DP 06-91 AND TT 17794 AMENDMENTS #1 a, WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of September, 1983, hold a duly noticed public hearing to consider a request by ALEX ADAMEK for approval of a 71 unit condominium project in a PR-5 zone, more particularly described as APN 622-020-032, 033, 034 do 035. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project has been previously assessed. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 7. The proposed project generally conforms to the intent and purpose of the PR zone district. 8. The proposed location of the use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 9. The proposed location of the use and the conditions under which it will be operated and maintained will not be detrimental to the pubic health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 10. The proposed use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 11. The proposed use complies with the goals, objectives, and policies of the city's adopted General Plan. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: owl 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. DP 06-81 and TT 17794 Amendments #1 Department of Environmental Services: :a 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the city engineer shall be installed in accordance with city standards. 3. Prior to submittal of the final map, the applicant shall provide the department of environmental services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of environmental services. 4. Access rights to Hovley Lane shall be offered to the city as a dedication on the final map. 5. The CC&R's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. C. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 7. Area shall be annexed to appropriate improvement districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. 9. All on-site utilities, including cable.T.V, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 10. Complete plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the city. 11. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 12. All requirements of the Planning Commission action on Development Plan 06-81 Amendment #1 shall be met as a part of the development of this tract. ilav 13. The applicant shall have 2 years from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time is granted by a resolution of the city council. 14. Drainage and Signalization Fund contributions as required by city ordinance shall be made prior to recordation of the final map. 15. Developer shall pay a fee in lieu thereof as a condition of the final map, for park -3-. PLANNING COMMISSION RESOLUTION NO. 887 and recreation purposes. The city shall commit the use of any such fees received within a five year period. 16. Final map not to be recorded until design changes, if required by approval of preliminary plans by the architectural review board are incorporated. 17. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan to the specifications of the public works director. 23. Project to receive approval from the city architectural commission prior to permits being issued. 24. Comply with parking requirements as required by city council action in September, 1983. 25. Traffic safety striping on Hovley Lane shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved J by the director of public works before placing pavement markings. _ Fire Marshal Conditions: 26. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 27. Install Riverside County super fire hydrants at each intersection and so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. Hydrants shall not be located closer than 25 feet to any building. b. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 28. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 29. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case DP 06-81 and TT 17794 is in accordance with the requirements prescribed by the fire marshal." 30. Prior to delivery of combustible materials to the building site, the required water -4- PLANNING COMMISSION RESOLUTION NO. 887 system shall be installed, operating and delivering the required flow. 31. Fifty (50) foot turning radius is required at entry for access both directions into project. 32. Entry gate shall operate by an approved emergency access system. � /lr -5- MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 20, 1983 Mr. Grant explained that these owners made a loan expecting to get principal and interest back but instead got property back. Commissioner Richards responded that when they entered into a contract they should have been aware of the possibility of problems like this arising. Commissioner Crites concurred. Moved by Commissioner Richards, seconded by Commissioner Downs, to approve Item A of the consent calendar, for a one year time extension, and deny Item B, being a fourth request for time extension. Carried 4-1 (Commissioner Erwood voting Nay; he was in favor of approval for both requests). VII. PUBLIC HEARINGS A. Case No. CUP 12-82 (Amendment) - TOWER GARDEN RESTAURANT and RICHARD ROEMER, Applicants Request for an amendment to a conditional use permit (for a restaurant/bakery) to allow an expansion of 708 sq.ft. for dining purposes in the C-1, S.P. zone located at the northeast corner of Sage Lane and El Paseo (73-260 El Paseo). Mr. Diaz,stated he had received a telepone call from the applicant stating he may request a continuance at the time of this hearing. Chairman Wood opened the public hearing and asked if the applicant was present. MR. JOHN BAKER, explained that their attorney could not be present at this time and requested a continuance. Moved by Commissioner Crites, seconded by Commissioner Richards, to continue this case to October 4, 1983, 7:00 p.m. per applicant's request. Carried unanimously 5-0. B. Case No. DP 06-81 and T 17794 mendment Nos. 1 - ALEX ADAMEK and ROBERT RICCIARDI, App scants Request for approval of a 71 unit condominium development on approximately 14.25 acres within the PR-5 (Planned Residential, 5 d.u./acre) zone generally located on the south side of Hovley Lane, 330 feet west of Portola Avenue. Mr. Joy reviewed the staff report and recommended approval. Chairman Wood opened the public hearing and asked if the applicant cared to make a presentation. MR. ROBERT RICCIARDI, 73-725 El Paseo, concurred with staff's recommendation and was present to answer any questions. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. The commission was concerned with the architecture, specifically the colors and landscaping. Mr. Ricciardi provided another rendering which showed the design of the development more specifically and explained the concept of the design. Moved by Commissioner Downs, seconded by Commissioner Richards, to approve findings as recommended by staff; carried unanimously 5-0. CUP 19-83 and PMW 04-83 - CHESTER DORN, Applicant Request for approval of a conditional use permit and parcel map waiver to allow construction of a retail commercial building in a C-1 zone located between the Frontage Road and Alessandro and on the north side of Alessandro Drive, 370 feet east of Portola Avenue. Mr. Smith reviewed the staff report and stated one of staff's recommended changes to the plan was that the applicant's proposed outdoor storage area be eliminated and the area be landscaped. He reviewed the conditions and stated that the applicant had agreed to these conditions. Mr. Smith added that a concern was mentioned by an adjacent property owner in regards to drainage; staff felt drainage would be adequate. Staff recommended approval. Commissioner Erwood questioned the parking lot lighting and its impact on adjacent residential areas. Mr. Smith replied that lighting has not been shown on the plans yet. Mr. Diaz explained the applicant is required to submit a lighting plan that would conform to the city's ordinance, which prohibits parking lot lighting spillover onto residential areas. