Councilman McPherson also pointed out that the dike existing
now is the same dike that failed in 1976 and caused so much
devastation in the City of Palm Desert . If this project
were denied, the City of Palm Desert would be left with the
same protection as in 1976 .
Mayor Mullins declared the Public Hearing closed.
Councilman Wilson stated that he was one of those in favor
of the continuance of this project request, and he was glad
he had in that he felt more confident with the information
that had been presented as a result of the meeting with the
Water District. However, it is a separate issue. We are
not putting more water in Indian Wells , but merely making
sure that the water goes where the Water District intended
it to go and that is down into Deep Canyon Channel and not
through the City of Palm Desert through an inadequate dike .
He stated that he certainly shared the concerns of Indian
Wells relative to the implementation of the Bechtel Plan,
and he asked that Staff be directed to start work immediately
with sister cities and other affected agencies to come up
with alternative financing methods to move ahead with the
. Bechtel Plan.
Councilman Wilson moved and Councilman McPherson seconded to
waive further reading and pass Ordinance No . 208A to second reading .
Motion carried on,the _following vote:

Councilman Newbrander stated that she did not think that this 1
dike would make any difference if the reinforced dike of the . J
Water District holds . She, for one, would love to see something
done. on the Bechtel Plan. However, she stated that she was
opposed to 805 mome-houses in the City.
B. CASE TT 12450, ANIEL RUSSIE , APPLICANT: CONSIDERATION
OF A RNU.ES-T—F-OR'TIME EXTENSION OF AN APPROVED TENTATIVE
TRACT MAP TO CONSOLIDATE 15 EXISTING LOTS TO CREATE 4 LOTS
TO PROVIDE FOR 21 CONDOMINIUM UNITS AND COMMON OPEN SPACE
ON PROPERTY GENERALLY LOCATED EAST OF DEEP CANYON, BETWEEN
SAGE BRUSH DRIVE AND DRIFTWOOD DRIVE .
Mr. Williams stated that the Tentative Map had been approved
by Council in June, 1978 , The applicant has been unable to
complete all necessary work to allow for implementation of
the Tentative Tract Map and is thus requesting the time
extension. Staff has reviewed all conditions imposed and
found them to be still in accordance with Code with the
exception of the Signalization Fund which the applicant
will now be required to participate in. Staff recommended
approval of the request for time extension.
Mayor Mullins declared the Public Hearing open and invited
input in FAVOR of the request . None was offered . He invited
input in OPPOSITION to the request , and none was offered. He
declared the Public Hearing closed.
Councilman Newbrander moved and Councilman McPherson seconded to
waive further reading'and adopt Resolution No . 79-59 , approving the 18
month time extension. Motion carried unanimously with the members present .

AND APPROVING AN 18 MONTH TIME EXTENSION PURSUANT
TO THE PROVISIONS OF SECTION 26 . 20 . 140 OF THE
PALM DESERT MUNICIPAL CODE OF THE APPROVED TENTATIVE
TRACT MAP 12450.
CASE NO . TT 12450
WHEREAS, the City Council of the City of Palm Desert,
California, did receive a request from DANIEL RUSSIE for an 18
month time extension, pursuant to the provisions of Section
26 . 20 . 140 of the Palm Desert Municipal Code of the approved Tenta-
tive Tract Map TT 12450, to consolidate 15 existing lots to create
4 lots to provide for 21 condominium units and common open space
on property generally located east of Deep Canyon, between Sage Brush
Drive and Driftwood Drive, more particularly described as :
Lots 15-29, Shadow Hills Estates ; and
WHEREAS , the City Council is empowered to grant time ex-
tensions of up to eighteen months for filing of the final map in
Section 26 . 20. 140 of the Palm Desert Municipal Code; and
WHEREAS , the City Council did find the following reasons
to exist to justify the granting of said time extensions :
1 . Granting the time extension will not in any way adversely
affect the public health, safety or general welfare .
2 . The applicant is not proposing any changes to the project
and the situation in the vicinity of the project is
unchanged since the subject tentative tract was originally
approved.
NOW, THEREFORE , BE IT RESOLVED, by the City Council of the
City of Palm Desert, California, as follows :
1. That DANIEL RUSSIE is hereby granted an 18-month time
extension of the approval of Tentative Tract Map .
TT 12450, subject to all conditions of Resolution No.
78-70, and the additional Condition "This Tract shall
be required to pay $50 . 00 per unit into the overall
Signalization Fund of the City of Palm Desert" .
2 . That the final map for Tract 12450 must be filed prior
to December 8 , 1980 , to preserve the validity of said
tract.

