A. STAFF RECOMMENDATION:
Waive further reading and adopt Resolution No. 79-134, approving Tentative Tract
No. 14998.
B. DISCUSSION:
As reflected in the Planning Commission minutes , a Development Plan allowing 22
units was also approved by the Commission.
While there was no audience participation, the Commission did modify one stand-
and condition. Because of a concern that an undivided interest in the common
use lots may not be transferred to each purchaser, the Commission added "d" to
Standard Condition No. 5, as follows, "Lots indicated as common shall be retained
in undivided interest granted to each homeowner."
After a short discussion regarding access to Portola Avenue, the Commission
unanimously approved this request for a Tentative Tract Map.

RESOLUTION NO. 79-134
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP
TO ALLOW 22 CONDOMINIUM UNITS.
CASE NO. TT 14998
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 8th day of November, 1979, hold a duly noticed Public Hearing to
consider the request of T&D CALIFORNIA INVESTMENTS for approval of a Tenta-
tive Tract Map to create a 28 lot subdivision to allow 22 condominium units
on approximately 4.75 acres within the PR-5 (Planned Residential , max. 5
d.u/ac. ) zone located on the southwest corner of Hovley Lane and Portola
Avenue, more particularly described as:
APN 621-190-063
WHEREAS, the Planning Commission, by Resolution No. 538, has
recommended approval subject to conditions ; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32" , in that the subject project has not been found to present an adverse
impact on the environment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said
City Council did find the following facts and reasons to exist to recommend
approval of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and
the State of California Subdivision Map Act, as amended.
j 2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of develop-
ment proposed.
4. The design of the subdivision and the proposed improve-
ments are not likely to cause substantial environmental
damage or serious health problems .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows :
1. That the above recitations are true and correct and constitute
the findings of the Council in this case.
2. That it does hereby approve the above described Tentative Map
No. TT 14998 for the reasons set forth in this Resolution and
subject to the attached conditions.
FURTHER, BE IT RESOLVED that the conditions of approval do include
a requirement that the applicant pay in-lieu fees to comply with the require-
ments of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In
return, the City Council hereby agrees to use said fees for park purposes in
conformance with an adopted Master Plan, within five (5) years of the recorda-
tion of the Final Map.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 14998
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations , and restrictions of
all municipal ordinances and State and Federal statutes now in force,
or which hereafter may be in force.
-. 2. Full public improvements including traffic safety lighting as required
by Ordinance and the City Engineer shall be installed in accordance
with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final
street name shall be made by the Director of Environmental Services.
4. Access rights to Hovley Lane and Portola Avenue, (except for one
approved entrance to each street) shall be offered to the City as a
dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the Director
of Environmental Services for review and final approval by the City
Attorney prior to the issuance of any building permits. Prior to record-
ation of the final subdivision map, the applicant shall 'submit to the
City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded. (Which have been
approved)
C. Management and maintenance agreement to be entered into with
the owners of the units of the project. (Which has been
approved)
d. Lots indicated as common shall be retained in undivided
jinterest granted to each homeowner.
6. Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free
of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision improve-
ments by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
16, 1979 shall be met as a part of the development of this tract.

14. The water system shall be signed by a registered civil engineer
and approved by the water company, with the following certifi-
cation: "I certify that the design of the water system of Tract
No. 14998 is in accordance with the requirements prescribed by
the City Fire Marshal . "
15. Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering
Department and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the
Development Plan 11-79 shall be met as a part of the de-
velopment of this tract.
18. The total number of lots shall be limited to 22 for condo-
minium unit use, and other lots for common purposes as 'deemed
necessary.
19. The applicant shall have twelve (12) months from the date of
the approval or conditional approval of the tentative map for
filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City
Council .
20. Drainage and Signalization Fund contributions as required by
City Ordinance shall be made prior to recordation of the Final
Map.
21. Developer shall pay in-lieu fees for Park and Recreation purposes
to comply with the requirements of Article 26.48 of the City of
j Palm Desert Subdivision Ordinance.
SPECIAL CONDITIONS:
1. Provide installation of adjacent Right-of-way design as follows:
Hovley Lane - dedication and improvement of 44 ft. half
street. Half street section to contain 32 ft. wide travel
lane, and 12 ft. public parkway (no sidewalk) , with
ornamental landscaping.
Portola Avenue - dedicate and improve 50 ft. half street.
Street section to contain ultimate 6 ft. (one-half of 12
ft. ) raised center median, 32 ft. wide travel lane, and
12 ft. public parkway and 20 ft. public access easement
adjacent to parkway. Easement and parkway to be improved
with and 8 ft. wide meandering pedestrian/bike path, orna-
mental landscaping.
2. The grade of Hovley Lane shall be re-established as directed
and approved by the Director of Public Works. All improvement
plans shall be based on that new grade.
3. Safety street lighting shall be installed at each tract entrance
on Hovley Lane and Portola Avenue.
4. If tract entrances are to be secured, provide capacity for
the stacking of four vehicles onsite.

5. Provide minimum 6 ft. high solid masonary wall around
tract (except for approved openings) , as approved through
the Design Review process.
6. Subdivider shall contribute $1,100 into the Signalization
Fund, and $1,500 per gross acre into the Drainage Fund of
the City of Palm Desert.
7. The map shall provide for 50% of the net site area (approx.
1.96 acres) to be held in common for open space purposes,
this may be accomplished by means of an easement.
8. A final,,map shall not be accepted for filing until the
Design Review process has been completed; the map shall
be adjusted to correspond to that approval and submitted
to the Director_of Environmental Services for a deter-
mination of compliance.

Gentlemen:
Prior to construction of any of the proposed buildings , the following conditions must
be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2.- Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 11-79 is in accordance with the require-
ments prescrihed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.

