CASE NO. TT 15630 (TIME EXTENSION) . l WHEREAS, the City Council of the City of Palm Desert, California, did receive a request from DUAINE K. BRICKER & ASSOCIATES for an 18 month time extension pursuant to Section 26.20.140 of the Palm Desert Municipal Code, for approved Tentative Tract Map TT 15630, providing for a 16 unit condominium sub- division on .approximately 1 .3 acres located between Shadow Hills Road and Deep Canyon Road, 225 feet south of Highway 111 , more particularly described as: APN 625-162-002 APN 625-162-010 APN 625-162-003 APN 625-162-011 WHEREAS, the City Council is empowered to grant time extensions of up to eighteen months for filing of the final map in Section 26.20.140 of the Palm Desert Municipal Code; and WHEREAS, the City Council did find the following reasons to exist to justify the granting of said time extension: 1 . Granting the time extension will not in any way adversely affect the public health, safety or general welfare. 2. The applicant is not proposing any changes to the project J and the situation in the vicinity of the project is un- changed since the subject tentative tract was originally approved. STAFF RECOMMENDATION: Waive further reading and adopt Resolution No. 81-3 , approving an extension of time of 18 months on the approval of Tentative Tract 15630. .. B. DISCUSSION: Due to uncertainties in the economy, the applicant is requesting an 18 month time extension on TT 15630. This Tentative Tract Map for a 16 unit condominium development, was approved by the City Council on December 27, 1979, with little Council or audience :discussion. Prior to Council approval , the Planning Commission approved the Tentative Tract Map, without comment, on December 4, 1979 and a related Conditional Use Permit (CUP 10-78) on September 5, 1978. The Commission granted a second one year extension on CUP 10-78 on September 2, 1980. ENVIRONMENTAL ASSESSMENT: The proposed project has been previously assessed in connection with Case No. CUP 10-78, and no further documentation is deemed necessary by the Director. STAFF REPORT December 4, 1979 Page -2- D. PREVIOUS PERTINENT CASES: CUP 10-73 and 143 MF, approval for a 16 unit condominium development on the subject site; one year time extension granted by the Planning Commission on August 15, 1979. III . DISCUSSION: The subject map seeks to implement a Conditional Use Permit and preliminary Design Review case for the subject site. Preliminary plan conditions of approval directed certain design changes and requirements which affect the site plan, but which have not been resubmitted for final Design Review approval . Therefore, •the map should be adjusted as needed to reflect the previous conditions and final Board action. IV. STAFF RECOMMENDATION: A Tentative Map approval is found to be somewhat premature until the final site plan has been fixed, but this consideration can be adequately addressed' ` by conditions, therefore, based on the justification contained in the draft Resolution: Recommend approval of TT 15E30 to the City Council , by adopting Planning Commission Resolution No. subject to the attached conditions. CASE NOS. TT 15734 AND TT 15735 (Continued) : Mayor Mullins invited input in OPPOSITION to the request , and none was offered. He/'declared the Public Hearing closed. He noted that the Planning Commission had done a very thorough job in reviewing this case. Councilman McPherson moved and Councilman Brush seconded to waive further reading and adopt Resolution Nos . 79-152 and 79-153 . Motion carried on a, 4-1 vote, with _Councilman Newbrander voting NO. She stated that with the size of the units starting at 485 sq. ft. , it was hard to imagine 1,tiiem as being homes . She also questioned the parking in the existi _lo_pment,-,—s-tracing that there were deadend areas there now. B. CASE NO. TT 15630 - DUAINE K. BRICKER, APPLICANT : CONSIDERATION OF APPROVAL OF A 17 LOT TENTATIVE TRACT MAP FOR CONDOMINIUM / ( PURPOSES TO ALLOW 16 DWELLING UNITS AND ONE COMMON LOT ON APPROXIMATELY 1. 3 ACRES WITHIN THE R-3 (MULTI-FAMILY DISTRICT) ZONE , LOCATED BETWEEN SHADOW HILLS ROAD AND DEEP CANYON ROAD, 225 FEET SOUTH OF STATE HIGHWAY 111. Mayor Mullins declared the Public Hearing open and called for Staff' s report. Mr. Williams reported that this request would implement a previously approved Conditional Use Permit and preliminary Design Review Case which allows the construction of a 16 unit condominium development. He stated that there were a number of revisions as a result of the Planning Commission' s approval. The Tentative Tract Map is in conformance with the City' s ordinances , and it was Staff' s recommendation to approve by Council Resolution No. 79-154, with an amend- ment to Condition No . 19 eliminating the dedication of land in lieu of a fee for park and recreation purposes to that no land would be available for dedication. Mr. Williams noted that the applicant had phoned the Clerk' s office that morning to advise of his illness . Staff, therefore, recommended continuance of the matter if there were any ques- tions to be directed to the applicant. Mayor Mullins invited input in FAVOR of the request , and none was offered. He invited input in OPPOSITION to the request , and none was offered. He declared the Public Hearing closed. Councilman Brush moved and Councilman McPherson seconded to waive further reading and adopt Resolution No. 79-154, with Condition No . 