Confirming our conversation of this morning , we
agree we will review the growth of our ground cover on
our Cook Street Park common area and if we do not show
progress of the growth of the ground cover , we will put
in additional plants or redo the front with grass.
We are also in the process of hydrofoaming the east
bank and are planting oleanders on our north bank.

Councilman Wilson moved and Councilman McPherson seconded to
waive further reading and adopt Resolution No . 79-114. Motion carried
unanimously.
E. CASE NO. TT 13236 - CLIFF SWANSON ET AL, APPLICANT: CON-
SIDERATION OF A REQUEST FOR APPROVAL OF A -YEAR EXTENSION
OF TIME FOR A TENTATIVE TRACT MAP TO CREATE A 40-LOT
INDUSTRIAL SUBDIVISION ON APPROXIMATELY 29 ACRES , LOCATED
ON THE EAST SIDE OF COOK STREET, NORTHERLY OF THE WHITE-
WATER CHANNEL.
Mayor Mullins declared the Public Hearing open and asked for
Staff ' s report .
Mr. Williams reviewed the report and stated that the
applicant is prepared to sign the Final Map, but because
of engineering problems , he has asked for an extension.
The conditions of approval as adopted in the Tentative
Tract Map approval are still in force. Staff recommended
approval of the request by Resolution No. 79-115 .
Mayor Mullins invited input in FAVOR of the request , and none
was offered. He invited input in OPPOSITION to the request,
and none was offered. He declared the Public Hearing closed.
Councilman McPherson moved and Councilman Brush seconded to waive
further reading and adopt Resolution No . 79-115. Motion carried unani-
mously.
F. CASE NO. TRACT 13881 (AMENDMENT) - DAME-DOTY DEVELOPMENT CO. ,
APPLICANT : CONSIDERATION OF.A REQUEST FOR APPROVAL OF AN
AMENDMENT TO A TRACT MAP WHICH PERMITS 653 DWELLING UNITS
TO ALLOW A DRIVEWAY ACCESS TO THE RECREATIONAL VEHICLE
STORAGE AREA ON PORTOLA AVENUE ON APPROXIMATELY 238 ACRES.
LOCATED ON THE WEST SIDE OF PORTOLA AVENUE AND NORTHERLY OF
THE WHITEWATER CHANNEL.
Mayor Mullins declared the Public Hearing open and called for
Staff' s report .
Mr. Williams reported that at the time the Tentative
Tract Map was approved in April of 1979 , Standard Con-
dition No . 4 only allowed access rights on Portola Avenue
for the main entry and one emergency access . The recrea-
tional vehicle storage area was originally shown on the
plan at the extreme southeast corner of the site. As
such, Standard Condition No. 4 should be amended to
include this driveway.
Mayor Mullins invited input either FOR or AGAINST the request.
MR. ALLEN PERRIERE , 225 S . Civic Center Drive, Palm Springs ,
addressed Council on behalf of Mr. Kapp Homme who owns 7
lots in Monterey Country Club , easterly and adjacent to this
project. He is concerned about the entire project and felt '
since it was being discussed at this meeting, this would be
a good time to review his concerns . Mr. Perriere stated that
he had visited the property in question that day and there
is a significant change in the grade in Portola. He felt
there had been some sort of mistake in the engineering in
Portola and perhaps it was tied in with the grading of the
Chaparral Project . He went on to state that the grade level
of the Chaparral Project was between 3-4 feet higher than

the adjacent Monterey Country Club. He stated also that
there seemed to be an effort to direct waters coming
from the Monterey Country Club project northerly rather
than southerly along the natural grade of the land.
He reviewed the present drainage of the Monterey Country
Club , pointing out that because of the new grade of
Portola, there was now a real problem in that the water
meets Portola and has no where to go and thus just stands
there. He suggested that Council review the situation
at this time and get further input because it seems that
this might be the kind of thing that would warrant recall
of the grading permit.
MR. 0. R. HOMME, 261 Cordoba, addressed Council expressing
concern about the drainage from his property and the fact
that the water reaches Portola and just stands. He stated
that it seemed wrong that something that was established
could be destroyed for something new. He requested that
Council take a look at it before the project was allowed to
continue.
MR. RICHARD DOTY, Chaparral Country Club , stated that their
project went through the public hearing process ; their
engineers reviewed the grading to the north. They processed
their grading in accordance with Mr. Beebe ' s office , and
they have a permit. One of the conditions of approval of
his project was improvement of Portola to Hovely Lane . Mr.
Beebe ' s office came up with all the specifications and
their engineerings , along with the City engineers , had
done the best job in designing Portola as could be done.
Mayor Mullins declared the Public Hearing closed.
Mr. Williams stated that he was not an engineer but standing
on that site, it appeared to be something wrong and unless
there was some modification on the Homme the
property,
emergency accesss would be down in the ground by 4 ft .
He stated that he had spoken with Jack Campbell of the

