The Final Subdivision Map of Tract No. 15384, City of Palm Desert, California , is hereby approved as the official subdivision map of said tract, subject to the conditions of the Tentative Map. 2. The Mayor and City Clerk are authorized to execute on behalf of the City a Standard Subdivision Agreement for each guaranteeing completion of the public improvements required by law. 3. CASE NO. TT 15384 WHE e City Council of the City of Palm Desert, California, did on the 25th day of October , 1979, hold a duly noticed Public Hearing to consider the request of BRUCE JOEL REIMER for approval of a Tentative Tract Map to create a one lot subdivision for condominium purposes to provide for ten dwelling units on approximately one acre within the R-2 (Single Family Residential ) zone generally located on the south side of Santa Rosa approximately 455 ft. west of San Pasqual Avenue more particularly described as: APN 627-102-013 APN 627-102-014 WHEREAS, the Planning Commission by Resolution No. 534, has recommended approval subject to conditions; and ` WHEREAS, said application has complied with the requirements of \i the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has been found to be a Class 1, Categorical Exemption, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Map No. TT 15384 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the require- ments of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City Council agrees to use said fees for park purposes in con- formance with an adopted master plan, within five (5) years of the recordation of the final map. COMMUNITY DEVELOPMENT SIXTH YEAR BLOCK GRANT PROGRAM (Cont ' d) : to be done on a multi-year basis . Mayor Mullins invited input relative to the Program and none was offered. He declared the Public Hearing closed. Councilman McPherson moved and Councilman Wilson seconded to authorize Staff to submit the following projects for considera- tion in the Sixth Year Block Grant Program: 1. Improvement of Las Palmas & Royal Palm Drive Drainage including curbs , gutter & pavement - $40 , 598 . 2. Development of San Pasqual Park, including landscaping, sprinkling system, public works improvements , tot lot and equipment , game court , and picnic area - $144, 700. 3. Neighborhood Center Portion of Community Building at Civic Center Site (multi-year project) - $373 , 000 with application of $250 , 000 for Sixth Year. Motion carried unanimously. C. CASE NO. T 1538 - BRUCE J . REIMER, APPLICANT : CONSIDERA- 'TION OF A FOR APPROVAL OF A ONE-LOT TENTATIVE TRACT MAP FOR CONDOMINIUM PURPOSES TO ALLOW CONVERSION OF A 10 UNIT APARTMENT TO CONDOMINIUMS ON APPROXIMATELY ONE ACRE IN THE R-2 (SINGLE-FAMILY RESIDENTIAL DISTRICT) ZONE ON THE SOUTH SIDE OF SANTA ROSA WAY, APPROXIMATELY 455 FEET [NEST OF SAN PASQUAL AVENUE. ?Mayor Mullins declared the Public Hearing open and asked for Staff' s report . Mr. Williams stated that the request was to convert some apartments to condominiums which would require approval of a Tentative Tract Map. He reviewed the project , stating that it would meet all the minimum standards . It was the recommendation of both the Planning Commission and Staff to approve the request with a number of conditions . Councilman Newbrander asked if these were already existing apartments , and Mr. Williams responded that they were . Mayor Mullins invited input in FAVOR of the request. MR. LEON PEAR, #2 Fordham Court , Rancho Mirage , addressed Council as the applicant and stated his concurrence with Staff and the Planning Commission. Mayor Mullins invited input in OPPOSITION to the request , and none was offered. He declared the Public Hearing closed. lCouncilman Wilson expressed his concern about conversion 1 of apartments to condominiums in that there was such a dire need for apartment housing in the City. Councilman Newbrander concurred in that Council had talked of the apartment shortage for years , and this seemed in direct violation of the effort to correct the shortage. Councilman Brush stated that he too had concerns about the apartment shortage, but that this conversion seemed like the best use of the land in question. Mayor Mullins agreed that it would upgrade the area, and Councilman McPherson stated that it would provide 10 additional low-cost housing units in the City. The applicant , at this point , stated that the units would sell for approximately $60 , 000 while if they remained _October 25 , 1979 _ _ _ ._Page 7 _ MINUTES REGULAR CITY COUNCIL 1.