19 amended as per Staff recommendation. Motion carried on a 4-1 vote, with Councilman Newbrander voting NO due to her opposition to any building on the south side at this time. C. ,CONSIDERATION__QZ_A_%STER DRAINAGE PLAN FOR THE PORTION OF THE CITY OF PALM DESERT AND ITS SPHERE OF INFLUENCE LYING l NORTHERLY OF THE WHITEWATER RIVER CHANNEL AND GENERALLY JBETWEEN MONTEREY AVENUE AND COOK STREET. Mayor Mullins declared the Public Hearing open and called for Staff' s repor,tt.. Mr. William's stated that Willdan Associates had prepared a Master Drainage Plan for the North Palm Desert Area which summarizes the study effort associated with the development of a Master Drainage Plan for the portion of the City' s Sphere of Influelice lying northerly of the Whitewater River. The Master Plan describes a comprehensive program for the development of drainage facilities and presents alternative facility plans designed to meet the needs of the community. CASE NO. TT 15630 WHEREAS, the City Council of the City of Palm Desert, California , did on the 27th day of December, 1979, hold a duly noticed Public Hearing to consider the request of DUAINE K. BRICKER for approval of a 17 lot Tentative .Tract Map for condominium purposes to allow 16 dwelling units and one commonlot on approximately 1.3 acres within the R-3 (Multi-family Residential District) zone, located between Shadow Hills Road and Deep Canyon Road, 225 feet south of Hwy. 111, more particularly described as: APN 625-162-002 APN 625-162-010 APN 625-162-003 APN 625-162-011 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has been found to be a Class 1, Categori- cal Exemption, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments , if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of develop- ment proposed. 4. The design of the subdivision and the proposed improve- ments are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve the above described Tenta- tive Map No. TT 15630 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that the recommended conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City Council agrees to use said fees for park pur- poses in conformance .with an adopted master plan, within five (5) years of the recordation of the final map. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements , limitations , and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. l 2. Full public improvements including traffic safety lighting as required by ordinance and th6lCity Engineer shall be installed in accordance with City standards . 3. Access rights to Deep Canyon Road and Shadow Hills Road (except for two approved driveways to each street) shall be offered to the City as a dedication on the Final Map. 4. The C.C. & R's for this development shall be submitted to the Director of Environmental Services for review and final approval by the Ci.ty Attorney prior to the issuance of any building permits . Prior to recorda- tion of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded (which have been approved). c. Management and maintenance agreement to be entered into with the owners of the units of the project (which has been approved) . 5. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 6. Area shall be annexed to appropriate Improvement Districts having juris-. l - diction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on-site utilities , including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services . 9. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . 11. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 12. All requirements of the City Fire Marshal from his letter of November 27, 1979, shall be met as a part of the development of this tract. 13. The grater system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I. certify that the design of the water system of Tract No. 15630 is in accordance with the requirements prescribed by the City Fire Marshal . " 14. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineered data as requested. i RESOLUTION NO. 79-1f Page -4- 15. All requirements of the Planning Commission action on the 'Conditional Use Permit No. 10-78 shall be met as a part of the development of this tract. 16. The total number of lots shall be limited to 16 for dwelling unit pur- poses and other lots for common purposes as deemed necessary. 17. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council . ` 18. -Drainage and Signalazation Fund contributions as required by City "Ordinance shall be made prior to recordation of the Final Map. 19. Developer shall pay a fee as a condition of the Final Map for park and recreation purposes. The City shall commit the use of any such fees received within a five-year period. SPECIAL CONDITONS 1 . A Final Map shall not be recorded until all of the conditions in Planning Commission Resolution No. 521 have been satisfied to the extent that map reflects all pertinent features of an approved final site plan which has been submitted through the Design Review process. The Director of Environmental Services shall confirm that the Final Map and site plan are in agreement, prior to recordation. AGREEMENT I accept and agree, prior to use of this permit or approval , to comply with all the conditions set forth, and understand that the Department of Building 1 and Safety will not issue a building permit or allow occupancy on the use 1 permitted until this signed confirmation has been received by the Department of Environmental Services. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 15630 is in accordance with the require- ments prescribed by the Fire Marshal . " Upon approval , the original plan will be returned to the developer. 