Co. DATE: January 26, 1979 Please be advised that this tract should be required to pay $50.00 per unit toward the overall signalization program of the City of Palm Desert. This has been required of all other developers and should not be deviated from on this extension. i 9 tract is coming up for expiration, and the applicant is requesting an extension of time because of the extreme complexity of the design of the subdivision and its improve- ments wherein the applicant was required to do a great deal of offsite drainage study work, additional storm drain design , and revision to the maps to accommodate the Depart- ment of Public Works ' s request to revise the ingress-egress to the subdivision along Haystack. Mr. Williams stated that upon receipt of the request , Staff reviewed the conditions and found there was no need for additional conditions . Staff recommended approval . Councilman Wilson asked where the project stood now, and Mr. Beebe responded that their plans were now in Plan Check. He pointed out that his department had held the project up because of the realignment of a street. Mayor Mullins declared the Public Hearing open and invited input in FAVOR of the extension. MRS . BETTY WILLIAMS , Division Manager, -Lewis Homes , stated that they were just about out of Plan Check and have received Improvement Agreements . She stated that it was taking a little longer than anticipated due to the change requested by Mr. Beebe. Mayor Mullins invited input in OPPOSITION to the extension, and none was offered. He declared the Public Hearing closed. Councilman McPherson moved. and Councilman Wilson seconded to waive further reading and adopt ,Resolution No. 79-3 , approving a one year extension of time. Motio carried on a 4-0-1 vote. E. CASE 0. TT 11883 , FFILIATED CONSTRUCTION COMPANY, APPLICANT: Consid t ' a Request for Approval of a 1-Year Extension of Time on the Approval of a Tentative Tract Map to Create 65 Lots to Provide for a Condominium Hotel , 7 Single-Family Resi- dences , and 57 Condominium Units on Approximately 17 . 8 Acres Generally Located Between Highway 111 and Candlewood Street , West of Palm Desert-Indian Wells City Limit Line. Mr. Williams stated that this subdivision will not expire until the end of February, but the applicant has requested an extension of time. He has had problems with his engineer- ing and financing and is requesting a one-year extension. Staff reviewed the conditions of approval and found that no additional requirements were necessary. Staff recommended approval of the extension. Mayor Mullins declared the Public Hearing open and invited input in FAVOR of the extension. None was offered. Mayor Mullins invited input in OPPOSITION to the extension, and none was offered.` He declared the Public Hearing closed. Councilman McPherson moved and Councilman Newbrander seconded to waive further reading and adopt Resolution No . 79-4 , approving a 1-year extension of time . Motion carried on a 4-0-1 vote. VIII. Based upon the above, we would request of the Southern California Edison, the dollar amount needed to fund the undergrounding on Highway 111 and that such a contract be prepared. It is our understanding that Southern California Edison would be bearing the cost of tying together the .Indian Wells Power Station with the power station adjacent to us, including the undergrounding across Highway 111 and from the South side of Highway 111 to the power station. This would leave us with the cost of undergrounding ,662 feet on Highway 111 and from the power station South to Candlewood. Therefore: We would need also, a figure for the undergrounding of the line from the power station, South to Candlewood. It is anticipated that our final map will be ready for recording in late July or early in August and as a consequence, this contract should be prepared and ready to be presented to the City Council at that time. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations , and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force . 2 . Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. Prior to submittal of the Final flop, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives . The approval of the final street names shall be made by the Director of Environ- mental Services. 4. Access rights on the Frontage Road and the proposed street connec- tion between Driftwood Drive and Shadow Hills Road shall be offered to the City as a dedication on the Final Map. 5. Environmental Finding: The Director of Environmental Services deter- mined on January 10, 1978 that the proposed tract will not have a significant adverse ef- fect on the environment. F. Utilities: Power - Southern California Edison Water - C.V.C.W.D. Sewer - C.V.C.W.D. Telephone - General Telephone Co. Natural Gas - Southern California Gas Co. IV. DISCUSSION: Full public improvements including curbs , gutters, tie-in paving and sidewalks are being required to be installed on Candlewood Street, this portion of the tract being comprised of single-family residential lots. Sidewalks are not being required to be installed along the access ease- ment in the interior of the condominium portion of the project. Nor are sidewalks being required along the access easement which connects Driftwood Drive and Shadow Hills Road on the western portion of the subject site. However, this proposed access easement is being required to be dedicated to the City by Special Condition No. 5. ' Special Conditions No. 3 and 6 require the applicant to pay both drainage and park fees to the City per the requirements of the City' s Ordinances relative to both concerns. A ten foot drainage easement is being provided along the eastern border of the project. Special Condition No. 4 insures a 60' width for Candlewood Street. The attached letter from the Coachella Valley County Water District points out the fact that the Bechtel Report provided as a flood control alter- native, a major storm channel along the easterly boundary of the subject property. It appears that such an alternative is not a very viable one. Staff