As allowed by code, the applicant is requesting a one year extension. II. PUBLIC HEARINGS (Continued) B . CASE NO. TT 14997 (Continued) Mr. Williams reviewed the Staff Report . He stated that the Planning Commission, in their review, had suggested a number of conditions which included improvements in conformance with the drainage plan which calls for improvements of Hovley Lane and installation of a storm drain. The Commission felt that -. the request was in conformance with the Zoning Ordinance and the Subdivision Ordinance and did recommend approval by their Resolution No. 570 . Staff also recommended approval . Mayor Mullins invited input in FAVOR of the request . Mr. William Fitch, Wallach & Associates , addressed Council on behalf of the developer and expressed their concurrence with the Commission' s recommendation. Mayor Mullins invited input in OPPOSITION to the request , and none was offered. He declared the Public Hearing closed. Mayor Pro-Temp McPherson stated his concern relative to a piece-meal improvement of Hovley Lane. He felt that it was to become a major traffic carrier and would wind up like Monterey Avenue with two lanes in one area and widening to four lanes in other areas . He stated that Council had required other developers to do off-site improvements and wondered if this type of condition could be imposed in this case. Mr. Beebe responded that Chaparral had been required to do the off-site improvement of Portola so that in the event the Portola Wash was closed, their residents would have ingress and egress to their homes . Councilman Wilson expressed the same concern about total improvement of Hovley Lane and asked about the possibility . of an additional condition along the lines of an agreement to participate in a future road improvement assessment district . Mr. Williams stated that Council did require this in some instances for undergrounding of utilities . Dave Erwin stated that this usually presupposes that they are not putting it in at the present time, and if this developer is now putting in the street, he is putting in his proportionate share. Further discussion decided that only 600' or two . lots would remain unimproved at this time, but Mr. Williams advised that they should be in the foreseeable future . Mayor Pro-Tempore McPherson moved and Councilman Newbrander seconded to waive further reading and adopt Resolution No. 80-23. Motion carried unanimously. C. SE NO. CASE NO. TT 14997 WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th day of February, 1980, hold a duly noticed Public Hearing to consider the request of PRO-CON DEVELOPMENT/T & D INVESTMENTS to subdivide land into 24 lots to allow 20 condominium units, recreational area, and common open space on approximately 4.5 acres within the PR-5 (Planned Residen- tial , 5 d.u./ac. ) zone generally located on the south side of Hovley Lane, 2400 feet east of Monterey Avenue, more particularly described as: APN 621-190-071 APN 621-190-080 WHEREAS, the Planning Commission, by Resolution No. 570, has recommended approval , subject to conditions; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32" , in that the subject project has been previously assessed under DP 09-79 (A) , and no further evaluation is deemed necessary; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of develop- ment proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve the above described Tentative Map No. TT 14997 for the reasons set forth in this Resolu- tion and subject to the attached conditions. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the require- ments of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In ( return, the City Council agrees to use said fees for park purposes in con- formance with an adopted master plan, within five (5) years of the recordation of the final map. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide --the Department of-Eiivironmental--Services-with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. Access rights to Hovley Lane (except for one approved project entrance and utility access easement) shall be offered to the City as a dedica- tion on the Final Map. 5. The C.C. & R' s for this development shall be submitted to the Director of Environmental Services for review and final approval by the City Attorney prior to the issuance of any building permits. Prior to re- cordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded (Which have been approved) . C. Management and maintenance agreement to be entered into with the owners of the units of the project (Which has been approved) . 6. Improvement plans for water and sewer systems shall meet the require- ments of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of -Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before con- struction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 11. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. As adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . 12. The acceptability of the current proposal has not received a detailed evaluation through the Design Review process, therefore, the map is considered premature. Conditions may be placed on the Tentative Map to guarantee its conformance with a final site plan approval . Perimeter treatment includes wind and (interim) blowsand protection. The preferred approach being suggested in draft condition of approval , requires that a minimum of 30 ft. along the north and west boundaries be retained in common ownership with individual lots and resulting dwelling unit improvements being adjusted accordingly. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. The total number of lots shall be limited to twenty (20) for dwelling unit purposes, and other lots for common use as deemed appropriate. 19. The applicant shall have twelve (12) months from the date of the approval or conditional approval fo the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council . 20. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. 21. Developer shall pay a fee in lieu thereof as a condition of the Final Map, for park and recreation purposes. The City .shall commit the use of any_ such fees received within a five year period. SPECIAL CONDITIONS 1. Subdivider shall contribute an amount equal to $1,000 as a fee paid into the Signalization Fund of the City of Palm Desert. 2. Subdivider shall dedicate and improve Hovley Lane as required to , implement the revised design for the adjacent street section, and install drainage system improvements called for in the Master Drainage Plan as required and approved by the Director of Public Works. 3. Subdivider shall install Safety Street Lighting at the intersection of Hovley Lane and the project entrance as required by the Director of Public Works and approved through the Design Review process. 4. If project entrance is to be secured, the entrance desiqn shall provide for four (4) standing vehicles; stacked outside -of the public right-of-way. 5. The entire Tract shall be bounded by a minimum 6 foot high solid masonary wall (except for approved openings) . 6. The north-south interior private street shall be increased to 32 feet in width, with the radius of the southern turn around area increased to a minimum of 35 feet. 7. The map shall provide for a minimum 30 foot wide common ownership area along the north and west property lines, with adjacent private dwelling unit lot lines and improvements being adjusted accordingly. 8.