-ETING VII . Motion carried on a 3-2 vote , with Councilmen - Newbrander and Wilson voting NO. D. CASE NOS . TRACT 12181-1 AND 12181-2 (AMENDMENT) - LEWIS HOMES, APPLICANT : CONSIDERATION OF A REQUEST FOR APPROVAL OF AN AMENDMENT OF SPECIAL CONDITION NO 8 OF TRACT 12181-1 AND SPECIAL CONDITION NO . _ 8 OF TRACT 12181-2 TO ALLOW CHANGING 6 FT . HIGH BLOCK WALL TO "LIVING FENCE" ON NORTH BOUNDARY AND GRAPESTAKE FENCE ON SOUTH BOUNDARY. Mayor Mullins declared the Public Hearing open and asked for Staff' s report . Mr. Williams reviewed the applicant ' s request stating that their justification was based on the fact that the rising cost of construction and the cost of the required wall would increase the costs of their homes . Mr. Williams stated that it was the recommendation of both Staff and the Planning Commission to deny the request inasmuch as both the Design Review Board and the Planning Commission had made adjustments to the requirement of wall upon original approval , thus pro- viding mitigation of costs . Mayor Mullins invited input in FAVOR of the request. MRS . BETTY WILLIAMS , 45-445 Portola Avenue, addressed Council on behalf of Lewis Homes . She stated that this wall would cost $76 , 380 which would increase the cost of the homes . She felt that the only people to benefit from the block wall were those homes backing up to the project. She also felt that people who purchased homes would like to put in their own fencing. Mayor Mullins invited input in OPPOSITION to the request. MR. JEFF WILSON, 43-650 Carmel Circle, Palm Desert , addressed Council as an adjoining property owner who felt that the block wall would make the project much more compatible with adjacent homes . MR. GREG MAJESTIC , 43-620 Carmel Circle, Palm Desert , also spoke in favor of requiring the block wall. He also raised a problem relative to some existing Tamarisk trees . It was agreed he should discuss this problem with Staff. Mayor Mullins declared the Public Hearing closed. Councilman Wilson moved and Councilman McPherson seconded to waive further reading and adopt Resolution Nos . 79-127 and 79-128 . j Motion carried unanimously. J E . (continued) Mr. Crump presented this case emphasizing consideration should be given to design compatibility and site aesthetics. He recommended approval for Case No. CUP 08-79 with requested setback and parking variance, subject to conditions. There being no questions from the Commission at this time, Chairman Snyder opened the Public Hearing. MR. BOB MAINIERO, Applicant, 2225 E. Tahquitz-McCallum Way, requested the Commission to be more specific on the condition regarding upgrading of the landscaping. Chairman Snyder indicated this is in a residential area, and he felt it would be difficult to approve less than what code demands. (a) a 2-car covered garage; (b) required front yard. He also stated he needed substantial landscaping. After..a short discussion between the applicant and the Commission, the Commission decided it would be best to continue the matter for the applicant to consider the alternative of moving the carport to the rear yard. The applicant agreed that perhaps a continuance was in order. Upon motion made by Commissioner Berkey, seconded by Commissioner Kryder, Case No. CUP 08-79 was continued to October 17, 1979 meeting. Carried unanimously (5-0). E. Case Nos. CUP 07-79 and TT�538 BRUCE JOEL REIMER, Applicant Request for approval of a Conditional Use Permit to allow the Conversion of existing apartments to condominiums and a one lot subdivision for condominium purposes on approximately one acre with the R-2 (Single Family Residential District) zone generally located on the south side of Santa Rosa Way approximately 455 ft. west of San Pasqua] Avenue. Mr. Crump presented this case noting there are only 2 zoning ordinance sections which distinguish apartments from condominiums: (1) 1000 sq. ft. floor area minimum; (2) required parking spaces. The plan satisfies these requirements. He also observed: (1) No difference between single owner apartment complex and individually owned condominiums; (2) No social impacts as a result of displacement of apartments tenants, as the units were not occupied; and, (3) The request would provide an additional choice in the housing market. Therefore, the staff recommended approval of Case Nos. CUP 07-79 and TT 15384, by adopting Resolution Nos. 533 and 534, subject to conditions. Commissioner Berkey .asked if the City Attorney could be asked to review Condition No. 4 of the standard conditions. Chairman Snyder also recommended this. The Staff agreed that the City Attorney should review all CC & R's. Chairman Snyder asked if Mr. Hill reviewed the request and concurs it (L meets the building code for condominiums. Staff pointed out the suggested condition which required compliance to the applicable building codes. There being no other questions at this time, Chairman Snyder asked the applicant to make a presentation. LEON PEAR, Applicant, No. 2 Fordham Rd. , Rancho Mirage, assured the Commission that Mr. Hill was contacted and he approved construction provided additional fire wall were constructed, which would be no problem because construction was not yet complete. He pointed out a rendering of the proposed project which reflected how the project would be modified to provide the required parking. Chairman Snyder then declared the Public Hearing open, asking if anyone present wished to speak in FAVOR or OPPOSITION to this request. There being none, Chairman Snyder closed the Public Hearing. Upon motion made by Commissioner Berkey, seconded by Commissioner Kryder Planning Commission Resolution Nos. 533 and 534 were adopted. Carried unanimously (5-0). F. Case No. CUP 09-78 (Amendment) - BANK OF INDIO, Applicant Request for approval of an amendment of an approved Conditional Use