RESOLUTION NO. 78-170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO CREATE AN 11 LOT MOBILE HOME SUBDIVISION (ADDITION) . CASE NO. TT 13586 WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th day of December, 1978, hold a duly noticed Public Hearing, to consider the request by PALM DESERT 210 LTD. for approval of a Tentative Tract Map to create eleven (11 ) mobile home lots from approximately 1 .49 acres within the R-M (Mobile Home Subdivision Residential ) zone contained within the Portola Country Club development located on the east side of Portola Avenue, North of the storm channel , more particularly described as follows: APN 621-400-018 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined that this project was previously evaluated under Tract 5110 (9-13-73) , and no further documentation will be required; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve the Tentative Tract Map: 1 . The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1 . That the above recitations are true and correct and constitute the findings of the Council in this case; 2. That it does hereby require that the applicant pay (to the extent which payment has not already been received on behalf of Tract No. 11215) a fee in an amount determined under the Ordinance provisions in order to comply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirement, any such fee to be collected by the City shall be committed within five years for the subject purposes; 3. That it does hereby approve the above described Tentative Map No. 13586 for the reasons set forth in this Resolution and subject to the attached conditions. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements , limitations, and restrictions Of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map , the applicant shall provide the Department of Environmental Services with a list or proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environ- mental Services. . 4. Access rights shall be offered to the City as a' dedication on the Final Map. 5. The C. C.&R' s for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits . Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer : a. The document to convey title. b. Covenants and restrictions to be recorded. C. Management and maintenance agreement to be entered into with the owners of the lots of the project . r 6. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. .8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances . D. All on-site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before -construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision im- provements by the City. 11 . In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . 12 . Prior to recordation of the Final Map , the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshal in memo dated 11/20/78, shall be met as a part of the development of this tract . 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification : "I certify that the design of the water system of Tract No. 13586 is in accordance with the requirements prescribed by the City Fire Marshal . All private streets shall be inspected by the Engineering Depart- ment and a Standard Inspection Fee shall be paid. 17. All requirements of the Planning Commission action on the CUI' 10-77 and TT11215-1 shall be met as a part of the development pf ,this tract . 18. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18). months is granted by a. The developer shall dedicate land, pay a fee in lieu thereof , or a combination of both, at the option of the City Council, as a condition of the Final Map , for park and recreation purposes. Williams: Provide the following fire protection in accordance: 1. Instail a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection but bu _.not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire 5larshal for review. 4. Mr. Williams reviewed the staff report and the conditions of approval . Chairman Kelly asked if the applicant wished to speak. The ap- plicant noted his agreement with the Conditions of Approval but had no comment at this time. Chairman Kelly declared the Public Hearing open and asked if anyone wished to speak in FAVOR or in OPPOSITION to the case. Being none, she declared the Public Hearing closed and asked for the pleasure of the Commission. On a motion by Commissioner Snyder , seconded by Commissioner Berkey, the Commission, by Planning Commission Resolution No. 430, recommended approval of the Tentative Tract to the City Council ; carried (4-1 ) AYES : Berkey, Kelly, Kryder , Snyder; NOES : Fleshman (Reason being, he voted no on the CUP) . KAVANAUGH ENTERPRISES/COVINGTON BROS . , INC. , Applicant Request for approval of a Tentative Tract Map to create a 384 lot condominium subdivision to allow 380 residential units and common open space on approximately 80 gross acres within the PR-5(U.A. ) zone east of Cook Street and north of Hovely Lane (extended) . Mr. Crump reviewed the staff report and noted that the applicant would be required to improve the streets involved in each phase as each phase is done. He then reviewed the remaining Conditions of Approval . Commissioner Berkey asked if Street A. should be a 4 lane street as it is the main entrance. Mr. Williams noted that this had been ap- proved already as is. Vice-Chairman Snyder declared the Public Hearing open and asekd if the applicant wished to speak at this time. D. K. REQUEST: Request for approval of a Tentative Tract Map to create eleven .(11 ) mobile home lots from approximately 1 .49 acres within the R-M (Mobile Home Sub- division Residential ) zone contained within the Portola Country Club develop- ment, located on the east side of Portola Avenue, north of the storm channel . II. BACKGROUND: A. Previous Pertinent Cases: 1 . CUP 10-77, 201 lot mobile home subdivision 2. Tract No. 11215, corresponding subdivision 3. CUP 10-77 (Amended), Provision for eleven additional lots in the mobile home subdivision III. DISCUSSION: On July 5, 1978, the Planning Commission adopted Planning Commission Resolu- tion No. 379, which granted an amended Conditional Use Permit to provide for eleven additional mobile home lots in the approved mobile home subdivision. The subject Tentative Tract Map implements that amendment providing for 9 lots on the east side of Bodie Road and south of Cobalt Way in the northwestern corner of the subject property and 2 lots on the east side of Diadomite Way in the northeastern corner of the project. IV. TT 13586 WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th day of December, 1978, hold a duly noticed Public Hearing, to consider the request by PALM DESERT 210 LTD. for approval of a Tentative Tract Map to create eleven (11 ) mobile home lots from approximately 1 .49 acres within the R-M (Mobile Home Subdivision Residential ) zone contained within the Portola Country Club development located on the east side of Portola Avenue, North of the storm channel , more particularly described as follows: APN 621-400-018 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined that this project was previously evaluated under Tract 5110 (9-13-73) , and no further documentation will be required; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve the Tentative Tract Map: 1 . CITY OF PALM DESERT SUPPLEMENTAL APPLICATION FORM TENTATIVE SUBDIVISION MAP Both State Law and the Palm Desert Subdivision Ordinance require that when any parcel of contiguous parcels in one ownership is proposed to be divided into more than four parts, now, or in the future, a tentative subdivision map must be processed through the City. Procedure: DEPARTMENT OF LAND PLANNING APPLICATION ENVIRONMENTAL DIVISION COMMISSION CITY COUNCIL SERVICES REVIEW RECOMMENDS APPROVES OR COMMIT- APPROVAL OR DENIES TEE DENIES REQ. Applications for a Tentative Subdivision Map are accepted only on the first working Monday of each month. Prior to submittal , it is recommended that the map be fully discussed with the City Engineer. The staff will investigate the request and notify adjacent property owners of the Public Hearing. The average review period for a subdivision map is five weeks. Prior to the Public Hearing, the map is reviewed by the Land Division Review Com- mittee. Said Committee reviews with the applicant to propose recommendations to the Plan- ning Commission, including any conditions.
