SUMMARY OF COUNCIL ACTION Mr. Diaz reviewed the actions of the Council for the meeting of March 25, 1982. V1. CONSENT CALENDAR All matters listed on the Consent Calendar are considered to be routine and will be enacted by one roll call vote. There will be no separate discussion of these items unless members of the Planning Commission or audience request specific items be removed from the Consent Calendar for separate discussion and action. A. TT 14999 AND INITIATION OF A CHANGE OF ZONE, WESTSIDE £N'RiRPRISES - Request for a one year time extension and initiation of a Change of Zone from R-2, 8,000 to R-1, also known as Skyward Place. PUBLIC HEARINGS: L INTEROFFICE MEMORANDUM CITY OF PALM DESERT TO: PLANNING COMMISSION FROM: DEPARTMENT OF ENVIRONMENTAL SERVICES SUBJECT: REQUEST FOR APPROVAL OF A ONE YEAR DATE: APRIL 6, 1982 TIME EXTENSION FOR CASE NO. TT 14996 (MACK DEVELOPMENT) Tentative Map 14996 provides for the creation of 118 lots to include 116 residential condominium units on 25 acres located on the south side of Country Club, approximately 1,800feet east of Monterey Avenue. Tentative Map 14996 was originally approved September 27, 1979. A one year time extension was granted Septebmer 25, 1980, and a six month time extension was granted September 24, 1981. Pursuant to the recently .revised subdivision ordinance provisions, the applicant is requesting an additional one year extension. This would be the final time extension which could be granted. STAFF RECOMMENDATION: That Planning Commission grant a one year time extension to Case No. TT 14996 subject to all previously imposed conditions continuing to be in effect. /pa ' T W. STAFF RECOMMENDATION: Waive further reading and adopt resolution No. 80-123 approving a one year extension of time for TT 14996. B. DISCUSSION: This Tract Map was originally approved by the City Council on September 27, 1979. At that time there was no discussion from the applicant or audience. Mayor Wilson (then a Councilman) , expressed concern that only two Planning Commissions had voted for approval (2-0-2-1 ) . Councilman Newbrander voted NO, explaining that she felt the project was too dense, a lot of buildings jammed into a small area. Since the time of original approval , the North Palm Desert Master Drainage Plan has been adopted. As a result, Special Condition No. 4 is recommended for amendment, with a New Special Condition recommended (pertaining to participation in Master Plan implementation) . It appears that the considerations that existed at the time of approval were still valid, and therefore, staff recommends approval of this time extension, with the conditions as recommended. RESOLUTION NO. 80-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A ONE YEAR TIME EXTENSION PURSUANT TO THE PROVISIONS OF SECTION 26.20. 140 OF THE PALM DESERT MUNICIPAL CODE OF THE APPROVED TENTATIVE TRACT MAP. CASE NO. TT 14996 WHEREAS, the City Council of the City of Palm Desert, California, did receive a request from MACK DEVELOPMENT, INC. , for a one year time extension, pursuant to the provisions of Section 26.20. 140 of the Palm Desert Municipal Code of the approved Tentative Tract Map TT 14996 to create a 118 lot subdivision for condominium purposes on property located on the south side of Country Club Drive, approximately 1800 feet east of Monterey Avenue, more particularly described as: APN 621-190-005, 006 and 007 WHEREAS, the City Council is empowered to grant time extensions of up to eighteen months for filing of the final map in Section 26.20.140 of the Palm Desert Municipal Code; and, WHEREAS, the City Council did find the following reasons to exist to justify the granting of said time extensions: 1. Granting the time extension will not in any way adversely affect the public health, safety or general welfare. 2. The applicant is not proposing any changes to the project and the situation in the vicinity of the project is unchanged since the Tentative Tract was originally approved. Mr. Paul Williams reviewed the Staff Report stating that the major topic of discussion with the Planning Commission dealt with the proposed north-south street. He stated that the applicant is being required to dedicate 1/2 of the street but only to improve it to the entrance of the project . The Commission felt that with this roadway, it would provide good access to the single-family area. Both Staff and the Planning Commission recommended approval as presented. Mayor Mullins invited input in FAVOR of the project . MS . INGRID MACK, 111 N. Fifth Street , Redlands , addressed Council as the applicant . She stated her concurrence with both the Planning Commission and Staff recommendations. Mayor Mullins invited input in OPPOSITION to the project , and none was offered. He declared the Public Hearing closed. r Councilman Wilson expressed concern that this project J was brought to Council having been approved by only two votes of the Planning Commission. He stated that one of the strengths of the Planning Commission is that 5 people explore all the issues , and it bothered: him that only two Commissioners had voted on it. Councilman McPherson moved and Councilman Brush seconded to waive further reading and adopt Resolution No . 