A. CASE NO . 16015 - MAYER GROUP , INC. , APPLICANT : CONSIDERATION
OF A REQUEST FOR APPROVAL OF A TENTATIVE TRACT MAP FOR 24 LOTS
TO ALLOW 264 RESIDENTIAL UNITS AND A 9 ACRE PUBLIC PARK ON
APPROXIMATELY 39 ACRES IN THE PR-7 (U.A. ) ZONE AT THE NORTH-
EAST CORNER OF MONTEREY AVENUE AND COUNTRY CLUB DRIVE .
Mayor Mullins noted that the Council had met in Study Session
prior to the Council Meeting, that discussion had been held
on all matters on the Agenda, but that no decisions had been
made.
Mayor Mullins declared the Public Hearing open and asked for
Staff ' s report .
Mr. Williams reviewed the Staff Report and stated that the
Planning Commission had held major discussion relative to
drainage requirements and access to the site from Country
Club Drive . The applicants requested they be required to
pay drainage fees only rather than be responsible for
implementation of the Master Plan of Drainage to the extent
determined necessary by the City. Mr. Williams referred to
a letter from the applicant addressing this issue and made
a part of the Staff report .

RESOLUTION NO. 80-37
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, APPROVING THE FINAL SUBDIVISION MAP OF TRACT 15082,
APPROVING THE AGREEMENT RELATING THERETO.
BE IT HEREBY RESOLVED by the City Council of the City of Palm Desert,
California, as follows:
1 . The Final Subdivision Map of Tract 15082, City of Palm Desert,
California, is hereby approved as the official subdivision map of said tract,
subject to the conditions of the Tentative Map.
2. The Mayor and City Clerk are authorized to execute on behalf of
the City a Standard Subdivision Agreement guaranteeing completion of the public
improvements required by law.
3. The City Engineer is authorized to receive the improvement security
as required by law on behalf of the City, subject to the approval of the City
Attorney as to form.
4. The City Engineer is directed to process the Final Map for recording
upon receipt of the required improvement security and the payment of all fees.
PASSED, APPROVED, and ADOPTED on this 27th day of March 1980, by

Mayor Mullins declared the Public Hearing open and called
for Staff ' s report .
Mr. Williams pointed out that at the meeting of August 23rd,
Staff had stated that this was a unique set of circumstances
in that this was the last remaining piece of property on
Panorama left to be developed, and since it is commercial,
the waiver of the requirement to underground utilities was
not possible. He referred to a letter from Mr. John

Outcault , architect for the project , which outlined the cir-
cumstances in this case and noted they were correct . There
are no poles on this property and the fact that it would
cost $100 , 000 to underground 70 feet of utility lines made
this an inordinate requirement . Mr . Williams concluded
his presentation by stating that Staff recommended that the
applicant be allowed to enter into an agreement to participate
in an undergrounding district if one were formed in the future.
This suggestion was incorporated as Standard Condition No. 7
in amended Resolution No . 79-101A.
Councilman Wilson noted that he had visited the site since the
last meeting and that he now agreed with the Staff' s recohmenda-
tion. Councilman Brush noted that he had read the minutes of
the previous meeting since he had been absent for this hearing .
Mayor Mullins invited input in FAVOR of the request , and none
was offered. He invited input in OPPOSITION to the request ,
and none was offered. He declared the Public Hearing closed.
Councilman Brush moved and Councilman Wilson seconded to waive
further reading and adopt Resolution No. 79-101A. Motion carried on a
3-1-1 vote, with Councilman Newbrander voting NO and Councilman McPherson
ABSENT. Councilman Newbrander explained her NO vote by stating that she
was not opposed to this project ' s undergrounding, but she was opposed to
it being built at all.

TION OF A REQUEST FOR AMENDKENTS TO THE ZONING ORDINANCE TEXT
(MUNICIPAL CODE SECTIONS 25. 30. 230D AND 25. 58 . 310) RELATIVE TO
THE MAXIMUM BUILDING HEIGHT AND PARKING REQUIREMENTS FOR DEVELOP-
MENTS IN THE PC (3) (PLANNED COMMERCIAL, REGIONAL) ZONE .
Mayor Mullins declared the Public Hearing open and asked
for Staff ' s . report.
Mr. Williams reported that the requested revision would
increase the maximum building height in PC (3) Zones from
30 feet to 35 feet and would decrease the parking require-
ments from 5 . 5 spaces per each 1, 000 square feet of gross
floor area to 5. 0 . He stated that it was Staff' s opinion
that there was a need for these amendments to reflect the
current evaluation of viable development standards . He
also pointed out the the City/Redevelopment Agency Traffic
Consultant , Barton/Ashman, had provided survey information
which indicated that our present standards were excessive.
Councilman Wilson stated that he felt the 35 ' building height
was reasonable. However, he saw a problem in reducing the
parking ration from 5 . 5 to 5 . 0 spaces per 1 ,000 . The standards
referred to in the study developed talked about averages , many
of which are in metropolitan areas . We have a unique area
where there is normally private transportation rather than public,
and regional centers will attract more automobiles in our area
than in a metropolitan area. He stated that it was easier to
correct an error in too much parking than in not enough. -
Mayor Mullins invited input in FAVOR of the request , and none
was offered. He invited input in OPPOSITION to the request ,
and the following was offered.

