Request for approval of a Tentative Tract Map to create 80 single-
family residential lots from a parcel approximately 23 acres in size
located within the R-1-9,000 zone, north of 44th Avenue and east of
Shadow Lane extended.

III . STAFF COMMENTS:
Staff would recommend that the Secretary forward the following comments
to the Riverside County Planning Department:
1 . The developer should provide a 44' half-width along 44th Avenue in
addition to a 19' landscaped area which would include a masonry wall
and meandering sidewalk. These improvements will be constructed in
a total right-of-way of 126' .
2. The widths of the proposed lots along 44th Avenue should be increased.
3. An open space easement 15' in width shall be provided between the
Whitewater Storm Channel and the proposed lots bordering the Channel .

The tentative subdivision shalt conform to the regtctrements of Ordinance 460, Schedule "A",
unless modified by these conditions.
1. If any grading is proposed, the subdivider shall submit one reproducible browaline and
four prints of a comprehensive grading plan to the Riverside County Sutweyoris Office.
The plan shall comply with the Uniform Building Code, Chapter 70, an amended by
Ordinance 457, The Surveyor's Office shall transmit prints to the Flood Control
District and the Department of Building and Safety for approval.
2. The subdivider skull submit a soils report to the Riverside County Surveyor's Office,
unless waived by the Building and Safety Director, The report shall address the eci.l.a-
stability and the geological coadi.tious of the cite.
3. The subdivider shall provide easements for roadway slopes, drainage facilities„
utilities, etc. Such easements shall be dedicated as approved by the Road Commissioner,
4, Street names for the proposed subdivision shall be subject to the approval of the Road
Commissioner,
5. Voter and sewerage disposal facilities shall be installed in accordance with the
provisions set forth in the Riverside County Health Department: letter dated April 13,

new County Service Area or for annexation to an existing, Service Area if street lighting
is: proposed to be installed, or if street lighting is to be installed on any street which

RE: Tentative Tract No. 11969
Dear Bill:
The purpose of this letter is to report to you a consensus that has been reached
with Mr. Harold Housley (Descove Consulting Engineers) who represents the
owner/builder of Tentative Tract No. 11969. As you will recall, there were
three major items of concern to the City of Indian Wells. Below I have listed
each item of concern and the consensus that has been agreed to:
1. Block Walls for Blowsand and Noise Mitigation
Along the Boundaries of the Tract
a. The developer has agreed to provide a block wall with a berm and
landscaping treatment (subject to the approval of the Planning
Director) along the 44th Street boundaries of this tract. The
purpose of this block wall will be to acknowledge the concern for
noise mitigation along this major arterial highway.
b. The developer has agreed to provide a block wall with suitable
landscaping treatment along the front side of lots 1 through 11.
He will also provide a block wall and/or other suitable blowsand
control measures along the north boundaries of the tract, lots
65 through 80.
All such blowsand control measures shall be in conformance with
County Ordinance No. 460.
2. 25 Ft. Easement in Recognition of the 8 Inch Force Main Sewer Line
Along the Right of Way of the Whitewater Channel
The developer has agreed to provide a 25 foot setback easement along the
back side of lots 65 through 80. Within this easement, residential
structure and/or any swimming pool construction would be restricted.
3. Undergrounding Utilities
The developer has agreed to underground all future facilities within
the project boundaries of this tract.

A minor change for this tract will be processed at the expense of this office
in order to facilitate these changes. The changes will be reviewed in next
week's Land Division Committee meeting and will be scheduled for hearing as
quickly as possibld before the East Area Planning Council.
I appreciate your drawing this matter to my attention, and wish to apologize for
the fact that my staff did not recognize the request when originally submitted
by both your city and the City of Palm Desert. Please be assured I will do
everything in my power to guarantee that this kind of problem does not occur
again either for the cities, the county, or the developer. I wish to close by
complimenting Mr. Housley and the developer of this tract for their courteous
compliance with these concerns.

The Planning Commission of the City of Palm Desert at its regular meeting
of April 18, 1978, instructed me to forward the following comments regard-
ing Case No. PM 11695 and Case No. TT 11969:

Dear Pat:
We would like to thank you or your prompt action in
dealing with some of Indian W Is ' concerns relating
to the design of Tract No. 11969 . Regrettably, how-
ever, the changes proposed in your letter of November
17 , 1978 do not adequately address the Citys concerns,
as enumerated in our letter of June 8 , 1978 (attached) .
Because Indian Wells still. sees . these as being criti-
cal issues, the City Council has authorized continued
legal action to see that these issues are addressed
in a manner that is acceptable from both planning and
design standpoints.
The City believes that a redesigned tentative map is
required in order to reach a suitable solution.

Other points brought up were that projects are not looked at
with regard to timing of completion of public facilities to handle
the additional population; the possible extension of Monterey to
Frank Sinatra; extension of Magnesia Falls to Portola; Monterey &
Il 44th Avenue signal will be in within 2 years ; and the traffic flow
is still the main concern of the Commission .
Chairman Berkey declared the Public Hearing open and asked if
the applicant wished to speak at this time .
Jack Conlon , representing Sunrise Co. , addressed
the Commission indicating that he is not interested
in contributing to improving San Pablo or the sig-
nalization of Monterey, but will contribute if
the signal will be at the entrance to both his
projects on Monterey. Mr. Conlon also added that
the market is still strong and he forsees no pro-
blem in the project being completed on schedule if
not before.
Chairman Berkey asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the project . Being none , he declared the
Public Hearing closed and asked for the pleasure of the Commission.
Chairman Berkey asked that the Special Condition No. 1 be
more elaborately spelled out to include the location of the signal".

would not object to the location being stated. Special Condition
No. 1 was revised to read : Applicant shall make an $80, 000 contriZ
bution for the future signalization of Monterey Avenue and the entrance
to the subdivision . On a motion by Commissioner Snyder, seconded by
Commissioner Kryder, the case was approved by Planning Commission
Resolution No. 351 ; carried 3-1 (AYES: Berkey , Kryder, Snyder ; NOES :
Kelly) .

Staff . The Commission asked that the following comments be added
to the staff comments : 4 . Street F should have no access onto 44th
Avenue; it should have a cul-de-sac as Streets C through E; 5. A
2 way stop sign should be provided at 44th Avenue and Shadow Lane
extended; 6 . Increase lot size to 12 , 000 sq . ft . to correspond with
potential development across the street .
On a motion by Commissioner Snyder, seconded by Commissioner
Kelly, the Commission directed the Secretary to forward the above
comments on both cases to the Riverside County Planning Department ;
carried unanimously (4-0) .

ing course of asphalt concrete and additionally a 0.1 foot overlay of asphalt
concrete as well as replacement of the existing traffic stripping as approved
by the County Road Department.
