STAFF RECOMMENDATION: Based on planning commission's denial action, staff recommends denial of this request by adoption of Resolution No. B. DISCUSSION: This request was considered by the planning commission on November 19, 1985. After considerable discussion, the planning commission denied the requested extension on a unanimous 4-0 vote (Downs absent) . This was after a prior motion to approve the extension ended in a 2-2 deadlock (Chairman Crites and Commissioner Erwood voting no and Wood and Richards voting yes) . The planning commission generally felt that the applicant had more than adequate time to start the project and other projects of similar vintage have also not been extended by the planning commission. TRANSMITTAL LETTER TT 16133, DP 04-80 8 204 MF The cases expire on December 6, 1985. The development plan and design review case has been granted extensions as permitted since approval in 1980. Tentative Tract 16133 is the implementing tract map for this project. The current tract map is a refiled map of the original tract map which was approved in 1980 with the development plan and design review case. This new map was refiled and approved on December 6, 1983, since the original map had utilized all its extensions. While the original concept and design of the plan dated back to 1980, because the current tentative tract map was approved in December 1983, staff did recommend approval of the extension to the planning commission. The applicants general reasons for the appeal are that the approval date of 1983 should be used as the effective date and most of the required plans have been prepared and expenses incurred to date have been "staggering". Commissioner Wood asked for and received clarification regarding the reference in the staff report about the original tentative tract approval and the school and Fringe-toed lizard fees. Mr. Drell noted that the fees could be imposed at this time. Mr. Phillips clarified that it would not be a condition of the tentative map, rather a condition of the building permit. Commissioner Richards asked if this would cause an economic hardship on the applicant. Mr. Drell replied that the applicant has only paid application fees at this time. Commissioner Richards expressed concern regarding the amount of time spent by both staff and the commission in the last five years on this project. I MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 19, 1985 i Commissioner Richards stated that he would like to change his vote. Moved by Commissioner Wood, seconded by Commissioner Richards, to reconsider the original vote. Carried 4-0. Moved by Commissioner Richards, seconded by Commissioner Erwood, to deny the requested time extension. Speaking to the motion, Commissioner Wood asked the reason for Commissioner Richard's change of vote. Commissioner Richards stated that because it was a 2-2 vote against the extension, the length of time this applicant has had, and in order to proceed, he would vote to deny the extension. i I Chairman Crites stated that he felt the developer had an adequate amount of time to start the project and he would vote to deny the extension. Chairman Crites noted that it was a policy to allow the applicant to address the commission. MR- LARRY JOHNSON, Morse Consultants, stated that the applicant was in the process of selling the project and all plans were ready for signature. He indicated that the applicant was having a problem with bonds, but urged the commission to approve the extension. Commissioner Richards indicated that the testimony did not change his vote. OTSCUSSION• The cases expire on December 6, 1985. The development plan and design review case has been granted extensions since approval in 1980. Tentative Tract 16133 is the imolementina tract map for this project. The current tract mao is a refiled map of the original tract map which was approved in 1980 with the development plan and design review case. This new map was refiled and approved on December 6, 1983, since the original map had utilized all its extensions. Although the tentative tract map was approved in 1983, the project concept and design date back to 1980 when the original approvals for the development plan and design review were granted. It has been planning commission Policy to not grant extensions for project which have not started construction within 2 to 3 years. This project would fall under that category, if the original 1960 date is considered. However, 1983 is the date of approval which the cases presently exist under. Two new fees which are now required are the fringe toed lizard mitigation fee and school impact mitigation fee. These fees were not imposed at the time of approval , but the lizard fee will be collected at the time building permits are issued. The school fee could only be imposed upon new environmental review and tentative tract map approval . The applicant is requesting an 18 month extension which is permitted following the initial 24 month approval . Should this extension be approved, an additional one year extension may be requested. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. J 2. Full public improvements including traffic safety lighting as required by ordinance and the city engineer shall be installed in accordance with city standards. 3. Prior to submittal of the final map, the applicant shall provide the department of environmental services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of environmental services. 4. Access rights to Cook Street and Via Cinta (except for those openings approved in Case Nos. DP 04-80 and 204 MF)shall be offered to the city as a dedication on the final map. - - 5. The CCkR's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. C. Management and maintenance agreement to be entered into with the owners of the units of the project. �j 6. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 7. Area shall be annexed to appropriate improvement districts having jurisidiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. - 9. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. - 10. The applicant shall have twenty-four (24) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time as 'permitted by code is granted by planning commission, otherwise, said approval shall become null, void, and of no effect whatsoever. City Fire Marshal: 11. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimumm of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 12. Install Riverside County super fire hydrants located at each street intersection but not greater than 500 feet apart in any direction and so that all buildings are not more than 250 feet from a fire hydrant. a. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. -3- PLANNING COMMISSION RESOLUTION NO.910 b. Curbs shall be painted red 15 feet in either direction from each hydrant. C. Hydrants shall not be located closer than 25 feet to any building. 