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. CHESTER DORN, stated that they concur with staff's recommended conditions. Moved by Commissioner Richards, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 889, approving CUP 20-83, as conditioned; carried unanimously 5-0. -3- City of Palm Desert Department of Environmental Services Staff Report TO: Planning Commission DATE: September 20, 1983 CASE NOS: DP 06-81 Amendment No. 1 and TT 17794 Amendment No. 1 REQUEST: A request for approval of a 71 unit condominium development on approximately 14.25 acres within the PR-5 (Planned Residential, 5 d.u./acre) zone generally located on the south side of Hovley Lane, 330 feet west of Portola Avenue. APPLICANT: ALEX ADAMEK ROBERT RICCIARDI, Architect 72-575 Betty Lane 42-600 Bob Hope Drive Rancho Mirage, CA 92270 Rancho Mirage, CA 92270 I. BACKGROUND: A. SITE DESCRIPTION: The site is just to the south of the Casablanca condominium development under construction presently. It consists presently of two 4.75 acre parcels, a third which is 3.02 acres and a fourth which was recently acquired from the water district, totals 1.73 acres and comprises the major portion of the amendment. The property then measures 994' in width and 629' in depth or 14.25 acres. B. ADJACENT ZONING/LAND USE: North: PR-5/Condominium Project South: PR-5/Vacant East: PR-5/Vacant West: PR-5/Vacant C. GENERAL PLAN LAND USE DESIGNATION: Low Density Residential 3-5 d.u./acre U. DISCUSSION: A. GENERAL: This application originated when the applicant proposed to consolidate duplex units into fourplex structures on an approved development plan. This change itself necessitated an amendment to both the development plan and tract map. Recently the applicant negotiated for the 1.7 acres adjacent to and now part of the site formerly owned by the water district. The acquisition of this property allowed the applicant to add nine units bringing the total number of units to 71 on 14.25 acres which is the maximum permissable in the PR-5 zone. The site design of the project is identical to the one previously approved in terms of the roadway layout. The main difference is the additional units at the southwest portion of the project that does not affect the original roadway design whatsoever. Two of the original 62 units were transferred to the southwest portion of the site accounting for the presence of eleven units in this area on the proposed site plan. The issue of off-street parking spaces has arisen in planned residential projects that possess private streets. The ordinance requires 2.5 spaces for -I- Staff Report DP 06-81 & TT 17794 Amendments #1 September 20, 1983 each such cluster unit, two of which must be covered. It has been acceptable in the past when the developer provides a two car garage for each unit to allow the extra half space for each unit to be located on the private street. The developer in this case provides two covered parking spaces for each unit and has agreed to provide the extra half-space per unit in any manner that the council determination on September 8 requires. The architecture of the buildings and landscaping has not been submitted as of this date and one of the conditions of this application will be to receive approval by the city's architectural commission. The site is to be surrounded by a six foot masonry wall with sidewalk along Hovley Lane. Amenities of the project include three swimming pools with spas and two sunken tennis courts. III. ANALYSIS: A. FINDINGS FOR A DEVELOPMENT PLAN: 1. The proposed location of the use is in accord with the objectives of the municipal code and the purpose of the district in which the site is located. Justification: The PR zone allows uses of this type with approval of a development plan. 2. The proposed location of the use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. Justification: The location is in an area with large lots which allow design flexibility wht_c1t wilLinsure that the use will not be detrimental. 3. The proposed use will comply with each of the applicable provisions of the municipal code except for approved variances or adjustments. Justification: The use will comply with all municipal codes by design or conditions imposed by this approval. 4. The proposed use complies with the goals, objectives and policies of the city's General Plan. Justification: The property is designated Low Density Residential, 3-5 d.u./acre on the General Plan. The PR zone allows this density with approval of a development plan and as such, is in compliance with the General Plan. B. FINDINGS NEEDED FOR APPROVAL OF TENTATIVE TRACT MAP: 1. Justification: The design of the project indicates that the site is suitable for the proposed density of development because the site can be served by respective utilities, the city, and existing or proposed circulation system. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. Justification: The design will not cause substantial environmental damage or injure fish or wildlife or their habitat because it will be constructed in compliance with applicable regulations. 6. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. Justification: The design will not cause serious public health problems because it will be in compliance with applicable health, safety and building codes. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. Justification: There have been no easements acquired by the public at large for access through or use of property within the proposed subdivision. Staff feels these findings can be justified in this case. V. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the city engineer shall be installed in accordance with city standards. 3. Prior to submittal of the final map, the applicant shall provide the department of environmental services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of environmental services. 4. Access rights to Hovley Lane shall be offered to the city as a dedication on the final map. 5. The CC&R's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Traffic safety striping on Hovley Lane shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. Fire Marshal Conditions: 26. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 27. Install Riverside County super fire hydrants at each intersection and so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. Hydrants shall not be located closer than 25 feet to any building. b. Exterior surfaces of hydrant barrels and heads shall be .painted chrome yellow, and the tops and nozzle caps shall be painted green. c.