Council stating that the building heights and parking require-
ments should be left as they were decided years ago. He felt
the changes were being requested to accommodate one developer.

A. STAFF RECOMMENDATION:
Waive further reading and adopt Resolution No. 79-101 A, approv-
ing Tentative Tract 15082.
B. DISCUSSION:
This item was reviewed by the City Council at the meeting of
August 23, 1979. The applicant questioned standard condition
No. 7, which in part requires that, "overhead utility lines
adjacent to the site shall be undergrounded as a part of
development of this map." After discussion, the Council re-
quested that the cost of undergrounding these utilities be
obtained prior to disposition of this case.
The applicant's architect has submitted a letter and plan re-
garding the cost and time involved in undergrounding of the
utilities . (See attached letter and plan)
The two options open to the Council are (1 ) leave condition No. 7
as is requiring the undergrounding of the utilities now, or, (2)
permit the recording of an agreement guaranteeing, that the pro-
perty will voluntarily be a part of any undergrounding district
which is subsequently established by the City including the pro-
perty in question. This agreement is not applicable to service
lines that lead directly to the building.

Staff feels that it is reasonable and acceptable to allow the
recording of an agreement in this case, modifing Standard
Condition No. 7. Standard Condition No. 7 has been amended in
the Resolution No. 79-101 A to reflect the recommended change.

CITY COUNCIL RESOLUTION NO. 79-101 A
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE
TRACT MAP TO ALLOW A COMMERCIAL CONDOMINIUM
PROJECT.
CASE NO. TT 15082
WHEREAS, the City Council of the City of Palm Desert, California,
f did on the day of 1, 1979, hold a duly noticed Public Hearing to
Il consider the request of DON LAWRENZ for approval of a Tentative Tract Map
to create a one-lot subdivision for commercial condominium purposes on
approximately .30 acres within the C-1, S.P. (General Commercial , Scenic
Preservation Overlay) zone located on the west side of Panorama Drive,
approximately 180 feet south of Highway 111 (frontage road) more particularly
described as:
APN 625-122-004
WHEREAS, the Planning Commission, by Resolution No. 517, has
recommended approval subject to conditions; and
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32", in that the subject project has not been found to present an adverse
impact on the environment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to be heard,
said City Council did find the following facts and reasons to exist to
recommend approval of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply
with Chapter 26 of the City of Palm Desert Municipal
Code, and the State of California Subdivision Map
Act, as amended.
2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of
development proposed.
4. The design of the subdivision and the proposed
improvements are not likely to cause substantial
environmental damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
2. That it does hereby approve the above described Tentative
Map No. TT 15082 for the reasons set forth in this
Resolution and subject to the attached conditions.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 15082
1 . The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements , limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
Ordinance and the City Engineer shall be installed in accordance with City
standards .
3. The C.C.& R. 's for this development shall be submitted to the City Engineer
for review and approval prior to the issuance of any building permits . Prior
to recordation of the final subdivision map, the applicant shall submit to
the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project.
4. Improvement plans for water and sewer systems shall meet the requirements of
the respective service districts.
5. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject.
6. All dedicated land and/or easements required by this approval shall be granted
to the City of Palm Desert, without cost to the City and free of all liens and
encumbrances .
7. All on-site utilities , including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services . Subdivider to record
an agreement guaranteeing that the property will voluntarily be a part of any
undergrounding district which is subsequently established by the City in-
cluding the property in question; this agreement not to be applicable to
service lines that lead directly to the building.
8. Complete plans and specifications shall be submitted as required by Ordinance
to the City Engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior
to acceptance of the subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construction period,
the subdivider shall maintain passable vehicular access to all buildings . An
adequate number of fire hydrants with required fire flows shall be installed as
recommended by the Fire Marshal .
10. Prior to recordation of the Final Map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
11 . Design Review Plan as approved in Case No. 114C shall be submitted to the City
Fire Marshal for review. All requirements of the City Fire Marshal as a result
of said review shall be met as a part of the development of this tract.
12. The water system shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system of Tract No. 15082 is in accordance with the require-
ments prescribed by the City Fire Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineered data as requested.
14. All requirements of the Planning Commission action on the Design Review Case
No. 114C shall be met as a part of the development of this tract.

15. The total number of lots shall be limited to one.
16. The applicant shall have twelve (12) months from the date of the approval or
conditional approval of the tentative map for filing of the final map unless an
extension of time of up to eighteen (18) months is granted by a Resolution of
the City Council .
17. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the Final Map.
SPECIAL CONDITIONS OF APPROVAL
1 . Complete street dedication and improvements shall be provided on Panorama Drive,
as required by the Director of Public Works; including tie-in paving, curb and
gutter, and sidewalk.
2. The typical street section for Panorama Drive shall be revised to reflect a
10-foot sidewalk with tree wells.
3. Subdivider shall contribute $400 into the Signalization Fund of the City of
Palm Desert.