FINDINGS AND APPROVING A TENTATIVE MAP TO CON-

WHEREAS, the City Council of the City of Palm Desert , did re-
ceive a verified application from DANIEL RUSSIE, requesting approval
of a Tentative Tract Map to consolidate 15 existing lots to create 4
lots to provide for 21 condominium units and common open space on
property generally located east of Deep Canyon , between Sage Brush
Drive and Driftwood Drive , more particularly described as :
Lots 15-29 Shadow Hills Estates
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32, " in that the Director of Environmental Services has deter-
mined that the project is exempt from further documentation as a Nega-
tive Declaration was issued for a related project , Case No. CUP' 19-77;
and,
WHEREAS, the City Council did take into consideration the Tenta-
tive Map as submitted, and the reports of the various reviewing agencies;
and,
WHEREAS, the City Council did find that the subject Tentative
Map does substantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Subdivision Map Act ,
as amended; and,
WHEREAS , the City Council did find that the subject Tentative
Map does comply with the adopted General Plan and the Palm Desert
Zoning Ordinance ; and,
WHEREAS, the City Council did find that the site is physically "
suitable for the type of development proposed; and,
WHEREAS, the City Council did find that the site is physically
suited for the proposed density of the development ; and,
WHEREAS , the City Council did find that the design of the sub-
division and the proposed improvements are not likely to cause sub-
stantial environmental damage or serious health problems .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert , as follows :
1. That the above recitations are true and correct and consti-
tute the findings of the Council in this case;
2. That it does hereby require that the applicant pay a fee in
an amount determined under the Ordinance provisions in order to com-
ply with Article 26. 15 of the City ' s Subdivision Ordinance regarding
the public facilities requirement ;

CONDITIONS OF APPROVAL

Standard Conditions :
1 . The development of the property described herein shall be subocc
to the restrictions and limitations set forth herein which arc in
addition to all municipal ordinances and State and Federal sta_ _tes
now in force , or which hereafter may be in force .
2 . Full public improvements including traffic safety lighting as re-
quired by Ordinance and the Director of Public Works , shall be
installed in accordance with City standards .
3 . Access rights on Sagebrush Dr . , Shadow Hills Dr . , 'A ' Street , rift-
wood Dr. , and Deep Canyon Dr . shall be offered to the City as a
dedication on the Final Map .
4. The C. C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision map ,
the applicant shall submit to the Director of Public Works :
a. The document to convey title .
b. Covenants and restrictions to be recorded .
c. Management and maintenance agreement to be entered into with
1. the owners of the units of the project .
4 5. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
6 . Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the Cite
and free of all liens and encumbrances.
8. All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services .
9. Complete plans and specifications shall be submitted as require•-d
by Ordinance to the Director of Public Works for checking and a7-
proval before construction of any improvements is commenced. The
subdivider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular ac-
cess to all buildings. An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
Marshal .
11 . All requirements of the City Fire Marshal shall be met as a part
of the development of this tract per attached memorandum.
12 . Drainage shall be subject to approval of the Director of Public
Works . Applciant shall Provide engineered data as requested.