79-112 . Motion carried on a 4-1 vote, with Councilman Newbrander voting NO. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements , limitations , and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services, 4. Access rights to Country Club Drive and proposed north-south street (except for approved openings) shall be offered to the City as a dedication on the Final Map. 5. The C.C. & R. Site Access - A primary feature of this development is provision for a new street running south of Country Club Drive. It will have the effect of reducing the number of access points to Country Club while allowing entrance to several properties. As the plans illustrate, this project will have its entrance on the new street, necessitating two travel lanes to be installed initially. B. Site Design - Unit arrangement is around motor courts. These modules of units and courts are rather ridgidly laid-out, but changes in site grades would help the appearance when actually constructed. Internal cir- culation could be improved by providing a driveway connection between two of the courts (between lot no. 102 and lot 103) . C. Recreational Amenities - The project provides a central =recreation area containing a pool and four tennis courts. The courts should be recessed to reduce their visual impact. . Four satelight pool areas are distributed in each quarter of the site. D. Architectural Approach - Buildings will incorporate hip roofs with flat tile, and stucco wall . The applicant's architectural representative indicates that they will be trying to achieve a modified version of the architecture commonly found in Florida, rather than a repeat of a Spanish approach. , E. Tract Map Considerations - While the filing of a Tract Map can not be precluded, it is considered premature until the Design Review process is completed. Therefore, the map should be revised to reflect any subsequent changes p in the site design. A condition to this effect has been included in the draft Resolution. IV. She stated her concurrence with both the Planning Commission and Staff recommendations . Mayor Mullins invited input in OPPOSITION to the project , and none was offered. He declared the Public Hearing closed. Councilman Wilson expressed concern that this project J was brought to Council having been approved by only two votes of the Planning Commission. She stated that there should be no problem as far as obtaining an easement but that she would like cooperation from the City in this matter if an easement could not be obtained. Chairman. Snyder asked that she define what she meant by coop- eration? Ms . Mack stated that they would like to go ahead and develop their side of the street and that the City should make sure that when the owners to the east develop their property, they are aware they must develop their portion of the street at that time. STAFF REPORT Page Three DP 10-79 III. DISCUSSION: A. Site Access - A primary feature of this development is provision for a new street running south of Country Club Drive. It will have the effect of reducing the number of access points to Country Club while allowing entrance to several properties. As the plans illustrate, this project will have its entrance on the new street, necessitating two travel lanes to be installed initially. B. Site Design - Unit arrangement is around motor courts. These modules of units and courts are rather ridgidly laid-out, but changes in site grades would help the appearance when actually constructed. Internal cir- culation could be improved by providing a driveway connection between two of the courts (between lot no. 102 and lot 103) . C. Recreational Amenities - The project provides a central = recreation area containing a pool and four tennis courts. The courts should be recessed to reduce their visual impact. Four satelight pool areas are distributed in each quarter of the site. D. Architectural Approach - Buildings will incorporate hip roofs with flat tile, and stucco wall . The applicant's architectural representative indicates that they will be trying to achieve a modified version of the architecture commonly found in Florida, rather than a repeat of a Spanish approach. E. Tract Map Considerations - While the filing of a Tract Map can not be precluded, it is considered premature until the Design Review process is completed. Therefore, the map should be revised to reflect any subsequent changes in the site design. A condition to this effect has been included in the draft Resolution. IV.