C. Continued Case Nos. DP 11-79 and TT 14998 - T & D CALIFORNIA
INVESTMENTS, Applicant
Request for approval of a preliminary Development Plan
to allow 22 dwelling units and recreational facilities
and 28 lot Tentative Tract Maps on approximately 5 acres
within the PR-5 (Planned Residential , 4 d.u./ac. ) zone
located at the southwest corner of Hovley Lane and
Portola Avenue.
Mr. Crump .presented this case noting that this case was a
continued item and updated staff reports were provided for the Commission.
He stated that the revision was to increase the number of lots. He also
noted that Staff revised Special Condition No. 7, to read: "The map shall
provide for 50% of the net site area (approx. 1.96 acres) to be held in
common for open space purposes, this may be accomplished by means of an
easement. "
Commissioner Kryder was concerned for the access on to Hovley
Lane asking if this would be safe.
Mr. Crump explained how the access would be developed.
Commissioner Kryder then asked if the access on Portola was
necessary. He believed this would create a traffic hazard.
After a short discussion on this matter Mr. Williams stated that
this opening would represent 3 permanent openings between Hovley Lane and
the Wash.
/ Chairman Snyder expressed a great concern for the number of lots,
and asked why the open space and recreation amenities were divided up into
individual , lots.
RAY HOWARD, Ballew-McFarland, stated that this was done by the
engineering firm and was unaware of why they did it that way.
Commissioner Berkey asked if the City Attorney would review the
C.C. & R. 's . It was agreed that in Standard Condition No. 5 of the
Tentative Tract Map, to add "d", stating: "Lots indicated as common shall
be retained in undivided interest granted to each homeowner. "
Commissioner Berkey pointed out that in Standard Condition No. 3
of the Conditions of Approval should be changed. This was modified to
read: - "Construction of the total development shall be done in one (1)
phase. "
Chairman Snyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none, the
Public Hearing was closed.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Kryder, Case Nos. DP 11-79 and TT 14998 were approved by adopting Resolution
Nos. 537 and 538, as modified. Carried unanimously; (3-0) .

A. C chella Valley County Water District Projects.
Mr. Crump resented this case giving a short review of the projects
and pointed out that e projects appeared to be in conformance with the
City's General Plan.

Commission was called to order at 1:02 P.M. by Chairman

between Monterey Avenue and Portola Avenue.
Mr. Williams presented this case stating that it was requested
by the applicant' to continue this case to the October 30, 1979, meeting.
On a motion made by Commissioner Berkey, seconded by Commissioner
Kryder, this case was continued to October 30, 1979. Carried unanimously;

B. Continued Case No. CUP 08-79 - PALM DESERT COMMUNITY SERVICES
DISTRICT, Applicant
Request for approval of a Conditional Use Permit for Public
Utility purposes (with related setback and parking variance)
to allow continued use of a facility containing an existing
maintenance building, water well building, and living
quarters (with proposed remodeling) on approximately .22 acres
within the R-1, S.P. (Single Family Residential , Scenic Pre-
servation Overlay) zone located at 44-491 Portola Avenue.
Mr. Williams noted a request from the applicant to continue
this case to the October 30, 1979, meeting. Mr. Crump added that the
applicant had not been able to proceed with the plans, therefore, not having
anything to present to the Commission.
Upon motion made by Commissioner Berkey, seconded by Commissioner

Public Hearing ; and, continued Public Hearings on September 19, October
2, and October 17, 1979, to consider the request of T & D CALIFORNIA

subdivision for condominium purposes on approximately 4.75 acres within

Gentlemen:
Prior to construction of any of the proposed buildings , the following conditions must
be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. /Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 1.1-79 is in accordance with the require-
ments prescribed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.

K. UNIT DESCRIPTION
2 single story units in 11 duples buildings; each
containing two bedrooms, and ranging in size from
1,100 to 1,600 sq. ft.
III. DISCUSSION:
A. The major issue concerning the original plan and map was
whether enough area had been provided to accommodate the
necessary perimeter treatment (wind/blowsand protection, and
Portola Avenue parkway/easement) in relation to the
proposed lots and unit locations.
With certain detail adjustments, the revised site plan
would appear to provide for a minimum wind/blowsand design
situation. A 20' pedestrian access easement has also
now been illustrated on Portola Avenue. Special Conditions
address these two subjects.
B. Site Access - Two entrances are proposed to the project
(serving the northern and southern half) , one from Hovley
Lane and the other off Portola Avenue.
C. Site Design = The proposed duplex buildings are arranged
around two court areas; 10 dwellings in the northern court,
and 12 dwellings in the southern court. The total of
number of minimum required guest parking bays has been
illustrated on the Development Plan.
D. Recreational Amenities - The amenities provided appear

acceptable for the scale of the project.
E. Architectural Approach - An illustration has been provided
of a view into the project but it is highly conceptual .
F. Tract Map Considerations - The filing of a Tract Map is
considered premature until the conceptual plan require-
ments are established, and then, the Design Review process
is completed. The subject map should be revised to reflect
Development Plan considerations and ultimately any Design
Review actions if it is to be approved.

PLAN OBJECTIVE AND DESCRIPTION
The primary objective for this project is to
create a private community offering a comfortable living
environment centered around recreational amenitites ass-
ociated with desert living and the desert climate .
The plan reflects this objective with the ten-
nis court and swimming pool area placed in a central lo-
cation offering ease in pedestrian access for residents .
Additionally, the residential units are clustered around
two separate courtyards providing a private atmosphere
and enhancing the aesthetic appeal of the units themselves .
The overall aesthetices of the project are even further
enhanced by the enriched paving of the courtyards and the
generous use of trees and vegetation .
Phasing
Due to the project 's small size (4 . 75 acres)

Standard Conditions :
1. The development of the property shall conform substantially with
Exhibit A (Case No. DP 11-79) on file with the Department of En-
vironmental Services , as modified by the following conditions .
2. Prior to the issuance of a building permit for construction of
any uses contemplated by this approval , the applicant shall first
complete all the procedural requirements of the City which
include, but are' not limited to, Design Review, Subdivision pro-
cess , and building permit procedures .
3.. Construction of the total development may be done in phases ; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as as single project.
4 . Construction of a portion of said project shall commence within
one year from the date of final approval otherwise said approval
shall become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing
to these Conditions of Approval.
6. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addixions to all municipal ordinances and State and Federal Statutes
nowjin force, or which hereafter may be in force.
C 7. All existing electrical distribution lines , telephone, cable an-
tenna television, and similar service wires or cables , which are
adjacent to the property being developed shall be installed under-
ground as a part of development from the nearest existing pole

8. All requirements of the City Fire Marshal shall be met as Dart of
the development of this project per attached letter dated August 16,
1979 .
9. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All conditions
shall be made a part of construction and no certificate of occu-
pancy shall be issued until completed.
10 . Traffic control provisions shall be provided as required by the
Director of Public Works .
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public Works .
12 . Prior to issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first ob-
tain permits and/or clearance from the following agencies :

