Mr. Sawa reviewed the staff report and stated that this building had previously

L DISCUSSION•
DP 06-81 and TT 17794 provide for the construction of a 62 unit condominium
development on 13.2f acres in the PR-5 zone on the south side of Hovley Lane, 500
—,� feet west of Portola Avenue. Original approval of the Development Plan was
granted June 2, 1981, by the Planning Commission. The Tentative Tract Map was
approved June 25, 1981, by the City Council.
v The applicant is requesting a one year and 18 month time extension for the
? Development Plan and Tentative Tract, respectively, as allowed by Municipal
's" a3 Code. The reason for this request is that the applicant has not been able to fund
3 construction of the project, due to the economic recession.
H. STAFF RECOMMENDATION:
Staff feels this request is acceptable. Therefore, staff recommends:
A. Approval of a one year extension for DP 06-81, with all previous conditions
to apply;
B. Approval of an 18 month extension for TT 17794 with all previous conditions
to apply.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT CALIFORNIA, APPROVING A TENTATIVE TRACT MAP
TO ALLOW 62 CONDOMINIUM UNITS ON 13.2 ACRES, GENERALLY
LOCATED ON THE SOUTH SIDE OF HOVLEY LANE, 500 FEET WEST
OF PORTOLA AVENUE.
CASE NO. TT 17794.
WHEREAS, the City Council of the City of Palm Desert, California, did
on the 25th day of June, 1981 , hold a duly noticed Public Hearing to consider
the request of ALEXANDER ADAMEK, for approval of a 63 lot Tentative Tract Map
to allow 62 condominium units on 13.2 acres, generally located on the south
side of Hovley Lane, 500 feet west of Portola Avenue, more particularly described
as:
APN 621-190-064, 621-190-065, 621-190-066
WHEREAS, the Planning Commission, by Resolution No. 719, has recommended
approval subject to conditions.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89" , in that the Director of Environmental Services has deter-
mined that the project will not have a significant impact on the environment and
a Negative Declaration of Environmental Impact has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all persons desiring to be heard, said City Council
did find the following facts and reasons justified in the staff report to the
Planning Commission dated June 2, 1981 , to exist to approve the Tentative Tract
Map:
(a) That the proposed map is consistent with appli-
cable general and specific plans.
(b) That the design or improvement of the proposed
subdivision is consistent with applicable general
and specific plans.
(c) That the site is physically suitable for the type
of development.
(d) That the site is physically suitable for the proposed
density of development.
(e) That the design of the subdivision or the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of
improvements is not likely to cause serious public
health problems.
(g) That the design of the subdivision or the type of
improvements will not conflict with easements, ac-
quired by the public at large, for access through
or use of, property within the proposed subdivision.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, as follows:
1 . That the above recitations are true and correct and constitute
the findings of the Council in this case.
2. That it does hereby approve the above described Tentative
RESOLUTION NO. 81-94 PAGE TWO
Map No. TT 17794, for the reasons set forth in this Resolu-
tion and subject to the attached conditions.
FURTHER, BE IT RESOLVED that the recommended conditions of approval do
include a requirement that the applicant pay in-lieu fees to comply with the
requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance.
In return it is recommended that the City Council agree to use said fees for
park purposes in conformance with an adopted master plan, within five (5) years
of the recordation of the final map. -

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 17794
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all the requirements, limitations, and restrictions of all municipal
ordinances and State and Federal statutes now in force, or which here-
after may be in force.
2. Full public improvements including traffic safety lighting as required by
ordinance and the City Engineer shall be installed in accordance with
City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final street
name shall be made by the Director of Environmental Services.
4. Access rights to Hovley Lane shall be offered to the City as a dedication
on the final map.
5. The C.C. & R's for this development shall be submitted to the Director of
Environmental Services for review, and final approval by the City Attorney
prior to the issuance of any building permits. Prior to recordation of
the final subdivision map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the
owners of the units of the project.
6. Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject area.
8. All dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free of
all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as
may be approved by the Director of Environmental Services.
10. Complete plans and specifications shall be submitted as required by Ordi-
nance to the City Engineer for checking and approval before construction
of any improvements is commenced. The subdivider shall submit "as built"
plans prior to acceptance of the subdivision improvements by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
13. All requirements of the City Fire Marshal from his letter of May 29, 1981,
shall be met as a part of the development of this tract.
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. 17794 is in accor-
dance with the requirements prescribed by the City Fire Marshal . "