Public Works Department after their meeting on the project
site, and it was Mr. Campbell ' s statement that he did not
know what Mr. Beebe had in mind; thus the problem could
not be resolved until Mr. Beebe returned from vacation.
Mr. Bouman expressed concern that there might be a traffic
accident hazard depending .
upon the location of the driveway.

He felt that a traffic engineering investigation was neces-
sary which could be conducted before the next meeting of the
City Council with appropriate report to the Council at that
time.
Councilman Wilson moved and Councilman McPherson seconded to
reopen the Public Hearing and continue the matter to the meeting of
October 11 , 1979 , asking Staff for a full report. Motion carried
unanimously.
Councilman Brush moved and Councilman Wilson seconded to
direct Staff to investigatethe questions raised relative to grading
and drainage of the project and report to Council and further, Staff
be authorized to stop work on the project if necessary. Motion carried
unanimously.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
APPROVING A 1-YEAR TIME EXTENSION, PURSUANT TO THE
PROVISIONS OF SECTIONS 26 . 20. 140 OF THE PALM DESERT
MUNICIPAL CODE ,OF THE APPROVED TENTATIVE TRACT MAP.
TT 13236.
WHEREAS, The City Council of the City of Palm Desert,
California, did receive a request from CLIFF SWANSON, ET AL for
a 1-year time extension pursuant of Section 26. 20 . 140 of the
Palm Desert Municipal Code of the approved Tentative Tract Map
TT 13236 , providing for a 40-lot industrial subdivision on ap-
proximately 29 acres , located on the east side of Cook Street,
Northerly of the Whitewater channel, more particularly described as :

WHEREAS, The City Council is empowered to grant time
extensions of up to eighteen months for filing of the final map
in Section 26 . 20. 140 of the Palm Desert Municipal Code; and
WHEREAS, The City Council did find the following reasons
to exist to justify the granting of said time extension:
1. Granting the time extension will not in any way ad-
versely affect the public health, safety or general welfare.
2. The applicant is not proposing any changes to the pro-
ject and the situation in the vicinity of the project is unchanged
since the subject tentative tract was originally approved.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Palm Desert, California as follows:
1. That CLIFF SWANSON, ET AL is hereby granted a 1-year
time extension of the approval of Tentative Tract Map 13236 .
2. That the final map for Tract No. 13236 must be filed
prior to September 29 , 1980, to preserve the validity of said tract.

WHEREAS, the City Council of the City of Palm Desert , California,
did on the 28th day of September, 1978 , hold a duly noticed Public
Hearing to consider an application filed by CLIFF SWANSON, et al , for
approval of a Tentative Tract slap to create a 40-lot industrial sub-
division from approximately 29 acres within the S . I . (U.A. ) (Service
Industrial, Upon Annexation) zone generally located on the east side
of Cook Street northerly of the Whitewater Channel, and more partic-
ularly described as :

