Mayor Mullins declared the Public Hearing open .
Mr. Williams reviewed the Staff Report , stating that the
Planning Commission , by Resolution No. 364 , did recommend
approval . Approval is subject to a number of conditions
including improvement of the Frontage Road and undergrounding
of utilities . Staff also recommended approval .
Mayor Mullins invited input in FAVOR of the project , and none
was offered.
Mayor Mullins invited input in OPPOSITION to the project , and
none was offered. He declared the Public Hearing closed.
Councilman McPherson moved and Councilman Wilson seconded to
approve the Tentative Tract 'lap by adopting Resolution No . 78-75 .
Motion carried on a 4-1 vote with Councilman Newbrander voting NOE .
C . CASE NO. TT 9144 , DEEP CANYON LTD . , Applicant : Considera-
tion of a Request for an Extension of Time on the Approval
of a Tentative Tract Map for 212 Single-Family Residences
on 47. 05 Acres , Generally Located South of 44th Avenue and
East of Deep Canyon Road.
Mr. Carlos Ortega stated that Southwest Engineering Company
of Riverside , agents for Deep Canyon Ltd. , is requesting an
extension of Tentative Tract No. 9144 , better known as the
Hidden Palms Project . Staff ' s recommendation is for approval
of the 12-month extension based on justification submitted
in the transmittal letter included in the Agenda packet .
He advised that Mr . Williams could answer any questions
Council might have . .
Mayor Mullins invited input in FAVOR of the extension .
Mr. Gair Bruton addressed Council on behalf of Southwest
Engineering. He explained the difficulties they had
experienced in preserving the date palm trees and the
measures they were taking to meet the City ' s requirements
to preserve some of the grove in which the development was
taking place . He requested Council ' s approval of the
extension .
Mayor Mullins invited input in OPPOSITION to the extension , and
none was offered . He declared the Public Hearing closed.
Councilman Newbrander moved and Councilman McPherson seconded
to waive further reading and adopt Resolution No . 78-76 , approving the
extension of time . Motion carried unanimously .
D . CONSIDERATION OF A RESOLUTION Authorizing the Staff to
Initiate an Acquisition Program to Acquire Real Property
Within the College of the Desert Area In Order to Change
the Street Pattern Within the Area and Provide for Recrea-
tional Facilities as Prescribed by the College of the Desert
Area Specific Plan .
Mayor Mullins declared the Public Hearin,, open .
.Mr . Ortega stated that the College of the Desert Plan ,
adopted by the City in the early part of 1978 , includes
within it certain parcels of land designated for public
use and selected to be acquired by the City . Resolution
No. 78-77 is part of the process by which the City obtains
authority to obtain private property . He advised that `.Ir.
Williams could answer more particular questions if Council
had any .

A. STAFF RECOMMENDATION:
Approve the Tentative Tract subject to the Conditions of Approval by
Resolution No. 78-75.
Justification is based upon the following:
1 . The subject Tentative Map does substantially comply with Chapter 26
of the City of Palm Desert Municipal Code, and the State of California
Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General Plan
and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development proposed.
4. The site is physically suited for the proposed density of the development.
5. The design of the subdivision and the proposed improvements are not
likely to cause substantial environmental damage or serious health pro-

PALM DESERT, CALIFORNIA, SETTING FORTH ITS FIND-
INGS AND APPROVING A TENTATIVE MAP TO CREATE A
5-LOT SUBDIVISION TO PROVIDE FOR 4 CONDOMINIUM
UNITS ON APPROXIMATELY . 42 ACRES EAST OF HIGHWAY
74 , NORTH OF VERBA SANTA.
CASE NO. TT 12725
WHEREAS, the City Council of the City of Palm Desert , California,
did receive a verified application from WILLARD T. JORDAN requesting ap-
proval of a Tentative Map to create a 5-lot subdivision to provide for
4 condominium units and common areas on approximately . 42 acres within
the R-3 18, 000(3) , S .P. (Residential , multi-family , 18, 000 sq. ft . min.
lot size, 3,000 sq. ft . minimum site area per unit , Scenic Preservation
Overlay District) zone, east of Highway 74, north of Verba Santa, more
particularly described as :