Dear Mrs. Gilligan :
On behalf of the Owner of this project, I am writing to the Council
concerning the continuation of the above case, with reference to the
electrical under-grounding.
Enclosed plase find eight copies of a Plot Plan describing the property
and the location of power poles. Pole no. P. P.3333S has been assigned
by the serving utility companies as the pole to service this project.
This pole has overhead high voltage and low-voltage electricity, tele-
phone and television. It serves telephone and television overhead to
the building to the west, some 100 feet.
If my client is forced to underground this pole, he would have
approximately 4001 of underground high voltage power, as well as tele-
phone and television. He also would have to obtain easement rights to
enter the adjoining property to under-ground the building to the west.
Since the pole line is some 30 feet away from the rear property line,
the Owner would be required to obtain, thru the power company, ease-
ments over adjoining properties even to accomplish the undergrounding.
This would take months to obtain.
The cost of undergrounding power, telephone and television could be as
high as $150.00 per lineal foot. Not only does this apply to under-
round, but also to risers up both poles. The cost could approach
100,000.00.
This cost would defeat the project we have planned. May I request your
approval of a participating agreement for an under-ground district,
to share undergrounding costs at a future date.

PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE
TRACT MAP TO ALLOW A COMMERCIAL CONDOMINIUM
PROJECT.
CASE NO. TT 15082
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 23rd day of August, 1979, hold a duly noticed Public Hearing to
consider the request of DON LAWRENZ for approval of a Tentative Tract Map
to create a one-lot subdivision for commercial condominium purposes on
approximately .30 acres within the C-1, S.P. (General Commercial , Scenic
Preservation Overlay) zone located on the west side of'Panorama Drive,
approximately 180 feet south of Highway 111 (frontage road) more particularly
described as:

WHEREAS, the Planning Commission, by Resolution No. 517, has
recommended approval subject to conditions; and
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32" , in that the subject project has not been found to present an adverse
impact on the environment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments , if any, .of all persons desiring to be heard,
said City Council did find the following facts and reasons to exist to
recommend approval of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply
with Chapter 26 of the City of Palm Desert Municipal
Code, and the State of California Subdivision Map
Act, as amended.
2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of
development proposed.
4. The design of the subdivision and the proposed
improvements are not likely to cause substantial
environmental damage or serious health problems .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
2. That it does hereby approve the above described Tentative
Map No. TT 15082 for the reasons set forth in this
Resolution and subject to the attached conditions.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 15082.
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements , limitations , and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
Ordinance and the City Engineer shall be installed in accordance with City
standards.
3. The C.C.&R. 's for this development shall be submitted to the City Engineer
for review and approval prior to the issuance of any building permits. Prior
to recordation of the final subdivision map, the applicant shall submit to
the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project.
4. Improvement plans for water and sewer systems shall meet the requirements of
the respective service districts.
5. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject area.
6. All dedicated land and/or easements required by this approval shall be granted
to the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
( 7. All on-site utilities , including cable TV, shall be placed underground and
lshall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services . Overhead utility lines
adjacent to the site shall be undergrounded as a part of development of this map.
8. Complete plans and specifications shall be submitted as required by Ordinance
to the City Engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior
to acceptance of the subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construction period,
the subdivider shall maintain passable vehicular access to all buildings . An
adequate number of fire hydrants with required fire flovis shall be installed as
recommended by the Fire Marshal .
10. Prior to recordation of the Final Map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
11. Design Review Plan as approved in Case No. 114C shall be submitted to the City
Fire Marshal for review. All requirements of the City Fire Marshal as a result
of said review shall be met as a part of the development of this tract.
12. The water system shall be signed by a registered civil engineer and approved -
by the water company, with the following certification : ' I certify that the
design of the water system of Tract No. 15082 is in accordance with the require-
prescribed by the City Fire Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineered data as requested.
14. All requirements of the Planning Commission action on the Design Review Case
No. 114C shall be met as a part of the development of this tract.
15. The total number of lots shall be limited to one.
16. The applicant shall have twelve ( 12) months from the date of the approval or
conditional approval of the tentative map for filing of the final map unless an
extension of time of up to eighteen ( 13) months is granted by a Resolution of
the City Council .