13. Prior to recordation of the final map, the developer shall furnish the original and three(3)copies of the water system plan to the fire marshal for review. 14. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 16133 is in accordance with the requirements prescribed by the fire marshal." Upon approval, the original plan will be returned to the developer. 15. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 16. Streets and cul-de-sacs must meet minimum code standards. Department of Public Works: 17. - Drainage, signalization and park fund fees, as required by city ordinance, shall be paid prior to the recordation of the final map. 18. Drainage facilities shall be provided per Ordinance No. 218 and the master drainage plan to the specifications of the director of public works. 19. - Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 20. Installation of curb and gutter at 43 feet from centerline, match-up paving and sidewalk on Cook Street. 21. Installation of a landscaped median on Cook Street. The city may accept cash payment in lieu of construction for one-half of the landscaped median at the option of the director of public works. 22. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 23. Improvement plans for water and sewer systems shall be approved by the respective service districts. 24. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit"as-built.'plans prior to acceptance of the subdivision improvements by the city. 25. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 26. Landscaping maintenance on Hovley Lane, Cook Street and Via Cinta shall be provided by the homeowners association. 27. Traffic safety striping an Cook Street shall be provided to the specifications of the director of public works._A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 28. A complete grading plan with specifications and preliminary soils report shall be submitted to the director of public works for checking and approval before issuance of any permits. 29. Waiver of vehicular and pedestrian access to Cook Street, Hovley Lane and Via Cinta, except at approved openings, shall be offered for dedication on the final map. -4- PLANNING COMMISSION RESOLUTION NO.910 30. The private streets that are 32 foot wide shall have parking permitted on only one side of the street. Standard regulation "no-parking" signs shall be installed on one side of such streets. 31. Pad and street grades shall be compatible with adjacent developments. Elevations shown on the tentative map are subject to revision during review of the precise ' grading plan. 32. Dedication of right-of-way to 33 feet from centerline on Cook Street. 33. Now that the proposal before congress has been revised, it appears that this project can be financed. The expenses that Michael Zapara has incurred to get this project to this point are staggering. To deny his request for an extension of time would be a terrible hardship. Tentative Tract 16133 is the implementing tract map for this project. The current tract map is a refiled map of the original tract map which was approved in 1980 with the development plan and design review case. This new map was refiled and approved on December 6, 1983, since the original map had utilized all its extensions. Although the tentative tract map was approved in 1983, the project concept and design date back to 1980 when the original approvals for the development plan and design review were granted. It has been planning commission policy to not grant extensions for project which have not started construction within 2 to 3 years. This project would fall under that category, if the original 1980 date is considered. However, 1983 is the date of approval which the cases presently exist under. Two new fees which are now required are the fringe toed lizard mitigation fee and school impact mitigation fee. These fees were not imposed at the time of approval , but the lizard fee will be collected at the time building permits are issued. The school fee could only be imposed upon new environmental review and tentative tract map approval . The applicant is requesting an 18 month extension which is permitted following the initial 24 month approval . Should this extension be approved, an additional one year extension may be requested. (2) Drainage facilities shall be provided per Ordinance No. 218 and the master drainage plan to the specifications of the Director of Public Works. (3) Additional storm drain construction shall be contingent upon a drainage study by the private engineer. (4) Installation of curb and gutter at 43 feet from centerline, match-up paving and sidewalk on Cook Street. (5) Installation of a landscaped median on Cook Street. The City may accept cash payment in lieu of construction for one-half of the landscaped median at the option of the Director of Public Works. (6) Full public improvements, including traffic safety lighting, as required by ordinance and the Director of Public Works, shall be installed in ac- cordance with City standards. (7) Improvement plans for water and sewer systems shall be approved by the respective service districts. (8) Complete improvement plans and specifications shall be submitted, as required by ordinance, to the City Engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. (9) All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. (10) Landscaping maintenance on Hovley Lane, Cook Street and Via Cinta shall be provided by the homeowners association. (11) Traffic safety striping on Cook Street shall be provided to the specifications of the Director of Public Works. A traffic control plan must be submitted to and approved by the Director of Public Works before placing pavement markings. (12) A complete grading plan with specifications and preliminary soils report shall be submitted to the Director of Public Works for checking and approval before issuance of any permits. (14) The private streets that are 32 foot wide shall have parking permitted on only one side of the street. Standard regulation "no parking" signs shall be installed on one side of such streets. (15) Pad and street grades shall be compatible with adjacent developments. Elevations shown on the tentative map are subject to revision during review of the precise grading plan. (16) Dedication of right of way to 55 feet from centerline on Cook Street. (17) Offsite improvement plans to be approved by Public Works and a surety posted to guarantee the required offsite improvements prior to this map recording. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street inter- section but not greater than 500 feet apart in any direction and so that all buildings are not more than 250 feet from a fire hydrant. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. C. Hydrants shall not be located closer than 25 feet to any building. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 16133 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6.