WHEREAS , said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32, " in that the Director of Environmental Services has deter-
mined on May 8, 1978, that the project will not have a significant
adverse effect on the environment and the appeal period has expired;
and,
WHEREAS, the City Council did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing
agencies; and,
WHEREAS, the City Council did find that the subject Tentative
Map does substantially comply with Chapter 26 of the City of Palm Desert

amended; and,
WHEREAS, the City Council did find that the subject Tentative

CONDITIONS OF APPROVAL

Standard Conditions :
1 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force .
2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the Director of Public Works , shall be in-
stalled in accordance with City standards .
3. Access rights on the frontage road shall be offered to the City as
a dedication on the Final Map.
4. The C.C. &R' s for this development shall be submitted to the Director
of Public Works for review ana approval prior to the issuance of
any building permits . Prior to recordation of the final subdivision
map, the applicant shall submit to the Director of Public Works :
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
5. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
8. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
9. Complete plans and specifications shall be submitted as required
by Ordinance to the Director of Public Works for checking and ap-
proval before construction of any improvements is commenced. The
subdivider shall submit "as-built" plans prior to acceptance of
the subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular ac-
cess to all buildings . An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
( Marshal .
I 11 . All requirements of the City Fire Marshal shall be met as a part
of the development of this tract per attached memorandum.
12. Drainage shall be subject to approval of the Director of Public
Works . Applicant shall provide engineered data as requested.
13. All requirements of the Planning Commission action on related case
No . CUP 15-77 shall be met as a part of the development of this
tract .
14. The total number of lots shall be limited to 5 .

15. The applicant shall have twelve ( 12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen
( 18) months is granted by a Resolution of the City Council .
16. Applicant shall pay fees into the Palm Desert Planned Local
Drainage Facilities Fund in an amount to be determined by the
provisions of Ordinance No. 175 .
17. Applicant shall pay a fee in an amount determined under the
Ordinance provisions in order to comply with Article 26 . 15 of the
City' s Subdivision Ordinance regarding the public facilities
requirement .
Special Conditions :
1 . Applicant shall fully improve the Frontage Road with sidewalks ,
curbs, and gutters, and tie-in paving on both sides thereof .

Provide the following fire protection:
I. Install a water system capable of delivering 2500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2.. Install Riverside County super fire hydrants located at each street intersection
. (a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted orange.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 12725 is in accordance with the
requirements prescribed by the Fire Marshal . " Upon approval , the original plan
will be returned to the developer.

IV. DISCUSSION:
The proposed Tentative Tract complies with the requirements of the
approved Conditional Use Permit CUP 15-77. The site is located within
an existing multi-family residential neighborhood so that the proposed
development will be compatible with adjacent land use. The Conditions
of Approval require that the applicant pay into the "Planned Local Drain-
age Facilities Fund" as required by adopted Ordinance No. 175 and that
a fee in an amount determined under the Ordinance provisions be paid in
order to comply with the Public Facilities requirement. The Director
of Public Works is requiring that the Frontage Road be fully improved
with sidewalks, curbs, gutters and .tie-in paving as stated in Special
Condition No. 1 .

Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

r Standard Conditions :
+f 1 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force .
2 . Full public improvements including traffic safety lighting as re-
quired by Ordinance and the Director of Public Works , shall be in-
stalled in accordance with City standards .
3. Access rights on the frontage road shall be offered to the City as
a dedication on the Final Map.
4 . The C. C. &R' s for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of
any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the Director of Public Works :
a. The document to convey title.
b . Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
5. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City
and free of all liens and encumbrances.
8. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
9. Complete plans and specifications shall be submitted as required
by Ordinance to the Director of Public Works for checking and ap-
proval before construction of any improvements is commenced. The
subdivider shall submit "as-built" plans prior to acceptance of
the subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular ac-
cess to all buildings. An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
Marshal .
11 . All requirements of the City Fire Marshal shall be met as a part
�._ of the development of this tract per attached memorandu.
12. Drainage shall be subject to approval of the Director of Public
Works . Applicant shall provide engineered data as requested .
13. All requirements of the Planning Commission action on related case
No. CUP 15-77 shall be met as a part of the development of this
tract .

Provide the following fire protection:
1 . Install a water system capable of delivering 2500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted orange.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 12725 is in accordance with the
requirements prescribed by the Fire Marshal . " Upon approval , the original plan
will be returned to the developer.

of electrical supply, we expect to meet our electrical load requirements for '
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978. -
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

by this office prior to 5:00 p.m. May 19 , 1978, in order to be
discussed by the Land Division Committee at their meeting of May 24th
The Land Division Committee (comprised of Director of Environmental
Services , City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
- through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