Mayor Mullins declared the Public Hearing open and asked
for Staff' s report .
Mr. Williams reviewed the Staff Report indicating that the
Planning Commission had approved the request with little
discussion by the Resolution No. 517 . However , the appli-
cant had questioned Standard Condition No . 7 and the require-
ment for undergrounding of utility lines . Under the ordinance,
Council may not require undergrounding in residential zones ,
but it is mandatory in commercial..unless Council elects to
approve participation in a Future Imnrovement Agreement .
Councilman McPherson noted that the 70' required to be under-
grounded served no purpose and the cost of under-rounding it
would be prohibitive. Councilman Wilson stated that it would
have to be done eventually, and Mr.. Williams pointed out that
the applicant could be required to enter into a Future Improve-
ment Agreement to do it at a later date .
Mayor Mullins invited input in FAVOR of the request , and none was
offered. He invited input in OPPOSITION to the request, and none
was offered. He declared the Public Hearing closed.
Councilman McPherson moved to waive further reading and adopt
Resolution No . 79-101 , amending Standard Condition No . 7 to delete the
last sentence "Overhead utility lines adjacent to the site shall be
undergrounded as a nart of development of this map . " '.Mayor Mullins
seconded the motion.
Councilman Wilson stated that he didn' t agree with the amount ,
and as commercial , Council should hold fast on it . The 70 '
sounds like a small amount, but where do you draw the line.
A dangerous precedent would be set by not requiring the under-
grounding.

FIRM TO PROVIDE THE CITY WITH ORGANIZATION AND PERSONNEL
SYSTEM ANALYSIS AND A CLASSIFICATION AND COMPENSATION STUDY.
Mr. Bouman stated that this was the action needed to launch
the organizational and personnel system analysis and the
classification and compensation study with Ralph Anderson
& Associates . He noted that Councilman McPherson, Larry
McAllister , Personnel Manager , and he had comprised the
interview panel of different consultant , and the panel
had unanimously selected this firm. They were very impressed
with Mr. Mike Davis of the firm who would be in charge of
the project for the City. The price is $12 , 000; the project
will take about 16-19 weeks ; Staff recommended approval of
the selection by Resolution No . 79-102 .
Councilman Newbrander moved and Councilman McPherson seconded to
waive further reading and adopt Resolution No . 79-102. Motion carried
unanimously with the members present.

XIV. ORAL COMMUNICATIONS
MR. GEORGE C . STONE, 43-831 Joshua Street , Palm Desert , addressed
Council stating that he had been "wiped out" in both floods - in
1976 and 1979 - because of a drainage ditch which runs between his
house and the one next door which provides drainage for the entire
tract from Highway 111 to Fairview Drive . He pointed out that
whether there was a flood or not, normal rain caused the ditch
to fill and break, flooding his home. He asked what the City
was going to do to correct the situation. He noted that the
County had not accepted the drainage ditch when the tract was
developed, and therefore the City says that they do not have
responsibility for it . The CVCTiTD says that they are not
responsible for drainage water in Palm Desert . He asked who
was responsible as he had lost $10, 000 in each flood and could
not afford another such loss .
Dave Erwin responded that the offer of easement for the drainage
ditch was apparently made as part of the development , and the
County chose not to accept it . Consequently, it does not belong
to anyone. He said that , assuming the offer is still standing,
the City could elect to accept it . However, more information
should be obtained, including whether or not the CVCWD would
accept the water out of the drainage ditch into the Palm Valley
Channel .
Councilman McPherson asked Mr . Stone if he would be willing to
join an assessment district with other property owners in the
tract in order. to provide the money with which to correct the
problem. Mr. Stone responded that he would not as he felt the
City should pay for it .
After considerable discussion, Council directed Staff to look
into the matter and report any possible solutions that might be available.

A. CITY MANAGER
RESOLUTION NO. 79-103 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, AUTHORIZING THE ACCEPTANCE
OF CERTAIN DEEDS FOR PROPERTY PURCHASED BY THE CITY IN ACCOR-
DANCE WITH THE C. O. D. SPECIFIC PLAN AND DIRECTING THE CITY
CLERK TO RECORD SAID DEEDS .
Mr. Bouman advised that this resolution dealt with two
properties within the C. O. D. Specific Plan area. A fair
price has already been negotiated, and the resolution merely
accepts the property on behalf of the City and authorizes
the City Clerk to record said deeds .
Councilman McPherson moved and Councilman Newbrander seconded to
waive further reading and adopt Resolution No . 79-103 . Motion carried
unanimously with the members present .
RESOLUTION NO. 79-104 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, AUTHORIZING AN ADVANCE
TO THE PALM DESERT REDEVELOPMENT AGENCY IN THE AMOUNT OF
$100, 000, SUCH ADVANCE TO BE TREATED AS A LOAN A14D REPAID
WITH INTEREST.
Mr. Bouman advised that this resolution would grant a request
by the Redevelopment Agency for a loan of $100, 000 to be used
for budgeted projects . The Agency operates on a "pay before
you go" spending program, and since the revenues to the Agency
will be greater than anticipated for next year, the Agency
will be able to spend a greater amount of money.
Councilman McPherson moved and Councilman Wilson seconded to waive
further reading and adopt Resolution No. 79-104. Motion carried unani-

