A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, ACCEPTING THE OFFER OF
A PARK SITE OF APPROXIMATELY SIX (6) ACRES FROM
LEWIS HOMES OF CALIFORNIA, DETERMINING THAT SAID
DEDICATION MEETS THE TOTAL PUBLIC FACILITIES
REQUIREMENT FOR TRACTS 12191-1, 12181-2 , 14001-AND
14004 AND AUTHORIZE THE MAYOR TO ENTER INTO ESCROW
ON THE OFFER AND EXECUTE THE NECESSARY AGREEMENTS
WHEREAS , the Chapter 26 . 48 of the Palm Desert Municipal Code
requires that a minimum of five percent of the land within any subdivi-
sion be given to the City as a dedication or as a fee for public facil-
ities purposes.; and
WHEREAS , on large projects, which are developed incrementally
as many subdivisions , the dedication of small individual portions of
each subdivision would not provide the City with any usable property
to meet the public facilities needs of the project or the community;
and
WHEREAS , the Council believes that an early agreement by
the City and developers of large projects to dedicate property of suf-
ficient size and location, in compliance with the City' s General Plan,
to meet or exceed the required for the total project under Chapter 26 .48
of the Municipal Code would be a more logical and reasonable procedure;
and
WHEREAS, Lewis Homes of California is developing such a�
project around the proposed Civic Center; and
WHEREAS , the City' s Master Plan of Parks and Recreation
designates an approximate six acre site within the Lewis holdings
which would more than satisfy the requirements of Chapter 26.48 of
the Municipal Code; and
WHEREAS, said site, being 6. 0 acres more or less , located
easterly of and adjacent to San Pablo Avenue, northerly of 44th Avenue
has been determined by the City Council as the appropriate dedication
to fulfill the total requirement of Tracts 12181-1, 12181-2, 14003
and 14004; and
WHEREAS, said determination is based upon five percent of
the developable acres within these Tracts , which is determined to
be 98 . 5 acres ; and
WHEREAS, Lewis Homes of California, by a letter dated
February 13 , 1979, attached hereto as Exhibit "A" , does make the
above described offer to the City Council subject to conditions ..
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Palm Desert, California, as follows :
1. That the above recitations are true, correct, and
constitute the findings of the Council in this matter .
2. The public facilities needs of the Subdivisions pro-
posed by Lewis Homes of California would be best met
by the acceptance of an individual park site at the .
proposed location.
3 . The Mayor is hereby authorized to enter into escrow
and to execute any necessary agreements to complete
this acquisition, subject to review and approval by
the City Attorney.
4. The City Clerk is hereby directed to provide all
necessary documentation to the escrow company and
sufficiently indicate the fulfillment of the City' s
obligations under the conditions of the offer .

5 . There is hereby appropriated the sum of $250 '
from the Unobligated Fund Balance of the New
Construction Tax Fund to "Closing Costs-Dedi-
cated Properties" (Account No . 31-4990-906) to

Dear Members of. the Council :.
In accordance with the Subdivision Provisions of the Municipal Code and
the Parks and Recreation Element of the Palm Desert General Plan, Lewis
Homes of California wishes to offer a six-acre site within its property,
located generally at the northeast corner of the intersection of 44th
Avenue and San Pablo Avenue, known as Lot 141, Tentative Tract No. 14003,
!� subject to the conditions listed below. .
This offer is conditioned upon the following:
1. Dedication of this site meets the full requirements of Article
26.48 of the City of Palm Desert Subdivision Ordinance for
dedication of land for parks purposes for Tracts 12181-1, .
12181-2, 14003, and 14004.
2. Said property shall be improved by the City for parks purposes
useable to the residents of said subdivisions within five years
of the acceptance of said offer or the property shall .
automatically revert to Lewis Homes of California.
3. Dedication of this site will fully satisfy present and future
requirements, and no further requirements including site
improvements, maintenance or other fees will be imposed.

VIII. RESOLUTIONS
A. RESOLUTION NO. 79-23 - A .RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING SUBDIVISION FEES
FOR DEVELOPMENTS IN THE CITY OF PALM DESERT.
Mr. Bouman stated that this resolution presented certain
subdivision fees which are required under Ordinance 125 .
However, the specific fees are established by Resolution
in that they may be changed from time to time . The fees
being recommended have been established ;by the Director of
Public Works and they are based on his analysis of what it
actually costs the City to process these documents . In
addition, he has presented a study of such fees collected
by other agencies or cities in the valley.
Councilman Newbrander moved and Councilman Wilson seconded to
waive further reading and adopt Resolution No . 79-23 . Motion carried

ly with the members present .
B. SOLUTION NO' 79-22 - A RESOLUTION OF THE CITY COUNCIL OF
HE CITY OF PALM DESERT, CALIFORNIA, ACCEPTING THE OFFER OF

Mr. Bouman reported that this was an offer by Lewis Homes
for 6 acres of park land to satisfy the park land dedication
on Tracts 14003 and 14004. It will be a very valuable asset
to the Park and Recreation' s long-range plan. The offer is
well in excess of the requirements they would have to fulfill .
Mr. Bouman requested that Sections 3 and 5 of the resolution
be amended as follows :
Section 3 - addition of the wording "subject to review and
approval of the City Attorney" .
Section 5 - changed to read: "There is hereby appropriated
the sum of $250 from the Unobligated Fund Balance of the New
Construction Tax Fund to "Closing Costs-Dedicated Properties"
(Account No . 31-4990-906) to provide for the necessary fees
to complete escrow on this offer. "
Councilman Wilson moved and Councilman Brush seconded to waive
further reading and adopt Resolution No . 79-22 as amended. Motion
carried unanimously with the members present. Councilman Brush extended
the Council ' s sincere appreciation to Lewis Homes .

D. LETTER OF RESIGNATION By Mrs . Gloria Kelly from Her Position
on the Palm Desert Planning Commission.
Mayor Mullins stated that he had asked that this item be
removed to explain that Mrs . Kelly had resigned because
. she has moved outside the City limits . He extended the
Council ' s appreciation for the great job she had done.
Mayor Mullins moved and Councilman Wilson seconded to accept the
resignation with sincere regrets . Motion carried unanimously with the
members present.

Tract 14004
Dear Mr. Diaz :
As a City imposed condition of Tentative Tract 14004 ,
a requirement was to underground all 'on-site utility lines.
This requirement will be met in all new ut lity lines for
Tract 14004 , utilizing utility stub outs on San Pasqual
constructed with Tract 12181 by Lewis Homes.
However, in planning and designing the on-site utilities
for Tract 14004, the Edison Company estimated the cost of
undergrounding the off-site power poles on Avenue 44 at
approximately' $150 per foot, or $165 , 000. This amount would
only underground four poles adjacent to Tract 14004 and the
Civic Center site. Edison would not require the under-
grounding of these poles as they are able to serve the Tract
from the poles and the existing stub outs in San Pasqual
Avenue.
Accordingly, we request your clarification as to whether the
City will require the undergrounding of these poles on
Avenue 44 , and as to the extent of the City' s financial
participation.

