He declared the Public Hearing closed. Councilman Wilson moved and Councilman McPherson seconded to waive further reading and adopt Resolution No . 79-114. Motion carried unanimously. E. CASE NO. TT 13236 - CLIFF SWANSON ET AL, APPLICANT: CON- SIDERATION OF A REQUEST FOR APPROVAL OF A -YEAR EXTENSION OF TIME FOR A TENTATIVE TRACT MAP TO CREATE A 40-LOT INDUSTRIAL SUBDIVISION ON APPROXIMATELY 29 ACRES , LOCATED ON THE EAST SIDE OF COOK STREET, NORTHERLY OF THE WHITE- WATER CHANNEL. Mayor Mullins declared the Public Hearing open and asked for Staff ' s report . Mr. Williams reviewed the report and stated that the applicant is prepared to sign the Final Map, but because of engineering problems , he has asked for an extension. The conditions of approval as adopted in the Tentative Tract Map approval are still in force. Staff recommended approval of the request by Resolution No. 79-115 . Mayor Mullins invited input in FAVOR of the request , and none was offered. He invited input in OPPOSITION to the request, and none was offered. He declared the Public Hearing closed. Councilman McPherson moved and Councilman Brush seconded to waive further reading and adopt Resolution No . 79-115. Motion carried unani- mously. F. CASE NO. TRACT 13881 (AMENDMENT) - DAME-DOTY DEVELOPMENT CO. , APPLICANT : CONSIDERATION OF.A REQUEST FOR APPROVAL OF AN AMENDMENT TO A TRACT MAP WHICH PERMITS 653 DWELLING UNITS TO ALLOW A DRIVEWAY ACCESS TO THE RECREATIONAL VEHICLE STORAGE AREA ON PORTOLA AVENUE ON APPROXIMATELY 238 ACRES. LOCATED ON THE WEST SIDE OF PORTOLA AVENUE AND NORTHERLY OF THE WHITEWATER CHANNEL. Mayor Mullins declared the Public Hearing open and called for Staff' s report . Mr. Williams reported that at the time the Tentative Tract Map was approved in April of 1979 , Standard Con- dition No . 4 only allowed access rights on Portola Avenue for the main entry and one emergency access . The recrea- tional vehicle storage area was originally shown on the plan at the extreme southeast corner of the site. As such, Standard Condition No. 4 should be amended to include this driveway. Mayor Mullins invited input either FOR or AGAINST the request. MR. ALLEN PERRIERE , 225 S . Civic Center Drive, Palm Springs , addressed Council on behalf of Mr. Kapp Homme who owns 7 lots in Monterey Country Club , easterly and adjacent to this project. He is concerned about the entire project and felt ' since it was being discussed at this meeting, this would be a good time to review his concerns . Mr. Perriere stated that he had visited the property in question that day and there is a significant change in the grade in Portola. He felt there had been some sort of mistake in the engineering in Portola and perhaps it was tied in with the grading of the Chaparral Project . He went on to state that the grade level of the Chaparral Project was between 3-4 feet higher than September 27 , 1979 Page 5 MINUTES REGULAR CITY COUNCIL D TING VII. PUBLIC HEARINGS (Continued) F. (Continued) the adjacent Monterey Country Club. He stated also that there seemed to be an effort to direct waters coming from the Monterey Country Club project northerly rather than southerly along the natural grade of the land. He reviewed the present drainage of the Monterey Country Club , pointing out that because of the new grade of Portola, there was now a real problem in that the water meets Portola and has no where to go and thus just stands there. He suggested that Council review the situation at this time and get further input because it seems that this might be the kind of thing that would warrant recall of the grading permit. MR. 0. R. HOMME, 261 Cordoba, addressed Council expressing concern about the drainage from his property and the fact that the water reaches Portola and just stands. He stated that it seemed wrong that something that was established could be destroyed for something new. He requested that Council take a look at it before the project was allowed to continue. MR. RICHARD DOTY, Chaparral Country Club , stated that their project went through the public hearing process ; their engineers reviewed the grading to the north. They processed their grading in accordance with Mr. Beebe ' s office , and they have a permit. One of the conditions of approval of his project was improvement of Portola to Hovely Lane . Mr. Beebe ' s office came up with all the specifications and their engineerings , along with the City engineers , had done the best job in designing Portola as could be done. Mayor Mullins declared the Public Hearing closed. Mr. Williams stated that he was not an engineer but standing on that site, it appeared to be something wrong and unless there was some modification on the Homme the property, emergency accesss would be down in the ground by 4 ft . He stated that he had spoken with Jack Campbell of the P P Public Works Department after their meeting on the project site, and it was Mr. Campbell ' s statement that he did not know what Mr. Beebe had in mind; thus the problem could not be resolved until Mr. Beebe returned from vacation. Mr. Bouman expressed concern that there might be a traffic accident hazard depending . upon the location of the driveway. P g P Y He felt that a traffic engineering investigation was neces- sary which could be conducted before the next meeting of the City Council with appropriate report to the Council at that time. Councilman Wilson moved and Councilman McPherson seconded to reopen the Public Hearing and continue the matter to the meeting of October 11 , 1979 , asking Staff for a full report. Motion carried unanimously. Councilman Brush moved and Councilman Wilson seconded to direct Staff to investigatethe questions raised relative to grading and drainage of the project and report to Council and further, Staff be authorized to stop work on the project if necessary. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force , or which hereafter may be in force. 2 . Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Storks , shall be installed in accordance with City Standards . 3. Access rights on Cook Street shall be offered to the City as a dedication on the Final Map. 4 . The C. C. & R' s for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits . Prior to recordation of the final subdivision map , ' the applicant shall submit to the Director of Public Works : a. The document to convey title . b . Covenants and restrictions to be recorded. C. Management and maintenance agreement to be entered into with the owners of the units of the project . 