CUP 12-80, 219 MF, an 1"TT 6396=Approval of an one year time extension for a conditional use ermit and design review case and an eighteen month time extension for a tentative tract map to allow 128 residential units at the northeast intersection of Fred Waring Drive and the Palm Valley Storm Channel. Moved by Commissioner Kryder, seconded by Commissioner Downs, to approve the consent calendar item as presented by staff. Carried unanimously 4-0. VII. PUBLIC HEARINGS A. Case No. CUP 14-82 - PALM DESERT TOWN CENTER ASSOCIATES, Applicants Request for approval of a conditional use permit to allow an amusement arcade in a PR-3 zone in the Palm Desert Town Center located at the northeast corner of Highway 111 and El Paseo (west). Mr. Joy reviewed the staff report and the staff's concerns of security and hours of operation. There is no direct access to the mall from the arcade and it has been assured that security will be provided at all times of operation. He noted that a condition relating to the hours of operation is included as part of the draft resolution. Staff recommended approval. Commissioner Kryder asked what the hours of operation were. Bierfreund, M.D. I. DISCUSSION- The conditional use permit and design review board case were approved on December 4, 1980, and granted an one year time extension in November, 1982. The tentative tract map was approved on December 3, 1981, by the City Council. As allowed by code, the applicant is requesting a one year extension of the CUP and design review board case and an 18 month extension of the tentative tract map. The applicant does not indicate a specific reason for the requested extensions. H. STAFF RECOMMENDATION: Staff feels this request is acceptable and recommends approval of an extension of CUP 12-80 and 219 MF to December 4, 1983, and TT 16396 to June 3, 1984. III. ATTACHMENTS: A. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay a fee to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return the City Council agrees to use said fees for park purposes in conformance with an adopted master plan, within five (5) years of the recordation of the final map. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. Access right to 44th Avenue and Park View Drive (except for those openings approved in Case Nos. CUP 12-80 and 219 MF) shall be offered to the City as a dedication on the final map. 5. The CC&R's for this development shall be submitted to the Director of Envir- onmental Services for review and final approval by the City Attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded (which have been approved) . c. Management; and maintenance agreement to be entered into with the owners of/"the units of the project (which .has been approved). 6. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 7. Area shall be annexed to appropriate improvement districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as built" plans prior - to acceptance of the subdivision improvements by the City. 11. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . 12. Prior ,to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshal from his letter of December 11, 1980, shall be met as a part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Tract No. 16396 is in accordance with the require•• ments prescribed by the City Fire Marshal . DISCUSSION: The current owner is requesting that this matter be considered by Council. Tentative Tract 16396 was reviewed by the Planning Commission at its meeting of December 2, 1980. The only item of discussion pertained to Special Condition No. 5, which requires that the Developer pay one eighth the cost for widening of the 44th Avenue bridge which abuts his property. The applicant wished to have this requirement deleted or modified, saying they would be willing to join a bridge assessment district if one was formed. City staff felt the condition was fair and a precedent for the imposition of this type of condition exists (Hahn Company has been 'required to pay for widening of the Highway III bridge). After considerable discussion, the Planning Commission determined that the condition should remain as worded. Thereafter the Commission unanimously voted to recommend approval to the City Council of this request. (3) All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. (4) Drainage and signalization fees as required by City ordinance shall be paid prior to recordation of the final map. (5) Drainage facilities shall be provided per Ordinance No. 218, and the Master Drainage Plan to the specifications of the Public Works Director. (6) Additional storm drain construction shall be contingent upon a drainage study by the private engineer. (7) Full public improvements including traffic safety lighting as required by ordinance and the Public Works Director shall be installed in accordance with City standards. (8) Improvement plans for water and sewer systems shall be approved by the respective service districts. (9) Complete improvement plans and .specifications shall be submitted as required by ordinance to the City Engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. (10) Provisions shall be made to protect the development from the Palm Valley Channel as deemed necessary by the private engineer and the Public Works Director. This area may be considered safe from stormwater flows except in rare instances. This area is designated Zone B on the Federal Flood Insurance rate maps which are in effect at this time. There may be erosion of the banks of the stormwater channel during periods of unusual rainfall and discharge; however, the degree of erosion can be minimized or eliminated by either channel landscaping or bank rip-rap. These protective measures shall be constructed to minimize potential erosive damage to tract improvements. Plans for stormwater protective works shalt be submitted to the Coachella Valley Water District for review. The District will furnish domestic water and sanitation service to this area in accordance with the currently prevailing regulations of this District. Case No. TT 14032 (Renewal ) - MCLAIN DEVELOPMENT COMPANY, Applicant Request for approval of a renewal of an expired Tentative Subdivision Map covering phases II through V (220 lots) , to allow construction of 206 dwelling units on 60.5 acres within the PR-4 (Planned Residential , 4 d.u./ac. ) zone at the southeast corner of Portola Avenue and Country Club Drive. Mr. Sawa presented this case stating that the original approval was made in 1979 and Phases II through V had not been recorded. Mr. Sawa presented this case, giving a brief summary of the staff report. Staff recommended approval . Chairman Miller opened the Public Hearing asking if the applicant wished to give a presentation. MS. . BETTY WILLIAMS, Representative, 73-160 El Paseo, referred to special condition No. 5, which states that .the developer would pay 1/8 of the cost for widening the 44th Avenue bridge. She stated that no other developer was required to do this and that they were willing to pay for a bridge assessment district fee instead. She added that this requirements would make lower cost housing development impossible. Commissioner Berkey asked for the Director of Public Works to comment on this matter. Mr. McClellan explained that the residential development in that area was built before the City incorporated and that the Hahn Shopping Center does not go up to 44th Avenue. He added that the Hahn Center is being required to contribute $300,000 to widen the bridge at Hwy 111. Commissioner Kryder asked Mr. McClellan how he felt about a bridge assessment district. PUBLIC HEARINGS (cont. ) Mr. McClellan replied that he had not been involved in a bridge assessment district but could be looked into. Commissioner Berkey felt there might be alternatives in acquiring the moni.es necessary for widening the bridge. Mr. McClellan stated that a precedent was established when they required the Hahn Center to contribute for the bridge on Hwy 111. He added that the cost analysis was necessary to give an estimated cost to the applicant. Commissioner Richards stated he did not agree that it should be the developers responsibility. He felt that it might not be necessary to widen the bridge and added that an exact cost should be established beofre the developer agreed:to-the condition. Commissioner Richards also felt that this should be handled by the City Council . Commissioner Berkey agreed that this matter should be determined by the City Council being that this was a fiscal matter.