Re: Request for Clarification of Undergrounding of Utilities Tract 14004
Dear Ms. Williams:
Further to your letter of June 26, 1981, I have investigated the matter of the
undergrounding of utilities on 44th Avenue.
Planning Commission Resolution No. 592, adopted April 29, 1980, approving a develop-
ment plan (DP 05-80) and design review case for the above property, imposed several
conditions of approval on the proposed development. Condition No. 7 of the Standard
Conditions of Resolution No. 592 reads as follows:
"All existing electrical distributor lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed shall be installed underground as a
part of development from the nearest existing pole not on the property
being developed."
Subsequently, City Council adopted Resolution No. 80-61 on May 22, 1980, approving
an 18 month time extension for Tentative Tract 14004. One of the conditions of the
time extension approval reads as follows:
"All requirements of Planning Commission action on the Development
Plan 05-80, shall be met as a part of the development of the tract. "
Based on this information the City will require the undergrounding of the poles on
44th Avenue.
The City is prepared to financially participate in such an undertaking on a prorata
basis dependent on the amount of street frontage.

that the timing of the undergrounding of the utilities be delayed until a later
phase of your development, should you request it.

Dear Mr. Williams:
Provide the following fire protection in accordance With the Uniform Fire Code:
1. Install a water system capable of delivering 2500 GPA fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in Tract No. 14004 is in accordance with the requirements
prescribed by the Fire M arshal.11 Upon approval.,., the original plan will be
returned to the developer.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN
AND DESIGN REVIEW CASE TO ALLOW CONSTRUCTION OF DWELLING
UNITS, RELATED PRIVATE RECREATION AMENITIES AND PUBLIC
PARK, LOCATED NORTH OF 44TH AVENUE AND SOUTH OF MAGNESIA
FALLS (PROPOSED EXTENSION) BETWEEN SAN PABLO (PROPOSED
EXTENSION) AND SAN PASCUAL.
CASE NOS. DP 05-80 and 207 MF
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 29th day of April , 1980, hold a duly noticed
Public Hearing to consider the request by LEWIS HOMES OF CALIFORNIA for
approval of an overall conceptual Development Plan to construct a total
of 282 single family and duplex units, private recreation amenities, with
a public park dedication, ,on approximately 70.3 net acres, and related
Design Review case to construct one portion of the overall project contain-
ing 142 dwelling units, within the PR-4, S.P. (Planned Residential , max.
4 d.u./ac. , Scenic Preservation Overlay) zone, generally located north of
44th Avenue & south of Magnesia Falls (proposed extension) and between
San Pablo (proposed extension) and San Pascual , more particularly described
as:
APN 621-360-008 and 621-360-009
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32" , in that the Director of Environmental Services has determined
that the project has previously been assessed in connection with Case
Nos. C/Z 09-78 and DP 13-78, and no further documentation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
to be heard, said Planning Commission did find the following facts to
justify their actions, as described below:
a. The proposed project generally conforms to the intent
and purpose of the PR Zone District.
b. The proposed project conforms to Palm Desert General
Plan--College of the Desert Area Specific Plan.

C. The proposed project will not be detrimental to the
health, safety and general welfare of the community.

CONDITIONS OF APPROVAL
CASE NOS. DP 05-80 and 207 MF
Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A thru RR (Case Nos. DP 05-80 and 207 MF) on file with the Department of
Environmental Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any
uses contemplated by this approval , the applicant shall first complete
all the procedural requirements of the City which include, but are not
limited to, Design Review, Subdivision process, and building permits
procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a
single project.
4. Construction of a portion of said project shall commence within one
year from the date of final approval otherwise said approval shall
become null , void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval .
6. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
7. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed shall be installed underground as a
part of development from the nearest existing pole not on the property
being developed.
8. \ All requirements of the City Fire Marshal shall be met as part of the
development of this project per the letter dated January 17, 1980, filed
in conjunction with the conditions of approval for Tentative Tract Map
Nos. 14003 and 14004.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
10. Traffic control provisions shall be provided as required by the Director
of Public Works.
11 . Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance erith City Standards and/or as required by the
Director of Public ':forks.
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Dept. of Building and Safety at the time of issuance
of a building permit for the use contemplated herewith.
13. No development shall occur on the subject property prior to the record-
ation of a tract map, except drainage improvements specifically approved
by the City and development of the public park site.

SPECIAL CONDITIONS
1. The maximum number of dwelling units shall be limited to 282.
2. Each phase of construction shall conform to all requirements of Chapter
25.24 of the Palm Desert Municipal Code, unless an exception is pro-
vided by the Planning Commission.
3. All buildings shall conform to a unifying architectural theme.
4. Future public street dedication and improvements shall be as follows:
a. The full frontage of San Pablo Avenue shall be dedicated and Il
improved with curb, gutter, tie-in paving, 8 ft. wide meandering
bicycle/pedestrian system, center median, and landscaping on the
basis of a 50 ft. wide half-street improvement width within a
63 ft half-street right-of-way width.
b. The full frontage of 44th Avenue shall be dedicated and improved
with curb, gutter, tie-in paving, 8 ft. wide meandering bicycle/
pedestrian system, center median, and landscaping on the basis of
a 55 ft. half-street right-of-way width with a 32 ft wide pavement
width from back of curb.
C. The full frontage of Magnesia Falls Drive shall be dedicated and
improved with curb, gutter, tie-in paving, 8 ft. wide meandering
bicycle/pedestrian system, center median, and landscaping on the
basis of a 55 ft. half-street right-of-way width with a 32 ft.
wide pavement width from back of curb.
d. The full frontage of San Pascual Avenue shall be dedicated on the
basis of an additional 17 ft. of right-of-way and improved with
curb, gutter, and tie-in paving on the basis of a 21 ft. improve-
ment width.
e. The proposed entrance streets from Magnesia Falls Drive and San
Pablo Avenue, whether public or private, shall be developed on
the basis of minimum of two fully improved, 20 ft wide travel
areas separated by a 16 ft. wide center median including appro-
priate turn pockets.
f. The above described street improvement requirements do not apply
to the proposed street frontage abutting the proposed public park.
Along said frontage, the applicant's responsibility shall be lim-
ited to the installation of curb, gutter, center median, and tie-
in pavement.
g. All street improvements shall include full-length cross gutters at

