IF THE BUDGET FURNISHED TO YOU BY THE DEVELOPER SHOWS A MDNTHLY ASSESSMENT FIGURE WHICH VARIES 10o OR MORE FROM THE ASSESSMENT AMOUNT SHOWN IN THIS PUBLIC REPORT, YOU SHOULD CONTACT THE DEPARTMENT OF REAL ESTATE BEFORE EN- TERING INTO AN AGREEMJEDFT TO PURCHASE. -4- of 7 pages FILE NO. 44372 (PRELIMINARY) MAINTENANCE AND OPERATIONAL EXPENSES - continued: The association may increase or decrease assessments at any time in accordance with the procedure prescribed in the CC&R's or Bylaws. In considering the ad- visability of a decrease (or a smaller increase) in assessments, care should be taken not to eliminate anounts attributable to reserves for replacement or major maintenance. THE INFORMATION INCLUDED IN THIS PUBLIC REPORT IS APPLICABLE AS OF THE DATE OF ISSUANCE. EXPENSES OF OPERATION ARE DIFFICULT TO PREDICT ACCUR- ATELY AND EVEN IF ACCURATELY ESTIMATED INITIALLY, MDST EXPENSES INCREASE WITH THE AGE OF FACILITIES AND WITH INCREASES IN COST OF LIVING. Monthly assessments will conznence on all lots on the first of the nonth following the closing of the first sale of a lot. From that time, the subdivider is re- quired to pay the association a monthly assessment for each lot which he awns. The remedies available to the association against owners who are delinquent in the payment of assessments are set forth in the CC&R's. These remedies are available against the subdivider as well as against other owners. The subdivider will post a bond as partial security for his obligation to pay these assessnents. The governing body of the association should assure itself that the subdivider has satisfied his obligations to the association with respect to the payment of assessments before agreeing to a release or exoneration of the security. RESTRICTIONS: This subdivision will be subject to restrictions to be recorded in the Office of the Riverside County Recorder. TAXES: Under the California Constitution, the maximum amount of property tax on real property that can be collected annually is one percent (1%) of the full cash value of the property. For the purchaser of a lot or unit in this subdivision, the "full cash value" of the lot or unit will be the valuation, as reflected on the tax roll, determined by the county assessor as of the date of purchase of the lot or unit or as of the date of completion of an improvement on the lot if that occurs after the date of purchase. RESERVATION MONEY HANDLING: If you reserve a lot, the subdivider must place all funds received from you in a neutral escrow at the Title Insurance and Trust Com- pany, 3490 Tenth Street, Riverside, California, subject to the conditions of the tentative reservation agreement. -5- of 7 pages FILE NO. 44372 (PRELIMINARY) GEOLOGIC CONDITIONS: THE UNIFORM BUILDING CODE, CHAPTER 70, PROVIDES FOR LOCAL BUILDING OFFICIALS TO EXERCISE PREVENTIVE MEASURES DURING GRADING TO ELIMINATE OR MINIMIZE DAMAGE FROM GEOLOGIC HAZARDS SUCH AS LANDSLIDES, FAULT MOVEMENTS, EARTH- QUAKE SHAKING, RAPID EROSION OR SUBSIDENCE. THIS SUBDIVISION IS LOCATED IN AN AREA WHERE SOME OF THESE HAZARDS MAY EXIST. SOME CALIFORNIA COUNTIES AND CITIES HAVE ADOPTED ORDINANCES THAT MAY OR MAY NOT BE AS EFFECTIVE IN THE CONTROL OF GRADING AND SITE PREPARATION. PURCHASERS MAY DISCUSS WITH THE DEVELOPER, THE DEVELOPER'S ENGINEER, THE ENGIN- EERING GEOLOGIST, AND THE LOCAL BUILDING OFFICIALS TO DFIERMINE IF THE ABOVE MEN- TIONED HAZARDS HAVE BEEN CONSIDERED AND IF THERE HAS BEEN ADEQUATE COMPLIANCE WITH CHAPTER 70 OR AN EQUIVALENT OR MORE STRINGENT GRADING ORDINANCE DURING THE CONSTRUC- TION OF THIS SUBDIVISION. A geotechnical report has been filed which states as follows: "The rmst likely geologic hazard to affect the site is groundshaking due to move- ment along the San Andreas Fault Zone or to a lesser degree, rmvement along the San Jacinto Fault Zone. Relative groundshaking hazard zones have been developed in Riverside County by dividing the county into five zones based on soil types and five zones based on the distance from causitive faults. The distance zonations were chosen arbitrarily and are defined in the technical report of the Riverside County Seismic Safety Report (1976) so that Zone I includes ground accelerations for average site conditions up to that taken into account in the 1973 Edition of the Uniform Building Code with each successive zone representing a multiple of that acceleration. Most