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution

CONDITIONS OF APPROVAL
CASE NO . TT 13236
Standard Conditions :
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force , or which hereafter may be in force.
2 . Full public improvements including traffic safety lighting as
required by Ordinance and the Director of Public Storks , shall be
installed in accordance with City Standards .
3. Access rights on Cook Street shall be offered to the City as a
dedication on the Final Map.
4 . The C. C. & R' s for this development shall be submitted to the
Director of Public Works for review and approval prior to the
issuance of any building permits . Prior to recordation of the
final subdivision map , ' the applicant shall submit to the Director
of Public Works :
a. The document to convey title .
b . Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
5 . Improvment plans for water and sewer system shall meet the require-
ments of the respective service districts .
6 . Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
1 7. All dedicated land and/or easements required by this approval shall
JI be granted to the City of Palm Desert , without cost to the City and
free of all liens and encumbrances.
8 . All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
9 . Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval
before construction of any improvements is commenced. The sub-
divider shall sumit "as-built" plans prior to acceptance of the
subdivision improvements by the ,City.
10. In order to maintain reasonable fire protection .during .the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings . An adequate number of fire hydrants
withe required fire flows shall be installed as recommended by
the Fire Marshal .
11 . All requirements of the City Fire Marshal shall be met as a part
of the development of this tract per attached memorandum.
j l 12 . Drainage shall be subject to approval of the Director of Public
Works. Applicant shall provide engineered data as requested .
13 . All requirements of the Planning Commission action on related
case No . CUP 07-78 hall be met as a part of the development of
this
14 . The total number of lots shall be limited to 40.
15. The applicant shall have twelve ( 12 ) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen
(18 ) months is granted by a Resolution of the City Council .

Special Conditions :
1. An eleven foot dedication shall be made on the easterly side
of Cook Street to enable a 110 foot right-of-way .
2 . Full curb , gutter and pavement improvements shall be required ,
on Cook Street .
3 . Safety street lighting shall be provided at the entrance
on Cook Street and within the tract as approved by the-Director of Publiu
Works.
4 . Applicant shall make a contribution in the amount of $5 , 000. 00
toward the signalization of Country Club Drive at Cook Street

Gentlemen:
Provide the following fire protection in accordance with City of Palm Desert,
Uniform Fire Code.
1 . Install a water system capable of delivering 4000 GPM fire flow from any
1 fire hydrant for a four hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pres-
sure in the supply main from which the flow is measured at the time of
measurement.
2. Install Riverside County super fire hydrants located at each street inter-
section (a) but not greater than 300 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome
Yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant .
3 . Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I certify
that the design of the water system in Tract No. 13236 is �n accordance with
the requirements prescribed by the Fire Marshal ." Upon approval , the original
plan will be returned to the developer.

Request for approval of a 40-lot industrial sub-
division and a related request for approval of
a Conditional Use Permit to allow an Industrial
Park Development on approximately 29 acres , lo-
cated on the east side of Cook Street northerly
of the Whitewater Channel .
Mr. Williams reviewed the cases and noted the Traffic Commit-
tees report regarding the Commissions ' concern with the location of
42nd Avenue .
Commissioner Snyder asked about the legal status of the private
road extension . Mr. Williams noted that the Tentative Tract for this
area will provide for both roads.
Chairman Kelly declared the Public Hearing open and asked if
the applicant wished to speak at this time. The applicant was not
present . She then asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the proposed project . Being none , she
declared the Public Hearing closed and asked for the pleasure of the
Commission .
Mr . Williams noted that on TT 13236 the memorandum from the
Fire Marshal should read 3000 gpm not 4000 gpm as noted by a new memo-
randum received from the Fire Marshal . r
On a motion by Commissioner Berkey , seconded by Commissioner
Snyder, the Commission approved the Conditional Use Permit by Plan-
ning Commission Resolution No . 395 ; carried ( 3-0-1 ) AYES : Berkey,

Mr. Williams reviewed the cases and noted that the Staff re-
commends a reduction in area involved and in the number of units
proposed, the applicant would then have to submit another Develop-
ment Plan proposal that will conform with City Standards . He then
reviewed the EIR and noted the various concerns noted by Staff .
Late responses from the Dept . of the Interior and the Dept . of Fish
and Game asking for a watering area to be provided for the Big Horn
sheep in the area and asking that the developer be responsible for
extending the drainage channel in the area .

Mr. Williams reviewed the Change of Zone and noted that it
is compatible with the adjacent zoning .

on Avenue 42 .
Mr. Williams stated that the thought was to separate the com-
mercial from the residential .
Mr. Beebe noted that northerly of Avenue 42 the County states
that they will not go much further but if they do it will be an 88
foot right-of-way.
Chairman Berkey stated that the City' s position on Avenue 42
should be firmed up before any action is taken.
Mr. Williams stated that the Tentative Tract and the Conditional
Use Permit could be continued in light of the question on Avenue 42 .
He also noted a letter of concern received from the City of Indian
Wells stating that they were concerned with the intrusion of industrial
upon commercial .
Commissioner asked that the Tentative Tract be continued and
allow the Staff time to pursue the issue of Avenue 42.
Chairman Berkey declared the Public Hearing open and asked if
the applicant wished to speak at this time .