6. The proposed 100 ft. wide drainage swale shall be dedicated to the
City as an easement. Any improvement of said area shall be limited
to the extent that such improvements shall not inhibit the function
of said area as a drainage way. The drainage way dedication and
improvement to carry storm water shall occur in the first phase of
project development. Maintenance of the drainage way shall be provided
by the Homeowner Association, or by an alternative acceptable to the
City Council in their subsequent review of tract map approval or
time extensions.
7. All landscaping installed within the required parkway area along all
public streets shall thereafter be maintained by the owners and/or
occupants of the total development.
8. Private street entrance to 44th Avenue shall provide for the stacking
of eight vehicles, the desion of which is subject to the approval of

Mr. Crump presented this case reviewing the staff report and stating
that the related Design Review case, which is the south portion, would be
the first area to be developed. He added that the north and south are being
developed as one project to satisfy the minimum common open space and density.
He stated that the Design Review Board did approve the related Design Review
case with a few revisions, which are included in the conditions. Mr. Crump
then referred to the exhibits provided showing the location, future street
improvements, and layout.
Chairman Miller asked Staff how off-street parking would be provided
for the guest. Mr. Crump responded illustrating on the exhibits where the
parking stalls would be located.
Chairman Miller opened the Public Hearing and asked if the applicant
wished to make a presentation.
MR. BILL SULLIVAN, Project Manager, 45-445 Portola, stated that it was
his understanding that any public area would be maintained by the City. This
was in reference to Special Condition No. 6, which was in regards to maintain-
ing the 100 ft. wide drainage swale. Mr. Sullivan also objected to Landscape
Conditions No. 3 and 4, which required increased sizes of the trees. He felt
that it would be costly and unnecessary.
MR. BURT LENT, Landscape Architect, explained briefly the layout and
location of the car stalls and guest parking.
Chairman Miller closed the Public Hearing.

Commissioner Kryder agreed with Mr. Sullivan that the Landscape
conditions No. 3 and 4 should be deleted and asked what reasons were given
to require the increased sizes.

Mr: Williams explained that these conditions were suggested by the
j Design Review Board, specifically by Eric Johnson, who is a Landscape Contractor.
Mr. Williams stated that Mr. Johnson felt the sizes of the trees would be too
small for the climate. He also pointed out that Condition No. 4 is an actual

reduction rather than an increase.
€ Commissioner Berkey suggested to add "or acceptable alternative
approved by the Design Review Board", to Landscape Conditions Nos. 3 and 4.
Motion was made by Commissioner Berkey, seconded by Commissioner Kryder,
to approve Case Nos. DP 05-80 and 207 MF, as amended, by adoption of Planning
Commission Resolution No. 592, subject to conditions. Carried unanimously.

Mr. Williams briefly reviewed what had been discussed and reviewed

Commissioner Berkey, in viewing the Resolution and Exhibit A, -felt
that the Resolution provided with uggested uses for this zone was clear in
terms of determining uses but also ggested that another Resolution be
adopted to initiate a Public Hearing or the General Plan and Zoning Ordin-
ance Amendment. Commissioner Kryder lso agreed.

Channel . As a result of applicant input , the Commission had
decided to modify #7 to leave the decision to the City Council .
He stated that it was Staff ' s recommendation to delete #7
from consideration.
Councilman Wilson asked Staff' s rationale for deleting #7 .
Mr . Crump responded that after research, Staff determined
that the improvement would provide an alternate access which
would not necessarily be required for access to the site , thus
imposing a condition on the applicant beyond that which would
normally be required. Councilman Wilson asked if this was not
contrary to previous actions of the Council where other
developers had been required to accept conditions such as
this , and Mr. Crump advised that each instance had to be
reviewed individually.
Mayor Mullins invited input in FAVOR of the request .
MRS . BETTY WILLIAMS , Division Manager , Lewis Homes , addressed
Council stating that they had reviewed the conditions as
they were presented by Staff and were in agreement with
all conditions with the exception of the request for the
bridge. She also respectfully requested Council ' s con-
sideration of their request that their drainage fees be
appropriated to the improvement of the Channel in their
project .
Mayor Mullins invited input in OPPOSITION to the request , and
none was offered. He declared the Public Hearing closed.
Councilman Brush moved and Mayor Mullins seconded to waive further
reading and adopt Resolution No . 79-18 , approving Tentative Tract No .
r 14003 .
Councilman Wilson asked for discussion and expressed that
111 he was in total agreement with the request for use of the
drainage fees but had serious concerns over the deletion
of Special Condition No . 7 . He stated that he felt this
would be an important access for this development due to
increased traffic resulting from the development of the
property. Therefore , he felt it was an obligation of this
developer to see to it that the road was completed .
Councilman Brush asked if there wasn' t some question as to
whether or not you can put these costs on one developer when
the improvement is going to be required whether the project
is developed or not . Councilman Wilson pointed out the
proposed Rancho Bella Vista Development wherein they would
have been required to construct drainage improvements that
would not have directly benefited their project. Council-
man Brush stated that in that case, the development itself
would have increased the drainage in the area by 20-25%,
so the developer should have been responsible for it .
Dave Erwin stated that there was a legality in assessing a
developer if the developer were not creating the need for
the improvements . -
Councilman Wilson moved-that Special Condition #7 be reinstated .
Further discussion following relative to the channel crossing
and the whether or not it should be a bridge or a paved
crossing.
Mayor Mullins reopened the Public Hearing to receive input from
Lewis Homes ' s engineer .
MR. STAN MORSE , 45-445 Portola Avenue , addressed the Council
stating that their plans showed their paving would stop short
of the channel in that they did not want to create a dry
weather crossing that would go no where . This could create
a dangerous crossing.

Councilman Wilson asked that the record state that he did not
necessarily mean a bridge, but a satisfactory crossing.
Councilman Wilson moved that the following additional condition
be required of the developer :

Manager, as required by City Engineer to extend Magnesia Falls
Drive to cross the 100 ' drainage channel adjacent to northerly
side of subdivision, but not necessarily a bridge . "

Waive further reading and adopt Resolution No. 80-61 , approving
an 18 month extension of time.
B. DISCUSSION:
This request for an extension of time along with a similar request
for TT 14003 was originally heard at the City Council meeting of
March 13, 1980. Because the original Development Plan (DP..13-78)
had expired and the applicants were seeking approval of a new
Development Plan, this request was continued to this meeting. The
Planning Commission at their meeting of April 29, 1980, approved
a new Development Plan (DP 05-80) for this tract and Tract 14003,
which is immediately to the north and west.
This Tentative Tract was originally approved by the City. Council
on March 8, 1979. Attached are the minutes for that meeting for
your review.
The major item of discussion at the April 29, 1980, Planning
Commission meeting pertained to the maintenance of the 100 foot
wide drainage swale which runs north--south along the easterly
boundary. The applicants felt that the drainage swale, which is
to be landscaped, should be maintained by the City in that it is
a public area. The condition of the new Development Plan pertaining
to the swale states that maintenance of the drainage swale is to be
provided by the Homeowners Association, or by an alternative
acceptable by the City Council in their subsequent review of the
Tract Map time extension.
Planning Staff feels that the drainage swale should be maintained
by the applicants. As justification, Staff would offer the follow-
ing comments:
1. The drainage swale is indicated as an easement and not a
separate lot dedicated to the City.