Evidence of said permit or clearance from the above agencies

outlet for a total of $40. 00 for two outlets. This would
represent an increase of 100%. Another area of clarifica-
tion should be in the commercial connection charges where
presently the cost is $15. 00 per outlet and the proposed f1i
increase would be $25 . 00 , a 66% increase .
Mayor Mullins declared the Public Hearing open and invited input
in FAVOR of the request .
MR. JOE BENES, Manager of Coachella Valley Television,
addressed Council introducing two associates , Mr . Wayne
Blick, Vice President of Palmer Broadcasting , and Mr .
Bob Englehart , Vice President in Charge of Engineering.
Mr. Benes stated that they were seeking the first rate
increase in over 15 years of operation. He reviewed
their operating costs , stating that in order to provide
better service to an ever-growing area, it was most
necessary to increase the cost of the service. He
presented a "Clarifications of Proposed Rate Schedule"
(attached and made a part of these minutes as Exhibit "A")
which answered Mr. Ortega' s concerns .
Mr. Benes addressed the problem relative to service by
his company and stated that he felt that since they now
had qualified personnel , service would not be a problem.
However, it had been difficult and had taken time to
employ people qualified to perform in this particular
business . He emphasized that they had a 24-hour
trouble-shooter line where people could call in to
report problems and this line would be kept in' operation.
Mayor Mullins invited input in OPPOSITION to the rate increase ,
and none was offered. He declared the Public Hearing closed.
Councilman Brush stated that he had had a change of
feeling on this matter since its original discussion.
He had felt that any company that had a monopoly on
business should be treated like a public utility and
open their books and explain those increases . However ,
after looking into it , there may be other things that
could come in that could. make a company like this
obsolete.
Councilman McPherson moved and Councilman Brush seconded to
accept the new Rate Schedule as submitted by Coachella Valley Tele-
vision, to be effective January 1 , 1980 . Motion carried unanimously.

Mr. Williams presented the Staff Report stating that
this was a request for a 26 lot subdivision that would
include 22 condominium units with the remainder Open
Space. The development would be located on the southwest
corner of Hovely Lane and Portola. He reviewed the actual
development Plan and stated that the Planning Commission,
because of a concern that an undivided interest in the
common use lots may not be transferred to each purchaser,

Mayor Mullins declared the Public Hearing open and invited input
in FAVOR of the request . None was offered. He invited input in
OPPOSITION to the request , and none was offered. He declared the
Public Hearing closed.
Councilman McPherson moved and Councilman "Brush seconded to
waive further reading and adopt Resolution No . 79-134.
Councilman Wilson asked where the City stood with respect
to the North Sphere Master Drainage Plan. Mr. Williams
responded that Staff needed to meet with the City Attorney
about it and that it should be brought to the Council by
next month.
Councilman Wilson stated his concern that more and more
projects are being approved in that area, and he would
like to see the Plan and the fee structure in effect before
the area is built out . Mr. Williams responded that any
map submitted before consideration of the Plan would be
exempt from the provisions of the Plan.
Mayor Mullins called for the vote, and the motion carried on a
3-2 vote with Councilmen Newbrander and Wilson voting NO .

FURTHER, BE IT RESOLVED that the conditions of approval do include

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 14998
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions of
all municipal ordinances and State and Federal statutes now in force,
or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as required
by Ordinance and the City Engineer shall be installed in accordance
with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final
street name shall be made by the Director of Environmental Services.
4. Access rights to Hovley Lane and Portola Avenue, (except for one
approved entrance to each street) shall be offered to the City as a
dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the Director
of Environmental Services for review and final approval by the City
Attorney prior to the issuance of any building permits. Prior to record-
ation of the final subdivision map, the applicant shall submit to the
City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded. (Which have been

C. Management and maintenance agreement to be entered into with

10. Complete plans and. specifications shall be submitted as required by ._
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision improve-
ments by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
- 12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
16, 1979 shall be met as a part of the development of this tract.

16. All private streets shall be inspected by the Engineering
Department and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the

18. The total number of lots shall be limited to 22 for condo-
minium unit use, and other lots for common purposes as deemed
necessary.
19. The applicant shall have twelve (12) months from the date of
the approval or conditional approval of the tentative map for

Gentlemen:
Prior to construction of any of the proposed buildings, the following conditions must
be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the

Request for approval of a preliminary Development Plan

within the PR-5 (Planned Residential , 4 d.u./ac. ) zone
located at the southwest corner of Hovley Lane and
Portola Avenue.
Mr. Crump presented this case noting that this case was a
continued item and updated staff reports were provided for the Commission.
He stated that the revision was to increase the number of lots. He also
noted that Staff revised Special Condition No. 7, to read: "The map shall
provide for 50% of the net site area (approx. 1.96 acres) to be held in
common for open space purposes, this may be accomplished by means of an
easement."
Commissioner Kryder was concerned for the access on to Hovley
Lane asking if this would be safe.
Mr. Crump explained how the access would be developed.
Commissioner Kryder then asked if the access on Portola was
necessary. He believed this would create a traffic hazard.
After a short discussion on this matter Mr. Williams stated that
this opening would represent 3 permanent openings between Hovley Lane and
the Wash.
Chairman Snyder expressed a great concern for the number of lots,
and asked why the open space and recreation amenities were divided up into
individual lots.
RAY HOWARD, Ballew-McFarland, stated that this was done by the
engineering firm and was unaware of why they did it that way.
Commissioner Berkey asked if the City Attorney would review the
C.C. & R. 's . It was agreed that in Standard Condition No. 5 of the
Tentative Tract Map, to add "d", stating: "Lots indicated as common shall
be retained in undivided interest granted to each homeowner. "
Commissioner Berkey pointed out that in Standard Condition No. 3
of the Conditions of Approval should be changed. This was modified to
read: "Construction of the total development shall be done in one (1)
phase. "
Chairman Snyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none, the
Public Hearing was closed.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Kryder, Case Nos. DP 11-79 and TT 14998 were approved by adopting Resolution
Nos. 537 and 538, as modified. Carried unanimously; (3-0) .