It was the concensus of the Commission that the Change of

The applicant noted his agreement and Mr . Williams stated

I1. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board
at their meeting of July 25, 1978 .
Mr . Cipriani reviewed the cases . Case No. 134MF was reviewed
and Mr . Larry Spicer of Ironwood spoke to the Commission .
Mr . Spicer noted that he had sent a letter to the Ironwood
residents telling them of this meeting but it appears to be a no
show. He then -introduced the architect for the project .
Mr . Dale Naegle addressed the Commission and noted that the
goal of the project was to have living units with privacy and se-
curity. He further reviewed the project and noted the location
of the tennis courts which allows for maximum unit privacy . Also
a 3rd pool has been added, 6 more tennis courts , and additional
parking were noted. Mr. Naegle stated that he felt they had met
the concerns of the Design Review Board and the Planning Commission .
Mr . Fred Archbuckel Landscape Architect for the project ,
noted that the courts obtain individual identity by use of lots of
plan material . Also the water in the swale area will be handled
i by a bed of rocks or boulders .
Mr . Spicer spoke about the correspondence received from
Ironwood residents noting the following concerns : traffic , size of
units , creating a resort atmosphere, and density . He then stated
that if the tennis courts are considered in the entire site the den-
sity would be 5 . 75 units per acre, without figuring the tennis courts
it is 8 . 5 units per acre. Mr. Spicer noted that he felt the best
presentation has been made.
Chairman Berkey asked about the impact on Foxtail and noted
his concern with same. He asked if Foxtail couldn ' t be widened
instead of having parking . Mr . Spicer stated that the impact would
be the same either way but that this is approach is better looking .
Commissioner Snyder stated that Ironwood is a grand project
but that this is summer and there are no people here to speak in
opposition . Also it will increase the density and the traffic .
Mr . Spicer noted that the City conducts business as usual
all year round and that Ironwood is no different . Legal notices
were sent .

IV. DISCUSSION:
This matter was continued from the Planning Commission meeting of August
1st to allow the staff to determine whether the City should preserve a
right-of-way for 42nd Avenue, along the northern boundary of the subject
property. On August 8, 1978, the City's Technical Traffic Committee re-
viewed this issue and determined that reservation of right-of-way is not
appropriate. Please note the attached minutes. They felt that 42nd Avenue
should intersect Cook Street further north of the subject property and
become Hovely Lane west of Cook Street. This intersection would have the
potential of having a traffic signal in the future, and would provide the
potential of extending 42nd Avenue to at least Monterey Avenue, and
possibly all the way to Bob Hope Drive.
The applicant is seeking approval of a tract map and Conditional Use Permit
to allow an industrial park development on the 29 acre site. The proposal
calls for an interior street system that would be private. These streets
would have 50' of paving within 66 foot right-of-ways. Lots 1-3 are pro-
posed to accomodate wholesale-retail uses such as lumberyards, this being
the reason they are larger than the remaining lots which are generally
100'xl45' in size. On the smaller lots 5,000 to 6,000 sq. ft. structures
are proposed. These structures would be masonry and metal with decorative
fronts facing the interior streets. Zero side yards are proposed on one
side of each lot in order to provide parking on each individual lot and
promote orderly development rather than random scattering of structures.
This would eliminate small areas where unsightly storage might occur. Per-
imeter fencing proposed includes chain link with masonry pilasters. Exten-
sive mounding is proposed along Cook Street with masonry walls broken by
landscaping at specific locations.

1 . The Bike path on Highway ill at the Palm Valley Channel crossing
was discussed. The State indicated that approximately $80,000 was
involved in providing a cantilevered walk to solve the bike access
problem. Considerable discussion ensued and no decision was made.
2. The Redevelopment Agency's construction plans for the frontage roads
was discussed at length and it was the unanimous opinion of the
Committee that the plans in principle were acceptable but further
study of street markings during the construction period should be
exercised by the Traffic Engineer. Several areas need a closer
scrutiny, especially at the intersection.