cannot recommend indefinite continuance of this case, due to an alternative proposed in a report when the possibility of such an alterna- tive being implemented appears so doubtful . In order to maintain adequate traffic circulation , within the area, the Director of Public Works is requiring that the frontage road be extended along the full frontage of the property. Special Condition No. 7 requires that the frontage road improvements include curbs, gutters, sidewalks and landscaping and be installed according to City standards: Whether the frontage road is one way or two way will be determined at a later date by the Director of Public Works after coordination with the City of Indian Wells. The $15,000 contribution the applicant is making toward the resolution of City-wide drainage problems is of his own volition and is not a mandatory . requirement of the City. F. REQUEST FOR FINAL APPROVAL OF CONTRACT 1014 , Improvement of San Luis Rey from Alessandro Drive to Catalina Way . Rec : By Minute Motion : ( 1 ) Accept the work as complete on behalf of the City. Mr. Paul Williams pointed out that this project had been previously reviewed as a change of zone and development ) plan . He stated that one of the major concerns of the Planning Commission during their review had been that one of the alternatives proposed in the Bechtel Report runs along the east side of the project . However , since sub- stantial development exists to the south, the Planning Commission decided that that alternative was not probable . In fact , they elected not to recommend that area as a possibility. Mr . Williams reviewed in detail the conditions . and special conditions included , pointing out that the appli- cant was in addition , contributing $15 , 000 toward the resolu- tion of the City-wide drainage problems of his own volition . Councilman McPherson questioned how the drainage problem of water on Toro Peak and Candlewood would be handled as now the water tends to just collect and stand there . Mr . Williams advised that some of the water would be directed through LaRocca. Mayor Mullins declared the Public Hearing open and asked for input in FAVOR of the project . MR. FRANK GOODMAN, 73-655 Shadow Mountain Drive , Palm Desert , addressed Council as the applicant , stating his agreement with Staff ' s recommendation of the project and all the conditions applied. He explained that a drainage swale would be constructed to the north , and that they have already widened the most easterly lot and broken through a wall to provide for drainage. Mayor Mullins requested input in OPPOSITION to the project , and none was offered. He declared the Public Hearing closed. State Highway Route 111 is the principal traffic artery between the upper and lower Coachella Valley. It carries the heaviest traffic in the area, resulting in substantial congestion and traffic safety problems. Development and the resultant density increases are occurring rapidly in this area. We do not antici- pate any improvements that will significantly increase the capacity of this facility within the foreseeable future. There- fore, it is imperative that the traffic carrying capabilities and safety of the existing circulation system be maintained at as high a level as possible. The highway is at times subject to flooding from rainstorms . Development along the highway has at many locations, increased, concentrated and confined runoff at the highway causing additional incidents of flooding. Care must be taken when developing along the highway to insure that drainage will be adequate for both the present and future higher densities in the Valley area. Any necessary highway drainage improvements should be included as part of the development of property along the highway. In order to maintain the traffic carrying capabilities and safety of the highway as service volumes increase, it is impera- tive that points of traffic conflict be kept to a minimum. Therefore, access to the highway should be provided by existing public road connections. The map indicates a frontage road which is apparently a continua- tion of Palm Desert Road from the west. We have no objection to the use of frontage roads for interior circulation. However, we have experienced considerable difficulty with frontage roads where they connect to the State highway in the usual tight-bulb configuration.. Invariably, as traffic increases and signalization of the intersection becomes necessary, the system cannot accommo- date the multiple-approach and turning paths . This creates Page 2 April 13, 1978 considerable motorist confusion and conflict and reduces the overall capacity and safety of the intersection, particularly at the cross street-frontage road connection. Therefore, we recommend that the near curb of proposed frontage roads at cross street connections be a minimum of 200 feet from the near curb of the State highway. The frontage road should be closed with an appropriate physical barrier at the easterly edge of this proposed development, so access from this proposal cannot be made through the private driveway near this location. When the frontage road is eventually extended to the east to Cook Street, this private driveway should be closed and discontinued so that the private, residential access is provided onto the frontage road. It is recognized that there is considerable public concern about noise levels adjacent to heavily traveled highways . Land develop- ment, in order to be compatible with this concern, may require special noise attenuation measures . This development should include any necessary noise attenuation. In developing plans for improvement of this property, care should be taken to preserve and perpetuate the existing drainage patterns . If any work is necessary within the highway right of way, the developer must obtain an encroachment permit from the District 8 office of the State Department of Transportation prior to beginning the work. We would like to receive a copy of any conditions of approval for this proposal when they become available.