2. The applicant has included the landscape drainage swale
as open space in their calculations.
3. The proposed landscaping and sidewalk systems is designed

Attached is a Draft Resolution recommending conditions of approval utilizing
the original approved Resolution with conditions updated to comply with
current requirements. Additionally, a condition has been added requiring

TIME EXTENSION PURSUANT TO THE PROVISIONS OF SECTION
26.20.140 OF THE PALM DESERT MUNICIPAL CODE OF THE APPROVED

__. WHEREAS, the City Council of the City of Palm Desert, California,
did receive a request from LEWIS HOMES OF CALIFORNIA for an 18 month time
j extension, pursuant to the provisions of Section 26.20. 140 of the Palm Desert
Il Municipal Code of the approved Tentative Tract Map TT 14004 for 7 lots to
allow 142 condominium units, on 27 acres in the PR-4, S. P. zone at the north-

WHEREAS, the City Council is empowered to grant time extensions
of up to eighteen months for filing of the final map in Section 26.20.140

WHEREAS, the City Council did find the following reasons to exist
to justify the granting of said time extensions:
1. Granting the time extension will not in any way adversely
affect the public health, safety or general welfare.
2. The applicant is not proposing any changes to the project
and the situation in the vicinity of the project is unchanged
since the subject tentative tract was originally approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
L Palm Desert, California, as follows:
1. That LEWIS HOMES OF CALIFORNIA is hereby granted an 18 month
time extension of the approval of Tentative Tract Map TT 14004,
subject to all conditions of Resolution No. 79-19, amending

CITY OF PALM DESERT , CALIFORNIA, AMENDING SECTION 6 . 04. 140
OF THE CODE OF THE CITY OF PALM DESERT , CALIFORNIA, RELATING
TO OWNER' S RESPONSIBILITY FOR ANIMALS.
Mr. Bouman reported that since the first reading of the
ordinance, the City had received one letter but that it
was relative to dog breeding.
Councilman Newbrander moved and Mayor Pro-Tempore McPherson seconded
to waive further reading and adopt Ordinance No. 220 . Motion carried on
a 3-2 vote, with Councilmen Brush and Wilson voting NO for the same reasons
stated during first reading.

XI. NEW BUSINESS
A. REQUEST FOR DELET�A£3-q� REQUIREMENT FOR DRAINAGE FEES FOR
TRACTS 1 003 AND 1 00 LEWIS HOMES , APPLICANT .
Mr. Beebe reported that these two tracts are located adjacent
to the proposed Civic Center site , easterly of San Pasqual and
northerly of 44th Avenue. As part of the approval of the tracts ,
the construction of a trapezoidal channel .was required from 44th
Avenue to Magnesia Falls . The total expenditure of the developer
for this improvement is $183 , 794, and the drainage fees which
would have been required are in the amount of $118 , 316 .
Therefore, it is the recommendation of Staff that the drainage
fees be waived.
Councilman Wilson moved to approve the request and authorize the
deletion of the requirement of drainage fees for Tract No. 14003 and
Tract No. 14004. Councilman Brush seconded the motion; motion carried
unanimously.
XII. OLD BUSINESS

XIII . ORAL COMMUNICATIONS
MR. GEORGE STONE , 43-831 Joshua Road, Palm Desert , addressed the
Council expressing his opposition to the proposed Emergency Fire/
Rescue Measure on the ballot . He stated he felt that the Council
should place their emphasis and concerns on flood control . He
reiterated his problem with a drainage channel next to his property
which has caused his home to flood during rains .
Councilman Wilson responded to Mr. Stone and stated that he could
vote on the Fire Measure on April 8th, and it was up to the voters
as to whether or not it would be approved.
XIV. REPORTS AND REMARKS L
A. CITY MANAGER
1 . Mr. Bouman requested that the Council authorize the Mayor
and City Clerk to sign a Bill of Sale to the Coachella
Valley Water District for the transfer of Sanitation
Collection Facilities At the new fire station site.
Mayor Pro-Tempore McPherson moved and Councilman Brush seconded to
authorize the Mayor and City Clerk to sign said Bill of Sale. Motion
carried unanimously.

Please be advised that the conceptual Development Plan (DP 13-78) ,
which the referenced Tentative Maps seek to implement has expired.
Development Plan approval was granted December 14, 1978, by City
Council Ordinance No. 194. A similar situation has arisen recently
(where the Development Plan had expired) and the Council continued
consideration of the Tentative Map time extension, to allow a
refiling of the Development Plan. We might consider a similar
approach in this instance, to preserve the Tentative Map approvals,
but it would require that your firm be prepared to file the new
Development Plan application (with presently required exhibits) , on
March 3, 1980.
Further be advised that the request for a Tentative Map time exten-
sion must be accompanied by a fee of $50.00 ($100.00 total for both
Tracts) , before processing is begun.
You may contact the Principal Planner, Mr. Murrel Crump, for further
details regarding filing of a new Development Plan, or other related
matters.

Channel. As a result of applicant input , the Commission had
decided to modify #7 to leave the decision to the City Council .
He stated that it was Staff' s recommendation to delete #7
from consideration.
Councilman Wilson asked Staff' s rationale for deleting #7 .
Mr. Crump responded that after research, Staff determined
that the improvement would provide an alternate access which
would not necessarily be required for access to the site, thus
imposing a condition on the applicant beyond that which would
normally be required. Councilman Wilson asked if this was not
contrary to previous actions of the Council where other
developers had been required to accept conditions such as
this, and Mr. Crump advised that each instance had to be
reviewed individually.
Mayor Mullins invited input in FAVOR of the request .
MRS . BETTY WILLIAMS , Division Manager , Lewis Homes , addressed
Council stating that they had reviewed the conditions as
they were presented by Staff and were in agreement with
all conditions with the exception of the request for the
bridge. She also respectfully requested Council ' s con-
sideration of their request that their drainage fees be
appropriated to the improvement of the Channel in their
project.
Mayor Mullins invited input in OPPOSITION to the request , and
none was offered. He declared the . Public Hearing closed.
Councilman Brush maved and Mayor Mullins seconded to waive further
reading and adopt Resolution No . 79-18 , approving Tentative Tract No .
14003 ,
Councilman Wilson asked for discussion and expressed that
he was in total agreement with the request for use of the
drainage fees but had serious concerns over the deletion
of Special Condition No . 7 . He stated .that he felt this
would be an important access for this development due to
increased traffic resulting from the development of the
property. -Therefore, he felt it was an obligation of this
developer to see to it that the road was completed.
Councilman Brush asked if there wasn' t some question as to
whether or not you can put these costs on one developer when
the improvement is going to be required whether the project
is developed or not . Councilman Wilson pointed out the
proposed Rancho Bella Vista Development wherein they would
have been required to construct drainage improvements that
would not have directly benefited their project . Council-
man Brush stated that in that case, the development itself
would have increased the drainage in the area by 20-25%,
so the developer should have been responsible for it .
Dave Erwin stated that there was a legality in assessing a
developer if the developer were not creating the need for
the improvements . :_
Councilman Wilson moved,-that Special Condition #7 be reinstated.
Further discussion following relative to the channel crossing
and the whether or not it should be a bridge or a paved
crossing.
Mayor Mullins reopened the Public Hearing to receive input from
Lewis Homes ' s engineer .
MR. STAN MORSE, 45-445 Portola Avenue, addressed the Council
stating that their plans showed their paving would stop short
of the channel in that they did not want to create a dry
weather crossing that would go no where . This could create
a dangerous crossing.