2. It was agreed unanimously that a letter to Marrakesh stating that
a hazardous condition exists adjacent to the drainage ditch on Emir
Drive where parking is allowed. The Director of Public Works was
instructed to send a letter notifying them that parking should be
adjacent to the residence, especially on the north-south portion of
Emir Drive.
OIt was agreed unanimously that the 42nd Avenue extension easterly
of Cook Street is not necessary. It was also agreed that Hovely Lane
should be extended to meet 42nd Avenue on the quarter section line
easterly of Cook Street. The Director of Public Works was authorized
to write a letter to the County stating the Committee's views.
4. By unanimous decision, the Technical Traffic Committee proposed that
the Portola Avenue improvements in the Whitewater Wash be offset in
the right-of-way with a distance of 50 feet between curbs with a

5. San Pablo between Highway 111 and El Paseo was discussed for a better
striping pattern. No decision was arrived at and the problem was

input in FAVOR of the request . None was offered.
Mayor Mullins invited input in OPPOSITION to the request , and

Mr. Williams reviewed the cases and noted the Traffic Commit-
tees report regarding the Commissions ' concern with the location of
42nd Avenue .
Commissioner Snyder asked about the legal status of the private
road extension . Mr . Williams noted that the Tentative Tract for this
area will provide for both roads.
Chairman Kelly declared the Public Hearing open and asked if
the applicant wished to speak at this time. The applicant was not
present . She then asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the proposed project . Being none , she
declared the Public Hearing closed and asked for the pleasure of the
Commission .
Mr . Williams noted that on TT 13236 the memorandum from the
Fire Marshal should read 3000 gpm not 4000 gpm as noted by a new memo-
randum received from the Fire Marshal .
On a motion by Commissioner Berkey, seconded by Commissioner
Snyder, the Commission approved the Conditional Use Permit by Plan-
ping Commission Resolution No . 395 ; carried (.3-0-1) AYES : Berkey ,
Kelly, Snyder ; ABSTAIN: Fleshman
On a motion by Commissioner Berkey, seconded by Commissioner
Snyder, the Commission approved the Tentative Tract by Planning

Request for a Change of Zone from ' S ' Study to PR-5(U.A . )
and O. S . (U.A. ) on approximately 680 acres , approval of
and overall conceptual Residential Development Plan to
allow 1 , 428 dwelling units and related recreational ameni-
ties and open space, and certification o-f the related
Environmental Impact Report as complete ; the site being
located approximately 3 miles southwest of the intersec-
tion of Highways 111 and 74, adjacent to the southerly
boundary of the City of Palm Desert on the west side of
Highway 74 .
Commissioner Berkey excused himself from this case and left
the room.
Mr. Williams reviewed the cases and noted that the Staff re-
commends a reduction in area involved and in the number of units
proposed, the applicant would then have to submit another Develop-
ment Plan proposal that will conform with City Standards . He then
reviewed the EIR and noted the various concerns noted by Staff.
Late responses from the Dept . of the Interior and the Dept . of Fish
and Game asking for a watering area to be provided for the Big Horn
sheep in the area and asking that the developer be responsible for
extending the drainage channel in the area.

This industrial Tract was approved by the City Council at the meeting of
September 28, 1978. There was no public input or Council discussion at
that time. The applicant is not proposing any changes and it appears that
the conditions that existed at the time of the original approval still
exist.

WHEREAS, The City Council of the City of Palm Desert,
California, did receive a request from CLIFF SWANSON, ET AL for
a 1-year time extension pursuant of Section 26 . 20 . 140 of the
Palm Desert Municipal Code of the approved Tentative Tract Map
TT 13236 , providing for a 40-lot industrial subdivision on ap-
proximately 29 acres, located on the east side of Cook Street,
Northerly of the Whitewater channel, more particularly described as:

WHEREAS, The City Council is empowered to grant time
extensions of up to eighteen months for filing of the final map
in Section 26. 20. 140 of the Palm Desert Municipal Code; and
WHEREAS, The City Council did find the following reasons
to exist to justify the granting of said time extension:
1. Granting the time extension will not in any way ad-
versely affect the public health , safety or general welfare.
2. The applicant is not proposing any changes to the pro-
ject and the situation in the vicinity of the project is unchanged
since the subject tentative tract was originally approved.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Palm Desert, California as follows:
111 1. That CLIFF SWANSON, ET AL is hereby granted a 1-year
time extension of the approval of Tentative Tract Map 13236 .
2 . That the final map for Tract No. 13236 must be filed

PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE
TRACT MAP TO CREATE A 40-LOT INDUSTRIAL SUBDIVI-
SION.