RESOLUTION NO. 79-105 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONTRACT
FOR BUILDING INSPECTION SERVICES .
Mr. Bouman explained that this resolution would approve a
contract for building inspection services to assist the
heavy workloan in the Building & Safety Department . The
workload of that department was substantially set back by
the July flood ,
Councilman McPherson moved and Councilman Wilson seconded to
waive further reading and adopt Resolution No. 79-105 . Motion carried
unanimously with the members present.
REQUEST FOR APPROVAL OF CONTRACT WITH F. MACKENZIE BROWN,
CONSULTANT.
Mr. Bouman noted that Mr. Brown had appeared at a Council
Study Session to advise Council of possible options avail-
able for revenues and funding sources for correcting the
drainage problems in the City. Since the General Obliga-
tion bond issue is probably 99% unavailable, an assessment
district is the only way to go. He has responded since
that time with an estimate that through expenditure of
front money, the City would be able to determine not only
the updated cost of providing necessary drainage facilities ,
but additionally an order of estimating what the costs would
be for property owners in the City. His letter of contract
outlines various steps 1 through 6 , and Staff recommends
that Council adopt a motion authorizing the Mayor to
execute a contract with Mr. Brown with the under-
standing he will use some outside consultants on this
project in an amount not to exceed $50 , 000 , and that the
money for this project come from the Drainage Facilities
Fund which has substantial balances at this time. Mr.
Bouman pointed out that in the long run , if we spend this
money and don' t go ahead with such a district , the money
would have to be repaid into the Drainage Facilities Fund.
Councilman McPherson moved and Councilman Wilson seconded to
authorize the Mayor to execute a contract with F. MacKenzie Brown in
an amount not to exceed $50 , 000 , said monies to be taken from the
Drainage Facilities Fund. Motion carried unanimously with the members
present.
REQUEST FROM ERWIN & ANDERHOLT , ATTORNEYS AT LAW, FOR
PAYMENT OF LEGAL FEES IN CONJUNCTION WITH BILLBOARD
LAW SUIT.
Mr. Bouman advised that the City had been presented with
a statement for its 1/3 share of the legal fees for the
subject lawsuit , said bill amounting to $9 , 992 . 76 . Mr.
Bouman requested authorization to pay the bill .
Councilman McPherson moved and Councilman Newbrander seconded
to approve payment of the statement for legal fees in conjunction
with the Naegele Billboard Law Suit with the monies to come from
Account No. 11-4300-303 . Motion carried on a 3-1-1 vote , with
Councilman Wilson voting NO and Councilman Brush ABSENT. Councilman
Wilson explained his NO vote, stating that he felt that Indian Wells
should be paying for all of it out of their legal "war chest" .

adjourned to Executive Session at 8 : 15 p.m. Mayor Mullins reconvened
the Council meeting at 9 : 30 p.m. and adjourned the meeting announcing
no action had been taken during Executive Session.

A RESOLUTION QF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE
TRACT MAP TO ALLOW A COMMERCIAL CONDOMINIUM
PROJECT.
CASE NO. TT 15082
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 13th day of Sept. , 1979, hold a duly noticed Public Hearing to
consider the request of DON LAWRENZ for approval of a Tentative Tract Map
to create a one-lot subdivision for commercial condominium purposes on
approximately .30 acres within the C-1, S.P. (General Commercial , Scenic
Preservation Overlay) zone located on the west side of Panorama Drive,
approximately 180 feet south of Highway 111 (frontage road) more particularly
described as:

WHEREAS, the Planning Commission, by Resolution No. 517, has
recommended approval subject to conditions; and
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32", in that the subject project has not been found to present an adverse
impact on the environment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to be heard,
said City Council did find the following facts and reasons to exist to
recommend approval of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply
with Chapter 26 of the City of Palm Desert Municipal
Code, and the State of California Subdivision Map
Act, as amended.
2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of
development proposed.
4. The design of the subdivision and the proposed
improvements are not likely to cause- substantial
environmental damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
2. That it does hereby approve the above described Tentative
Map No. .TT 15082 for the reasons set forth in this
Resolution and subject to the attached conditions.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 15082
1 . The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
Ordinance and the City Engineer shall be installed in accordance with City
standards .
3. The C.C.& R. 's for this development shall be submitted to the City Engineer

for review and approval prior to the issuance of any building permits . Prior
to recordation of the final subdivision map, PP the applicant shall submit to
the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project.
4. Improvement plans for water and sewer systems shall meet the requirements of
the respective service districts .
5. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject.
6. All dedicated land and/or easements required by this approval shall be granted
to the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
J 7. All on-site utilities , including cable TV, shall be placed underground and
J shall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services. Subdivider to record
an agreement guaranteeing that the property will voluntarily be a part of any
undergrounding district which is subsequently established by the City in-
cluding the property in question; this agreement not to be applicable to
service lines that lead directly to the building.
8. Complete plans and specifications shall be submitted as required by Ordinance
to the City Engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior
to acceptance of the subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construction period,
the subdivider shall maintain passable vehicular access to all buildings. An
adequate number of fire hydrants with required fire flows shall be installed as
recommended by the Fire Marshal .
10. Prior to recordation of the Final Map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
11 . Design Review Plan as approved in Case No. 114C shall be submitted to the City
Fire Marshal for review. All requirements of the City Fire Marshal as a result
1 of said review shall be met as a part of the development of this tract.
J 12. The water system shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system of Tract No. 15082 is in accordance with the require-
ments prescribed by the City Fire Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineered data as requested.
14. All requirements of the Planning Commission action on the Design Review Case
No. 114C shall be met as a part of the development of this tract.