Provide the following fire protection:
I . Install a water system capable of delivering 2500 0•. fire flow from any
fire hydrant for a two hour duration in addition to dcmel�
computation shall be based upon a minimum of 20 psi residual supply. The

2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4 The water system plan shall be signed by a registered civil engineer and aoprov=_d
J company, with 'tne follo:lina certification : "I certify that the
design of the rater system in Tract tio. 12450 - in accordance with the
requirements prescribed by the Fire Marshal . " Upon approval , the original plan
will be returned to the developer.

Mayor Mullins declared the Public Ilearing open and asked for
Staff ' s report .
Mr. Williams reviewed the Staff Report for Council indicating
that the Planning Commission , in their review of the project ,
had found it in conformance with the Subdivision Ordinance ,
the General Plan , and the State Asap Act . It will be well
below the allowed density , and it is a suitable development
for the property . By their Resolution No. 354 , they did
recommend approval , subject to a number of conditions
including undergrounding of utilities. Staff also recom-
mends approval by Council Resolution No . 73-70.
Councilman Newbrander inquired as to the number of pools
to be located in the project , and Mr . Williams advised
there would be 3 . -Councilman Newbrander expressed her
strong concern for the area ' s water supply . She said i
that every time the City got a request for a new tract
approval , the Water District sent us a beautiful form
letter expressing their approval . However , she was
experiencing water pressure problems in her neighborhood ,
and had been advised of similar problems in other nei-hbor-
hoods , and the Water District always explained them away
by stating that there existed so much new development that
it was only natural that the pressure would be down .
Mayor Mullins invited input in FAVOR of the project .

Newbrander ' s concern about water shortage , Air . Root advised
that he has built many houses in the area , most of which
have a pool .
lfayor Mullins invited input in OPPOSITION to the project , and
none was offered. lie declared the Public Hearing closed.
Councilman Wilson asked Staff , in response to Councilman
Newbrander ' s concern over the water shortage , to forward
it to the Planning Commission for review and comment .
?Mayor ?iullins pointed out that the Commission had done
this in the recent past ; in fact , 11r . Lowell Weeks of the
Water District had talked at a Commission meeting and
stated there was no shortage and would not be for at
least 200 years.
Councilman McPherson moved and Councilman Brush seconded to waive
further reading and adopt Resolution No. 78-70. Motion carried on the

ebe reported that the owner of the property is building
a mi i-warehouse adjacent to Cook Street on the westerly
side and above the whitewater Channel in the. Industrial Zone.
When he Development Plan was approved, there were two con-
dition one of which required the dedication of the right-
of-way •n Avenue 42 which is 700, long. Staff is recom-
mending a proval of the proposed resolution which accepts
this dedication and authorizes the City Clerk to record .
Councilman McPh rson moved and Councilman Newbrander seconded to
waive further reading and adopt Resolution No. 75-71 . Motion carried
unanimously.
B. RESOLUTION N0. 78-72 - A RESOLUTION OF THE CITY COUNCIL OF
(41) THE CITY OF PALM DESERT, CALIFORNIA , AMENDING THE OPERATING
BUDGET FOR THE 1'977/78 FISCAL YEAR.
Mr. Bouman stated\,that this was expected to be the final
budgetary housekeeping item for the current fiscal year ,
and each year, them is a need to come to Council mid
June for some adjustments . There are no increases , just
transfers to cover areas where we did not estimate right .
The major increased appropriation is for insurance as
once again , our insurance costs have increased astronomi-
cally . Even though we budgeted a substantial increase
for this year , we are autdited during the year and are now
required to pay an additi nal balance of in excess of
59, 000. He reviewed the ther transfers.
Councilman Wilson asked if here had been any word as yet
relative to the research on - self-insurance program . Air .
Bouman responded that he had been in touch recently with
Don Blubaugh , City !.tanager of Palm Springs , who had advised
that the investigation had proven the program would not be
advantageous for Palm Springs . \ However , because we are a
smaller city , like Rancho liira.-e , Coachella, and Indian
Wells , it. still might prove wor'& hile for us to band
together in such a program. The consultant will be in
touch with us within the next week or so with exact figures
and recommendation .

