TT 14999 (WESTSIDE ENTERPRISES), ALSO KNOWN AS SKYWARD PLACE. Tentative Map 14999 calls for the creation of 36 single family dwelling lots. In addition two more lots; one for common recreation facilities and the other for the street are delineated on the map. The property is located at the easterly end of Bel Air Road between Skyward Way and Homestead Road and is zoned R-2 - 8,000. The subject map was originally approved October 11, 1979. In January, 1981, an 18 month time extension was granted which expires April 12, 1982, ( the 18 month time extension was retroactively effective to October 12, 1980). Pursuant to the recent revisions to the Subdivision Ordinance, the applicant is requesting an additional one year extension to the tentative map. As noted previously the property is zoned R-2 8,000. This zoning permits one unit for every 4,000 square feet of lot area and requires a minimum lot size of 8,000 square feet. Considering that the intent was to create a single family subdivision, staff feels that the zoning is in error and a change of zone should be processed. STAFF RECOMMENDATION: That Planning Commission continue the request for a one year time extension to TT 14999 and direct staff to process a Change of Zone for the subject property from R-2, 8,000 to R-1 8,000. /pa ,j W. STAFF RECOMMENDATION: Waive further reading and adopt Resolution No. 81-2 approving an extension of time of 18 months on the approval of Tentative Tract 14999. B. DISCUSSION: The applicants requested a time extension on TT14999 on September 8, 1980. However, Staff was unable to proceed with the request until now, due to the lack of the required application fee and updated list of property owners within 300 feet of said Tract. The Tentative Tract approval expired on October 11 , 1980. As a matter of policy, Staff is treating the matter as a time extension instead of requiring the applicants to go through the entire planning process again. This Tentative Tract Map along with a change of zone (C/Z 07-79) for a 36 unit residential development was approved by the City Council on October 11 , 1979. Prior to Council approval , the Planning Commission approved the Tentative Tract Map,change of zone and related Conditional-Use Permit (CUP 05-79) on September 19, 1979; the Commission will consider a time extension on CUP 05-79 on January 14, 1981 . It appears that the conditions that warranted approval in 1979 still exist, and therefore, Staff recommends approval of an 18 month time extension, based on the justifications stated in the Resolution. The Planning Commission has sug- gested that the present ordinance be rewritten to provide for screening of recreational vehicles if they are not used as part of normal family activities . t They cannot be parked for longer than 74 hours on a public street . It was also suggested that this be applicable to private properties only which is the intent of the ordinance as it was originally passed. Councilman McPherson asked qho would be responsible for maintaining the landscaping until all of the lots were sold and a homeowners association formed. Mr. Williams responded that the developer would be. Councilman Brush stated that the Staff Report had indicated the Commission ' s concern for setback of the wall on Skyward Way, and he asked why that concern had not been extended to the wall to be built on Barbery Lane and Bel Air Road. It was pointed out that the plans called for a 15 ' to 20 ' set- back for the wall on those streets , but it had not been made a condition. 1 4� Mr. Williams advised that the Fire Marshal wanted access J j on Bel Air Road as the response time from Mesa View would be much greater. He stated that this project would be of high quality; many of the drainage problems existing in the area now would be resolved by their development ; homes would range from between 1, 800 sq. ft. to 2, 400 sq. ft. He pointed out that this will be single-family residences and that the purpose for requesting a Change of Zone to R-2 was that R-1 did not allow for common lots for the proposed recreational area. The smallest lot would be 8 , 700 sq. ft. with the average lot size being 9 , 700 sq. ft. i Mr. Fleshman concluded by stating that they would be =" willing to accept the condition to include increased wall setback on Barbery Lane and Bel Air Road. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or, which here- after may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. Access rights to Chia Drive, Little Bend Trail , Bel Air Avenue, and Skyward Way (except for an entrance to Chia Drive, and on Emergency access point to be determined) shall be offered to the City as a dedication on the Final Map. 5. TENTATIVE TRACT 14999 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. Access rights to Chia Drive, Little Bend Trail , Bel Air Avenue, and Skyward Way (except for an entrance to Chia Drive, and on Emergency access point to be determined) shall be offered to the City as a dedication on the Final Map. 5. The total number of lots shall be limited to 36 lots for dwelling unit purposes, and other lots for common use as deemed necessary. However, this may have to be reduced to 35 units .at the request of the fire marshal to provide an emergency access to the west. 19. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council . 20. Drainage and Signalization Fund contributions as required by City ( Ordinance shall be made prior to recordation of the Final Map. 21. Developer shall pay in-lieu fees for park and recreation purposes l to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. SPECIAL CONDITIONS: 1. Subdivider shall pay $1,800 to the signalization fund of the City of Palm Desert. 2. Subdivider shall pay $16,650 into the drainage fund of the City of Palm Desert. 