Permit 'to-allow an additional 20 ft. wide entrance only driveway on El Paseo to facilitate access to a bank building on approximately 5.4 acres (total Hughes Investment site) , within the C-1, S.P. (General Commercial District, Scenic Preservation Overlay) , Zone generally located at the northeast corner of State Hwy 74 and El Paseo. Mr. Crump presented this case stating the proposed driveway would create a problem because of the proximity to the intersection of Hwy 74. Further, staff believes that site had adequate access. Staff recommended denial of the amendment to CUP 09-78. There being no questions at this time, Chairman Snyder asked if the applicant would like to speak. CARL COX, Applicant,: 73-125 Shadow Mountain Dr. , emphasized the driveway would be an entrance only and would take traffic off E1 Paseo. He stated it was imparative to have the new access. Chairman Snyder then opened the Public Hearing asking if anyone present wished to speak in FAVOR or OPPOSITION to the case. There being none, Chairman Snyder closed the Public Hearing. The Commissioners indicated their concern for the traffic situation on El Paseo. Commissioner Berkey stated that the project needed the access, in his opinion. Commissioner Kryder stated he did not believe the traffic count is any different than Bank of America , in relation to the driveway access. Chairman Snyder indicated that he thought it would be a more dangerous situation. Mr. Crump state that the Design Review Board did not feel it is an acceptable design. Commissioner Fleshman stated he believed that it was not a good place for a bank and expressed concern for the parking. The Commission agreed that this matter should be continued to f consider alternative plans. The applicant agreed to the continuance L but indicated their reluctance to not having the requested driveway opening. Chairman Snyder Reoponed the Public Hearing. - Ron motion made by Commissioner Kryder, seconded by Commissioner Fpeshman, it was moved to continue Case No. CUP 09-78 (Amendment) to the October 30th, 1979 meeting; carried unanimously (5-0) . REQUEST: Approval of a one lot Tentative Tract Map for condominium purposes to allow conversion of a 10 unit apartment to condo- miniums on approximately one acre in the R-2 (Single-Family Residential District) Zone on the south side of Santa Rosa Way approximately 455 feet west of San Pasqual Avenue. STAFF RECOMMENDATION: Waive further reading and adopt Resolution No. 79-126 , approving Tentative Tract No. TT 15384 . B. DISCUSSION: In addition to this Tentative Tract Map request, the Planning Commission approved a Conditional Use Permit (CUP 07-79) to allow conversion of the existing apartments to condominiums . As reflected in the Planning Commission minutes of October 2 , 1979 , the major topic related to the . differences between apart- ments and condominiums . The Code Requirements indicates two differences: (1) Condominiums require 1000 sq, ft. of floor area in each unit, and (2) Condominiums require 2 . 5 parking spaces per unit versus 2 per unit for apartments. The floor area minimum is met by this project and the Planning Commission approval allowed a variance of one parking space (24 instead of 25 spaces) . TRANSMITTAL LETTER PAGE TWO TT 15384 The Planning Commission also felt the C.C. &R' s should be reviewed by the City Attorney as well as the City Engineer (per Standard Condition No. 4) . The Commission then unanimously approved the request for this Tentative Tract Map and a Conditional Use Permit. RESOLUTION NO. 79-126 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO ALLOW A 1 LOT SUBDIVISION FOR CONDOMINIUM PURPOSES. CASE NO. TT 15384 WHEREAS, the City Council of the City of Palm Desert, California, did on the 25th day of October , 1979, hold a duly noticed Public Hearing to consider the request of BRUCE JOEL REIMER for approval of a Tentative Tract Map to create a one lot subdivision for condominium purposes to provide for ten dwelling units on approximately one acre within the R-2 (Single Family Residential ) zone generally located on the south side of Santa Rosa approximately 455 ft. west of San Pasqual Avenue more particularly described as: APN 627-102-013 APN 627-102-014 WHEREAS, the Planning Commission by Resolution No. 534, has recommended approval subject to conditions; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32" , in that the subject project has been found to be a Class 1, Categorical Exemption, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable forthe type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the require- ments of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City Council agrees to use said fees for park purposes in con- formance with an adopted master plan, within five (5) years of the recordation of the final map. Tahquitz-McCallum Way, requested the Commission to be mor specific on the condition regarding upgrading of the landscape Chairman Snyder indicated thi is in a residential area, and he felt it would be difficult to approv less than what code demands. (a) a 2-car covered garage; (b) requ ed front yard. He also stated he needed substantial