IV. DISCUSSION:
The proposed tract conforms with the Development Plan approved for the
project (Case No. CUP 19-77) except in one minor instance. Special
Condition No. 5 for Case No. CUP 19-77 and 10611F required a minimum 10
foot setback between buildings. The proposed tract map responds to this
requirement in every instance except one, in Lot 2, there are two pro-
posed condominium units that do not reflect the 10 foot minimum setback.
This minor adjustment can be made on the Tract Map and approved by the
City Engineer.

and,
WHEREAS , the City Council did take into consideration the Tenta-
tive Map as submitted, and the reports of the various reviewing agencies;
and,
WHEREAS , the City Council did find that the subject Tentative

Provide the following fire protection:
1 . Install a water system capable of delivering 2500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for revie,:r.
4. The water system Plan shall be signed by a registered civil engineer and approved
by the rater company, with the following certification : "I certify that the

4. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits . Prior to recordation of the final subdivision map ,
the applicant shall submit to the Director of Public Works :
a. The document to convey title .
b. Covenants and restrictions to be recorded.
C. management and maintenance agreement to be entered into with
the owners of the units of the project .
i 5. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances .
S. All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services .
9. Complete plans and specifications shall be submitted as required
by Ordinance to the Director of Public Works for checking and ap-
proval before construction of any improvements is commenced. The
subdivider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
10 . In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular ac-
cess to all buildings. An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
Marshal. .
11 . All requirements of the City Fire marshal shall be met as a
of the development of this tract per attached memorandum. part
12 . Drainage shall be subject to approval of the Director of Public
Works . Appiciant shall provide engineered data as requested .
13 . All requirements of the Planning Commission action on related case
No . CUP 19-77 shall be met as a part of the development of this
tract .
14 . The total number of lots shall be limited to 4 .

foot setback between buildings. The proposed tract map responds to this
requirement in every instance except one, in Lot 2, there are two pro-
posed condominium units that do not reflect the 10 foot minimum setback.
This minor adjustment can be made on the Tract Map and approved by the
City Engineer.

Mr . Williams reviewed the case and noted the Design Review
Boards concern over the garage doors for Plan No . 2 and the perimeter
wall . He also noted that the project would have a bike system that
would integrate with existing systems in and around the City .
There was some discussion about the tennis courts and whether
they would be lighted. Mr. Williams noted that they would be lighted
and that they would be 27 ft . from the units and that the courts
would be lowered . With regard to the streets, 1Ir . Williams noted that
the interior streets would be private .
Chairman Berkey declared the Public Hearing open and asked

Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters. of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
Of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our loin sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1970.
It is our intention to continue to do everything that can reasonably
I accomplished to provide our customers with a continuous and sufficient supply
of electricity.

service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on rile with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should

Mayor Mullins declared the Public Hearing open and asked for
Staff ' s report .
Mr. Williams reviewed the Staff Report for Council indicating
that the Planning Commission , in their review of the project ,
had found it in conformance with the Subdivision Ordinance ,
the General Plan , and the State Map Act . It will be well
below the allowed density , and it is a suitable development
for the property. By their Resolution No . 354 , they did
recommend approval , subject to a number of conditions
including undergrounding of utilities. Staff also recom-
mends approval by Council Resolution No . 78-70.
Councilman Newbrander inquired as to the number of pools
to be located in the project , and Mr. Williams advised
there would be 3 . ,Councilman Newbrander expressed her
strong concern for the area' s water supply . She said
that every time the City got a request for a new tract
approval , the Water District sent us a beautiful form
letter expressing their approval . However , she was
experiencing water pressure problems in her neighborhood ,
and had been advised of similar problems in other neighbor-
hoods , and the Water District always explained them away
by stating that there existed so much new development that
it was only natural that the pressure would be down .
Mayor Mullins invited input in FAVOR of the project .