As reflected in the Planning Commission minutes , a Development Plan allowing 22
units was also approved by the Commission.
While there was no audience participation, the Commission did modify one stand-
ard condition. Because of a concern that an undivided interest in the common
use lots may not be transferred to each purchaser, the Commission added "d" to
Standard Condition No. 5, as follows, "Lots indicated as common shall be retained
in undivided interest granted to each homeowner. "
After a short discussion regarding access to Portola Avenue, the Commission
unanimously approved this request for a Tentative Tract Map.

noted that Staff revised Special Condition No. 7, to read: "The map shall
provide for 50% of the net site area (approx. 1.96 acres) to be held in
common for open space purposes, this may be accomplished by means of an
easement. "
Commissioner Kryder was concerned for the access on to Hovley
Lane asking if this would be safe.
Mr. Crump explained how the access would be developed.
Commissioner Kryder then asked if the access on Portola was
necessary. He believed this would create a traffic hazard.
After a short discussion on this matter Mr. Williams stated that
this opening would represent 3 permanent openings between Hovley Lane and
the Wash.
Chairman Snyder expressed a great concern for the number of lots,
and asked why the open space and recreation amenities were divided up into
individual . lots.
RAY HOWARD, Ballew-McFarland, stated that this was done by the
engineering firm and was unaware of why they did it that way.
Commissioner Berkey asked if the City Attorney would review the
C.C. & R. 's . It was agreed that in Standard Condition No. 5 of the
Tentative Tract Map, to add "d", stating: "Lots indicated as common shall
be retained in undivided interest granted to each homeowner. "
Commissioner Berkey pointed out that in Standard Condition No. 3
of the Conditions of Approval should be changed. This was modified to
read: - "Construction of the total development shall be done in one (1)
phase. "
Chairman Snyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none, the
Public Hearing was closed.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Kryder, Case Nos. DP 11-79 and TT 14998 were approved by adopting Resolution
Nos. 537 and 538, as modified. Carried unanimously; (3-0).

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 4th day of September, 1979, hold a duly noticed
Public Hearing ; and, continued Public Hearings on September 19, October
2, and October 17, 1979, to consider the request of T & D CALIFORNIA
INVESTMENTS for approval of a Tentative Tract Map to create a 26 lot

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 14998
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions of
all municipal ordinances and State and Federal statutes now in force,
or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as required
by Ordinance and the City Engineer shall be installed in accordance
with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final
street name shall be made by the Director of Environmental Services.
4. Access rights to Hovley Lane and Portola Avenue, (except for one
approved entrance to each street) shall be offered to the City as a
dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the Director
of Environmental Services for review and final approval by the City
Attorney prior to the issuance of any building permits. Prior to record-
ation of the final subdivision map, the applicant shall submit to the
City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded. (Which have been
approved)
c. Management and maintenance agreement to be entered into with
the owners of the units of the project. (Which has been
approved)

6. Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having

granted to the City of Palm Desert, without cost to the City and free
of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision improve-
ments by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
16, 1979 shall be met as a part of the development of this tract.

14. The water system shall be signed by a registered civil engineer
and approved by the water company, with the following certifi-
cation: "I certify that the design of the water system of Tract

15. Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.

16. All private streets shall be inspected by the Engineering
Department and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the
Development Plan 11-79 shall be met as a part of the de-
velopment of this tract.
18. The total number of lots shall be limited to 22 for condo-
minium unit use, and other lots for common purposes as deemed
necessary.
19. The applicant shall have twelve (12) months from the date of
the approval or conditional approval of the tentative map for
filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City
Council .
20. Drainage and Signalization Fund contributions as required by
City Ordinance shall be made prior to recordation of the Final
Map.
21. Developer shall pay in-lieu fees for Park and Recreation purposes
Q to comply with the requirements of Article 26.48 of the City of
Palm Desert Subdivision Ordinance.
SPECIAL CONDITIONS:
1. Provide installation of adjacent Right-of-way design as follows:
Hovley Lane - dedication and improvement of 44 ft. half
street. Half street section to contain 32 ft. wide travel
lane, and 12 ft. public parkway (no sidewalk) , with
ornamental landscaping.
Portola Avenue - dedicate and improve 50 ft. half street.
Street section to contain ultimate 6 ft. (one-half of 12
ft. ) raised center median, 32 ft. wide travel lane, and
12 ft. public parkway and 20 ft. public access easement
adjacent to parkway. Easement and parkway to be improved
with and 8 ft. wide meandering pedestrian/bike path, orna-
mental landscaping.
" 2. The grade of Hovley Lane shall be re-established as directed
and approved by the Director of Public Works. All improvement
plans shall be based on that new grade.
3. Safety street lighting shall be installed at each tract entrance
on Hovley Lane and Portola Avenue.
4. If tract entrances are to be secured, provide capacity for
the stacking of four vehicles onsite.

7. The map shall provide for 50% of the net site area (approx.
1.96 acres) to be held in common for open space purposes,
this may be accomplished by means of an easement.
8. A final,_ map shall not be accepted for filing until the
Design Review process has been completed; the map shall
be adjusted to correspond to that approval and submitted

Gentlemen:
Prior to construction of any of the proposed buildings , the following conditions must
be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2.- Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 11-79 is in accordance with the require-
ments prescribed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.

containing two bedrooms, and ranging in size from
1,100 to 1,600 sq. ft.
III. DISCUSSION:
A. The major issue concerning the original plan and map was
whether enough area had been provided to accommodate the
necessary perimeter treatment . (wind/blowsand protection, and
Portola Avenue parkway/easement) in relation to the
proposed lots and unit locations.
With certain detail adjustments, the revised site plan
would appear to provide for a minimum wind/blowsand design
situation. A 20' pedestrian access easement has also
now been illustrated on Portola Avenue. Special Conditions
address these two subjects.
B. Site Access - Two entrances are proposed to the project
(serving the northern and southern half) , one from Hovley
Lane and the other off Portola Avenue.
C. Site Design = The proposed duplex buildings are arranged
around two court areas; 10 dwellings in the northern court,
and 12 dwellings in the southern court. The total of
number of minimum required guest parking bays has been
illustrated on the Development Plan.
D. Recreational Amenities - The amenities provided appear
acceptable for the scale of the project.
E. Architectural Approach - An illustration has been provided
of a view into the project but it is highly conceptual .
F. Tract Map Considerations - The filing of a Tract Map is
considered premature until the conceptual plan require-
ments are established, and then, the Design Review process
is completed. The subject map should be revised to reflect
Development Plan considerations and ultimately any Design
Review actions if it is to be approved.