15. The total number of lots shall be limited to one.
16. The applicant shall have twelve (12) months from the date of the approval or
conditional approval of the tentative map for filing of the final map unless an
extension of time of up to eighteen (18) months is granted by a Resolution of
the City Council .
17. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the Final Map.
SPECIAL CONDITIONS OF APPROVAL
1 . Complete street dedication and improvements shall be provided on Panorama Drive,
as required by the Director of Public Works; including tie-in paving, curb and
gutter, and sidewalk.
2. The typical street section for Panorama Drive shall be revised to reflect a
10-foot sidewalk with tree wells.
3. Subdivider shall contribute $400 into the Signalization Fund 'of the City of
Palm Desert.

Dear Mrs . Gilligan :
On behalf of the Owner of this project, I am writing to the Council
concerning the continuation of the above case, with reference to the
electrical under-grounding.
Enclosed plase find eight copies of a Plot Plan describing the property
and the location of power poles. Pole no. P.P.3333S has been assigned
by the serving utility companies as the pole to service this project.
This pole has overhead high voltage and tow-voltage electricity, tele-
phone and television. It serves telephone and television overhead to
the building to the west, some 100 feet.
If my client is forced to underground this pole, he would have
approximately 4001 of underground high voltage power, as well as tele-
phone and television. He also would have to obtain easement rights to
enter the adjoining property to under-ground the building to the west.
Since the pole line is some 30 feet away from the rear property line,
the Owner would be required to obtain, thru the power company, ease-
ments over adjoining properties even to accomplish the undergrounding.
This would take months to obtain.
The cost of undergrounding power, telephone and television could be as
high as $150.00 per lineal foot. Not only does this apply to under-
round, but also to risers up both poles. The cost could approach
100,000.00.
This cost would defeat the project we have planned. May I request your
approval of a participating agreement for an under-ground district,
to share undergrounding costs at a future date.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE
CITY COUNCIL OF A TENTATIVE TRACT MAP TO CREATE A ONE-
LOT SUBDIVISION FOR COMMERCIAL CONDOMINIUM PURPOSES.
CASE NO. TT 15082
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 31st day of July, 1979, hold a duly noticed Public Hearing, to consider
I the request of DON LAWRENZ for approval of a Tentative Tract Map to create a one-lot
subdivision for commercial condominium purposes on approximately .30 acres within
the C-1, S.P. (General Commercial , Scenic Preservation Overlay) zone located on the .
west side of Panorama Drive, approximately 180 ft. south of Highway 111 (frontage
road) more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32" , in that the
subject project has not been found to present an adverse impact on the environment
and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to recommend approval
of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and the
State of California Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General
fPlan and the Palm Desert Zoning Ordinance.
1 3. The site is physically suitable for the type of development
proposed.
4. The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage or
serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows :
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case;
2. That it does hereby recommend conditional approval to the City
Council of the City of Palm Desert of the above described .Tentative
Map No. 15082 for the reasons set forth in this Resolution and
subject to the attached conditions.

Planning Commission, held on this 2nd day of August, 1979, by the following vote,

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 15082.
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
Ordinance and the City Engineer shall be installed in accordance with City
standards.
3. The C.C.&R. 's for this development shall be submitted to the City Engineer
for review and approval prior to the issuance of any building permits. Prior
to recordation of the final subdivision map, the applicant shall submit to
the City Engineer:
a. The document to convey title.
b. . Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project.
4. Improvement plans for water and sewer systems shall meet the requirements of
the respective service districts.
5. Area shall be annexed to appropriate Improvement Districts having juris
diction over the subject area.
6. All dedicated land and/or easements required by this approval shall be granted
to the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
7. All on-site utilities , including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services. Overhead utility lines
adjacent to the site shall be undergrounded as a part of development of this map.
8. Complete plans and specifications shall be submitted as required by Ordinance
to the. City Engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior
to acceptance of the subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construction period,
the subdivider shall maintain passable vehicular access to all buildings. An
adequate number of fire hydrants with required fire flows shall be installed as
recommended by the Fire Marshal .
10. Prior to recordation of the Final Map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
11. Design Review Plan as approved in Case No. 114C shall be submitted to the City
Fire Marshal for review. All requirements of the City Fire Marshal as a result
of said review shall be met as a part of the development of this tract.
12. The water system shall be signed by a registered civil engineer and approved -
by the water company, with the following certification: "I certify that the
design of the water system of Tract No. 15082 is in 'accordance With the require-
prescribed by the City Fire Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineered data as requested.
14. All requirements of the Planning Commission action on the Design Review Case
No. 114C shall be met as a part of the development of this tract.
15. The total number of lots shall be limited to one.
16. The applicant shall have twelve (12) months from. the date of the approval or
conditional approval of the tentative map for filing of the final map unless an
extension of time of up to eighteen (18) months is granted by a Resolution of
the City Council .

17. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the Final Map.
SPECIAL CONDITIONS OF APPROVAL
1. Complete street dedication and improvements shall be provided on Panorama Drive,
as required by the Director of Public Works ; including tie-in paving, curb and
gutter; and sidewalk.
2. The typical street section for Panorama Drive shall be revised to reflect a
10-foot sidewalk with tree wells.
3. Subdivider shall contribute $400 into the Signalization Fund of the City of
Palm Desert.

The subject map proposes to create a commercial condominium subdivision, for the
approved office building development on the site. Subject to compliance with the
conditions of approval for the related Design Review Case, and specific conditions
for this map, a subdivision for commercial condominium purposes would appear
acceptable.
IV. STAFF RECOMMENDATIONS:
Based on the justification contained in the Resolution:
Recommend approval to the City Council of Tentative Tract Map No. 15082, subject
to Conditions.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE
CITY COUNCIL OF A TENTATIVE TRACT MAP TO CREATE A ONE-
LOT SUBDIVISION FOR COMMERCIAL CONDOMINIUM PURPOSES.
CASE NO. TT 15082
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 31st day of July, 1979, hold a duly noticed Public Hearing, to consider
Il the request of DON LAWRENZ for approval of a Tentative Tract Map to create a one-lot
subdivision for commercial condominium purposes on approximately .30 acres within
the C-1, S.P. (General Commercial , Scenic Preservation Overlay) zone located on the
west side of Panorama Drive, approximately 180 ft. south of Highway 111 (frontage
road) more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32" , in that the
subject project has not been found to present an adverse impact on the environment
and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to recommend approval
of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and the
State of California Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted General
fPlan and the Palm Desert Zoning Ordinance.
l 3. The site is physically suitable for the type of development
proposed.
4. The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage or
serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows :
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case;
2. That it does hereby recommend conditional approval to the City
Council of the City of Palm Desert of the above described .Tentative
Map No. 15082 for the reasons set forth in this Resolution and
subject to the attached conditions.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 15082.
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations , and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
Ordinance and the City Engineer shall be installed in accordance with City
standards.
3. The C.C.&R. ' s for this development shall be submitted to the City Engineer
for review and approval prior to the issuance of any building permits. Prior
to recordation of the final subdivision map, the applicant shall submit to
the City Engineer:
a. The document to convey title.
b. . Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project.
4. Improvement plans for water and sewer systems shall meet the requirements of
the respective service districts.
5. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject area.
6. All dedicated land and/or easements required by this approval shall be .granted
to the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
7. All on-site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services. Overhead utility lines
adjacent to the site shall be undergrounded as a part of development of this map.
8. Complete plans and specifications shall be submitted as required by Ordinance
to the. City Engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior
to acceptance of the subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construction period,
the subdivider shall maintain passable vehicular access to all buildings. An
adequate number of fire hydrants with required fire flows shall be installed as
recommended by the Fire Marshal .
10. Prior to recordation of the Final Map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
11. Design Review Plan as approved in Case No. 114C shall be submitted to the City
Fire Marshal for review. All requirements of the City Fire Marshal as a result
of said review shall be met as a part of the development of this tract.
12. The water system shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system of Tract No. 15082 is in accordance with the require-
ments prescribed by the City Fire Marshal . "
13. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineered data as requested.
14. All requirements of the Planning Commission action on the Design Review Case
No. 114C shall be met as a part of the development of this tract.
15. The total number of lots shall be limited to one.
16. The applicant shall have twelve (12) months from the date of the approval or

Dear Members of the Commission:
Enclosed for filing are a complete application form and a $252.50 check
for filing fee, 30 copies of the Tentative Map for Tract 15082, a completed
initial study of environmental impact and a $30.00 check for the required
filing fee, and a list of property owners within 300 feet of the project.
It is our understanding that this Tentative Map will be considered by your
Commission at the July 31 , 1979 meeting, and bythe City Council two or three
weeks thereafter.
The project is protected from storm water from the South by a wall , runoff
from that area is diverted to Panorama and the site will be graded to direct
storm water to Panorama Drive.
The City Director of Environmental Services has waived any requirement at the
Tentative Map stage for proposed CCGR' s, Health Officer Statement, preliminary
soils report and grading plan. All applicable requirements will be satisfied
during the design stage prior to final map recordation or construction.
We do not propose to dedicate a portion of this project to public park use.
We are willing, however, to meet the ordinanace requirement by payment of fees
in lieu of dedication.