WHEREAS , the City Council of the City of Palm Desert , California ,
did on the 28th day of September , 1978 , hold a duly noticed Public
Hearing to consider an application filed by CLIFF SWANSON, et al , for
approval of a Tentative Tract Map to create a 40-lot industrial sub-
division from approximately 29 acres within the S . I . (U.A. ) (Service
Industrial , Upon Annexation) zone generally located on the east side
of Cook Street northerly of the Whitewater Channel , and more partic-
ularly described as :

WHEREAS , said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution
No . 78-32 , " in that the Director of Environmental Services has deter-
mined that this project will not have a significant effect on the
environment and no further documentation will be required; and,
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to be
heard, said Council did find the following facts and reasons to exist
to recommend approval of the Tentative Tract flap :
1 . The subject Tentative Map does substantially comply
with Chapter 26 of the City of Palm Desert illunicipal
Code, and the State of California Subdivision Map Act ,
as amended.
2 . The subject Tentative ?,lap does comply with the opted
General Plan and the Palm Desert Zoning Ordinance .
3. The site is physically suitable for the type of develop-
ment proposed.
4 . The design of the subdivision and the proposed improve-
ments are not likely to cause substantial environmental
damage or serious health problems.
5. Planning Commission recommendation of approval as expressd

CONDITIONS OF APPROVAL

Standard Conditions :
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force.
2 . Full public improvements including traffic safety lighting as
required by Ordinance and the Director of Public Yorks , shall be
installed in accordance with City Standards .
3. Access rights on Cook Street shall be offered to the City as a
dedication on the Final Map .
4 . The C.C. & R' s for this development shall be submitted to the
Director of Public Works for review and approval prior to the
issuance of anv building permits . Prior to recordation of the
final subdivision map , the applicant shall submit to the Director
of Public Works :
a . The document to convey title .
b . Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project .
5. Improvment plans for water and sewer system shall meet the require-
ments of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City and
JJJ free of all liens and encumbrances.
8. All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
9 . Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval
before construction of any improvements is commenced . The sub-
divider shall sumit "as-built" plans prior to acceptance of the
subdivision improvements by the .City .
10. In order to maintain reasonable fire protection during ,the con-
struction period, the 'subdivider shall maintain passable vehicular
access to all buildings . An adequate number of fire hydrants
withe required fire flows shall be installed as recommended by
the Fire Marshal .
11 . All requirements of the City Fire Marshal shall be met as a part
of the development of this tract per attached memorandum.
12 . Drainage shall be subject to approval of the Director of Public
Works. Applicant shall provide engineered data as requested .
13. All requirements of the Planning Commission action on related
case No . CUP 64-7S shall be met as a part of the development of
this tract . 05
14 . The total number of lots shall be limited to 40.
15. The applicant shall have twelve ( 12 ) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen
( 18 ) months is granted by a Resolution of the City Council .

Special Conditions :
1. An eleven foot dedication shall be made on the easterly side
of Cook Street to enable a 110 foot right-of-way .
2 . Full curb , gutter and pavement improvements shall be required ,
on Cook Street .
3 . Safety street lighting shall be provided at the entrance
on Cook Street and within the tract as approved by the Director of Public
Works.
4 . Applicant shall make a contribution in the amount of S5 , 000 . 00
toward the signalization of Country Club Drive at Cook Street

Gentlemen:
Provide the following fire protection in accordance with City of Palm Desert,
Uniform Fire Code.
' �l Install a water system capable of delivering 8300 GPM [ire flow from any

� fire hydrant for a four hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pres-
sure in the supply main from which the flow is measured at the time of

measurement.
2. Install Riverside County super fire hydrants located at each street inter-
section (a) but not greater than 300 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted rod 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and throe (3\ copies of the water system plan to the Fire Marshal for review.