Mayor Mullins pointed out that the Commission had done
this in the recent past ; in fact , Mr. Lowell Weeks of the
Water District had talked at a Commission meeting and
stated there was no shortage and would not be for at
least 200 years .

VIII . RESOLUTIONS .
A. RESOLUTION NO. 78-71 - A RESOLUTION OF THE CITY COUNCIL OF
(84) THE CITY OF PALM DESERT, CALIFORNIA, ACCEPTING THE DEDICA-
TION OF A PORTION OF LAND LYING ADJACENT TO 42ND AVENUE.
Mr. Beebe reported that the owner of the property is building
a mini-warehouse adjacent to Cook Street on the westerly
side and above the Whitewater Channel in the Industrial Zone.
When the Development Plan was approved, there were two con-
ditions , one of which required the dedication of the right-
of-way on Avenue 42 which is 700' long. Staff is recom-
mending approval of the proposed resolution which accepts
this dedication and authorizes the City Clerk to record .
Councilman McPherson moved and Councilman Newbrander seconded to
waive further reading and adopt Resolution No . 78-71. Motion carried
unanimously .
B. RESOLUTION NO. 78-72 - A RESOLUTION OF THE CITY COUNCIL OF
(41) THE CITY OF PALM DESERT, CALIFORNIA, AMENDING THE OPERATING
BUDGET FOR THE 1977/78 FISCAL YEAR.
Mr. Bouman stated that this was expected to be the final
budgetary housekeeping item for the current fiscal year ,
and each year , there is a need to come to Council mid
June for some adjustments . There are no increases , just
transfers to cover areas where we did not estimate right .
The major increased appropriation is for insurance as
once again , our insurance costs have increased astronomi-
cally. Even though we. budgeted a substantial increase
for this year, we are audited during the year and are now
required to pay an additional balance of in excess of
$9, 000. He reviewed the other transfers.
Councilman Wilson asked if there had been any word as vet
relative to the research on a self-insurance program. Mr .
Bouman responded that he had been in touch recently with
Don Blubaugh, City 14anager of Palm Springs , who had advised
that the investigation had proven the program would not be
advantageous for Palm Springs . However , because we are a
smaller city , like Rancho Mirage , Coachella, and Indian
Wells , it still might prove worthwhile for us to band
together in such a program. The consultant will be in
touch with us within the next week or so with exact figures
and recommendation .

I . REQUEST:
Request for approval of a Tentative Tract Map to consolidate 15
existing .lots to create 4 lots to :provide for 21 condominium units
and common open space on property generally located east of Deep
Canyon, between Sage Brush Drive and Driftwood Drive.
H . STAFF RECOMMENDATION:
By Planning Commission Resolution No. forward a recommendation
of approval to the City Council subject to compliance to conditions
Justification is based upon the following:
1 . The subject Tentative Map does substantially comply with Chapter 26
of the City of Palm Desert Municipal Code, and the State of California
Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General Plan
and the Palm Desert Zoning Ordinance.
3. The site,Hs physically suitable for the type of development proposed.
4. The site is physically suited for the proposed density of the develop-
ment.
5. The design of the subdivision and the proposed improvements are not
likely to cause substantial environmental damage or serious health
problems.

of CEQA as a Negative Declaration was issued
for a related project, CUP 19-77.

IV. DISCUSSION:
The proposed tract conforms with the Development Plan approved for the
project (Case No. CUP 19-77) except in one minor instance Special
Condition No. 5 -for Case No. CUP 19-77 and 106MF required a minimum 10
foot setback between buildings.. The proposed tract map responds to this
requirement in every instance except one, in Lot 2, there are two pro-
posed condominium units that do not reflect the 10 foot minimum setback.
This minor adjustment can be made on the Tract Map and- approved by the
City Engineer.