PLAN OBJECTIVE AND DESCRIPTION
The primary objective for this project is to
create. a private community offering a comfortable living
environment centered around recreational amenitites ass-
ociated with desert living and the desert climate .
The plan reflects this objective with the ten-
nis court and swimming pool area placed in a central lo-
cation offering ease in pedestrian access for residents .
Additionally, the residential units are clustered around
two separate courtyards providing a private atmosphere
and enhancing the aesthetic appeal of the units themselves .
The overall aesthetices of the project are even further

shall become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing
to these Conditions of Approval.
6 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
additions to all municipal ordinances and State and Federal Statutes
now in force , or which hereafter may be in force .
L. 7. All existing electrical distribution lines , telephone , cable an-
tenna television, and similar service wires or cables , which are
adjacent to the property being developed shall be installed under-
ground as a part of development from the nearest existing pole
not on the property being developed.
S. All requirements of the City Fire Marshal shall be met as Dart of
the development of this project per attached letter dated August 16,
1979 .
9 , Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All conditions
shall be made a part of construction and no certificate of occu-
pancy shall be issued until completed.
10 . Traffic control provisions shall be provided as required by the
Director of Public Works .
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public Works .
12 . Prior to issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first ob-
tain permits and/or clearance from the following agencies :

Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies
shall be presented to the Deot. of Building and Safety at the
time of issuance of a building permit for the use contemplated

SPECIAL CONDITIONS:

Commission for confirmation of Board action.
2. Revise perimeter design as follows:
a. Hovley Lane - delete sidewalk, and install ornamental landscaping in

III. DISCUSSION:
A. The major issue concerning the original plan and map was
whether enough area had been provided to accommodate the
necessary perimeter treatment . (wind/blowsand protection, and
Portola Avenue parkway/easement) in relation to the
proposed lots and unit locations.
With certain. detail adjustments, the revised site plan
would appear to provide for a minimum wind/blowsand design
situation. A 20' pedestrian access easement has also
now been illustrated on Portola Avenue. Special Conditions
address these two subjects.
B. Site Access - Two entrances are proposed to the project
(serving the northern and southern half) , one from Hovl.ey
Lane and the other off Portola Avenue.
C. Site Design = The proposed duplex buildings are arranged
around two court areas; 10 dwellings in the northern court,
and 12 dwellings in the southern court. The total of
number of minimum required guest parking bays has been
illustrated on the Development Plan.
D. Recreational Amenities - The amenities provided appear
acceptable for the scale of the project.
E. Architectural Approach - An illustration has been provided
of a view into the project but it is highly conceptual .
F. Tract Map Considerations - The filing of a Tract Map is.
considered premature until the conceptual plan require-
ments are established, and then, the Design Review process
is completed. The subject map should be revised to reflect
Development Plan considerations and ultimately any Design
Review actions if it is to be approved.

PLAN OBJECTIVE AND DESCRIPTION
The primary objective for this project is to
create a private community offering a comfortable living
environment centered around recreational amenitites ass-
ociated with desert living and the desert climate.
The plan reflects this objective with the ten-
nis court and swimming pool area placed in a central lo-
cation offering ease in pedestrian access for residents.
Additionally, the residential units are clustered around
two separate courtyards providing a private atmosphere
and enhancing the aesthetic appeal of the units themselves .
The overall aesthetices of the project are even further
enhanced by the enriched paving of the courtyards and the
generous use of trees and vegetation.
Phasing
Due to the project' s small size (4.75 acres)
construction will occur in a single phase with the start-
ing date scheduled for March, 1980.

Commissioner Fleshman :expressed a concern for the required trash bin
location, which was pointed out by Mr. Crump. He also asked if there
was a door opening on the south side and would they be allowed a sign
facing El Paseo?
Mr. Crump responded indicating they have an adopted Sign Program for
that building and this use was eligible for sign on the street frontage.
Upon motion made by Commissioner Miller, seconded by Commissioner
Kryder, Planning Commission Resolution No. 532 was adopted. approving

CONDITIONS OF APPROVAL

Standard Conditions :
1. The development of the property shall conform substantially with Exhibit A
(Case No. DP 11-79) on file with the Department of Environmental Services,
as modified by the following conditions .
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval , the applicant shall first complete all the
procedural requirements of the City which include, but are not limited to,
Design Review, Subdivision process, and building permit procedures.
3. Construction of the total development shall be done in one phase.
4. Construction of a portion of said project shall commence within one year
from the date of final approval otherwise said approval shall become null ,
void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of construc-
tion on said project. the applicant shall agree in writing to these
Conditions of Approval .
6. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and State and Federal statutes now in force, or
which hereafter may be in force.
7. All existing electrical distribution lines , telephone, cable antenna
television, and similar service wires or cables, which are adjacent to
the property being developed shall be installed underground as a part of
development from the nearest existing pole not on the property being
developed.
8. All requirements of the City Fire. Marshal shall be met as part of the
development of this project per attached letter dated August, 16, 1979.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits . All conditions shall be
made a part of construction and no certificate of occupancy shall be_
issued until complete.
10. Traffic control provisions shall be provided as required by the Director
of Public Works .
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works .
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies :
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of issu-
ance of a building permit for the use contemplated herewith.
13. No development shall occur on the subject property prior to the recorda-
tion of a tract map.

a. Hovley Lane - delete sidewalk, and install ornamental landscaping in
the 12 foot parkway. Provide minimum 6 foot high solid masonry wall
at property line. Install a solid tree screen with lower bushes on
the inside of the wall .

California, did on the 4th day of September, 1979, hold a duly noticed
Public Hearing ; and, continued Public Hearings on September 19, October

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 14998
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions of
all municipal ordinances and State and Federal statutes now in force,
or which hereafter may be in force.
-- 2. Full public improvements including traffic safety lighting as required
by Ordinance and the City Engineer shall be installed in accordance
with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final
street name shall be made by the Director of Environmental Services.
4. Access rights to Hovley Lane and Portola Avenue, (except for one
approved entrance to each street) shall be offered to the City as a
dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the Director
of Environmental Services for review and final approval by the City
Attorney prior to the issuance of any building permits. Prior to record-
ation of the final subdivision map, the applicant shall submit to the
City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded. (Which have been
approved)
C. Management and maintenance agreement to be entered into with
the owners of the units of the project. (Which has been
approved)
d. Lots indicated as common shall be retained in undivided
interest granted to each homeowner.
6. Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free
of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision improve-
ments by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
16, 1979 shall be met as a part of the development of this tract.