Councilman Wilson asked that the record state that he did not
necessarily mean a bridge, but a satisfactory crossing.
Councilman Wilson moved that the following additional condition
be required of the developer :
"Subdivider shall provide for improvements either in cash, bond,
or some form of security agreement satisfactory to the City
Manager , as required by City Engineer to extend Magnesia Falls
Drive to cross the 100 ' drainage channel adjacent to northerly
side of subdivision, but not necessarily a bridge. "
Councilman Newbrander seconded the motion. Motion carried Il
unanimously with the members present .
Mayor Mullins called for a vote on Councilman Brush' s original
motion to waive further reading and adopt Resolution No . 79-18 ; motion

A. RESOLUTION NO. 79-23 - A .RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING SUBDIVISION FEES
FOR DEVELOPMENTS IN THE CITY OF PALM DESERT.
Mr. Bouman stated that this resolution presented certain
subdivision fees which are required under Ordinance 125 .
However, the specific fees are established by Resolution
in that they may be changed from time to time . The fees
_ being recommended have been established :by the Director of
Public Works and they are based on his analysis of what it
actually costs the City to process these documents . In
addition, he has presented a study of such fees collected
by other agencies or cities in the valley.
Councilman Newbrander moved and Councilman Wilson seconded to
waive further reading and . adopt Resolution No . 79-23 . Motion carried
una sly with the members present.
B. SOLUTION N0. 79-22 - A RESOLUTION OF THE CITY COUNCIL OF
HE CITY OF PALM DESERT, CALIFORNIA, ACCEPTING THE OFFER OF
A PARK SITE OF APPROXIMATELY 6 ACRES FROM LEWIS HOMES OF
. CALIFORNIA, DETERMINING THAT SAID DEDICATION MEETS THE TOTAL
PUBLIC FACILITIES REQUIREMENT FOR TRACTS 12181-1 , 12181-2 ,
14003 AND 14004, AND AUTHORIZE THE MAYOR TO ENTER INTO AN
ESCROW ON THE OFFER AND EXECUTE THE NECESSARY AGREEMENTS .
Mr. Bouman reported that this was an offer by Lewis Homes
for 6 acres of park satisfy the park land dedication
on Tracts 14003 and 14004 . It will be a very valuable asset
to the Park and Recre on' s long-range plan. The offer is
well in excess of the requirements they would have to fulfill .
Mr. Bouman requested that Sections 3 and 5 of the resolution
be amended as follows :
Section 3 - addition of the wording "subject to review and
1,., approval of the City Attorney" .
Section 5 - changed to read : "There is hereby appropriated
tTie sum of $250 from the Unobligated Fund Balance of the New
Construction Tax Fund to "Closing Costs-Dedicated Properties"

to complete escrow on this offer . "
Councilman Wilson moved and Councilman Brush seconded to waive

CONDITIONS OF APPROVAL

Standard Conditions :
1. . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements , limitations, and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force.
.2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards .
3. Prior to submittal of the Final Map, the applicant shall provide
the Department of Environmental Services with a list or proposed
street names with at least three alternatives. The approval of
the final street name shall be made by the Director of Environ-
mental Services.
4. Access rights , except for approved private street -entrances on San Pablo Avenue,
Magnesia-Falls Drive, and Public Street 'A' , shall be offered to the City as a
dedication on the Final Map.
5. The C.C.&R' s for this development shall be submitted to the City
Engineer for review and approval prior to . the issuance of any
building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer :
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into
with the owners of the units of the project .
6. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts.
. 7. Area shall be annexed to appropriate Improvement Districts having
Jurisdiction over the subject area. .
.8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
.10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shale
submit "as-built" plans prior to acceptance of the subdivision im-
provements by the City.
11 . In order to maintain reasonable fire protection during the construe-
tion period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with required
fire floes shall be installed as recommended by the Fire Marshal .
- • 12. Prior to recordation of the Final Map , the developer shall furnish
the original and three (3) copies of. the water system plan to the
Fire Marshal for review.
13. All requirements of the City Fire Marshal shall be met as a part of
the development of this tract (from letter dated January 17, 1979) .
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification : "I
certify that the design of the water system of Tract No. is in
accordance with the requirements prescribed by the City Fire Marshal . "

SPECIAL CONDITIONS
1 . A Final Map for subject Tract No. 14004 shall not be approved for
recordation until lot 141 of Tr. No. 14003 is conveyed to the City
of Palm Desert for park and recreation purposes, to satisfy the
Public Facilities requirement of the subject tract .
2. Except for approved private street entrances to the tract , the entire
perimeter shall be bounded by a six (6) foot high masonary wall to
be installed in the first phase, as approved through the Design
Review process.
3. Each phase shall be served by full private street improvements,
and that any phasing shown on the Final Map shall reflect this
condition.
4 . This subdivision shall pay $7, 100. 00 to the Signalization Fund of
the City of Palm Desert . These funds shall be applicable to a
signal at the intersection of San Pablo Avenue and 44th Avenue.
5. This subdivision shall pay $1 , 500. 00 into the Drainage Fund of the
City of Palm Desert.

6. San Pasqual shall be approved with curb, gutter and pavement on the
westerly side thereof.
7. It is recommended that the street width right-of-way be 38 feet , in
accordance with the Subdivision Ordinance of the City of Palm Desert .
8. The 100-foot drainage easement located on the easterly side of this
subdivision shall be landscaped in accordance with the recommendations
of the Director of Environmental Services.
' 9. The 100-foot drainage easement shall be sized by the subdivider' s
engineer for a trapezoidal ditch and excavated. The soil excavated
therefrom shall be utilized within the tract .

.15. Drainage shall be subject to approval of the City Engineer. Ap-
plicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering Depart-
ment and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the Develop-
ment Plan 13-78 shall be met as a part of the development of this
tract .
18. The total number of lots shall be limited to 7 ,
19. The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen (18)
months is granted by a Resolution of the City Council .
20. Drainage and Signalization Fund contributions as required by City
Ordinance shall be made prior to recordation of the Final Map.
21 . Developer shall dedicate land as directed by the City Council as
a condition of the Final Map, for park and recreation purposes.