5 . Install a water system capable of delivering 4000 GPM fire flow from any 1 fire hydrant for a four hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street inter- section (a) but not greater than 300 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome Yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant . 3 . Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 13236 is �n accordance with the requirements prescribed by the Fire Marshal ." Mr. Williams reviewed the cases and noted the Traffic Commit- tees report regarding the Commissions ' concern with the location of 42nd Avenue . Commissioner Snyder asked about the legal status of the private road extension . Mr. Williams noted that the Tentative Tract for this area will provide for both roads. Chairman Kelly declared the Public Hearing open and asked if the applicant wished to speak at this time. The applicant was not present . She then asked if there was anyone wishing to speak in FAVOR or in OPPOSITION to the proposed project . Being none , she declared the Public Hearing closed and asked for the pleasure of the Commission . Mr . Spicer noted that he had sent a letter to the Ironwood residents telling them of this meeting but it appears to be a no show. He then -introduced the architect for the project . Mr . Dale Naegle addressed the Commission and noted that the goal of the project was to have living units with privacy and se- curity. He further reviewed the project and noted the location of the tennis courts which allows for maximum unit privacy . Also a 3rd pool has been added, 6 more tennis courts , and additional parking were noted. Mr. Naegle stated that he felt they had met the concerns of the Design Review Board and the Planning Commission . Mr . Spicer spoke about the correspondence received from Ironwood residents noting the following concerns : traffic , size of units , creating a resort atmosphere, and density . He then stated that if the tennis courts are considered in the entire site the den- sity would be 5 . 75 units per acre, without figuring the tennis courts it is 8 . 5 units per acre. Mr. Spicer noted that he felt the best presentation has been made. Chairman Berkey asked about the impact on Foxtail and noted his concern with same. DISCUSSION: This matter was continued from the Planning Commission meeting of August 1st to allow the staff to determine whether the City should preserve a right-of-way for 42nd Avenue, along the northern boundary of the subject property. On August 8, 1978, the City's Technical Traffic Committee re- viewed this issue and determined that reservation of right-of-way is not appropriate. Please note the attached minutes. They felt that 42nd Avenue should intersect Cook Street further north of the subject property and become Hovely Lane west of Cook Street. This intersection would have the potential of having a traffic signal in the future, and would provide the potential of extending 42nd Avenue to at least Monterey Avenue, and possibly all the way to Bob Hope Drive. The applicant is seeking approval of a tract map and Conditional Use Permit to allow an industrial park development on the 29 acre site. The proposal calls for an interior street system that would be private. These streets would have 50' of paving within 66 foot right-of-ways. Lots 1-3 are pro- posed to accomodate wholesale-retail uses such as lumberyards, this being the reason they are larger than the remaining lots which are generally 100'xl45' in size. On the smaller lots 5,000 to 6,000 sq. ft. structures are proposed. These structures would be masonry and metal with decorative fronts facing the interior streets. Zero side yards are proposed on one side of each lot in order to provide parking on each individual lot and promote orderly development rather than random scattering of structures. This would eliminate small areas where unsightly storage might occur. Per- imeter fencing proposed includes chain link with masonry pilasters. Exten- sive mounding is proposed along Cook Street with masonry walls broken by landscaping at specific locations. Mr. Crump reviewed the Staff Report , stating that it was their recommendation that the request be approved by approval of Resolution No. 78-118 . The applicant was in agreement with all of the conditions . He reviewed the justification for approval as outlined in the report . Mayor Mullins declared the Public Hearing open and asked for input in FAVOR of the request. None was offered. Mayor Mullins invited input in OPPOSITION to the request , and none was offered. He declared the Public Hearing closed . Review of Cases acted on by the Design Review Board at their meeting of July 25 , 1978 . Mr. Cipriani reviewed the cases. Case No . 134MF was reviewed and Mr . Larry Spicer of Ironwood spoke to the Commission . Mr . Spicer noted that he had sent a letter to the Ironwood residents telling them of this meeting but it appears to be a no show. He then introduced the architect for the project . Mr . Dale Naegle addressed the Commission and noted that the goal of the project was to have living units with privacy and se- curity . He further reviewed the project and noted the location of the tennis courts which allows for maximum unit privacy . Also a 3rd pool has been added, 6 more tennis courts, and additional parking were noted. Mr. Naegle stated that he felt they had met the,<concerns of the Design Review Board and the Planning Commission . . Mr . Fred Archbuckel , Landscape Architect for the project , 4 ' noted that the courts obtain individual identity by use of lots of plan material . Also the water in the swale area will be handled lj by a bed of rocks or boulders . Mr. Spicer spoke about the correspondence received from Ironwood residents noting the following concerns : traffic, size of units, creating a resort atmosphere , and density. He then stated that if the tennis courts are considered in the entire site the den- sity would be 5 . 75 units per acre, without figuring the tennis courts it is 8. 5 units per acre . Mr. Spicer noted that he felt the best presentation has been made . I Chairman Berkey asked about the impact on Foxtail and noted L his concern with same. He asked if Foxtail couldn ' t be widened instead of having parking. Mr. Spicer stated that the impact would be the same either way but that this is approach is better looking. Commissioner Snyder stated that Ironwood is a grand project but that this is summer and there are no people here to speak in opposition. Also it will increase the density and the traffic . Mr .