14. The water system shall be signed by a registered civil engineer
and approved by the water company, with the following certifi-
cation: "I certify that the design of the water system of Tract
No. 14998 is in accordance with the requirements prescribed by

15. Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering
Department and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the
Development Plan 11-79 shall be met as a part of the de-
velopment of this tract.
18. The total number of lots shall be limited to 22 for condo-
minium unit use, and other lots for common purposes as deemed
necessary.
19. The applicant shall have twelve (12) months from the date of
the approval or conditional approval of the tentative map for
filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City
Council .
20. Drainage and Signalization Fund contributions as required by
City Ordinance shall be made prior to recordation of the Final
Map.
21. Developer shall pay in-lieu fees for Park and Recreation purposes
to comply with the requirements of Article 26.48 of the City of
Palm Desert Subdivision Ordinance.
SPECIAL CONDITIONS:
1. Provide installation of adjacent Right-of-way design as follows:
Hovley Lane - dedication and improvement of 44 ft. half
street. Half street section to contain 32 ft. wide travel
lane, and 12 ft. public parkway (no sidewalk) , with
ornamental landscaping.
Portola Avenue - dedicate and improve 50 ft. half street.
Street section to contain ultimate 6 ft. (one-half of 12
ft. ) raised center median, 32 ft. wide travel lane, and
12 ft. public parkway and 20 ft. public access easement
adjacent to parkway. Easement and parkway to be improved
with and 8 ft. wide meandering pedestrian/bike path, orna-
mental landscaping.
2. The grade of Hovley Lane shall be re-established as directed
and approved by the Director of Public Works. All improvement
plans shall be based on that new grade.
3. Safety street lighting shall be installed at each tract entrance
on Hovley Lane and Portola Avenue.
4. If tract entrances are to be secured, provide capacity for
the stacking of four vehicles onsite.

5. Provide minimum 6 ft. high solid masonary wall around
tract (except for approved openings) , as approved through

6. Subdivider shall contribute,$1,100 into the Signalization
Fund, and $1,500 per gross acre into the Drainage Fund of
the City of Palm Desert.
7. The map shall provide for 50% of the net site area (approx.
1.96 acres) to be held in common for open space purposes,
this may be accomplished by means of an easement.
8. A final map shall not be accepted for filing until the
Design Review process has been completed; the map shall
be adjusted to correspond to that approval and submitted
to the Director of Environmental Services for a deter-
mination of compliance.

Gentlemen:
Prior to construction of any of the proposed buildings , the following conditions must
be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of. the water system in Case Number DP 11-79 is in accordance with the require-

2 single story units in 11 duples buildings; each
containing two bedrooms, and ranging in size from
1,100 to 1,600 sq. ft.
III. DISCUSSION:
A. The major issue concerning the original plan and map was
whether enough area had been provided to accommodate the
necessary perimeter treatment . (wind/blowsand protection, and
Portola Avenue parkway/easement) in relation to the
proposed lots and unit locations.
With certain detail adjustments, the revised site plan
would appear to provide for a minimum wind/blowsand design
situation. A 20' pedestrian access easement has also
now been illustrated on Portola Avenue. Special Conditions
address these two subjects.
B. Site Access - Two entrances are proposed to the project
(serving the northern and southern half) , one from Hovl.ey
Lane and the other off Portola Avenue.
C. Site Design = The proposed duplex buildings are arranged
around two court areas; 10 dwellings in the northern court,
and 12 dwellings in the southern court. The total of
number of minimum required guest parking bays has been
illustrated on the Development Plan.
D. Recreational Amenities - The amenities provided appear
acceptable for the scale of the project.
E. Architectural Approach - An illustration has been provided
of a view into the project but it is highly conceptual .
F. Tract Map Considerations - The filing of a Tract Map is
considered premature until the conceptual plan require-
ments are established, and then, the Design Review process
is completed. The subject map should be revised to reflect
Development Plan considerations and ultimately any Design
Review actions if it is to be approved.

PLAN OBJECTIVE AND DESCRIPTION
The primary objective for this project is to .
create a private community offering a comfortable living
environment centered around recreational amenitites ass-
ociated with desert living and the desert climate .
The plan reflects this objective with the ten-
nis court and swimming pool area placed in a central lo-
cation offering ease in pedestrian access for residents .
Additionally, the residential units are clustered around
two separate courtyards providing a private atmosphere

California, did on the 4th day of September, 1979, hold a duly noticed
Public Hearing ; and, continued Public Hearings on September 19, October
2, and October 17, 1979, to consider the request of T & D CALIFORNIA
INVESTMENTS for approval of a Tentative Tract Map to create a 26 lot
subdivision for condominium purposes on approximately 4.75 acres within

all testimony and arguments, if any, of all persons desiring to be heard,
said Planning Commission did find the following facts and reasons to exist
to recommend approval of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply
with Chapter 26 of the City of Palm Desert Municipal
Code, and the State of California Subdivision Map Act,
as amended.
2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of de-
velopment proposed.
4. The design of the subdivision and the proposed improve-
ments are not likely to cause substantial environmental
damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2. That it does hereby recommend conditional approval to
the City Council of the City of Palm Desert of the above
described Tentative Map No. 14998 for the reasons set
forth in this Resolution and subject to the attached

FURTHER, BE IT RESOLVED that the recommended conditions of
approval do include a requirement that the applicant pay in-lieu fees
to comply with the requirements of Article 26.48 of the City of Palm
Desert Subdivision Ordinance. In return, it is recommended that the
City Council agree to use said fees for park purposes in conformance
with an adopted master plan, within five (5) years of the recordation

1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide
the Department of Environmental Services with a list of proposed
street names with at least three alternatives. The approval of
the final street name shall be made by the Director of Environmental
Services.
4. Access rights to Hovley Lane and Portola Avenue, (except for one
approved entrance to each street) shall be offered to the City as
a dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the Director
of Environmental Services for review and final approval by the City
Attorney prior to the issuance of any building permits. Prior to record-
ation of the final subdivision map, the applicant shall submit to the
City Engineer:
a. The document to convey title.
b.. Covenants and restrictions to be recorded (Which have been..approved)
C. Management and maintenance agreement to be entered into
with the owners of the units of the project. (Which has been
approved)
6. Improvement plans for water and sewer systems shall meet the re-
quirements of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before con-
struction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision
improvements by the City.
11. In order to maintain reasonable fire protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings . An adequate number of fire hydrants with
required fire flows shall be installed as recommended by the Fire
Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
16 , 1979 shall be met as a part of the development of this tract.