15. All private streets shall be inspected by the Engineering Department and a
Standard Inspection Fee shall be paid.
16. All requirements of the Planning Commission action on the Development Plan
06-81 shall be met as a part of the development of this tract.
17. The applicant shall have twelve (12) months from the date of the approval
or conditional approval of the tentative map for filing of the final map
unless an extension of time of up to eighteen (18) months is granted by a
Resolution of the City Council .
18. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the final map.
19. Development shall pay a fee in lieu thereof as a condition of the final map,
for park and recreation purposes. The City shall commit the use of any such
fees received within a five year period.
20. Final map not to be recorded until design changes, if required by approval
of preliminary plans by the Design Review Board are incorporated.
21. Blowsand planting to be provided along northern and western boundaries of
subdivision as approved by Design Review Board.
22. Subdivision to be provided with minimum six foot high solid masonry wall
around project (except for approved opeings) as approved by Design Reivew
Board.
23. Additional storm drain construction shall be contingent upon a drainage
study by the private engineer.
24. Landscaping maintenance on Hovley Lane shall be provided by the homeowner's
association. l
25. Hovley Lane shall be dedicated and improved to secondary roadway standards. J]
Curb and gutter to be 32 feet from centerline.
26. Drainage facilities shall be providedper Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public Works Director.
27. Minimum lot sizes for dwelling units to be increased to minimum 2500 sq.ft.
to comply with Municipal Code requirements.

Gentlemen:
Prior to construction of any of the proposed buildings, the following conditionsmust be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flaw is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that .no point of any building
))) is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.

A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall .be painted green.
C. Curbs (if -installed), shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a. building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent of the Building Department, and the ori-
ginal will be returned to the developer.
4. The water system plan shall be. signed by a registered civil engineer, and
approved by the water company, with the following certification: "I certify
that the design of the water system in. Case Number DP-06-81 & TT 17794 is in
accordance with the requirements prescribed by the Fire Marshal ."
5. Prior to delivery of combustible materials to the building site; the required
I water system shall be installed, .operating and delivering the required flow.
!I 6. Alternative access is required.
7. Entry gate must be controlled from emergency vehicles by an approved system.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the Ind day of June, 1981, hold a duly noticed public hearing to consider the
request of ALEX ADAMEK for approval of a 63 lot Tentative Tract Map to allow 62 condo-
minium units on 13.2 acres, generally located on the south side of Hovley Lane, 500
feet west of Portola Avenue, more particularly described as:
APN 621-190-064, 621-190-065, 621-190-066
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined
that the project will not have a significant impact on the environment and a Negative
Declaration of Environmental Impact has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Planning Commission
did find the following facts and reasons justified in the staff report for TT 17794
on file in the Department of Environmental Services to exist to recommend approval of
the Tentative Tract Map:
(a) That the proposed map is consistent with applicable
general and specific plans.
(b) That the design or improvement of the proposed sub-
division is consistent with applicable general and
specific plans.
( (c) That the site is physically suitable for the type
of development.
(d) That the site is physically suitable for the proposed
density of development.
(e) That the design of the subdivision or the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of
improvements is not likely to cause serious public
health problems.
(g) That the design of the subdivision or the type of
improvements will not conflict with easements,
acquired by the public at large, for access through
or use of, property within the proposed subdivision.
WHEREAS, in the review of this Tentative Tract Map the Planning Commission
has considered the effect of the contemplated action on the housing needs of the
region for purposes of balancing these needs against the public service needs of the
residents of the City of Palm Desert and its environs, with available fiscal and
environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case;
2. That it does hereby recommend conditional approval to the City
Council of the City of Palm Desert of the above described
Tentative Map No. 17794 for the reasons set forth in this
Resolution and subject to the attached conditions.
3. That a Negative Declaration of Environmental Impact is hereby
recommended for approval .

restrictions and limitations set forth herein which are in addition to
all the requirements, limitations, and restrictions of all municipal
ordinances and State and Federal statutes now in force, or which here-
after may be in force.
2. Full public improvements including traffic safety lighting as reiuired by
ordinance and the Public Works Director shall be installed in accordance with
City standards.
3. The approval of the final street names shall be made by the Director of
Environmental Services, prior to the submittal of the final map.
4. Access rights to Hovley Lane shall be offered to the City as a dedication
on the final map.
5. The C.C. & R's for this development shall be submitted to the Director of
Environmental Services for review, and final approval by the City Attorney
prior to the issuance of any building permits. Prior to recordation of
the final subdivision map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the
owners of the units of the project.
6. Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject area.
[ 8. All dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free of
all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as
may be approved-by the Director of Environmental Services.
10. Complete plans and specifications shall be submitted as required by Ordi-
nance to the City Engineer for checking and approval before construction
of any improvements is commenced. The subdivider shall submit "as built"
-- plans prior to acceptance of the subdivision improvements by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
•- Marshal for review.
13. All requirements of the City Fire Marshal from his letter of
shall be met as a part of the development of this tract.
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. 17794 is in accor-
dance with the requirements prescribed by the City Fire Marshal . "
15. All private streets shall be inspected by the Engineering Department and a
Standard Inspection Fee shall be paid.
16. All requirements of the Planning Commission action on the Development Plan
06-81 shall be met as a part of the development of this tract.