of the project site is in distance Zone III, and is lo- cated in soil type Zone C (alluvium and soft sediments ain excess of 2,000 feet thick) ." SOIL CONDITIONS: An engineering report has been filed which indicates soil is non-expansive, and included in the report are certain recommendations. Subdivider has certified that he will comply with the recommendations of the engineer, that the purchasers' funds will be impounded in escrow, and that no escrows will close until recommendations have been completed. FLOOD AND DRAINAGE: The Coachella Valley County Water District advises as follows: This area is protected from storawater flows by a system of channels and dikes. This area may be considered safe from stormwater flows except in rare instances. The District will furnish domestic water and sanitation service to said area in accordance with the currently prevailing regulations of this District. This area shall be annexed to Improvement District Nos. 54 and 80 of the Coachella Valley County Water District for sanitation service. -6- of 7 pages FILE N0. 44372 (PRELIMINARY) FIRE PROTECTION: The Riverside County Fire Department advises as follows: Fire Protection is provided by Riverside County Fire Stations #33 and #50. Station #33 would respond from the Palm Desert Station with two engines and one squad from approximately one mile away. Station #50 (Rancho Mirage) would respond with one engine and one squad from approximately five miles away. The water system in this area is adequate for fire protection. SEWAGE DISPOSAL: The subdivider advises that there is presently $5.00 sewerage service charge per lot per month. STREETS AND ROADS: The private streets inside the project will be maintained by the homeowner association. The costs of repair and maintenance of these private streets are included in the budget and are a part of your regular assessment. Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexDected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demand is expected to continue to increase _ annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981. In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory, together with our contractual commitments for delivery, and our customers ' conservation efforts, will permit us to meet the forecasted demand for electricity during 1978. It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity. Fred Hameetman stating that there was a deed restriction on the property (see Ex- _. hibit A) . He indicated that the applicant was not aware of a deed restriction and it had not shown up in the escrow or title search report . Chairman Berkey asked if the Commissioners had any questions of Mr'. Williams at this time. Commissioner Reading asked about , sidewalks along Highway 74, noting that he felt it would be a traffic hazard to have people walking along Highway 74. Commissioner Snyder felt it would be safer to have people on the sidewalk than in the street . Chairman Berkey declared the Public Hearing open at this time and asked if the applicant wished to address the Commission . ROBERT RICCIARDI , 73-700 Highway 111, architect for the applicant, addressed the Commission noting that there was no known deed restriction and it had been completely checked out by the H. F. Mr: Ricciardi noted that the applicant agreed with the conditions. Chairman Berkey asked if there was anyone wishing to speak in FAVOR or in OPPOSITION to the project . Being none, he declared the Public Hearing closed and asked for the pleasure of the Commis- sion . Commissioner Snyder stated that he still wanted exterior sidewalks on Highway 74. Commissioner Kelly agreed with Commissioner Snyder. Chairman Berkey noted that it would make for safer conditions with sidewalks on Highway 74. CITY OF PALM DESERT STAFF REPORT To: Planning Commission Report On: Tentative Tract for a 13-lot subdivision Applicant: LINSCO AGENCIES, LTD. Case No. : TT 12050 Date: February 28, 1978 I . REQUEST: Request for approval of a Tentative Tract Map to create 12 residential lots and 1 common lot::.on approximately 1 .39 acres within the R-3 20,000(3) , S.P. zone generally located on the east side of Ocotillo, south of Tumble- weed. II . STAFF RECOMMENDATION: By Planning Commission Resolution No. 336, forward a recommendation of ap- proval to the City Council subject to compliance to conditions. Justification is based upon the following: 1 . The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The site is physically suited for the proposed density of the develop- ment. 5. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health pro- blems. III. BACKGROUND: A. Telephone - General Telephone Co. IV. DISCUSSION: The subject site is located within an existing multi-family residential neighborhood so that the proposed development will be compatible with adjacent land use. The submitted tentative tract conforms with the re- quirements of the approved Development Plan, related Case No. CUP 16-77. The Conditions of Approval require that the Epplicant pay into the "Planned Local Drainage Facilities Fund" as required by recently adopted Ordinance No. 175. Special Condition of Approval No. 1 requires the applicant to install curbs, gutters, tie-in paving and sidewalks along 'theefull front- age of the property on Ocotillo. With regard to this issue , the Design Review Board wrestled with the question of sidewalks and concluded that a meandering sidewalk on the subject property would be an acceptable alternative to a regular sidewalk, but the Director of Public Works be- lieves it is imperative that sidewalks be installed within the multi- family residential neighborhoods at time of new construction—viThe Commis- sion will necessarily have to make a determination as to the requirements for pedestrians in this vicinity. Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexpected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demand is expected to continue to increase annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981. In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. Ile now believe our low sulfur fuel oil inventory, together with our contractual commitments for delivery, and our customers' conservation efforts, will permit us to meet the forecasted demand for electricity during 1978. It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity. Case No. : TT 12050 Date: February 28, 1978 I. REQUEST: Request for approval of a Tentative Tract Map to create 12 residential lots and 1 common lot on approximately 1 . 39 acres within the R-3 20,000(3) , S.P. zone generally located on the east side of Ocotillo, south of Tumble- weed. II . STAFF RECOMMENDATION : By Planning Commission Resolution No. 336, forward a .recommendation of ap- proval to the City Council subject to compliance to conditions. Tract Size: Approximately 1 .39 acres B. Proposed Lots: Lots 1-12 Condominium Units Lot 13 Common Area C. Zoning: R-3 20,000(3) , S.P. D. Adjacent Zoning: North - R-3(4) South - R-3 20,000(3) , S.P. East - R-1 12,000 West - R-3 18,000(3) , S.P. E. Environmental Finding : The Director of Environmental Services determined on February 13, 1978, that the project would not have a significant adverse impact on the environ- ment and the appeal period has expired. Case No. TT 12050 February 28, 1978 Page Two III. BACKGROUND: (Cont. ) F. Utilities: Power - So. Calif. Edison Co. Water - C.V.C.W.D. Sewer - C.V.C.W.D. Natural Gas - So. Calif. Gas Co. Telephone - General Telephone Co, IV. DISCUSSION: The subject site is located within an existing multi-family residential neighborhood so that the proposed development will be compatible with adjacent land use. The submitted tentative tract conforms with the re- quirements of the approved Development Plan, related Case No. CUP 16-77. The Conditions of Approval require that .the Epplicant pay into the "Planned Local Drainage Facilities Fund" as required by recently adopted Ordinance No. 175. Special Condition of Approval No. i requires the applicant to install curbs, gutters, tie-in paving and sidewalks along the full front- age of the property on Ocotillo. With regard to this .issue, the Design Review Board wrestled with the question of sidewalks and concluded that a meandering sidewalk on the subject property would be an acceptable alternative to a regular sidewalk, but the Director of Public Works be- lieves it is imperative that sidewalks be installed within the multi- family residential neighborhoods at time of new construction. The Commis- sion will necessarily have to make a determination as to the requirements for pedestrians in this vicinity. RESOLUTION NO. 78-30 Page Three CONDITIONS OF APPROVAL CASE NO. In addition,'the major'fuel used in Edison's generating facilities is low sulfur fuel oil.