14. The water system shall be signed by a registered civil engineer
and approved by the water company, with the following certifi-
cation: "I certify that the design of the water system of Tract
No. 14998 is in accordance with the requirements prescribed by

_ 15. Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering
Department and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the
Development Plan 11-79 shall be met as a part of the de-
velopment of this tract.
18. The total number of lots shall be limited to 22 for condo-
minium unit use, and other lots for common purposes as deemed
necessary.
19. The applicant shall have twelve (12) months from the date of
the approval or conditional approval of the tentative map for
filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City
Council .
20. Drainage and Signalization Fund contributions as required by
City Ordinance shall be made prior to recordation of the Final
Map.
21. Developer shall pay in-lieu fees for Park and Recreation purposes
to comply with the requirements of Article 26.48 of the City of
Palm Desert Subdivision Ordinance.
SPECIAL CONDITIONS:
1. Provide installation of adjacent Right-of-way design as follows:
Hovley Lane - dedication and improvement of 44 ft. half
street. Half street section to contain 32 ft. wide travel
lane, and 12 ft. public parkway (no sidewalk) , with
ornamental landscaping.
Portola Avenue - dedicate and improve 50 ft. half street.
Street section to contain ultimate 6 ft. (one-half of 12
ft. ) raised center median, 32 ft. wide travel lane, and
12 ft. public parkway and 20 ft. public access easement
adjacent to parkway. Easement and parkway to be improved
with and 8 ft. wide meandaring pedestrian/bike path, orna-
mental landscaping.
2. The grade of Hovley Lane shall be re-established as directed
and approved by the Director of Public Works. All improvement
plans shall be based on that new grade.
3. Safety street lighting shall be installed at each tract entrance
on Hovley Lane and Portola Avenue.
4. If tract entrances are to be secured, provide capacity for
the stacking of four vehicles onsite.

Gentlemen:
Prior to construction of any of the proposed buildings , the following conditions must
be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation •shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 11-79 is in accordance with the require-
ments prescribed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.

and McFarland, Planners of the project, requested that under
Special Condition #2 , the figure be changed to a 10 ft. emer-
gency access only.
Chairman Snyder questioned Mr. Williams as to any objection
to this change? Mr. Williams suggested that a compromise be
made of 12 ft. This would also change Special Condition #6
on the Tract Map.
There were no questions from the Commission at this time,
therefore, Chairman Snyder asked if anyone present wished to
speak in FAVOR or OPPOSITION to the request. There being
none, Chairman Snyder closed the public hearing.
Upon motion made by Commissioner Berkey, seconded by Chairman
Snyder, Planning Commission Resolution No. 523 and No. 524
was adopted with the changes as previously mentioned. Car-
ried. 2-0-2-1. Commissioner Fleshman abstained.

Mr. Williams presented this case reminding the Commission
that this is a parcel that they previously considered for a
change of zone to PR-3 and a condominium development. He
stated that this has been refiled because of redesign. The
Staff feels that other than a few suggestions for improvement,
that overall this project is quite commendable. Suggestion
was made that the number of pools be increased to a ratio of
1 per every 35 units. Suggestion was also made that maybe
the location of the maintenance facility be reviewed, that
there may be a better location. He stated that the Fire
Marshal was very concerned about the long cul-de-sac . He sug-
gested in his memorandum that it be extended to make a loop
across the golf course. As an alternative , he was agreeable

The Director of Environmental Services has determined that
the proposed project will not have a significant adverse
impact on the environment and a Negative Declaration has
been prepared.
D. MAJOR TRACT IMPROVEMENTS: (Requirements)
Adjacent half street improvements as follows:
Hovley Lane - dedication and improvement of 44 ft. half
street, with 32 ft. wide travel lane, and 12 ft. parkway
(no sidewalk) , ornamental landscaping and boundary wall .
Hovley Lane is to be regraded, per the requirements of
the Director of Public Works.
Portola Avenue - dedication and improvement of 50 ft.
half street, with *6 ft. (one half of 12 ft. ) raised
median (ultimate) , 32 ft. wide travel lane, 12 ft.

to parkway improved with 8 ft. wide meandaring pedestrian/

K. UNIT DESCRIPTION:
22 single story units in 11 duplex buildings; each
containing two bedrooms, and ranging in size from
1,100 to 1,600 sq. ft.
III. DISCUSSION:
A. The major issue concerning the proposed plan and map is
having enough area to accommodate the necessary perimeter
treatment (wind/blowsand protection, and Portola Avenue
parkway/easement) along with the proposed lots and units.
1. Wind/Blowsand Protection Planting - an
acceptable alternative had not been sub-
mitted by the applicant to justify the
proposed setback from the west property
line. It has, therefore, not been de-
termined whether an adequate area is
provided. In any event, the protection
planting area should be under common
ownership, rather than a part of a private
lot. In this regard, it is observed that
several proposed lots encroach into what
would be the protection planting area on
the north and west boundaries.
2. Portola Avenue Design - The design approach
for Portola Avenue includes an 8 ft. wide
meandaring pedestrian/bike path along the
west side of the Avenue. To accomplish
this, a 20 ft. wide easement is required
adjacent to the public parkway. Proposed
private lots (and possibly corners of dwelling
unit patios) extend into this area.
B. Site Access - Two entrances are proposed to the project (serving
the northern and southern half) , one from Hovley Lane and the
other off Portola Avenue.
C. Site Design - The proposed duplex buildings are arranged
around two court areas; 10 dwellings in the northern court,
and 12 dwellings in the southern court. The total of
number of minimum required guest parking bays has been
. illustrated on the Development Plan, but they are not
proportionally distributed,and open 20 ft. driveway
apron space has not been provided for each unit as an
alternative.
D. Recreational. Amenities - The amenities provided appear
acceptable for the scale of the project.
E. Architectural Approach - An illustration has been provided
of a view into the project but it is highly conceptual .
F. Tract Map Considerations - While the filing of a Tract Map
can not be precluded, it is considered premature until (in
this specific instance) the conceptual plan requirements are
established, and then, the Design Review process is completed.
The subject map should be revised to reflect Development Plan
considerations and ultimately any Design Review actions if it
is to be approved.

IV. STAFF RECOMMENDATIONS:
Realizing that there could be minor, and also major, adjustments
to the Development Plan and Tract Map, several options appear
available for Planning Commission action:
A. With the concurrence of the applicant, continue both
applications to a specified meeting to allow: (a) the
exhibits to be redrawn; and (b) an alternative scheme
for wind/blowsand protection to be ,brought before the
Design Review Board.
B. Approve a preliminary Development Plan for 22 dwelling
units, forwarding it to the Design Review stage to re-
solve the outstanding issues; and, deny the Tract Map.
.C. Approve both applications, with appropriate conditions,
directing a .redrafting of exhibits to correspond to the
Design Review action.