WHEREAS, the Planning Commission of the City of Palm Desert ,
California, did receive a verified application from DANIEL RUSSIE re-
questing approval of a Tentative Map to consolidate 15 existing lots
to create 4 lots to provide for 21 condominium units and open space
on approximately 3 . 48. acres within the R-3(Multi-family Residential)
and R-3(3) (Multi-family Residential , min . 3, 000 sq . ft . of lot area/
du) zones generally located east of Deep Canyon , between Sage Brush
Drive and Driftwood Drive, more particularly described as :

WHEREAS , said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No . 77-7" , in that the Director of Environmental Services has deter-
mined that the project is exempt from further documentation as a Nega-
tive Declaration was issued for a related project , Case No. CUP 19-77 ;
and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing
agencies; and,
�- WHEREAS , the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Subdivision Map Act ,
as amended; and,
WHEREAS, the Planning Commission did find that the subject Tenta-

2 . That it does hereby require that the applicant pay a fee
in an amount determined under the Ordinance provisions in order to com-
ply with Article 26. 15 of the City' s Subdivision Ordinance regarding
the public facilities requirement ;
3. That it does hereby recommend approval to the City Council
of the City of Palm Desert of the above described Tentative Map No .
12450, subject to fulfillment of the attached conditions :

t dard Conditions :
I 1 . The development of the property described herein shall be subject
Il to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force.
2 . Full public improvements including traffic safety lighting as re-
quired by Ordinance and the Director of Public Works, shall be
installed in accordance with City standards .
3 . Access rights on Sagebrush Dr. , Shadow Hills Dr . , 'A ' Street , Drift-
wood Dr . , and Deep Canyon Dr. shall be offered to the City as a
dedication on the Final Map .
4. The C.C.&R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision map,
the applicant shall submit to the Director of Public Works :
a. The document to convey title .
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
5. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts h P P awing
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City
and free of all liens and encumbrances.
8. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services .
9. Complete plans and specifications shall be submitted as required
by Ordinance to the Director of Public Works for checking and ap-
proval before construction of any improvements is commenced. The
subdivider shall submit "as-built" plans prior to acceptance of the
subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular ac-
cess to all buildings . An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
I Marshal .
111. All requirements of the City Fire Marshal shall be met as a part
of the development of this tract per attached memorandum.
12 . Drainage shall be subject to approval of the Director of Public
Works. Applciant shall provide engineered data as requested.
13. All requirements of the Planning Commission action on related case
No. CUP 19-77 shall be met as a part of the development of this
tract .
14. The total number of lots shall be limited to 4.

15. The applicant shall have twelve ( 12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen
(18) months is granted by a Resolution of the City Council .
16. Applicant shall pay fees into the Palm Desert Planned Local
Drainage Facilities Fund in an amount to be determined by the
provisions of Ordinance No. 175.
17. Applicant shall pay a fee in an amount determined under the Ordi-
nance provisions in order to comply with Article 26 . 15 of the
City ' s Subdivision Ordinance regarding the public facilities re-
quirement .
Special Conditions :
1 . Concrete curbs, gutters „ tie-in paving and sidewalks shall be in-
stalled for this development .
2 . Sidewalks shall be installed 5 feet wide , adjacent to the curb
in this entire area.

Provide the following fire protection:
1 . Install a water system capable of delivering 2500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
( (a) but not greater than 400 feet apart in any direction.

Environmental Impact Report
Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all .customer loads during peak_
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

This letter is not to be interpreted as a contractual commitment to
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a particular project. If you desire further
information on any of our energy conservation programs , please contact
this office for assistance.

to you for comments and recommended Conditions of Approval . The City
is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals, parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. April 21 , 1978, in order to be
discussed by the Land Division Committee at their meeting of April 26th
The Land Division Committee (comprised of Director of Environmental
Services, City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
eration.