Provide the following fire protection in accordance with the Uniform Fire Code:
1. Install a water system capable of delivering 2500 GPM fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in Tract No. 14004 is in accordance with the requirements

as many subdivisions , the dedication of small individual portions of
each subdivision would not provide the City with any usable property
to meet the public facilities needs of the project or the community;

ficient size and location, in compliance with the City' s General Plan,
to meet or exceed the required for the total project under Chapter 26 .48
of the Municipal Code would be a more logical and reasonable procedure;

WHEREAS, Lewis Homes of California is developing such a�'
project around the proposed Civic Center; and
WHEREAS, the City' s Master Plan of Parks and Recreation
designates an approximate six acre site within the Lewis holdings
which would more than satisfy the requirements of Chapter 26. 48 of
the Municipal Code; and
WHEREAS , said site, being 6. 0 acres more or less , located
easterly of and adjacent to San Pablo Avenue, northerly of 44th Avenue
has been determined by the City Council as the appropriate dedication
to fulfill the total requirement of Tracts 12181-1, 12181-2, 14003
and 14004; and
WHEREAS, said determination is based upon five percent of
the developable acres within these Tracts , which is determined to
be 98 . 5 acres ; and
WHEREAS, Lewis Homes of California, by a letter dated
February 13, 1979, attached hereto as Exhibit "A" , does make the
above described offer to the City Council subject to conditions .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Palm Desert, California, as follows :
1. That the above recitations are true, correct , and
constitute the findings of the Council in this matter.
2. The public facilities needs of the Subdivisions .pro-
posed by Lewis HOmes of California would be best met
by the acceptance of an individual park site at the
proposed location.
3 . The Mayor is hereby authorized to enter into escrow
and to execute any necessary agreements to complete
this acquisition, subject to review and approval by
the City Attorney.
4. The City Clerk is hereby directed to provide all
necessary documentation to the escrow company and
sufficiently indicate the fulfillment of the City' s

Dear Members of the Council: .
In accordance with the Subdivision Provisions of the Municipal Code and
the Parks and Recreation Element of the Palm Desert General Plan, Lewis
Homes of California wishes to offer a six-acre site within its property,
located generally at the northeast corner of the intersection of 44th
Avenue and San Pablo Avenue, known as Lot 141, Tentative Tract No. 14003,
subject to the conditions listed below.
This offer is conditioned upon the following:
1. Dedication of this site meets the full requirements of Article
26,48 of the City of Palm Desert Subdivision Ordinance for
dedication of land for parks purposes for Tracts 12181-1, .
12181-2, 14003, and 14004.
2. Said property shall be improved by the City for parks purposes
useable to the residents of said subdivisions within five years
of the acceptance of said offer or the property shall
automatically revert to Lewis Homes of California.
3. Dedication of this site will fully satisfy present and future
requirements, and no further requirements including site
improvements, maintenance or other fees will be imposed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING AN 18 MONTH
TIME EXTENSION PURSUANT TO THE PROVISIONS OF SECTION 26.20.140
OF THE PALM DESERT MUNICIPAL CODE OF THE APPROVED TENTATIVE
TRACT MAP 14004. CASE NO. TT 14004.
WHEREAS, the City Council of the City of Palm Desert, California, did
receive a request from LEWIS HOMES OF CALIFORNIA for an 18-month time extension,
pursuant to the provisions of Section 26.20.140 of the Palm Desert Municipal
Code, of the approved Tentative Tract Map TT 14004 for 7 lots to allow 142
condominium units, on 27 acres in the PR-4, S. P. zone at the northwest corner
of San Pascual Avenue and 44th Avenue,,more particularly described as :
Portions of APN 621-360-008 and
621-360-009
WHEREAS, the City Council is empowered to grant time extensions of
up to eighteen months for filing of the final map in Section 26.20. 140 of
the Palm Desert Municipal Code; and -
WHEREAS, the City Council did find the following reasons to exist
to justify the granting of said time extensions :
1 . Granting the time extension will not in any way adversely
affect the public health, safety or general welfare.
2. The applicant is not proposing any changes to the project and
the situation in the vicinity of the project is unchanged since
the subject tentative tract was originally approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1 . That LEWIS HOMES OF CALIFORNIA is hereby granted an 18-month
time extension of the approval of Tentative Tract Map TT 14004,
subject to all conditions of Resolution No. 79-19, amending
l the following conditions:
JStandard Condition No. 17 - All requirements of the Planning
Commission action on the Development Plan 05-80, shall be met
as a part of the development of this tract.
Special Condition No. 5 - Waived per City Council action of
February 14, 1980.
2. That said approval of time extension is subject to addition
of Special Condition No. 10 as follows :
"Maintenance of the 100 foot wide drainage structure and ease-
ment shall be provided in a manner determined by the City
Council of the City of Palm Desert, prior to or concurrent
with final map approval ."
3. That the final map for Tract 14004 must be filed prior to
September 8, 1981 , to preserve the validity of said tract.

Mr. Bouman requested permission to introduce a companion item
dealing with this tract and the drai ge ditch already placed
there by the City. He reported that wis Homes and their
attorney was requesting a letter from e City holding them
harmless from damage or liability that m result from that
ditch. The channel is there as a result o the City ' s request
and it is desirable to have it there in ca ,e of some additional
heavy storms . It is reasonable that Lewis mes should not
have to bear the burden of any problems arisi g as a result
of our requesting the channel be there. He re d a letter as
prepared by the City Attorney which would relea e Lewis Homes
from liability (letter attached and made a part ereof as
Exhibit "A") .
Mr. Sullivan, Lewis Homes , stated that the letter, s read, met
the requirements that they had requested.
Councilman Newbrander moved to accept the letter as presented
by the City Manager and authorize him to sign it. Councilman Snyder
seconded the motion; carried unanimously. \