3. ' All street improvements shall be constructed on Chia Drive. Safety street lighting shall be installed at the entrance to this tract on Chia Drive. 4. All storm waters shall be engineered for and approved by the Director of Public Works. 5. Right-of-way dedications shall be per the Director of Public Works. Chia shall be dedicated at Haystack and improved the full width as a drainage conduit to the tract boundary. 6. Provisions shall be made on Arrow Trail for drainage coming from the southeasterly per Director of Public Works approval . 7. The entire tract (except for approved openings) shall be bounded by a min. 6 ft. high solid masonary wall , as approved through the Design Review process. Chairman Snyder asked who owns the property at the southeast corner and can it be obtained? Mr. Williams stated that if the property is not available, a revised Tentative Tract Map would have to be submitted showing an alternative access to the subdivision as stated in Special Condition #11 . Chairman Snyder asked if property owners surrounding the subject pro- posal were notified that .there would be a change of zone? Mr. Williams replied that letters are sent to surrounding owners and it is also printed in the newspaper. Chairman Snyder suggested that a sign be placed on the subject property so that surrounding owners would be more aware of activities taking place. No action was taken at this time regarding Chairman Snyder's suggestion. Mr. Williams stated that this change of zone is acceptable to the Staff and therefore recommends that the Commission approve this case by adopting Planning Commission Resolution No. 528, with the addition to Standard Condition #18 "However, this may have to be reduced to 35 units at the request of the Fire Marshal to provide an emergency access to the west." Commissioner Kryder asked why the proposal was under R-2 Zoning instead of PR Zoning? Mr. Williams stated that this will be an upgraded single family sub- division and in addition , provides a recreational area which would explain the R-2 Zoning. Commissioner Kryder stated his concern for the size of the lots in the area becoming smaller, in that it may set an undesirable precedent. MR. APPLICANT: City of Palm Desert I. BACKGROUND: A. HISTORY: In 1979 a project calling for the construction of 36 single family residences was presented to the City. Tentative Tract Map 14999 was prepared and eventually approved. The Tentative Tract Map provided for 36 lots on which a single family dwelling would be placed on each. Two additional lots were delineated on the Tentative Tract Map on which recreational facilities and a private street were proposed. In order to have the common recreational facilities a Conditional Use Permit was required. The applicant was also required to file an application to rezone the property from R-1, 10,000 to R-2 8,000. Why the change of zone to R-2 8,000 was required is not known but recreational facilities are a permitted use in an R-1 zone subject to the -issuance of a Conditional Use Permit. Ordinance 214 changing the zoning of the subject property was adopted by City Council October 25, 1979. B. ADJACENT ZONING AND LAND USE: North - R-1 - 13,000/Single Family Dwellings South - P.R-3/Vacant East - R-1 - 10,000/Vacant West - R-1 - 13,000/Single Family Dwellings C. GENERAL PLAN LAND USE DESIGNATION: Residential - Low Density, 3-5 units/acre. II. ANALYSIS: A. FINDINGS: The R-2 8,000 zoning permits the creation of minimum 8,000 square foot lots and permits one unit for every 4,000 square feet of net lot area. A Development of this type and density would be inconsistent with the General Plan Land Use Element which designates this area Residential Low Density (ie: 3 to 5 units per acre). The R-2 zone, allowing one unit for every 4,000 square feet of lot area would net a maximum of 9 units per acre after streets are established. The nine (9) unit per acre maximum is well in excess of the maximum permitted by General Plan (ie: 5 unit maximum/acre). i CASE NO. C/Z 02-82 MAY 4, 1982 A. FINDINGS (CONTINUED): 1 At this time any development of the property is controlled by the Conditional Use Permit which limits the property to be developed with a single family dwelling. However, should the owner choose to let the Conditional Use Permit and Tentative Map expire, then he would be left with a parcel of land (some 11.2 acres) zoned R-2, 8,000 permitting one unit for every 4,000 square feet of net lot area which could result in up to 103 units on the site. B. PROPOSED ZONING: In order to comply with the state law requiring consistency between the General Plan and the Zoning Ordinance and in order that the City does sot in the future have to process a multifamily development plan for 103 units on this site, it is suggested that the property be rezoned from R-2 8,000 to R-1 8,000, which would limit the development to single family residences on minimum lot sizes of 8,000 square feet. The 8,000 square foot minimum lot size would mean that all the lots created by Tentative Map 14999, should it be finaled, would continue to comply. Zoning the site R-1 8,000 would also be consistent with the General Plan designation of Low Density (3-5 units per acre). C. ENVIRONMENTAL REVIEW: The Director of Environmental Services has determined that the proposed zone change will not have a significant adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared. III. STAFF RECOMMENDATION: Based on reasons delineated in the report, staff recommends approval of Resolution No. " A resolution of the Planning Commission of the City of Palm Desert, California, recommending to the City Council approval of a Change of Zone from R-2 8,000 to R-1 8,000 for property located south of Skyward Place west of Chia Road at the easterly end of Bel Air Road".