PLAN OBJECTIVE AND DESCRIPTION
The primary objective for this project is to
create a private community offering a comfortable living
environment centered around recreational amenitites ass-
ociated with desert living and the desert climate .
The plan reflects this objective with the ten-
nis court and swimming pool area placed in a central lo-
cation offering ease in pedestrian access for residents :
Additionally, the residential units are clustered around
two separate courtyards. providing a private atmosphere .
and enhancing the aesthetic appeal of the units themselves .
The overall aesthetices of the project are even further
enhanced by the enriched paving of the courtyards and the
generous use of trees and vegetation.
Phasing
Due to the project 's small size (4.75 acres)
construction will occur in a single phase with the start-
ing date scheduled for March, 1980.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 4th day of September, 1979, hold a duly noticed
Public Hearing to consider a request by T & D CALIFORNIA INVESTMENTS
for approval of a preliminary Development Plan to allow construction
of 22 Residential condominium units, on approximately 4.75 acres within
the PR-5 (Planned Residential , max. 5 d.u./ac. ) zone located on the
southwest corner of Hovley Lane and Portola Avenue, more particularly
described as:

of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32" , in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the environ-

WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
to be heard, said Planning Commission did find the following facts to
justify their actions, as described below:
a. The proposed project generally conforms to the
intent and purpose of the PR Zone District.
b. The proposed project is adequately suited for
the specific site and is compatible with existing
and proposed development in the area.
c. The proposed project will not be detrimental to
the health, safety and general welfare of the
community.

Standard Conditions:
1. The development of the property shall conform substantially with
Exhibit A (Case No. DP 11-79) on file with the Department of En-
vironmental Services , as modified by the following conditions .
2. Prior to the issuance of a building permit for construction of
any uses contemplated by this approval , the applicant shall first
complete all the procedural requirements of the City which
include, but are not limited to, Design Review, Subdivision pro-
cess , and building permit procedures .
3- Construction of the total -development may be done in phases ; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as as single project.
4 . Construction of a portion of said project shall commence within
one year from the date of final approval otherwise said approval
shall become null , void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing
to these Conditions of Approval.
6 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
additions to all municipal ordinances and State and Federal Statutes
now in force, or which hereafter may be in force.
7. All existing electrical distribution lines , telephone , cable an-
tenna television, and similar service wires or cables , which are
adjacent to the property being. developed shall be installed under-
ground as a part of development from the nearest existing pole
not on the property being developed.
8. All requirements of the City Fire Marshal shall be met as part of
the development of this project per attached letter dated August 16,
1979.
9. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All conditions
shall be made a part of construction and no certificate of occu-
pancy shall be issued until completed.
10 . Traffic control provisions shall be provided as required by the
Director of Public Works .
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public Works .
12. Prior to issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first ob-
tain permits and/or clearance from the following agencies :
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies
shall be presented to the Dept. of .Building and Safety at the
time of issuance of a building permit for the use contemplated
herewith.

13 . No development shall occur on the subject property prior to the
recordation of a tract map.
SPECIAL CONDITIONS:
1. Provide wind/blowsand protection along the north and west boundaries, as

to correspond to Board action, prior to it being forwarded to the Planning
Commission for confirmation of Board action.
2. Recess tennis court to a depth to be determined in the Design Review process.

I accept and agree, prior to use of this permit or approval , to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow occu-
pancy on the use permitted until this signed confirmation has been re-

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 14998
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide
the Department of Environmental Services with a list of proposed
street names with at least three alternatives. The approval of
the final street name shall be made by the Director of Environmental
Services.
4. Access rights to Hovley Lane and Portola Avenue, (except for one
approved entrance to each street) shall be offered to the City as
a dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the City
Engineer for review and approval prior to the issuance of any building
permits. Prior to recordation of the final subdivision map, the
applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project.
l6. Improvement plans for water and sewer systems shall meet the re-
quirements of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before con-
struction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision
improvements by the City.
11. In order to maintain reasonable fire protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings. An adequate number of fire hydrants with
lrequired fire flows shall be installed as recommended by the Fire
JMarshal .
12. Prior to recordation of the Final Map, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
16 , 1979 shall be met as a part of the development of this tract.

14. The water system shall be signed by a registered civil engineer
and approved by the water company, with the following certifi-
cation: "I certify that the design of the water system of Tract
No. 14998 is in accordance with the requirements prescribed by
the City Fire Marshal . "
15. Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering
Department and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the
Development Plan 11-79 shall be met as a part of the de-
velopment of this tract.
18. The total number of lots shall be limited to 22 for condo-
minium unit use, and other lots for common purposes as deemed
necessary.
19. The applicant shall have twelve (12) months from the date of
the approval or conditional approval of the tentative map for
filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City
Council .
20. Drainage and Signalization Fund contributions as required by
City Ordinance shall be made prior to recordation of the Final
Map.
21. Developer shall pay in-lieu fees for Park and Recreation purposes
to comply with the requirements of Article 26.48 of the City of
Palm Desert Subdivision Ordinance.
SPECIAL CONDITIONS:
1. Provide installation of adjacent Right-of-way design as follows:
Hovley Lane - dedication and improvement of 44 ft. half
street. Half street section to contain 32 ft. wide travel
lane, and 12 ft. public parkway (no sidewalk) , with
ornamental landscaping.
Portola Avenue - dedicate and improve 50 ft. half street.
Street section to contain ultimate 6 ft. (one-half of 12
ft. ) raised center median, 32 ft. wide travel lane, and

2. The grade of Hovley Lane shall be re-established as directed
and approved by the Director of Public Works. All improvement
plans shall be based on that new grade.
I 3. Safety street lighting shall be installed at each tract entrance
on Hovley Lane and Portola Avenue.
4. If tract entrances are to be secured, provide capacity for
the stacking of four vehicles onsite.

tract (except for approved openings) , as approved through

6. Subdivider shall contribute $1,100 into the Signalization

the City of Palm Desert.
7. The map shall provide for 50% of the net site area (approx.
1.96 acres) to be held in common for open space purposes.
8. A final map shall not be accepted for filing until the
Design Review process has been completed; the map shall
be adjusted to correspond to that approval and submitted
to the Director of Environmental Services for a deter-
mination of compliance.

1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is.
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 1.1-79 is in accordance with the require-
ments prescribed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required water
system.shall be installed , operating and delivering the required flow.

(2) All storm waters shall be engineered and approved by the Director of Public
Works.
(3) Safety street lighting shall be installed on the Hovely Lane main entrance
and on Portola Avenue main entrance.
(4) Storage shall be provided for at least four automobiles at the gate
entrances.
(5) This development shall contribute $1 ,100 towards the signalization fund of
the City of Palm Desert.
(6) This development shall pay $1 ,500 per gross acre to the drainage fund of
the City of Palm Desert.
(7) Any right-of-way dedications shall be per the Director of Public Works.