li. the applicant shall have twelve (12) munths from the date of the appr(,,.-
or conditional approval of the tentative map for filing of the final map
unless an extension of time of up to eighteen (18) months is granted by a
Resolution of the City Council .
18. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the final map.
19. Development shall pay a fee in lieu thereof as a condition of the final map,
for park and recreation purposes. The City shall commit the use of any such
fees received within a five year period.
20. Final map not to be recorded until design changes, if required by approval
of preliminary plans by the Design Review Board are incorporated.
21. Blowsand planting to be provided along northern and western boundaries of
subdivision as approved by Design Review Board.
22. Subdivision to be providedwith minimum six foot high solid masonry wall
around project (except for approved openings) as approved by Design Review
Board.
23. Additional storm drain construction shall be contingent upon a drainage
study by the private engineer. m,
24. Landscaping maintenance on Hovley Lane shall be provided by the homeowner's
association.
25. Hovley Lane shall be dedicated and approved to secondary roadway standards.
Curb and gutter to be 32 feet from centerline.
26. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public Works Director.
27. Minimum lot sizes for dwelling units to be increased to minimum 2500 sq.ft.

Gentlemen:
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that -no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall .be painted green.
C. Curbs (if -installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a. building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval., one copy will be sent of the Building Department, and the ori-
ginal will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and
approved by the water company, with the following certification: "I certify
that the design of the water system in. Case Number DP-06-81 & TT 17794 is in
accordance with the requirements prescribed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
- 6. Alternative access is required.
7. Entry gate must be controlled from emergency vehicles by an approved system.

Mr. Sawa presented this case describing the design and location of the project.
He noted that this project would be outside the five minute response time for fire
protection, therefore, staff recommended a requirement of a $100 per unit fee. He
reviewed the findings and justifications and recommended approval .
Chairman Miller opened the Public Hearing and asked if the applicant wished
to make a presentation.
MR. HARRY SCHMITZ, 45-900 Paseo Coronado, Indian Wells, concurred with staff's
conditions and requested approval .
Chairman Miller asked if anyone wished to speak in FAVOR or OPPOSITION to
this case. There being none, the Public Hearing was closed.
Minute motion was made by Commissioner Kryder, seconded by Commissioner McLachlan,
to adopt findings as recommended by staff. Carried unanimously (4-0) .
Motion was made by Commissioner Richards, seconded by Commissioner Kryder, to
waive further reading and adopt Planning Commission Resolution No. 718, a Resolution
of the Planning Commission of the City of Palm Desert approving Development Plan 06-81
and certifying a Negative Declaration of Environmental Impact as it pertains thereto.
Carried unanimously (4-0) .
Motion was made by Commissioner Richards, seconded by Commissioner Kryder, to
waive further reading and adopt Planning Commission Resolution No. 719, a Resolution

TENTATIVE SUBDIVISION MAP
Both State Law and the Palm Desert Subdivision Ordinance require that when any parcel of
contiguous parcels in one ownership is proposed to be divided into more than four parts,
now, or in the future, a tentative subdivision map must be processed through the City.

Applications for a Tentative Subdivision Map are accepted only on the first working Monday
of each month. Prior to submittal , it is recommended that the map be fully discussed with
the City Engineer. The staff will investigate the request and notify adjacent property
owners of the Public Hearing. The average review period for a subdivision map is five
weeks. Prior to the Public Hearing, the map is reviewed by the Land Division Review. Com-
mittee. Said Committee reviews with the applicant to propose recommendations to the Plan-
ning Commission, including any conditions. Prior to the Hearing, the applicant will re-
ceive a copy of the Agenda and a copy of the staff report concerning the case. If the
map is approved by the Planning Commission , it is reviewed by the City Council who takes
final action on the tentative map. The final subdivision map is processed through the
Engineering Department.
CONTENTS OF A TENTATIVE SUBDIVISION MAP
The Tentative Subdivision Map shall be in a form acceptable to the City Engineer and shall
comply with the provisions of the State Map Act.