landscaping. After. a short discussion between the plicant and the Commission, the Commission decided it would be bes to continue the matter for the applicant to consider the altern tive of moving the carport to the rear yard. The applicant agreed that perhaps a continua a was in order. Upon motion made by Commissioner Berkey, second by Commissioner Kryd - 979 meeting. Carried unanimously (5-0) . E. Case Nos. CUP 07-79 and TT 15384 - BRUCE JOEL REIMER, Applicant Request for approval of a Conditional Use Permit to allow the Conversion of existing apartments to condominiums and a one lot subdivision for condominium purposes on approximately one acre with the R-2 (Single Family Residential District) zone generally located on the south side of Santa Rosa Way approximately 455 ft. west of San Pasqual Avenue. Mr. Crump presented this case noting there are only 2 zoning ordinance sections which distinguish apartments from condominiums: (1) 1000 sq. ft. floor area minimum; (2) required parking spaces. The plan satisfies these requirements. He also observed: (1) No difference between single owner apartment complex and individually owned condominiums; (2) No social impacts as a result of displacement of apartments tenants, as the units were not occupied; and, (3) The request would provide an additional choice in the housing market. Therefore, the staff recommended approval of Case Nos. CUP 07-79 and TT 15384, by adopting Resolution Nos. 533 and 534, subject to conditions. Commissioner Berkey .asked if the City Attorney could be asked to review Condition No. 4 of the standard conditions. Chairman Snyder also recommended this. The Staff agreed that the City Attorney should review all CC & R's. Chairman Snyder asked if Mr. Hill reviewed the request and concurs it meets the building code for condominiums. Staff pointed out the suggested condition which required compliance to the applicable building codes. There being no other questions at this time, Chairman Snyder asked the applicant to make a presentation. LEON PEAR, Applicant, No. 2 Fordham Rd. , Rancho Mirage, assured the Commission that Mr. Hill was contacted and he approved construction provided additional fire wall were constructed, which would be no problem because construction was not yet complete. He pointed out a rendering of the proposed project which reflected how the project would be modified to provide the required parking. He did request that the Commission consider eliminating one required open parking space. Minutes Palm Desert Planning Commission October 2, 1979 Page -4- After a discussion on the parking spaces, it was agreed that 20 covered spaces, and 4 open spaces were sufficient. Chairman Snyder then declared the Public Hearing open, asking if anyone present wished to speak in FAVOR or OPPOSITION to this request. There being none, Chairman Snyder closed the Public Hearing. Upon motion made by Commissioner Berkey, seconded by Commissioner Kryder Planning Commission Resolution Nos. 533 and 534 were adopted. Carried unanimously (5-0). F. Case - - ant Re est for approval of an amendment of an approved Conditional Use Permit to allow an additional 20 ft. wide entrance only driv way on El Paseo to facilitate access to a bank building on appro imately 5.4 acres (total Hughes Investment site) , within the C-1, S.P. (General Commercial District, Scenic Preservation Overlay Zone generally located at the northeast corner of State Hwy 74 a El Paseo. Mr. Crump p esented this case stating the proposed driveway would create a pro lem because of the proximity to the intersection of Hwy 74. Furt er, staff believes that site had adequate access. Staff recommen ed denial of the amendment to CUP 09-78. There being no q stions at this time, Chairman Snyder asked if the applicant wou like to speak. CARL COX, Applicant, 73-125 Shadow Mountain Dr. , emphasized the driveway would be an ntrance only and would take traffic off E1 Paseo. He stated 1 was imparative to have the new access. Chairman Snyder then op ed the Public Hearing asking if anyone present wished to speak FAVOR or OPPOSITION to the case. There being none, Chairman Snyd closed the Public Hearing. The Commissioners indicated their concern for the traffic situation on El Paseo. Commissioner Berkey stated tha the project needed the access, in his opinion. Commissioner Kryder stated he did of believe the traffic count is any different than Bank of Amer ca , in relation to the driveway access. Chairman Snyder indicated that he tho ght it would be a more dangerous situation. Mr. Crump state that the Design Review B and did not feel it is an acceptable design. Commissioner Fleshman stated he believed t at it was not a good place for a bank and expressed concern for he parking. The Commission agreed that this matter shoul be continued to consider alternative plans. The applicant ag eed to the continuance but indicated their reluctance to not having t e requested driveway opening. Chairman Snyder Reoponed the Public aring. III. DISCUSSION: The R-2 zone provides for planned residential developments (in this application condominiums) subject to the granting of a Conditional Use Permit.
