WHEREAS , the City Council of the City of Palm Desert , California,
did receive a verified application from PHILIP ABRAMS CONSULTING ENGINEERS ,
requesting approval of a Tentative Tract Map to divide a 6. 16 acre parcel
into two parcels, Lot 1 which is located within the R-3(4) (Multi-family
residential , minimum 4 , 000 sq. ft. lot area/d. u. ) zone and Lot 2 which
is located within the C-1 , S .P. (General Commercial , Scenic Preservation
Overlay) zone and the R-3(4 ) (Multi-family residential , minimum 4, 000
sq. ft . lot area/d. u. ) zone; Lot 1 being further divided as a statuatory
condominium to provide for 30 condominium units and common open space
and common recreation facilities, the entire site being located south of
E1 Paseo, north of Shadow Mountain , between Lupine Lane and Sun Lodge
Lane, more particularly described as :

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
77-7" , in that the Director of Environmental Services has determined on
January 10, 1978, that the project will not have a significant adverse
effect .on the environment and no further documentation will be required
under the provisions of the State guidelines for the implementation
of CEQA; and,
WHEREAS, the City Council did take into consideration the Tenta-
tive Map as submitted, and the reports of the various reviewing agencies;
and,
WHEREAS, the City Council has received a recommendation of ap-
proval of the subject tentative map from the Planning Commission as
indicated in Planning Commission Resolution No. 331 ; and,
WHEREAS , the City Council did find that the subject Tentative
Map does substantially comply with Chapter 26 of the City of Palm Desert
Municipal Code, and the State of California Subdivision Map act , as
amended; and,
WHEREAS, the City Council did find that the subject Tentative
Map does comply with the Adopted General Plan , the Redevelopment Plan
and the Palm Desert Zoning Ordinance ; and,
WHEREAS , the City Council did find that the subject site is
physically suitable for the type of development proposed; and, .
l WHEREAS , the City Council did find that the subject site is
I physically suited for the proposed density of the development ; and,
JWHEREAS , the City Council did find that the design of the sub-
division and the proposed improvements are not likely to cause substan-
tial environmental damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council fo the
City of Palm Desert as follows :
1 . That the above recitations are true and correct and consti-
tute the findings of the Council in this case;

fee in an amount determined under the Ordinance provisions in order

adverse impacts to wildlife . Increases in vehicular traffic and air
pollution in the vicinity due to the project will be negligible .
Any interested citizen may appeal this determination to the Planning Commission
within eight (8) days of the date of the posting of public notice by filing an appeal
in accordance with Resolution No. 77-7 with the Department of Environmental
Services located at 45-275 Prickly Pear Lane, Palm Desert, California. If no
appeal is filed within said time, this determination shall be final.

Based on a review of our case file for the referenced tract,
we are unable to determine if a Notice of Determination was
filed with the County Clerk. If a Notice was not sent, the
statute of limitations on court challenges would have expired
180 days after the City Council approval on February 23, 1978.
There having been none, a court challenge could not be raised
today, relative to the decision to prepare a Negative Declara-
tion.

Mr. Bouman explained that certain projects had been included
in the 1.977-78 , but because they were not implemented , the
(24) funds had gone into the year-end surplus, and they were not
included in the 1.978-79 budget . By Resolution No . 78-112 ,
Staff is requesting that these projects be included in the
78-79 budget as follows : .
1 . Local Transportation Fund:
- Property- Acquisition - Monterey Widening S 52 ,000. 00
- Reconstruction of Monterey 150 , 000. 00
- Storm Damage Repair - Monterey 40 , 000 . 00
( 2 Building Excise Tax Fund :

Discussion:
Tract No. 11881 is the city block contained within the following

Lane. The Tract consists of two lots on 6.2 acres,
The Tentative Map was approved February 23, 1978, and the Final Map
conforms with the Tentative Map as approved.
The Subdivider has met all conditions of approval , signed the
subdivision agreement and posted the required bonds , all of which
have been approved by the City Attorney.

CALIFORNIA, APPROVING, THE FINAL SUBIDIVISION MAP OF TRACT NO.

BE IT HEREBY RESOLVED by the City Council of the City of Palm Desert,
California , as follows: I
1 . The Final Subdivision Map for Tract No. 11881 , City of Palm Desert,
California, is hereby approved as the official subdivision map of said tract,
subject to the conditions of the Tentative Map.
2. The Mayor and City Clerk are authorized to execute on behalf of

Gentlemen:
i":is is to advise that the subject property is located within tee
sen. -ice territory of the Southern California Ldison Company, and that the
electric loads of the project are within parameters of projected .load growth
which Ldison is planning to meet in this area.
Unless the de-Nand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new genera_-
iag facilities arc delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Fdison's generating facilities
is low sulfur fuel oil. We now helieve our low sulfur fuel oil inventory,
together with our contractual comii'ments for delivery, any our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continual and sufficient supply
of electricity.