4. The water system plan shall be signed by a registered civil engineer and
approved by the water company/ with the following certification: //| certify
that the design of the water system in Tract Mo. 13236 is [n accordance with
the requirements prescribed by the Fire Marshal .'' Upon approval , the original

Mr . Crump reviewed the Staff Report , stating that it was
their recommendation that the request be approved by approval
of Resolution No. 78-113 . The applicant was in agreement with
all of the conditions . He reviewed the justification for
approval as outlined in the report .
Mayor Mullins declared the Public Hearing open and asked for
input in FAVOR of the request . None was offered.
Mayor Mullins invited input in OPPOSITION to the request , and
none was offered. He declared the Public Hearing closed.
Mr. Beebe pointed out that Special Condition No . 4 should
be corrected to read "City" rather than "County" . t
Councilman Brush moved and Councilman McPherson seconded to
waive further reading and adopt Resolution No . 78-118 as corrected.
Motion carried on a 4-1 vote. with Councilman Newbrander voting NOE .
Councilman Newbrander explained her NOE vote by stating that
she felt that it should be discussed more with Indian [Jells 1
before action is taken. They were very definitely opposed , J

b . Covenants and restrictions to be recorded.
c . -Management and maintenance agreement to be entered into with
the owners of the units of the project .
5 . Improvment plans for water and sewer system shall meet the recuire-
ments of the respective service districts .
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area. i
7. All dedicated land and/or easements required by this approval shall i
be granted to the City of Palm Desert , without cost to the City and
free of all liens and encumbrances.
8 . All on-site utilities , including cable TV , shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
9 . Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public {'forks for checking and approval
before construction of any improvements is commenced. The sub-
divider shall sumit "as-built " plans prior to acceptance of the
subdivision improvements by the City .
10. In order to maintain reasonable fire protection during .the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings . An adequate number of fire hydrants
w•itl�e required fire flows shall be installed as recommended by
the Fire Marshal .
11 . All reauirements of the City Fire Marshal shall be met ' as a part
of the development of this tract per attached memorandum.
12 . Drainage shall be subject to approval of the Director of Public
Works . Applicant shall provide engineered data as requested .
13 . All requirements of the Planning Commission action on related
case No . CUP 07-7S shall be met as a part of the development of
this tract .
14 . The total number of lots shall be limited to 40.
15. The applicant shall ha`:e twelve ( 12 ) months from the date of the
ar)nroval or conditional approval of the tentative map for filing
of the final map unless an eNrension of time of up to eighteen
( 1S) months is granted by a Resolution of the City Council .

Northerly of the Whitewater Channel .
Mr. Crump reviewed the Staff Report , stating that it was
their recommendation that the request be approved by approval
of Resolution No. 78-118 . The applicant was in agreement with
all of the conditions . He reviewed the justification for
approval as outlined in the report .
Mayor Mullins declared the Public Hearing open and asked for
input in FAVOR of the request. None was offered.
Mayor Mullins invited input in OPPOSITION to the request , and
none was offered. He declared the Public Hearing closed .
Mr. Beebe pointed out that Special Condition No. 4 should
be corrected to read "City" rather than "County" . f'
Councilman Brush moved and Councilman McPherson seconded to
waive further reading and adopt Resolution No . 78-118 as corrected.
Motion carried on a 4-1 vote. with Councilman Newbrander voting NOE .
Councilman Newbrander explained her NOE vote by stating that
she felt that it should be discussed more with Indian Wells l
before action is taken . They were very definitely opposed , J
and we should have had more conversations with them.

On a motion by Commissioner Snyder, seconded by Commissioner
Kryder, the Commission approved the Development Plan and Preliminary
Design Review by Planning Commission Resolution No. 388 with the
noted changes to the Conditions and the addition of Condition No . 11 ;
carried unanimously (4-0) .
Commissioner Fleshman was excused for the remainder of the
meeting at 9 : 30 p.m.

