Dwelling cost, quality and size: No dwelling shall be permitted
on any lot at a cost of less than $10,000.00 based upon cost levels
prevailing on the date these covenants are recorded, it being the
intention and purpose of the covenant to assure that all dwellings
shall be of a quality of workmanship and materials substantially
the same or better than that which can be produced on the date
these covenants are recorded at the minimum cost stated herein for
the minimum permitted dwelling size. The ground floor area of the
main structure, exclusive of one-story open porches and garages, .
shall be not less thanj&q y square feet for a one-store dwelling,
nor less than 1336 square feet for a dwelling of more than one story.
(4) No residential building shall be located on any lot nearer to the
front lot line or nearer to the side street line than the minimum
building setback lines shown on the recorded plat. No residential
dwelling shall be located on any interior lot nearer than 25 feet
to the rear lot line. In any event , no building shall be located
on any lot nearer than 25 feet from the front lot line or nearer
than 15 feet to any side street line on corner lots , or nearer
than 5 feet to an interior lot line excepting that a minimum 3
foot side yard shall be required for a garage or other permitted
accessory building placed 20 feet or more to the rear of the build-
ing setback line. No residential dwelling shall be located nearer
than 25 feet from the rear lot line and all residential dwellings
on said lots shall face the front street. The front street shall
be determined as the street on which a 25 foot building line is
shown on the recorded plat. For the purpose of the covenant ,
eaves, steps and open porches shall not be considered as a part of
a building, providing, however, that this shall not be construed
to permit any portion of a building on a lot to encroach upon a-
nother lot.
(5) No residential building site shall be used for business , nor any
activities conducted of an offensive nature, nor any activities
creating a nuisance by noise or otherwise, nor any activities
creating a noxious odor : except developer may use any number of
lots necessary for construction yard, sample houses and offices
while engaged in the construction and sale of houses in this sub-
division.
(6) . No temporary house, trailer, garage, tent or other buildings can
be placed, or erected upon any part of this subdivision and occu-
pied as living quarters , However, during the construction of a
house on any lot , any necessary temporary building may be erected
and maintained by the person constructing the house; no person
shall occupy or live in any house until it is completed, painted,
and ready for occupancy.

height of three (3), feet ; nor any fence , wall or hedge placed or

(7) Sight distance at intersections. No fence , wall , hedge or shrub
planting which obstructs sight lines at elevations between 2 and
6 feet above the roadways shall be placed or permitted to remain
on any corner lot within the triangular area formed by the street
property lines and a line connecting them at points 25 feet from I
the intersectiQnepf the street lines or in the case of a rounded
property corner from the intersection of the street property lines
extended. The same sight-line limitations shall apply on any lot
within 10 feet from the intersection of a street property line
with the edge of a driveway or alley pavement . No tree shall be
permitted to remain within such distances of such intersections
unless the foliage line is maintained at sufficient height to pre-
vent obstruction of such sight lines.
(8) No animals including dogs , .cats , poultry, fowl , ' rabbits , etc. ,
shall be kept , maintained or raised on the premises for commer=.
cial purposes and not more than a total of four cats or dogs shall
be maintained on the premises at any time in any event.
(9) Oil and Mining Operations. No oil drilling, oil development,
operation, oil refining, quarrying or mining operations of any
kind shall be permitted upon or in any lot, nor shall oil wells ,
tanks , tunnels , mineral excavations or shafts be permitted upon
or in any lot. No derrick or other structure designed for use in
boring for oil or natural gas shall be erected, amintained or per-
mitted in or upon any lot.
0 0) No trucks, trailers , boats, or unlicensed motor vehicles of any
kind shall be kept, parked in or upon any portion of said property
between the street and the front setback line , except in a completely
covered carport or garace.
0 1) No sign of any kind shall be displayed to the public view on any
lot except one professional sign of not more than one square foot ,
one sign of not more than five square feet advertising the prop-
erty for sale or rent , or signs used by a builder to advertise
the property during the construction and sales period.
(12) Garbage and refuse disposal : No lot shall be used or maintained
as a dumping ground for rubbish. Trash, garbage or other waste
shall not be kept except in sanitary containers. All incinerators
or other equipment for the storage or disposal of any such material
shall be kept in a clean and sanitary condition.
(13) Easements for installation and maintenance of utilities and drain-
age facilities are reserved as shown on the recorded plat.
.(14) That each grantee of a lot in said tract agrees for himself and
his assigns that he will not in any way interfere with the estab-
lished drainage pattern over his lot from adjoining or other lots
in said tract , or that he will make adequate provisions for proper
drainage in the event it is necessary to change the established
drainage over his lot . For the purposes hereof, "Established"
drainage is defined as the drainage which occurred at the time the
overall grading of said tract, including the landscaping of each
lot in said -tract, was completed by the undersigned grantor.

provide for a planned neighborhood. A majority of the corumitte
may designate a representative to act for it , and it will be the
responsibility of this committee to approve all pains for dwellings
to be constructed on any of the property covered herein. In the
event of death or resignation of any member of the committee, the
remaining members shall have full authoriY'� to designate a succes-
sor. Neither the members of the committee nor its designated re-
presentative shall be entitled to any compensation for services
performed pursuant to this covenant. At any time the then record
owners of a majority of the lots shall have the power through a
duly recorded written instrument to change the membership of the
committee or to withdraw from the committee or restore it to any

(16) Term. These covenants are to run with the land and shall be
binding on all parties and all persons claiming under them for a
period of 30 years from the date these covenants are recorded ,
after which time said covenants shall be automatically extended
for successive periods of 10 years unless an instrument signed

agreeing to change said covenants in whole or in part .
(17) Enforcement. Enforcement shall be by proceedings at law or in