IX. RESOLUTIONS
A. RESOLUTION NO. 80-68 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT;I. CALIFORNIA, AUTHORIZING THE CITY MANAGER
NEGOTIATE WITH THE COUNTY OF RIVERSIDE FOR CERTAIN SPECIFIED
FIRE PROTECTION SERVICES.
Mr. Bouman reviewed the resolutions and each provision of it.
Councilman Snyder stated that with respect to Item 4, the Manager
should make sure that the County does not have the equipment availa-
ble before the City goes out and ,buys it Mr. Bouman stated that a
list of equipment was available, and he would be aware of this concern.
Councilman Puluqi stated that he felt that in Item 5 , the phrase
as a first priority" should be eliminated in that it might be
misinterpreted by the other cities . Mr. Bouman stated that this
was in the resolution at the County' s request and could be deleted.
At Council ' s request , Mr. Eric Vogt , Fire, Marshal , explained the
capabilities of the City' s Snorkel Truck. Councilman Puluqi added
that it was not so much the truck as it is the manpower that it can
provide.
Mayor Pro-Tem McPherson moved and Councilman Puluqi seconded to
waive further reading and adopt Resolution No. 80-68 as. amended to delete
the words "as a first priority" in Item 5 . Motion carried unanimously-
B. RESOLUTION NO. 80-69 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, DETERMINING THE. AMOUNT OF
PROPERTY TAX REVENUE TO BE EXCHANGED BET14EEN THE `COL'NTY OF
RIVERSIDE AND THE CITY OF PALM DESERT RELATING TO ANNEXATION
NUMBER 6 TO THE CITY OF PALM DESERT, CALIFORNIA, LAFC #78-64-4.
Mr. Bouman explained that this is another resolution dealing
with annexation where, after Proposition #13 , the City will
receive 25% of the property tax collected by the County.
Councilman Newbrander moved and Councilman Snyder seconded to
waive further reading and adopt Resolution No. 80-69 ; carried unanimously.

Dear Mr. Williams :
This letter is in response to your request- for
comments and conditions of approval regarding the
above referenced projects . The Palm Desert Community
Services District attempted to provide the previous
Lewis Homes developments Tract Nos . 12181-1 and 12181-2
with domestic water service. The District requested
the City' s cooperation in making service by Palm Desert
Community Services District a condition of approval .
As you know, the City refused to cooperate . The developer
has avoided any contact with the Community Services District
dispite numerous attempts by the District to contact the
representatives . Presumably water service is being pro-
vided by the Coachella Valley County Water District,
dispite the fact that the property involved was annexed
to the community Services District in 1974.
We simply wish to state that Palm Desert Community
Services District is willing to provide the above .referenced
projects with domestic water service. Also the District
wishes to annex the property. Should the developer be
interested, the representatives should contact the District.
If you have any questions in regard to the above,
please do not hesitate to contact us .

TT 14004 - Request for approval of a Tentative Tract
Map to allow 142 single family condominiums on approx-
imately 27 acres located between San Pablo Avenue and
San Pasqual , north of 44th Avenue.
Mr. Crump made the presentation of cases to the Commission.
The Applicant is requesting that Special Condition No . 7 be deleted,
as the right-of-way width has been fixed and this would not be
appropriate to carry on this resolution.
Chairman Kelly asked for any questions or comments from the
Commissioners at this time.
Commissioner Berkey noted that Special Condition No. 4 should
read "$1, 500. 00 per acre" rather than simply "$1 , 500. 00" .
Chairman Kelly then asked if the Applicant would care to make
a presentation .
BETTY WILLIAMS , representative for Lewis Homes. Mrs. Williams
agrees with Staff recommendations except for Special
Condition No . 7 , stating that this condition was not on the
Development Plan conditions. She contends that under the
Subdivision Map Act , municipalities bear the burden of this
cost .
She does not feel that they should have to pay half of the
cost to build this bridge; however , they will agree to use
any excess per/acre drainage fees to be used toward the
drainage channel .
Commissioner Snyder asked if the fees were put into the
channel fund or to a specific project .
Paul Williams stated that they are put into the fund .
At present , this Tract Map must pay $1 , 500. 00 per acre into the
City drainage fund, but it is not designated how it is used.

Mrs. Williams said that on previous discussions, it was
indicated that the money would be used toward major drainage.
Commissioner Snyder thinks it is rather unfair to ask
developer to pay into drainage fund and then assume the additional
obligation of the bridge.
Discussion ensued regarding this question. A suggestion was
made that Special Condition No . 7 could be modified to leave out
specific mention of the bridge, and leave that issue up to the City
Council.
Mr . Crump offered alternative wording as follows : "Sub-
divider shall provide for improvements as required by City Council
to extend Magnesia Falls Drive to cross 100' drainage channel . "
That would leave the decision on the issue up to City Council .
Betty Williams did not agree with putting the issue in limbo.
Mr . Crump stated that the issue would need to be addressed by the
Council .
Chairman Kelly declared the Public Hearing open , asking if
anyone wished to speak in FAVOR or OPPOSITION of the proposals.
Being none , she declared the Public Hearing closed.
On a motion by Commissioner Kryder, seconded by Commissioner
Berkey, Planning Commission Resolution No . 453 was approved as
amended (amendment below) , and Resolution No . 454 was approved as
presented.

the Commission. He then revi ed the related project exhibits which
detailed the specific elements the proposal ./ Mr . Williams concluded

matter. Following the Staff recomm dation it was suggested that the
project needed restudy to resolve a n ber of basic design problems.
Chairman Kelly asked if the Cc • ssioners had any questions
or comments at this time. There were none forthcoming, so she asked

RICHARD DOTY, 43 Barcel a, Rancho Mira e, introduced his
company, and gave a s rt description of he history of the
land of the Chappar Country Club. State that he and
Mr . Dame' had hir experts in all fields o development .
Mr . Doty note that at their meeting of January 1979,
the Design view Board felt that the project was well
thought o and endorsed it . Their recommendation have
been to n under advisement , and have been agreed to\.

tion of a drainage fund that Mr. Beebe has expressed an
int est in their committing to. Mr . Doty also agreed on

WHEREAS, the City Council of the City of Palm Desert, California,
did, on the 8th day of March, 1979, hold a duly noticed Public Hearing to consider
the request of LEWIS HOMES OF CALIFORNIA for approval of a Tentative Tract Map to
create 7 lots to allow for 142 Single family attached condominiums on approximately
27 acres within the PR-4, S.P. (Planned Residential , 4 d.u./ac. , Scenic Preservation
Overlay) zone, located between San Pablo Avenue and San Pascual , north of 44th
Avenue, more particularly described as:

WHEREAS, the Planning Commission, by Resolution No. 454, has recom-
mended approval subject to conditions ; and
WHEREAS, said application has complied with the requirements of
the City of Palm Desert Environmental Quality Procedure Resolution No. 78-32" ,
in that the subject project has been previously assessed under CZ 09-78 and
DP 13-78, and no further evaluation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments , if any, of all persons desiring to be heard, said
City Council did find the following facts and reasons to exist to recommend approval
of the Tentative Tract Map:
1 . The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and
the State of California Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General
Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development
proposed.
4. The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage or
serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows:
1 . That the above recitations are true and correct and constitute
the findings of the Council in this case;
2. That it does hereby approve the above described Tentative Map
No. 14004 for the reasons set forth in this Resolution and subject
to the attached conditions .