Request for approval of a Change of Zone from ' S '
Study to S . I . (U.A. ) on approximately 29 acres
located on the east side of Cook Street northerly
of the Whitewater Channel and related 40-lot in-
dustrial subdivision and a related request for ap-
proval of a Conditional Use Permit and Preliminary
Design Review to allow an Industrial Park Develop-
ment on the site .
Mr. Williams reviewed the Change of Zone and noted that . it
is compatible with the adjacent zoning.
( Chairman Berkey noted that this request does not conform to
the Minute Motion that was sent to CVAG regarding the right-of-way
on Avenue 42 .
Mr. Williams stated that the thought was to separate the com-
mercial from the residential .
Mr. Beebe noted that northerly of Avenue 42 the County states
that they will not go much further but if they do it will be an 88
foot right-of-way.
Chairman Berkey stated that the City ' s position on Avenue 42
should be firmed up before any action is taken.
Mr. Williams stated that the Tentative Tract and the Conditional
Use Permit could be continued in light of the question on Avenue 42 .
He also noted a letter of concern received from the City of Indian
Wells stating that they were concerned with the intrusion of industrial
upon commercial .
Commissioner asked that the Tentative Tract be continued and
allow the Staff time to pursue the issue of Avenue 42 .
Chairman Berkey declared the Public Hearing open and.. asked if
the applicant wished to speak at this time.
r�ED.-WALLICK, Project Engineer, asked if the applicant
, _„'would have to improve Avenue 42, noting that he would
r rather not .
Chairman Berkey asked if there was anyone wishing to speak
in FAVOR or in OPPOSITION to the proposals.

the Commission had read the letter from the
City of Indian Wells stating there concerns .

It was the concensus of the Commission that the Change of
Zone should be approved, but that the Tentative Tract and the
Conditional Use Permit should be continued for further information
on the Avenue 42. If`
The applicant noted his agreement and Mr . Williams stated
that the cases would be continued to the first meeting in September .
On a motion by Commissioner Kryder , seconed by Commissioner
Snyder, the Commission approved the Change of Zone by Planning
Commission Resolution No . 389 and continued Case No . TT 13236 and
CUP 08-78 to September 5 , 1978 ; carried unanimously ( 3-0) .

IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board
at their meeting of July 25 , 1978 .
Mr. Cipriani reviewed the cases. Case No . 134MF was reviewed
and Mr . Larry Spicer of Ironwood spoke to the Commission .
Mr . Spicer noted that he had sent a letter to the Ironwood
residents telling them of this meeting but it appears to be a no
show. He then introduced the architect for the project .
Mr . Dale Naegle addressed the Commission and noted that the
goal of the project was to have living units with privacy and se-
curity . He further reviewed the project and noted the location
of the tennis courts which allows for maximum unit privacy . Also
a 3rd pool has been added, 6 more tennis courts, and additional
parking were noted. Mr. Naegle stated that he felt they had met
the,<concerns of the Design Review Board and the Planning Commission .
. Mr . Fred Archbuckel , Landscape Architect for the project ,

noted that the courts obtain individual identity by use of lots of
plan material . Also the water in the swale area will be handled
lj by a bed of rocks or boulders .
Mr. Spicer spoke about the correspondence received from
Ironwood residents noting the following concerns : traffic, size of
units, creating a resort atmosphere , and density. He then stated
that if the tennis courts are considered in the entire site the den-
sity would be 5 . 75 units per acre, without figuring the tennis courts
it is 8. 5 units per acre . Mr. Spicer noted that he felt the best
presentation has been made . I
Chairman Berkey asked about the impact on Foxtail and noted L
his concern with same. He asked if Foxtail couldn ' t be widened
instead of having parking. Mr. Spicer stated that the impact would
be the same either way but that this is approach is better looking.
Commissioner Snyder stated that Ironwood is a grand project
but that this is summer and there are no people here to speak in
opposition. Also it will increase the density and the traffic .
Mr . Spicer noted that the City conducts business as usual
all year round and that Ironwood is no different . Legal notices
were sent .

The attached data was prepared by the applicant and is being forwarded
to you for comments and recommended Conditions of Approval . The City
is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals, parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 P.M. July 21st , 1978, in order to be
discussed by the Land Division Committee at their meeting of July 26th .
The Land Division Committee (comprised of Director of Environmental
Services, City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received. by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