5. Edison, 74-000 Highway 111, added that an additional improvement would be that the service line to the station would be placed underground. He stated that the conditions were agreeable. Chairman Snyder asked Mr. Martin if he was sub-contracting the landscaping maintenance. Mr. Martin replied that they were. Commissioner Miller asked if the residents on the west side would be bothered by the noise. Mr. Martin introduced Mr. Spix, who did the noise study. JOHN SPIX, Engineer, Whittier, Ca. , gave a- lengthy explanation on the noise levels. He further stated that the station would have two transformers and would not increase the noise. Chairman Snyder asked Mr. Spix if the company would ever consider sound proofing the station as the need continues to grow. Mr. Spix replied that the need had not come up at this point. Commissioner Berkey indicated that a Special Condition could be added in regards to the noise level . Mr. Spix assured him that it would not increase. Mr. Williams pointed out that their report indicated a one decibel increase at night would occur. Commissioner Kryder stated that he did not feel it was necessary• to add a Special Condition regarding the noise level if it was stated that it would not change. Commissioner Miller asked Mr. Spix if he was aware of how much the . noise bothered the Silver Spur Ranch residents. Mr. Spix stated some people are sensitive to the sound and assured him it would not be any greater than it is presently.at the location under consideration. Mr. Martin also stated that if there was a problem the company would resolve it. Chairman Snyder concluded the discussion by stating that it was the Commission's responsibility to make sure no problems would exist. He felt sure that if there was a problem the utility company would take care of it. He then opened the Public Hearing asking if anyone present wished to speak in FAVOR or OPPOSITION to the case. Mr. Williams presented this case noting that under recent State Legislation, Stock Cooperatives must be reviewed by the City as a Tentative Map. He reviewed the parking analysis which showed .a difficiency of 33 covered spaces to be covered, but that the required number of spaces were being provided. He expressed a concern for the parking and amenities, which are not located within the subdivision boundaries, but are provided by means of access and easements. He then reviewed the special conditions and recommended approval to the City Council . Commissioner Kryder asked if the parking spaces would be used for other uses. Mr. Williams stated that it was suggested to the applicant that it be verified and met in accordance with the ordinance. It is also specified in Special Condition No. 1. Chairman Snyder asked if the applicant cared to make a presentation. TED LENNON, 73-745 Shadow Lake Drive, explained what a cooperative was and stated that he had converted others before and had proved to be successful . He believed it was not necessary to provide covered parking spaces and explained what extensive work would be involved to provide this. He asked the Commission' s thoughts in this matter. ((( Chairman Snyder expressed a concern for the required parking spaces and asked Mr. Lennon if there was adequate spaces for the units. Mr. Lennon explained and assured him there would be more than adequate parking. Commissioner Berkey asked Mr. Williams if they were to delete the condition requiring covered spaces what else could be done? Mr. Williams stated that if they were determined to be apartments they would be required to approve a variance. Commissioner Berkey was concerned with the new state law requirement in relation to the covered spaces. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings . Prior to recordation of the Final Map, the developer shall furnish the t original and three (3) copies of the water system plan to the Fire I Marshal for review. 12. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construction Period, the subdivider shall maintain passable vehicular access to all buildings. Developer shall dedicate land, pay a fee in lieu thereof, or a combina- tion of both, at the option of the City Council , as a condition of the Final Map, for park and recreation purposes. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations , and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the City Engineer shall be installed in accordance with City standards . 3. Access rights to Deep Canyon Road and Shadow Hills Road (except for two approved driveways to each street) shall be offered to the City as a — . dedication on the Final Map. 4. The C.C. & R's for this development shall be submitted to the Director of Environmental Services for review and final approval by the City Attorney prior to the issuance of any building permits. Management and maintenance agreement to be entered into with the owners of the units of the project (which has been approved) . 5. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. r 6. Area shall be annexed to appropriate Improvement Districts having juris- diction over the subject area. l 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services . 9. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . 11. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire ( Marshal for review. 12. All requirements of the City Fire Marshal from his letter of November 27, l 1979, shall be met as a part of the development of this tract. 13. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I. certify that the design of the water system of Tract No. 15630 is in accordance with the requirements prescribed by the City Fire Marshal ." 14. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of -up to eighteen (18) months is granted by a Resolution of the City Council . 18. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation. of the Final Map. 19. Developer shall dedicate land, pay a fee in lieu thereof, or a combina- tion of both, at the option of the City Council , as a condition of the Final Map, for park and recreation purposes. The City shall commit the use of any such fees received within a five year period. SPECIAL CONDITIONS 1. A Final Map shall not be recorded until all of the conditions in Planning Commission Resolution No. 521, have been satisfied, to the extent that map reflects .all pertinent features of an approved final site plan which has been submitted through the Design Review process.