CONDITIONS OF APPROVAL

Standard Conditions : -
-. 1 . . The development of the property described he min shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements , limitations, and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force .
.2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
'.3. Prior to submittal of the Final Map, the applicant shall provide
the Department of Environmental Services with a list or proposed
street names with at least three alternatives . The approval of
the final street name shall be made by the Director of Environ-
mental Services.
4. Access rights , except for approved private street 'entrances on San Pablo Avenue,
Magnesia Falls Drive, and Public Street W , shall be offered to the City as a
dedication on the Final Map.
5. The C. C.&R ' s for this development shall be submitted to the City
Engineer for review and approval prior to . the issuance of any
building permits . Prior to recordation of the final subdivision
map , the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
- c. Management and maintenance agreement to be entered into
with the owners of the units of the project .
6 . Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area. .
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances .
9. All on-site utilities , including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services .
.10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision im-
provements by the City.
11 . In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with required
fire flows shall be installed as recommended by the Fire Marshal .
12 . Prior to recordation of the Final Map, the developer shall f 1.urnish
the original and three ( 3) copies of. the water system plan to the
Fire Marshal for review.
13. All requirements of the City Fire Marshal shall be met as a part o.f
the development of this tract (from letter dated January 17 , 1979) .
14. The water system shall be signed by a registered civil engineer and
approved by the water company , with the following certification : "I
certify that the design of the water system of Tract No. is in
accordance \with the requirements prescribed by the City Fire Marshal . "

SPECIAL CONDITIONS
1 . A Final Map for subject Tract No. 14004 shall not be approved for
recordation until lot 141 of Tr. No. 14003 is conveyed to the City
of Palm Desert for park and recreation purposes, to satisfy the
Public Facilities requirement of the subject tract .
2. Except for approved private street entrances to the tract , the entire
perimeter shall be bounded by a six (6) foot high masonary wall to
be installed in the first phase, as approved through the Design
Review process.
3 . Each phase shall be served by full private street improvements,
and that any phasing shown on the Final Map shall reflect this
condition .
4 . This subdivision shall pay $7 , 100. 00 to the Signalization Fund of
the City of Palm Desert . These funds shall be applicable to a
signal at the intersection of San Pablo Avenue and 44th Avenue.
5. This subdivision shall pay $1 , 500. 00 into the Drainage Fund of the
City of Palm Desert .

6. San Pasqual shall be approved with curb, gutter and pavement on the
westerly side thereof . _
7 . It is recommended that the street width right-of-way be 38 feet , in
accordance with the Subdivision Ordinance of the City of Palm Desert .
8 . The 100-foot drainage easement located on the easterly side of this
subdivision shall be landscaped in accordance with the recommendations
of the Director of Environmental Services.
9. The 100-foot drainage easement shall be sized by the subdivider ' s
engineer for a trapezoidal ditch and excavated. The soil excavated
therefrom shall be utilized within the tract .

15. Drainage shall be subject to approval of the City Engineer. Ap-
plicant shall provide engineered data as requested.
16 . All private streets shall be inspected by the Engineering Depart-
ment and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the Develop-
ment Plan 13-78 shall be met as a part of the development of this
tract .
18. The total number of lots shall be limited to 7.
19. The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen ( 18)
months is granted by a Resolution of the City Council .
20. Drainage and Signalization Fund contributions as required by City
Ordinance shall be made prior to recordation of the Final Map.
21 . Developer shall dedicate land as directed by the City Council as
a condition of the Final Map, for park and recreation purposes.

Standard Conditions:
. l . . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
' addition to all the requirements, limitations, and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force.
.2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
`.3. Prior to submittal of the Final Map , the applicant shall provide
the Department of Environmental Services with a list or proposed.
street names with at least three alternatives. The approval of
the final street name shall be made by the Director of Environ-
mental Services.
4. Access rights , except for approved private street -entrances on San Pablo Avenue,
Magnesia=Falls Drive, and Public Street 'A' , shall be offered to the City as a
dedication on the Final Map.
5. The C. C.&R' s for this development shall be submitted to the City
Engineer for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer :
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into
with the owners of the units of the project .
6. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts .
. 7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area. -
.8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
3. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision im-
provements by the City.
11 . In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with required
fire flows shall be installed as recommended by the Fire Marshal .
•12 . Prior to recordation of the Final Map , the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review. --- - -- --
13. All requirements of the City Fire Marshal shall be met as a part of
the development of this tract (from letter dated January 17, 1979) .
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification : "I
certify that the design of the water system of Tract No. is in.

.15. Drainage shall be subject to approval of the City Engineer. Ap-
plicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering Depart-
ment and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the Develop-
ment Plan 13-78 shall be met as a part of the development of this

18. The total number of lots shall be limited to 7,
19 . The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen ( 18)
months is granted by a Resolution of the City Council.
20. Drainage and Signalization Fund contributions as required by City
Ordinance shall be made prior to recordation of the Final Map.
21 . Developer shall dedicate land as directed by the City Council as
a condition of the Final Map, for park and recreation purposes.

1 . A Final Map for subject Tract No. 14004 shall not be approved for
recordation until lot 141 of Tr. No. 14003 is conveyed to the City
of Palm Desert for park and recreation purposes, to satisfy the

2. Except for approved private street entrances to the tract , the entire
perimeter shall be bounded by a six (6) foot high masonary wall to
be installed in the first phase, as approved through the Design
Review process.

4 . This subdivision shall pay $7, 100. 00 to the Signalizat.ion Fund of

F. PUBLIC FACILITIES REQUIREMENT:
Dedication of a six (6) acre park site, as defined in DP 13-78, is
required to satisfy park land dedication for the subject Tentative
Maps (TT 14003 & TT 14004) , and previous Tentative Maps
(TT 12181-1 & TT 12181-2).
III. DISCUSSION:
The proposed Tentative Tract Maps seek to implement an approved over-all
Development Plan providing for 282 dwelling units and public park
dedication on the subject site. Proposed lot no. 141 of Tentative
Tract 14003, contains a six (6) acre public park and the planned civic
center site. Dedication of the park site is required to satisfy the
Public Facilities requirement for the subject maps and two other tracts;
therefore, it should be defined as a separate lot to more easily
facilitate dedication (see Special Condition No. 1 ).
Features of the proposed maps are in accordance with the approved
Development Plan. Right-of-way dedication and improvements were
established in the previous plan review and are conditioned to be
implemented by these maps.

2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the desi.r
of the water system in Tract No. 14003 is in accordance with the requirements

22. During construction of this project, minor amounts of dust
may be created in the project area. All grading will be
performed in accordance with the City of Palm Desert' s
ordinances , including all dust mitigating measures (watdring,
etc. )
24. Existing drainage patterns will be altered by the construction
of the 100-foot wide drainage channel on the East side of
the Tract. This channel will greatly alleviate this flood-
prone area.
27. All of the units will be designed so as to comply with all
energy saving features to include compliance with Title 24
of the State Administration Code.

service, but this increase will be more than offset by the