TENTATIVE SUBDIVISION MAP
Both State Law and the Palm Desert Subdivision Ordinance require that when any parcel of
contiguous parcels in one ownership is proposed to be divided into more than four parts,
now, or in the future, a tentative subdivision map must be processed through the City.
Procedure:

Applications for a Tentative- Subdivision Map are accepted only on the first working Monday
of each month. .Prior to submittal , it is recommended that the map be fully discussed with
the City Engineer. The staff will investigate the request and notify adjacent property
owners of the Public Hearing. The average review period for a subdivision map is five
weeks. Prior to the Public Hearing, the map is reviewed by the Land Division Review Com-
mittee. Said Committee reviews with the applicant to propose recommendations to the Plan-
ning Commission, including any conditions. Prior to the Hearing, the applicant will re-
ceive a copy of. the Agenda and a copy of the staff report concerning the case. If the
map is approved by the Planning Commission, it is reviewed by the City Council who takes
final action on the tentative map. The final subdivision map is processed through the
Engineering Department.

The Tentative Subdivision Map shall be in a form acceptable to the City Engineer and shall
comply with the provisions of the State Map Act. -

Supplemental Information
Reports and written statements on the following matters shall accompany the tentative
map unless waived in writing:
1. Subdivision building or development plan;
2. proposed method of control of storm water; including data as to grade
and dimensions ;
3. protective covenants proposed to be recorded;
4. if private streets are proposed, the method by which their maintenance
will be accomplished and financed;
5. proposed tree planting;
6. a written statement from the City Health Officer stating the type of
sewage disposal that will be permitted. To aid in this determination,
the City Health Officer may require soil percolation tests or other
pertinent information.
7. Proposed landscaping and irrigation.
8. Preliminary soils report and grading plan.

2. Thirty (30) copies (folded 82" x 13") of the Tentative Subdivision Map
and an unfolded sepia.
3. Required fee.
4. Property-owners list showing all property owners within 300 feet of
the property under consideration.
INSTRUCTION FOR OBTAINING
PROPERTY OWNERS NAMES
In order to expedite the processing of Changes of Zone, Variances , and
Conditional Use Permits , all applicants will furnish the Department of Environmental
Services with a list (in duplicate) of the property owners and their addresses for
all parcels within 300 feet of the application. Said list shall include the owner
of the property under consideration. These property owner names may be obtained in
one of the two following manners:
A. Contact a title company and request that they furnish you with
a list of names , for which there will probably be a charge.
B. You may obtain them yourselves in the following manner:
1. Secure from the County Assessor's Office parcel maps covering
your application and all lands within at least 300 feet.
2. Indicate the area of your request by a red outline on the
parcel maps.
3. Delineate, in red, all property within 300 feet of the area
of your request.
4. From the parcel map, make a list of book, page, block number ,
and parcel number within the above 300 foot area.
5. Using the Visual Numerical Index File, which is to be found
in the Assessor's Office, place the name and address for each
parcel opposite the number described in No. 4 above.
6. Sign Affidavit attesting to name list.
7. Return this list with your application to the Department of
Environmental Services.

I . FILING PROCEDURE: Prior to submittal the applicant shall discuss his pro-
posal with the Planning staff to determine whether or not the proposal is
in conformance with the General Plan and to determine zoning ordinance,
subdivision ordinance, or other requirements.
II . GENERAL INFORMATION:
A. Meetings : 1 ) City Council meetings are held on the second and fourth
Thursday of each month, at 7:00 PM in the Council Chambers in the City
Hall , 45-275 Prickly Pear Lane. 2) Planning Commission meetings are
held on Tuesday, nine (9) days prior to the first Council meeting of
the month, also at 7:00 PM in the Council Chambers and Wednesday, eight
(8) days prior to the second Council meeting of the month, at 1 :00 PM
in the Council Chambers. 3) The Design Review Board convenes on Tues-
day, a week before the Planning Commission, at 5:30 PP1 in the Council
Chambers.
B. Public Hearing: Public hearings are held when the City considers re-
quests for a change of zone, variance, conditional use permit, general
plan amendment, etc. Legal notices for these hearings are published
in the Palm Desert Post at least ten (10) days prior to the hearing.
Public hearing items before the Palm Desert Redevelopment Agency are
published in the Desert Sun.
C. peals: Where the Zoning Ordinance provides for appeal to the City
Council or Planning Commission, the appeal shall be made within fifteen
(15) days of the date of the decision by filing an application of appeal
with the Director of Environmental Services.
D. Fees : All required fees are listed in the Fee Schedule, as approved by
the City Council .
E. Building Permits : Building permits are issued by the Department of
Building and Safety and are required before any new construction , re-
construction , plumbing, mechanical work is commenced.
F. Business License : Prior to engaging in an enterprise for profit, zoning
and building code clearance for the proposed use is required and a city
business license obtained. Application should be made to the Code En-
forcement Supervisor.
G. Private Deed Restrictions : Many parcels of land in the City of Palm
Desert are subject to private covenants , conditions , and deed restrictions
which may conflict with the requirements of the City Zoning Ordinance.
The applicant is responsible for resolving conflicts with deed restriction
requirements.