Commissioner Snyder asked about the width of the frontage and
if it was in compliance. Mr . Williams noted that the actual design
had been approved whCn the development plan was considered. Commis-
sioner Snyder stated that the property adjacent is zoned R-1-10 , 000.
Chairman Berkey declared the Public Hearing open and asked if
the applicant wished to speak at this time.

the Commission and noted that the original plan had

Mr. Williams informed the Commission that the person desiring
this amendmenthad made other arrangements and had withdrawn his re-
quest . Mr . Williams suggested that the item be tabled at this time .
On a motion by Commissioner Snyder, seconded by Commissioner
Kelly, Case No. ZOA 01-78 was tabled until such time that the Com-
mission requests its further consideration ; carried unanimously ll
(5-0) .
At this time Mr . Williams noted two items that had been in-
advertently omitted from the agenda that the applicant had requested
be continued to the February 15th meeting, by a letter addressed to
the Planning Commission , notably Case Nos . CUP 18-77, 67C and P.M
11796. On a motion by Commissioner Reading, seconded by Commissioner
Kelly , the Commission continued the cases to the February 15th meet-
ing; carried unanimously (5-0) . (See attached Exhibit B)
Mr. Williams also informed the Commission of the Council ' s
consideration of Case No. C/Z 12-77 , Lewis Homes of California ,
applicant at their meeting of January 26 , 1978. He noted the map
showing the Council ' s proposal . Since their proposal is different
that the recommendation of the Planning Commission , the case must be
referred back to the Planning Commission for further review and a
report must be reported back to the Council within 40 days. Mr.
Williams noted the alternatives the Commission could take , which
are as follows :
1 . Reaffirm its previous recommendation of R-1-12 , 000 on the total
property .
2 . Concur with the action of the City Council on this matter .
3. Consider other alternatives .
There was some discussion with regard to when the case should
be discussed and when the Planning Commission makes their recommenda-
tion , can the City Council continue the case at their meeting . Mr.
Williams noted that the City Council can continue the case and take
a second reading of the Ordinance .

Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the Adopted General Plan,
the Redevelopment Plan and the Palm Desert Zoning Ordinance.

IV. DISCUSSION:
Full improvements including sidewalks are being required at the subject
site due to its centralized location in the heart of the City's commercial
area. Dedication is being required on Sun Lodge Lane, Shadow Mountain
Drive and Lupine Lane. to insure that these streets have 60' widths. Of
prime concern throughout the review of this project has been the numerous
driveway openings onto the streets which border the project. This con-
cern has been adequately addressed in the review of the related Conditional
Use Permit (CUP 17-77) for the residential portion of the project (Lot 1 ) .
Special Condition No. 3 in the Conditions of Approval for the subject tract
insures that the Director of Public Works will have sufficient control over
the location of any openings onto the perimeter streets for the entire
block including the proposed commercial portion of the project on Lot 2.
Special Conditions No. 4 and 5 require the applicant to pay both park and
drainage fees to the City per the requirements of the City's Ordinances
relative to both concerns.

Standard Conditions :
1 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions
of al). municipal ordinances and State and Federal statutes now in
force , or which hereafter may be in force .
2 . Full public improvements including traffic safety lighting as re-
quired by Ordinance and the Director of Public Works , shall be in-
stalled in accordance with City standards .
3. Access rights on E1 Paseo , Sun Lodge , Shadow Mountain and Lupine
shall be offered to the City as a dedication on the Final. Nap .
4. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of
any building permits . Prior to recordation of the final subdivi-
sion map, the applicant shall submit to the Director of Public
Works :
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be eneted into with
the owners of the units of the project .
5 . Improvement plans for water and sewer system shall meet the require-
ments of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
8 . All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as amy be approved by the Director of Environmental
Services.
9. Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval
before construction of any improvements is commenced . The subdivider
shall submit "as-built" plans prior to acceptance of the subdivision
improvements by the City.
10. In order to maintain reasonable fire protection during the construc-
tion period , the subdivider shall maintain passable vehicular access
to all buildings . An adequate number of fire hydrants with required
fire flows shall be installed as recommended by the Fire Marshal .
11 . All requirements ol . the City Fire Marshal shall be met as a part of
the development of this tract per attached memorandum.
12. Drainage shall be subject to approval of the Director of Public Works.
Applicant shall provide engineered data as requested .
13. All requirements of the Planning Commission action on the Develop-
ment Plan , Case No. CUP 1.7-77, shall be met as a part of the develop-
mentof• this tract .
14 . The total number of lots shall be limited to 2 .

Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Lnless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

Justification:
The applicant will be providing storm drainage protection through

existing residential and commercial area there will be no significant
adverse impacts to wildlife . Increases in vehicular traffic and air
pollution in the vicinity due to the project will be negligible .
Any interested citizen may appeal this determination to the Planning Commission
within eight (8) days of the date of the posting of public notice by filing an appeal
in accordance with Resolution No. 77-7 with the Department of Environmental

following is being requested:
Approval of a Tentative Tract Map to divide a 6.16 acre parcel into
two parcles Lot 1 and Lot 2. Lot 1 will be further divided to provide
for 30 condominium units and common open space and common recreation
facilities. Lot 1 is located within the R-3(4) zone and Lot 2 is located
within the C-1 , S.P. zone and R-3(4) zone. The site is located south of
El Paseo, north of Shadow Mountain, between Lupine Lane and Sun Lodge Lane.
The attached data was prepared by the applicant and is being forwarded
to you for comments and recommended Conditions of Approval . The City
is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals, parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. Jan. 20 , 1977, in order to be
discussed by the Land Division Committee at their meeting of jan. 25th
The Land Division Committee (comprised of Director of Environmental
Services , City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
eration.
